Migration is a form of spatial and social transplant from one local and national context to another. Migration trajectories often expose the underlying intersections of social relations and social hierarchies that underpin cultural and social national environments. Migrants who encounter those complex structural inequalities must learn to negotiate classed, gendered and racialised social relations and seek the most suitable social positions within new systems. This article builds on Amartya Sen's capability approach to conceptualise migrants' embeddedness in the framework of social inequalities and explores the relationship between individual choices, resources and entitlements. It points towards patterns of advantage and disadvantage that frame migrants' opportunities and draws tacit analytical, theoretical and methodological links that have the innovative potential for the study of migration. Building on the parallels between studies in the fields of social inequalities and migration, this article argues that Sen's analytical and conceptual approach provides innovative insights into migration experiences, and Sen's unique reasoning opens up new avenues for the discussion of migrants' social justice.

On 18 October 2016 the European Court of Justice, in the case Greece v. Nikiforidis, decided: 'Article 9 (3) of the Regulation No. 503/2008 on the law applicable to contractual obligations must be interpreted as precluding overriding mandatory provisions other than those of the State of the forum or of the State where the obligations arising out of the contract have to be or have been performed from being applied, as legal rules, by the court of the forum, but as not precluding it from taking such other overriding mandatory provisions into account as matters of fact in so far as this is provided for by the national law that is applicable to the contract pursuant to the regulation'. Ole Lando already anticipated this development when he dealt with this problem arising under the Rome Convention of 1980 on the law applicable to contractual obligations still in force in Denmark.

Fortement enraciné et unanimement professé, le credo proudhonien des sections françaises de l'Internationale à ses débuts s'accompagne, au cours de l'intervalle des années 1867-1869, d'une pratique qui en contredit cependant fondamentalement le paradigme : la grève ! Cette contradiction, que le seul prisme idéologique de l'historiographie consacrée laissa longtemps impensée, se révèle notamment à l'occasion de la grande grève des ouvriers bronziers de mars-avril 1867 à Paris. Une grève dont la démonstration de force de l'AIT (Association interna- tionale des travailleurs) et les décantations politique qu'elle occasionne sur le long terme, offrent matière à l'analyse d'une étiologie sociale de la mutation du petit cercle d'étude proudhonien en un véritable outil de résistance ouvrière.
