In den Zeiten der Globalisierung und der internationalen Freizügigkeit trifft das Staatsrecht der Demokratie auf eine grundlegende Herausforderung: Wer ist das Volk, von dem alle Staatsgewalt ausgehen soll? Traditionell knüpfen die Staaten das nationale Wahlrecht an zwei Voraussetzungen: die Staatsangehörigkeit und die Ansässigkeit im Staatsgebiet. Doch die Tradition schwindet. Jüngere Entwicklungen zeigen, dass an die Stelle der überkommenen territorialen und personalen Abschließung des staatlichen Wahlrechts verschiedene Konzepte und Strategien treten, die der Tatsache Rechnung tragen wollen, dass immer mehr eigene Staats- und Nationsangehörige im Ausland leben und, dass umgekehrt immer mehr fremde Staatsangehörige dauerhaft im Inland ansässig sind. Die Beiträge dieses Bandes beschäftigen sich mit den aus dieser Entwicklung erwachsenden Fragen und Problemen aus der Warte des Völkerrechts und des Staatsrechts sowie in rechtsvergleichender Hinsicht. Sie sind aus einem Symposium der Studiengruppe für Politik und Völkerrecht im Oktober 2012 hervorgegangen

The discussion of corruption and bribery in most auditing textbooks focuses only on the Foreign Corrupt Practices Act which is an amendment to the Securities Exchange Act of 1934. As the US moves toward the implementation of International Financial Reporting Standards (IFRS) and international auditing standards, an understanding of international legislation pertaining to corruption and the perception of corruption in specific countries are important. This paper provides an overview of the Foreign Corrupt Practices Act (FCPA) and the Organization for Economic Co-operation and Development (OECD) Anti-bribery Convention. While prior literature has discussed the impact of both the FCPA and OECD on corruption and bribery, this paper. extends prior literature by providing an update on phase II the OECD and examines how the OECD countries are viewed in comparison to non OECD countries using five publicly available measures of corruption. Corruption indices that can be purchased are also identified. Our findings show that the highest ranked OECD countries across the corruption indices are Denmark, Finland and New Zealand while the lowest ranked OECD countries are Argentina, Brazil, Mexico and Turkey. One non-OECD country, Singapore, consistently received high scores (low corruption) across the indices.

International crimes are mostly prosecuted at the national level and domestic judges have to contend with a plethora of divergent judgments from international tribunals and other domestic courts. This book assesses the impact of this legal pluralism, exploring whether divergence can be accepted as a regular feature of international criminal justice.

Thema des vorliegenden Beitrags ist die internationale Verrechtlichung. In einem ersten Abschnitt wird zunächst das Verständnis von Verrechtlichung im Kontext der internationalen Beziehungen präzisiert. Erörtert wird, ob Verrechtlichung in den internationalen Beziehungen eine im Vergleich zu der innerstaatlichen Verrechtlichung spezifische Qualität aufweist und ob es Indikatoren gibt, die es erlauben, Verrechtlichung im Bereich der internationalen Beziehungen von "einfacher" Verrechtlichung zu unterscheiden. Unterstellt, daß diese Differenzierung von Belang ist, werden dabei die Funktionen von verrechtlichten Vereinbarungen im Gegensatz zu anderen Formen internationaler Verregelung diskutiert. Auf der Grundlage dieser Funktionen erfolgt im zweiten Abschnitt eine Auswertung einiger Beiträge zum Thema internationaler Verrechtlichung (im gleichen Band wie der vorliegende Aufsatz versammelt) unter der Frage, wann die starke Form der internationalen Verregelung, die internationale Verrechtlichung gewählt wird. Die Hypothesen der einzelnen Beiträge werden zusammengetragen. (psz)
