Dargestellt werden unter diesem Aspekt traditionelle afrikanische Gesellschaften, altindonesische Völker, der Islam und Indien (Witwenverbrennung!), südamerikanische Waldindianer und die abendländische Tradition. Die Vielschichtigkeit des Problems zeigt nicht nur die Skala menschlichen Verhaltens, wichtig ist vor allem auch die Information darüber, welche wirtschaftlichen und sozialen Verhältnisse, kulturellen und religiösen Wertvorstellungen hinter dem jeweiligen Verhalten stehen. Ein zentrales Thema der Ethik wird hier kompetent, allgemeinverständlich, anschaulich und gut lesbar dargestellt. Fachkenntnisse werden nicht vorausgesetzt, daher auch für Oberstufenschüler. The dispute settlement system of the World Trade Organisation has been referred to as the jewel in the crown of the WTO. Reviewing more than twenty years of the system's operation, this volume takes stock by providing an in-depth analysis of key issues that have emerged. The book collects and updates papers by a group of eminent experts that were presented at an international conference at the College of Europe in Bruges. The fundamental question of whether the system is in good shape or whether changes are necessary is addressed through five themes. Firstly, the book looks at the interpretive function of the dispute settlement system and questions whether rulings are capable of "gap-filling". Secondly, under the heading 'Jurisdiction and Applicable Law' we cover the thorny issue of how public international law can be integrated into the dispute resolution system. Thirdly, regarding problems associated with implementation, we ask whether the system ensures satisfactory compliance with its rules and rulings or whether financial remedies need to be added. Furthermore, through themes four and five we compare the WTO dispute settlement system with the dispute settlement system contained in the Free Trade Agreements, as well as the investor-state arbitration system (ISDS). We investigate how these two different systems can influence each other and learn from one another. With respect to the reform debate on ISDS, for example, the question was raised whether the WTO dispute settlement system could be considered as a model for such a reform. This review comes to the conclusion that the system is functioning, if not perfectly, at least reasonably well. Where problems are identified, solutions are suggested to improve the system

In seven years of WTO dispute settlement (1995–2001), six panels appointed scientific experts,2 two panels requested expert advice from other international organisations3 and one panel nominated a linguistic expert.4 Under GATT 1947, in contrast, only one panel saw the need to seek expert advice.5 Very often also the parties to a WTO dispute nominate experts on their delegation, be they lawyers, economists, scientists or linguists. In addition, an increasing number of 'outsiders' or amici curiae, such as NGOs, but also industry and academics, have pressed their (expert) opinion on WTO panels and the Appellate Body.

Es folgen die für die Praxis notwendigen Kenntnisse: Rechtsordnung, Methoden der Rechtsanwendung und Rechtsinterpretation, Rechtsquellen und Verwaltungsvorschriften. The essay starts from the observation that attempts to formalize negotiations in the World Trade Organization (WTO) have consistently spawned new forms of informality, such as the holding of meetings as 'chairperson's consultations' which do not require the adoption of an agenda, or the emergence of new types of 'unofficial' documents. The essay sketches the resulting layers of formality/informality and attempts to account for the survival of informality in the WTO. The most commonly offered explanation for the persistence of informality in WTO negotiations is that it serves to facilitate and disguise the exercise of power. The essay argues instead that formal and informal meetings serve essentially different functions. Informality can provide opportunities for productive interventions, alliances, and performances that are precluded in more formal settings. Gradations of formality/informality offer different avenues for WTO Members to talk to each other and to their domestic and international audiences.

Das "Recht der Datenwirtschaft" ist noch kein abgeschlossenes dogmatisches Rechtsgebiet, jedoch eine höchst dynamische Rechtsmaterie, die insbesondere seit 2017 auf EU-Ebene stetig vorangetrieben wird. Die Anzahl der seither beschlossenen und vorgelegten Rechtsakte ist enorm. Vor diesem Hintergrund stellt sich die Frage, welcher rechtliche Rahmen für eine regulatorisch europäisch gesteuerte Datenwirtschaft als zentralem Wirtschaftsfeld des 21. Jahrhunderts notwendig ist und gesetzt wird. Der Fokus des Buches liegt auf dem Datenwirtschaftsrecht als Querschnittsmaterie zwischen Zivil-, Sachen-, Wettbewerbs- und Datenschutzrecht.Der kleinste begriffliche Anknüpfungspunkt ist somit das Datum/die Daten, dies sowohl als personenbezogene Daten wie auch als maschinell-generierte Rohdaten ohne Personalbezug, sog. "Big Data".Dieses Lehrbuch verfolgt eine Grundlagenbildung, welche wissenschaftlich und für die Lehre angezeigt ist
