Trump Board More Flexible About Employer Conduct

How the National Labor Relations Board views statements management makes to employees in the context of union organizing or other protected activity has always been influenced to some degree by which political party was in power. The Obama NLRB tended to rigidly treat any questionable employer statements made in the context of union organizing as unlawfully coercive. As in other areas, the Trump Board has shown itself more willing to consider all the circumstances, as in Johnston Fire Services, LLC, 367 NLRB No. 49 (2019).
