El martes 16 de junio se reunieron en la ciudad rusa de Ekaterimburgo los líderes de Brasil, Rusia, India y China. Esta "cumbre" no ha tenido hasta ahora mucha resonancia en la prensa mundial pero, no por ello, ha pasado desapercibida.Consideradas como las cuatro economías más poderosas de los países emergentes, este grupo fue bautizado como "BRIC" allá por el año 2001 por un analista financiero norteamericano con algún talento para pergeñar siglas pero, en realidad, el grupo comenzó a adquirir cierto sentido recién hacia 2004-2005.Aunque ya se han realizado varias reuniones informales entre los líderes de estos cuatro países, lo cierto es que el martes, probablemente gracias a un fuerte liderazgo del anfitrión, realizaron su "presentación oficial en sociedad".Las razones por las cuales muchos analistas consideran la concreción de este grupo de países emergentes como un hito de importancia son, por lo general, de corte meramente cuantitativo. Nos dicen que los países del BRIC constituyen, según el Banco Mundial, el 27% del PBI mundial (siendo Rusia la economía No. 11, Brasil la No 10, China la No. 5 y la India la No. 12, en el ranking del FMI), que su población supera el 40 % de la población mundial, que disponen en este momento de aproximadamente el 40% de las reservas monetaria, que ocupan el 25 % del territorio mundial, etc., etc.En suma, nadie puede negar que se trata de países que son altamente significativos en el mundo contemporáneo y que, muy probablemente, seguirán adquiriendo importancia creciente en el futuro inmediato (toda vez que varios de ellos están atravesando la crisis en bastante mejores condiciones que otras potencias) y también en el mediano plazo surgirán como referentes internacionales de peso.Resulta importante señalar que la emergencia de este grupo puede ser revelador de un fenómeno que todos percibimos con bastante claridad: la globalización, (al contrario de lo que sostienen sus eternos detractores en los países subdesarrollados) ha sido una estupenda oportunidad de crecimiento para muchos de los países emergentes. Es más: en varias oportunidades se ha considerado si países como Sudáfrica, México o Pakistán no podrían formar parte del mismo grupo. Si no ha sido así, es por razones políticas específicas que, en cada caso, se considera que los inhabilitan por el momento.En otros términos, para muchos, el BRIC aparece como un nuevo "player global" potencial y, en algún sentido eso es así si planteamos la cuestión a la inversa: el "espacio" político internacional ocupado por los EE.UU., la UE y el Japón se ha reducido, relativamente, y ello de manera independiente de esta crisis económica por la que estamos atravesando, por lo que otros países o grupos de países tienden a ocupar ese nuevo "margen" que aparece como vacante.Pero ¿es precisamente esta configuración "BRIC", de los nuevos "players globales", la fórmula mas idónea para ocupar esos nuevos espacios y desafiar a los 3 centros de poder establecidos?Cuando uno revisa la temática tratada en la reunión por Medvédev, Hu Jintao, Manmohan Singh y Lula da Silva, lo que llama la atención es que se trató, esencialmente de una plataforma reivindicatoria, si no es que de una lista de quejas. El dólar y el euro ya no serían suficientes como monedas de reserva, el peso de sus países en los organismos multilaterales no es equitativo, hay que recordar las responsabilidades de los países desarrollados en el terreno energético y en la cuestión ambiental, se requiere reformar las Naciones Unidas, etc. En otros términos: más allá de que algunas de estas cuestiones puedan resultar pertinentes, la reunión no parece haber generado una sola propuesta concreta -(si no es la de volver a reunirse en Brasil en el 2010)- y se centró en el archi-conocido "lamento" contra EE.UU. y el "establishment" internacional existente.Desde esa perspectiva, la reunión de Ekaterimburgo dejó una impresión más bien pobre. El Presidente Medvédev declaró: "Nuestra cumbre inicial ha justificado las expectativas" y, luego, que "La cumbre del BRIC debe crear condiciones para la formación más justa de un medio favorable que permita resolver tareas actuales de envergadura mundial" lo que en principio, si uno logra identificar algún sentido coherente a estas declaraciones, parece ser una declaración de satisfacción y, simultáneamente, la proclamación de la necesidad de afirmación de un principio de justicia en el ámbito de la política internacional.Nadie puede discrepar con el principio de la justicia pero, lo que primero salta a la vista es que este nuevo paladín de la justicia tiene un doble problema de credibilidad.El primer problema es que, como grupo, constituye un nucleamiento demasiado disímil -(desde lo cultural hasta lo militar)- como para liderar, o siquiera prohijar, un funcionamiento más justo del mundo internacional. Es más, con la excepción del Brasil, los otros tres actores tienen entre sí un pasado relativamente reciente de fuertes enfrentamientos, incluso militares. Sus lazos comerciales son escasos y los que se han desarrollado son más bien recientes. Desde el punto de vista cultural: ¿que tienen que ver Rusia que, desde Catalina la Grande hasta la fecha, está por decidir si es occidental o asiática, con la China, "El Imperio del Medio" del Oriente? ¿Que tienen que ver la milenaria India colonizada por Gran Bretaña y liberada por Gandhi, con el imberbe Brasil luso-afro-americano cuya historia independiente no llega a 200 años?Pero, en segundo problema de credibilidad reenvía todavía a problemas más álgidos y concretos. ¿Es la Rusia de Putin la que clama por la justicia y el multilateralismo equilibrado y ponderado? ¿Cómo ven este nuevo papel las decenas de países actualmente sometidos a la presión constante de un país compulsivamente expansionista? ¿Esa China de Hu Jintao no es la misma que sostiene el gobierno de Sudán responsable, en altísima medida, de la tragedia de Darfur? ¿Es "otra" China la que ha sometido al Tibet? ¿No es la India la potencia que mantiene subyugada a Cachemira? Y este Presidente Lula que declara, con tono "izquierdista" que "…la sociedad moderna debe revisar un sistema que…condena a millones de personas a la pobreza y a la desesperación", ¿no pertenece al país más expansionista de América del Sur que hace y deshace, dentro de Mercosur, cerrando y abriendo fronteras, sacando y poniendo aranceles a su antojo? Seguramente que ya revisó los precios que paga por la energía que le vende obligadamente el Paraguay de la represa binacional de Itaipú, como clama el Presidente Lugo. También pide Lula que los países desarrollados cubran: "…los costes de la adaptación tecnológica necesaria para que…los países en desarrollo se beneficien del progreso científico sin hacer daño al medio ambiente." ¿No es el mismo Presidente que no ha detenido el proceso de desforestación de la Amazonia? ¿O la culpa de ello es del "imperialismo" y es este último el que debe pagar la factura?Vamos, …que tampoco nos tomen por tontos!¿ China, Rusia, India y el Brasil en el papel de defensores de la justicia y de redentores del mundo internacional?Bienvenido el BRIC como un potencial actor de importancia en la escena internacional si es que, en sus políticas, se va a mostrar efectivamente más coherente y apegado a los principios de derecho que las actuales superpotencias. !Pero hay de nosotros si estos cuatro recién llegados se suman, efectivamente, a las superpotencias existentes y a sus prácticas! En la mayoría de los casos, su "record" de conducta internacional es bastante más dudoso que el de las conocidas grandes potencias actuales. Y más vale lidiar con tres potencias que, con esas mismas tres, más estas "nuevas cuatro", que, además, llegan con sus apetitos intactos.

Schon aufgrund des Volumens kommt der Sammelband Mediengeographie. Theorie – Analyse – Diskussionen, herausgegeben von Jörg Döring und Tristan Thielmann, gewichtig daher: Auf über 600 Seiten wurden 24 Beiträge deutschsprachiger und internationaler AutorInnen – darunter Theorie- und Diskursstars wie Bruno Latour, Paul Virilio, Lev Manovich und Saskia Sassen – versammelt, die sich der "Remedialisierung der Geographie in Form von Mediengeographie" (Einleitung, S. 10) widmen möchten. Eine Schlüsselstellung sprechen die Herausgeber dabei Latours "Die Logistik der 'immutable mobiles' " zu, eine aus dessen Science in Action (1987) entnommene Passage, die eigens und erstmals für den vorliegenden Band übersetzt wurde. Latours Konzept der unveränderlich mobilen Elemente soll "die Identifizierung von Elementen/Strukturen" ermöglichen, die "sowohl für Medien als auch für den Raum, für Menschen als auch für Nicht-Menschen unveränderlich sind, um anhand derer – einfach dem Akteur folgend – die Transformationskette der Inskriptionen zu skizzieren" (S. 19). Damit hoffen die Herausgeber eine für die Mediengeographie geeignete Methode gefunden zu haben, die die Nachteile der Medienwissenschaft bzw. der Geographie, entweder den Raum oder die Medien konstant halten zu müssen, um das je andere zu beobachten, überwindet. Erfrischend ist die editoriale Entscheidung, diesem als zentral verstandenen Text Latours eine Kritik von Erhard Schüttpelz voraus zu schicken, die sich auf Fernand Braudels Globalisierungsgeschichte beruft und auf deren "Skepsis gegenüber einer Geschichte, die sich an einer Chronologie von Technikinnovationen orientiert" (S. 90), rekurriert. Schüttpelz meldet damit Zweifel an, ob Latours Terminus der unveränderlich mobilen Elemente auch bereits auf den Zeitraum von 1500 bis 1800 angewandt werden kann, in dem weder der Buchdruck eine identische Textgestalt garantierte (S. 72-77), noch die Inkorporation geometrischer Formen (z.B. in der Gestaltung von Tänzen oder Festungsgrundrissen) bereits klar dem Zweck der optischen Konsistenz unterstellt war (S. 77-85). Einen solchen Diskutanten, wie ihn Schüttpelz für die Annahme einer frühzeitigen medientechnischen Überlegenheit des Westens gibt, wünscht man sich auch für Paul Virilios Beitrag "Die morphologische Irruption", um diesen z.B. nach dem Verhältnis von direkter ("sinnlicher") Beobachtung und Geometrie zu befragen, das bei dem Entwurf einer optoelektronischen ("intelligiblen") Beobachtung vergleichweise unterbelichtet bleibt, etwa wenn Virilio schreibt: "Das Raum-Zeit-Gefüge der optoelektronischen Welt-Darstellung entspricht also nicht mehr dem der physikalischen Dimensionen der Geometrie, die Tiefe ist nicht mehr der sichtbare Horizont und auch nicht der ''Fluchtpunkt' der Perspektive, sonder einzig die "Urgröße der Geschwindigkeit [.]" (S. 155). Weiters stellt im ersten, "Mediengeographie global: Geomedientheorie" getitelten Abschnitt Jens Schröter sein Konzept des "transplanen Bildes" dar, unter welches er solche Bildtechnologien fasst, "die mehr Rauminformation liefern, als es die perspektivische Projektion auf die Bildfläche vermag" (S. 170; vgl. Schröter 2009). Als Beispiele nennt er die Stereoskopie, die Fotoskulptur, die integrale Fotografie, die Volumetrie (bzw. Tomografie) sowie die Holografie – meist als Randerscheinungen behandelte Verfahren, von deren Theorie Schröter die Stärkung einer Bildtheorie als Kontinuum zwischen Fläche und Raum erhofft. Unter dem Begriff "Visuelle Geographien" diskutiert Judith Miggelbrink "bildliche Formen von Objektivierung durch Verräumlichung und Verortung" (S. 192) und unterscheidet zwischen einer erdräumlich-landschaftlichen Bildsprache und räumlichen Ordnungen, die durch visuelle Metaphern ausgedrückt werden. Marc Ries entwickelt für das Porträt eine Topologie von "Hier" und "Da-Draußen", welche er auch auf die perspektivisch navigierbare Online-Umgebung Second Life anwendet, und so zu dem Schluss kommt, dass deren zentraler Antrieb "das Begegnen anderer 'Porträts', das Austauschen mit ihnen, das 'Existieren' in Szenarien" sei (S. 214). Der zweite Abschnitt, "Mediengeographie analog", versammelt Beiträge zur Geomediengeschichte, beginnend mit einem weiteren sich auf Latour berufenden Beitrag, in dem Sven Werkmeister die Ursprünge der vergleichenden Musikwissenschaft im Kontext medientechnischer, v.a. phonographischer Aufzeichnungen diskutiert. Verblüffend sein Bericht über die Forschung Erich von Hornbostels: "An die Stelle subjektiv-kulturgebundener Exegese sollten physikalische Verfahren des Messens und Zählens treten" (S. 230) – es wurde versucht Kulturaustausch anhand von Schwingungszahlen nachzuweisen. Jörg Dörings "Geschichte der Literaturkarte" nimmt nicht Karten 'in', sondern Karten 'zur' Literatur in den Blick, wie z.B. Barbara Piattis Kartierungen literarischer Schauplätze (2008), deren analytische Erträge im Verhältnis zum Aufwand mit jeder Karte zur Literatur neu verhandelt würden. Stefan Zimmermann rekapituliert in "Filmgeographie – Die Welt in 24 Frames" frühere und laufende Annäherungen der Geographie an die visuellen Medien: u.a. als Mittel zur Dokumentation, Gegenstand der Kulturgeographie und in Form von Untersuchungen filmischer Landschaften. Paul Reuber und Anke Strüvers Untersuchungen der "Diskursive[n] Verräumlichungen in den deutschen Printmedien" bestätigen den Verdacht, "dass die Anschläge vom 11. September zur Polarisierung geopolitischer Leitbilder und Diskurse" (S. 328) und zur Schaffung einer globalen Topographie des Eigenen und des Fremden beigetragen haben. James Schwoch widmet sich der verquickten Geschichte des mehrfach verschobenen Atomexperiments Starfish Prime am 9. Juli 1962, dem Start des ersten zivilen Kommunikationssatelliten Telstar-1 am folgenden Tag und dem Moskauer Atomteststoppabkommen von 1963, welche die Entwicklung von Satellitenüberwachungsprogrammen erst ermöglicht habe. Den zweiten Abschnitt schließt Wolfgang Hagens "Zellular – Parasozial – Ordal" mit "Skizzen zu einer Medienarchäologie des Handys", dessen Nutzung er vorschlägt als ordale Herausforderung des Schicksals zu betrachten: "Wer glaubt, dass das 'Was', 'Mit wem', 'Wie lange' und 'Wo' am Zellphon Gesprochene [.] verschlossen blieben vor seinem privatesten Akt der Interaktion, den er am Handy begeht, befindet sich schon mitten in seiner Wasserprobe. Kann sein, dass er oben schwimmt, kann auch sein, dass er untergeht." (S. 377). Der im Titel mitangekündigte, aber erst kurz vor Artikelschluss unternommene Versuch, 'Zellphon'-Nutzung auch der parasozialen Interaktion zuzuordnen, bleibt unterdefiniert. Wie bei allen Sammelbänden stellt auch hier die Tektonik der Beiträge eine Herausforderung für sich dar: Die Unterordnung der vier Hauptabschnitte unter die Leitdifferenzen global/lokal und analog/digital bietet nur eine begrenzte Navigationshilfe, was jedoch zuallererst die Schwierigkeit aufzeigt, das hybride Feld der Mediengeographie entlang dieser Differenzlinien einzuteilen. Den dritten Abschnitt – "Mediengeographie digital: Geobrowsing" – eröffnet ein Interview mit Lev Manovich, in dem er u.a. den Erfolg von Google Earth gegenüber wissenschaftlichen geographischen Informationssystemen (GIS) darauf zurückführt, dass dort verschiedene "kulturelle DNAs" – im Fall von z.B. Satellitenbildern, 3D-Modellen, Layer-Konzepten und Partizipation der UserInnen (S. 387) – erfolgreich zusammenspielen würden. Im Sinne der eingangs geschilderten dritten Option der Mediengeographie wäre dieses Erklärungsmodell freilich unbrauchbar: Mit der Identifikation von 'kultureller DNA' oder von 'Genen' werden sowohl Medien als auch Raum zugunsten der Beobachtung eines vermeintlichen Kampfes sich artikulierender Gene stillgestellt – die Evolutionsanalogien sind jedoch gerade in der Auseinandersetzung mit digitalen Medien eher auf dem Vormarsch, denn in der Stagnation begriffen (vgl. die Thesen von Thomas W. Malone, Susan Blackmore oder Kevin Kelly). Eric Gordon untersucht, wie sich die "Metageography of the Internet" in den letzten 30 Jahren, insbesondere aber mit dem Übergang vom (nachträglich konstruierten) Web 1.0 zu Web 2.0 verändert hat: Vom Gitternetz aus Fiktionen wie Tron (1982), Neuromancer (1984) oder The Matrix (1999), d.h. von Repräsentationen eines externen digitalen Netzwerks hin zu Tools, die Navigation innerhalb dieses Netzwerks erlauben, z.B. Google Maps aber auch soziale Geo-Mashups wie z.B. Plazes. Als "phantastische Zeitreise" charakterisiert Anne Vowinckel in ihrem Beitrag den Gebrauch eines Flugsimulators, die damit zwar das Raum-Zeit-Kontinuum aufhebt, aber nicht im Sinne eines baudrillardschen Hyperrealen das Reale verdrängt, sondern als "Raum für die Realisierung des Imaginären" (S. 428). Ob der Google Earth 'Global Awareness Layer' namens 'Crisis in Darfur' wirklich das beabsichtigte Potenzial hat, die Ereignisse "am Boden" (so Google-Pressevertreter) zu beeinflussen, untersucht Lisa Parks und kommt zum Ergebnis, dass Satellitenbilder dort nur eine "Durchgangsstation" (S. 441) vor dem Aufrufen von Nahaufnahmen z.B. von Verwundeten darstellen und – im Unterschied zur Verwendung in Fernsehnachrichten – Konflikte eher der Vergangenheit als der Dringlichkeit aktueller Ereignisse zuweisen. Parks identifiziert weiters Strategien, die sie als "Konflikt-Branding" bezeichnet und charakterisiert das Projekt als Googles "Instrumentalisierung seine Handelns als Werbung für die eigene Marke" und als "mustergültiges Beispiel für neoliberales Handeln" (S. 446), gegenüber dem unsere visuelle Erfahrung historisch wachsam bleiben müsse (S. 448). Die Untersuchung der "Produktion einer Politik der Angst" (S. 455) nimmt sich Jeremy Crampton vor und spannt dabei den Bogen von geographischen Imaginationen nach dem 11. September bis zur statistischen Kartographie des 19. Jahrhunderts, welche z.B. in Frankreich einen Skandal produzierte, "als dort eine Landkarte publiziert wurde, die keinen Zusammenhang zwischen Kriminalitätsraten und Bildung erkennen ließ" (S. 465) – Kriminalität konnte von nun an überall vorkommen, eine Situation, die Crampton als analog zur gegenwärtigen sieht, in der Regierungen die Bedrohung mit Mitteln der Geosurveillance zu bewältigen suchen: "Technologie ist Teil des politischen Entscheidungsprozesses und keine neutrale Aktivität" (S. 473). Der Macht bewegter räumlicher Bilder, das emotionale Erleben zu intensivieren, zeigen sich auch Stuart Aitken und James Craine durchaus bewusst – das Ziel der beiden Geographen ist nicht weniger, als durch "Affektive Geovisualisierung" Daten so aufzubereiten, dass sie uns wie das Kino staunen lassen und "dadurch unser Leben" erhellen (S. 483). Aus medien- und literaturwissenschaftlicher Perspektive zeichnet Albert Kümmel-Schnur nach, wie Modelle nicht-linearer Erzählweisen zunächst von Hypertexttheorien und schließlich von solchen abgelöst wurden, die Narration als Navigation durch ein Netzwerk konzipieren, wobei wiederum "das navigierende Tun in den Modus einer linearen Erzählstrategie" gebracht wird (S. 503). Dicht am Material wendet Kümmel-Schnur dies auf zwei Webseiten an – auf das österreichische Hypermedienprojekt Past Perfect und die von Bruno Latour mitentwickelte Flashanimation Paris: Invisible City. Beide Beispiele können im Übrigen mithilfe einer einfachen Suchanfrage gefunden werden - was unmittelbar die Frage aufwirft, wie das seitenunabhängige, schlagwortbasierte Navigieren durch Suchen, das rezente UserInnenpraktiken kennzeichnet (vgl. Mager 2010), in diesem linienbasierten Ansatz der "Arachnefäden" (so der Titel) eingeordnet werden kann. Den "Global Cities, Knowledge Villages, Media Homes" wendet sich schließlich der vierte und letzte Abschnitt, "Mediengeographie lokal" zu. Saskia Sassen plädiert in "Reading the City in a Global Digital Age" für die Berücksichtigung der Verräumlichung globaler und digitaler Komponenten, denn eine rein physikalische Topographie "would fail to capture the electronic connectivity possibly marking even poor areas as locations on global circuits" (S. 513). Als Analysebeispiel zieht sie New Yorks "geographies of talk" (vgl. http://senseable.mit.edu/nyte/visuals.html), d.h. Auswertungen von globalen, in New York City getätigten Telefonanrufen heran: "Global talk happens largely among those at the top of the economy and at its lower end. [.] The vast middle layers of our society are far less global" (S. 516). Das als lokal Repräsentierte erweise sich letztlich häufig als "microenvironment with global span" (S. 531). Mike Crang wendet sich der Imagination mediatisierter globaler Räume zu, typischerweise durch die Kontrastierung von physischem "place" und virtuellem "space", "through notions of substitution, derealisation, transcendence and thence to consequence of dispersal, distanciation and social disintegration" (S. 539). Dem stellt Crang die Raumvision Singapurs als "Intelligent Island", als "switching centre for goods, services, capital and information and people" (S. 553) gegenüber, als Beispiel der Produktion neuer Zentralitäten, welche selbst Dinge hervorbringen, statt bloß Bestehendes zu enkodieren. Auch Scott McQuire ("Public Screens, Civic Architecture and the Transnational Public Sphere") wendet sich gegen die These der Obsolenz von Raum und Zeit durch elektronische Echtzeitkommunikation und schlägt stattdessen vor, von einer fortlaufenden dynamischen Rekonfigurierung von Raumdimensionen und zeitlichen Rhythmen zu sprechen, die er seinerseits anhand von urbanen elektronischen Plakat- und Werbeflächen untersucht. Rolf Nohr argumentiert auf der Grundlage von Harold Innis für die Verflechtung von Waren- und Bedeutungsformen bzw. von symbolischer Kommunikation und deren räumlichen Erstreckung und gelangt so zur Frage nach dem Verhältnis von medienimmanenter zu symbolisch vermittelter Topographie bzw. – konkret am Fall TV beobachtet – zum Verhältnis von Wohnzimmer oder 'Public Viewing Area' und televisuell produzierten Orten und Ereignissen. In diesen vier Beiträgen werden die Fragestellungen im letzten Abschnitt von allen insgesamt am dichtesten geführt; der letzte Beitrag von Tom Holert zur "Geographie der Exzellenz" wendet sich schließlich den "gern – und oft beschönigend – 'Campus' genannten postindustriellen Wissensfabriken" (S. 630) und der Inszenierung von Humankapital zu, wie sie in IT-Forschungs- und Entwicklungszentren wie dem Dubai Knowledge Village, dem Infosys-Campus Bangalore oder dem Cyber Gateway Hyderabad stattfindet. In Summe bleibt die Fülle der Perspektiven und Ansätzen, die in Mediengeographie. Theorie – Analyse – Diskussionen vorgestellt und angerissen werden, beeindruckend. Typisch für ein Vorhaben dieser Größe wird die Zusammenführung dieser Linien mitunter zu einer Herausforderung; insbesondere der angestrebte Dialog zwischen Medienwissenschaft und Geographie in Richtung der Begründung einer Geomedienwissenschaft bleibt bei einem bloßen Nebeneinander stecken, auch der Latour'sche Faden verliert sich im Band alsbald. Der Wunsch, die vielfältigen Beiträge auf drei schmalere Bände mit stärkerer, editorialer Begleitung aufzuteilen, erscheint legitim, muss jedoch auf das nächste Projekt der Herausgeber projiziert werden. Immerhin ist Mediengeographie selbst bereits ein Nachfolger auf einen 460-Seiter, den 2008 ebenfalls von Döring und Thielemann herausgegebenen Band Spatial Turn. Satisfied with some important progress being made in health care reform on the home front, these past few days President Obama turned his full attention to foreign policy. In a week packed with international speeches, bilateral meetings and joint declarations, he succeeded in establishing a new ambitious agenda for international cooperation and wasted no time in getting started. In his speech to the UN, he outlined his main foreign policy goals based on four pillars: non-proliferation, climate change, Middle East peace and economic stability. He spoke clearly about his determination to put an end to the international skepticism and distrust the United States faced during the Bush years and enumerated the changes already made: banning the use of torture, closing the Guantánamo base, drawing down forces in Iraq, renewing efforts in the Arab-Israeli conflict by naming a special envoy, seriously addressing climate change and abandoning plans for a land-based missile defense in Eastern Europe. He challenged other leaders to respond in kind by joining US efforts at non-proliferation, fighting terrorism, taking measures to reduce greenhouse gas emissions and combating poverty. A day later in Pittsburgh for the G-20 summit, the President, flanked by British Prime Minister Gordon Brown and French President Sarkozy, revealed a new nuclear facility built by Iran in the city of Qum and called for further sanctions on the Islamic Republic. This well-timed revelation is supposed to give the administration some more leverage when talks with the Iranians start later this week. As it happens, the US had known about this new uranium enriching plant for more than a year but had kept the information secret for later use. In Pittsburgh, with France and Britain safely on his side, the President had further opportunity to press the other two members of the UN Security Council, Russia and China, to cooperate with the new sanctions regime that will most likely include imports of refined oil into Iran. While Russia appears to be leaning towards cooperation (perhaps as a quid pro quo of Obama's decision not to deploy the anti-missile defense system in Poland and Czech Republic), it is not as yet clear whether the Chinese will too. This week has been a good one for China, which seems to be coming of age as an international player both in climate change and as a partner for economic stability in the G-20. But the revelation at Qum was certainly a pre-emptive coup that put the Iranians on the defensive, and gave Obama an opportunity to publicly test the other Permanent Members of the Security Council to prove their commitment to non-proliferation.As the United States moves aggressively to engage with the rest of the world and vows to renew its pledge to international law and institutions, the expectation is that others will take their share of responsibility and respond to global challenges. Obama's moral authority flows not only from what he says, and how he says it, but also by virtue of who he is: in his case, the man is the message and the intended drastic cut with his predecessor could not be more apparent. However, as Realists constantly remind us, foreign policy is about national interest defined as power, and while the change of tone and of emissary is well-noted, we are likely to see some change, but also a lot of continuity in US foreign policy. Barack Obama's first speech at the United Nations General Assembly was well-received around the world but had less impact on a home audience whose main concerns are unemployment, health care reform and economic recovery. Inevitably, the usual suspects accused him of treason for recognizing America's past mistakes in public and for socializing with tyrants. Others denounced his narcissistic impulses, for trying to portray American foreign policy as "all about Obama". While it is easy to dismiss the extreme critics, it is important for the rest of the world to realize how much the United Nations' legitimacy and prestige has suffered in the United States during the last ten years, and not only due to derisions by Bolton and Bush. TV images of the UN headquarters in New York seem distant and irrelevant to most Americans, who view the organization as an anachronistic shibboleth that embodies all fluff and no substance and whose activities are hard to take seriously in most cases, be it when it deals with Rwanda, Darfur or with Iranian sanctions. At this year's opening session, the General Assembly room, with a badly lit podium and a very unbecoming blue-greenish background, was showing its age in spite of a 2002 facelift (it was built in 1952). And while Obama was as dynamic and articulate as usual, his televised speech was followed by that of Mohammad Khadafy from Libya, which lasted one hour and a half and included bizarre statements and phrases that can only be accounted for by a serious onset of senility. Besides calling for a UN investigation of John F. Kennedy's assassination, and surreally complaining about how far most of those present had had to travel to get to New York (was jetlag his excuse to explain away his own state of mental confusion?), he repeatedly called President Obama "my son" (I cringed at imagining the right wing blogs reaction to that) and referred to the UN Security Council as the "Terror Council". His difficulty to find a place in New York where he would be allowed to pitch his tent was followed with amusement by the media and further added to his own oddity, and by extension, to the inadequacy of the UN as a serious forum. While later Prime Minister Netanyahu's excellent, Churchill-like speech brought the audience back to the 21st century and restored some respectability to the venue, the UN lost credibility again when Iranian president Ahmadinejad went on a new rant later in the day and again and proceeded once more to deny the Holocaust's existence. In addition to this rarified atmosphere, the main foreign policy topic that is of concern for the American public, and the one that would have made them pay attention, namely, the war in Afghanistan was hardly mentioned by Obama in this occasion. After eight years of war in Afghanistan, the effort seems to be unraveling on all fronts. European NATO members, whose soldiers are fighting and dying in Afghanistan, are unwilling or unable to commit more troops; the Taliban has renewed its offensives with new intensity in the south and the east of the country, and the Afghan election was plagued with corruption, proving what many already suspected, that President Hamid Karzai is an extremely unreliable partner and a corrupt leader who will not be able to hold the country together. At the same time, Al Qaeda has found refuge in neighboring Pakistan so the US initial counterterrorist mission, namely to hunt down and exterminate Al Qaeda, has mutated into one of counterinsurgency against an indigenous group, the Taliban, fighting against the government and the foreign forces to regain its power. All this in a country that has never been a nation, a narco-state whose economic base is the production and trafficking of opium, and where several empires, from the Macedonians to the British and the Soviets were once defeated. The President's plan so far has been to train the Afghan army so that it can hold off the Taliban, support government institutions, gain the trust of villagers and create structures of governance in rural areas so that Al Qaeda won't be able to move in again. This week a Pentagon memo by General Crystal was leaked by Bob Woodward of Watergate fame. Published in the Washington Post on September 21st, it presents a grim picture of the war and warns that success is uncertain. It calls for new resources and a new counterinsurgency campaign. While the number of troops requested is not specified, it warns that "under-resourcing" the effort could be fatal. Woodward, never one to sell himself short, has called his leaked memo the equivalent of the 1971 Pentagon Papers leaked by Daniel Ellsberg in the New York Times, which revealed the expansion of the Vietnam War from 1965 on, that had been kept secret from the American public. Of course the memo is not the equivalent of Ellsberg and Russo's revelations, but still, it refocused attention on the intractability of this war. The President's response has been that after the Afghan election, the White House is re-assessing its strategy and that until he is satisfied with a new strategy he will not send more troops. It is clear that the administration is having doubts about a conflict it once called a war of necessity. Public opinion is also turning against what will soon be the longest war in American history, as casualties continue to increase and there is no end in sight. As the term "military surge" is being increasingly used to denote McCrystal's new demands, comparisons with the war in Iraq are inevitable. Similarly to the Iraq war, elections have represented a turning point. But the surge in Iraq began with the so-called Sunni awakening, when the Iraqis themselves decided they had had enough of the violence and organized against those that insisted on it (mainly outsiders, Al Qaeda-in-Iraq). Also, in Iraq's leader Al-Maliki, the US found a relatively reliable and legitimate partner, one who instigated the political class to resolve their differences by political means. Finally, Iraq had an economic base that could be restored to produce substantial national wealth, and a mostly urban, well-educated population with some institutional experience. In contrast, Afghanistan is a mainly rural country, a tribal society which repudiates any attempts at centralization and profoundly distrusts the government in Kabul more, in some cases, than the foreign troops. The central government is rotten and weak, Karzai an unreliable leader who stole the election and whose brother is the head of the drug mafia. Can more US troops make up for all these weaknesses?Obama is thus in a delicate situation: he can't be "at war" with his own generals (indeed, General McCrystal was appointed by Obama only in March, after he dismissed the previous general in charge). On the other hand, if he allows more troops to be deployed, there is danger that Afghanistan may become his Vietnam. He therefore needs to choose between continuing a counterinsurgency operation, training more Afghan forces, protecting the local populations, getting into their villages and gaining their trust, or withdrawing ground troops and focusing on counter-terrorism, using drones and other off-shore means and special forces to go after the terrorist bases. Vice-President Biden is advocating a middle ground strategy: leaving enough troops on the ground to prevent Al Qaeda from returning to Afghanistan, but redefining the mission as one of narrow counter-terrorism and move away from nation-building and a protracted counter-insurgency operation that would signify more US casualties and more discontent at home. After all, the main reason why the US went to Afghanistan was to confront and eliminate Al Qaeda, which has since then moved across the border to the tribal areas of Pakistan. As several domestic arrests have demonstrated this week, Al Qaeda threats are just as likely to come from Springfield Illinois, Queens New York or Dallas Texas as from abroad or from the virtual Al Qaeda organizing through the worldwide web. Recalibrating his approach to Afghanistan is thus imperative, and it must be done for the right reasons, regardless of personal gain or saving face.Obama has had a very successful September, but his ambitious agenda both at home and abroad faces many pitfalls ahead. A youthful president, brimming with self-confidence, with a huge electoral mandate and with the best team of experts in history, can still be thwarted by unsolvable problems, domestic and foreign enemies and by serendipity itself. As a student of history and a John F Kennedy admirer, Obama knows this, and he should measure his decisions and temper his ambitions accordingly. Weizman on the Architectural-Image Complex, Forensic Archeology and Policing
across the Desertification Line
Incidents
in global politics are usually apprehended as the patterned interaction of macro-actors
such as states. Eyal Weizman takes a different tack—an architect by training,
Weizman tackles incidents through detailed readings of heterogeneous materials—digital
images, debris, reforestation, blast patterns in ruins—to piece together concrete
positions of engagement in specific legal, political, or activist controversies
in global politics. In this Talk,
Weizman—among others—elaborates on methods across scales and material
territories, discusses the interactions of environment and politics, and traces
his trajectory in forensic architecture.

What
is—or should be—according to you, the biggest challenge, central focus or
principal debate in critical social sciences?
We
live in an age in which there is both a great storm of information and a
progressive form of activism seeking to generate transparency in relation to government
institutions, corporations or secret services. These forms of exposure
exponentially increase the number of primary sources on corporations and state
and provide also rare media from war zones, but this by itself does not add
more clarity. It could increase confusion and increasingly be used disseminate
false information and propaganda. The challenge is to start another process to
carefully piece together and compose this information.
I'm
concerned with research about armed conflict. Contemporary conflict tends to take
place in urban environments saturated with media of varicose sorts, whenever
violence is brought into a city, it provokes an enormous production of images,
clips, sounds, text, etc.
As
conflict in Iraq, Syria, Missouri and the Ukraine demonstrate, one of the most
important potential sources for conflict investigations is produced by the very
people living in the war zones and made available in social networks almost
instantly. The citizens recording events in conflict zones are conscious of
producing testimonies and evidence, and importantly so, they do so on their own
terms. The emergence of citizen journalists/witness has already restructured
the fields of journalism with most footage composing Al Jazeera broadcasts, for
example, being produced by non-professional media. The addition of a huge
multiplicity of primary sources, live testimonies and filmed records of events,
challenge research methods and evidentiary practices. There is much locational
and spatial information that can be harvested from within these blurry, shaky
and unedited images/clips and architectural methodologies are essential in
reconstructing incidents in space. Architecture is a good framework to
understand the world, alongside others.
Whereas
debates around the 'politics of the image' in the field of photography and
visual cultures tended to concentrate on the decoding of single images and
photojournalistic trophy shots we now need to study the creation of extensive
'image-complexes' and inhabit this field reconstruct events from images taken
at different perspective and at different times. The relation between images is
architectural, best composed and represented within 3D models. Architectural
analysis is useful in locating other bits of evidence—recorded testimonies,
films and photos—from multiple perspectives in relation to one other bits of
evidence and cross referring these in space.
But
'image complexes' are about interrogating the field of visibility it is also
about absence, failures of representation, blockages or destruction of images.
How
did you arrive at where you currently are in your thinking about global
politics?
I'm
an architect, and my intellectual upbringing is in architectural theory and
spatial theory. I tend to hold on to this particular approach when I'm entering
a geopolitical context or areas that would otherwise be the domain of
journalists and human rights people, traditional jurists, etc. Architecture taught
me to pay attention to details, to materiality, to media, and to make very
close observations about the way built structures might embody political
relations.
When I study political situations, I
study them as an architect: I look at the way politics turns into a material—spatial
practice—the materialization, and at the spatialization, of political forces. Architectural
form—as I explained many times—is slowed-down force. My thinking is structured
around a relation between force and form. And form, for an architect, is an
entry point from which to read politics. So when I look at matter and material
reality—like a building, a destroyed building, a piece of infrastructure, a
road or bridge, a settlement or suburb or city—I look at it as a product of a political
force field. But it is never static. A city always grows, expands or contracts
recording the multiple political relations that shaped it.
Buildings
continuously record their environment. So one can read political force on buildings.
In taking this approach, I am influenced by building surveyors, and insurance
people going into a building to look at a scratch in a wall to piece together
what might have happened, and what might still happen. So I feel like a kind of
property surveyor on the scale of a city at times of war. But in practicing
this forensic architecture
I also work like an archaeologist: archaeology is about looking at material remains
and trying to piece together the cultural, political, military, or social spheres.
But I'm an archaeologist of very recent past or of the present. While
some of my investigations will always retain a haptic dimension based on
material examination, much of it is an analysis of material captured and
registered by various medias. Verify, locate, compose and cross-reference a
spatial reality from images of architecture.
What
would a student need to become a specialist in your field or understand the
world in a global way?
The institutes I run do not recruit
only architects. We need to open up the disciplinary bounds of education. We work
with filmmakers and architects and with artists.
It embodies a desire to understand
architecture as a field of inquiry, with which you can interrogate reality as
it is effectively registering material transformation. I see architecture as a
way of augmenting our way of seeing things in the world, but it's not for me a
kind of sacred field that should not be touched or changed.
But I'm also using architecture
across the entire spectrum of its relation to politics, from the very dystopian—with
forensic architecture, a kind of architectural pathology—to the utopian. I have
a studio in Palestine with Palestinian partners of mine, and internationals.
Alessandro Petty and Sandi Hilal
are in this group, which is called Decolonizing Architure. It's this group that is engaged in
very utopian projects for the West Bank and Palestine and the return of
refugees and so on. So I use architecture across the entire spectrum, from the
very dystopian to the very utopian. Architecture is simply a way of engaging
the world and its politics. Space is the way of establishing relations between
things. And actually space is not static, it is both a means of establishing
relations between people and objects and things. Just as material itself is
always an event, always under transformation. So that is something I have taken
from architecture and try to bring into politics, but not only in analyzing
crimes, but in producing the reality yet to come.
So what we
need from people is the desire to understand aesthetics as a field of inquiry,
not simply as a pleasurable play of beauty and pleasing kind of effect, but as
a kind of very sensorial field, sensorium, in which you can interrogate reality
as it is effectively registering material transformation. So I would look
simply for that kind of sensorial intensity and high critical approach and
understanding and speculating of how it is we know what we think we know. Of
course, you cannot see, or you do not know what you see, you do not have the
language to interpret or question what it is you 'see' without abstract
constructs. This means I don't necessarily look for theoretical capacities in
people: I see theory as a way of augmenting our way of seeing things in the
world, of registering them, of decoding them, but it's not for me a kind of
sacred field to which I submit in any way.
So
what is it you work on now?
I'm mostly trying to establish forensic architecture as a
critical field of practice and as an agency that produce and disseminate
evidence about war crimes in urban context. Recent forensic investigations in Guatemala
and in the Israeli Negev involved
the intersection of violence and environmental transformations, even climate
change. For trials and truth commissions, we analyze the extent to which
environmental transformation intersect with conflict.
The imaging of this
previously invisible types of violence—'environmental violence' such as land degradation, the destruction of fields and forests (in the tropics), pollution
and water diversion, and also long term processes of desertification—we use as new type of evidence of processes dispersed across time
and space. There are other conflicts that unfold in relation to climatic and
environmental transformations and in particular in relation to environmental
scarcity.
Conflict has reciprocal
interaction with environment transformation: environmental change could
aggravate conflict, while conflict tends to generate further environmental
damage. This has been apparent in Darfur, Sudan where the conflict was
aggravated by increased competition over arable due to local land erosion and desertification.
War and insurgency have occurred along Sahel—Arabic for 'shoreline'—on the
southern threshold of the Sahara Desert, which is only ebbing as million of
hectares of former arable land turn to desert. In past decades, conflicts have
broken out in most countries from East to West Africa, along this shoreline:
Eritrea, Ethiopia, Somalia, Sudan, Chad, Niger, Mali, Mauritania, and Senegal.
In 2011 in the city of Daraa, farmers' protests, borne out of an extended cycle
of droughts, marked
the beginning of the Syrian civil war. Similar processes took place in the
eastern outskirts of Damascus, Homs, al-Raqqah and along the threshold of the
great Syrian and Northern Iraqi Deserts. These transformations impact upon
cities, themselves a set of entangled natural/man-made environments. The conflict
and hardships along desertification bands compel dispossessed farmers to embark
upon increasingly perilous paths of migrations, leading to fast urbanization at
the growing outskirts of the cities and slams.
I'm
trying to understand these processes across desert thresholds. There has been a
very long colonial debate about what is the line beyond which the desert begins.
Most commonly it was defined as 200 mm rain per annum. Cartographers were
trying to draw it, as it represented, to a certain extent, the limit of
imperial control. From this line on, most policing was done through bombing of
tribal areas from the air. Since the beginning, the emergence of the use of air
power in policing in the post World War I period—aerial control, aerial
government—took form in places that were perceived, at the time, as lying
beyond the thresholds or edges of the law. The British policing of Iraq, the
French in Syria, and Algeria, the Italians in Libya are examples where control
would hover in air.
Up
to now I was writing about borders that were physical and manmade: walls in the
West Bank or Gaza and the siege around it—most notably in Hollow Land (2007, read the introduction here).
Now I started to write about borders that are made by the interaction of people
and the environment—like the desert line—which is not less violent and brutal. The
colonial history of Palestine has been an attempt to push the line of the
desert south, trying to make it green or bloom—this is in Ben Gurion's terms—but
the origins of this statement are earlier and making the desert green and
pushing the line of the desert was also Mussolini's stated aim. On the other
hand, climate change is now pushing that line north.
Following
not geopolitical but meteorological borders, helps me cut across a big
epistemological problem that confines the writing in international relations or
geopolitics within the borders organize your writing. Braudel is an
inspiration but, for him, the environment of the Mediterranean is basically
cyclically fixed. The problem with geographical determinism is that it takes
nature as a given, cyclical, milieu which then affects politics—but I think we
are now in a period where politics affects nature in the same way in which
nature affects politics. The climate is changing in the same speed as human
history.
What does your background in
architecture add to understanding the global political controversies you engage
in?
We are a forensic agency that
provides services to prosecution teams around the world. With our amazing
members we ran 20-odd cases around the world from the Amazon to Atacama, for
the UN, for Amnesty, for Palestinian NGOs, in Gaza of course, West Bank, issues
of killings, individual killings in the West Bank that we do now, and much more
drastic destructions.
Forensic Architecture is unique in using
architectural research methodologies to analyze violations of human rights and
international humanitarian law as they bear upon the built environment—on
buildings, cities and territories, and this is why we get many commissions. We
produced architectural evidence for numerous investigations and presented them
in a number of cases in national and international courts and tribunals. We
were commissioned by the UN Special Rapporteur for Human Rights to study single
destroyed buildings, as well as patterns of destruction, resulting from
drone warfare in Pakistan, Yemen, Somalia and Gaza. This study was presented at
the UN General Assembly in New York. We developed techniques to locate the
remains of buildings and villages overgrown by thick rain forests and presented
this material as evidence in the genocide trial of former president Efraín Ríos
Montt in the National Court of Guatemala and the Inter-American
Court. We quantified and analyzed levels of architectural destruction in Gaza
after the 2014 conflict for Amnesty International. We provided architectural
models and animations to support a petition against the wall in Battir
submitted to the Israeli High Court, helping to win the case.
Recently, we use and deal with the
reconstruction of human testimony. Witnesses to war give account of the worst
moment of their lives; times when their dear ones have died or hurt. Their
memory is disturbed, and tends to be blurred. We have developed a way of very
carefully interviewing and discussing with witnesses. Together with them, we
build digital models of their own homes. So we can see a very slow process of reconstruction
of the relation between memory space and architecture. And events start coming
back, through the process of building.
In order to develop this, we needed
to explore the historical use of memory and architecture, such as Frances Yates'
The Art of Memory (read it here), as well as different accounts on
the use of trauma, and bring them into the digital age, bring an understanding
of the relation of testimony and evidence into contemporary thinking. Single
incidents tend to be argued away as aberrations of 'standard operating
procedures'. To bring charges against government and military leaderships, it
is necessary to demonstrate 'gross and systematic' violations.
This means finding consistent and repeated patterns of
violations. Architectural analysis, undertaken on the level of
the city is able to demonstrate repetition and transformations in patterns of
violation/destruction in space and time—within the battle zone along the
duration of the conflict. Architectural analysis is useful not only in dealing
with architectural evidence—i.e with destroyed buildings—but also helpful in
locating other bits of evidence—testimony films or photos—in relation to one
other bits of evidence, and cross referring these in space.
Urban violence unfolds at different
intensities, speeds and spatial scales: it is made of patterns of multiple
instantaneous events as well as slower incremental processes of 'environmental
violence' that affects the transformation of larger territories. We aims to analyze
and present the relation between forms of violence that occur at different
space and time scales. From eruptive kinetic violence of the instantaneous/human
incident through patterns of destruction mapped across and along the duration
of urban conflict, to what Rob Nixon calls the 'slow violence' of environmental
transformation (read the introduction of the eponymous book here,
pdf).
Last question. How does your approach to research relate to, or differ
from, approaches to international politics?
To study conflict as a reality that unfolds across
multiple scales, we use the microphysical approach—dealing with details,
fragments and ruins—as an entry-point from which we will unpack the larger
dynamics of a conflict. We reconstruct singular incidents, locate them in space
and time to look for and identify patterns, then study these patterns in
relation to long terms and wide-scale environmental transformations. This
approach seeks to make connections between, what Marc Bloch of the Annales
School called 'micro- and macro-history, between close-ups and extreme long
shots' in his thesis on historical method. This topological approach is
distinct from a traditional scalar one: the macro
(political/strategic/territorial) situation will not be seen a root cause for a
myriad set of local human right violations (incidents/tactics). In the complex
reality of conflict, singularities are equally the result of 'framing
conditions' and also contributing factors to phase transitions that might
affect, or 'de-frame' as Latour has put it, changes occurring in wider areas.
Instead of nesting smaller scales within larger ones, our analysis will seek to
fluidly shift from macro to micro, from political conditions to individual
cases, from buildings to environments and this along multiple threads,
connection and feedback loops.
While in relation to the single
incident it might still be possible to establish a direct, liner connection
between the two limit figures of the perpetrator and the victim along the model
of (international) criminal law, evidence for environmental violence is more
scattered and diffused. Instead, it requires the examination of what we call
'field causalities'—causal ecologies that are non-linear, diffused,
simultaneous, and that involve multiple agencies and feedback loops,
challenging the immediacy of 'evidence'.

Whereas linear causality entails a focus on sequences of causal events on the
model of criminal law that seeks to trace a direct line between the two limit
figures of victim and perpetrator field causality involves the spatial
arrangement of simultaneous sites, actions and causes. It is inherently relational
and thus a spatial concept. By treating space as the medium of relation between
separate elements of evidence brought together, we aim to expand the analytical

Let me illustrate this a bit. Forms
of violence are crucially convertible one to another. Drying fields along the
Sahel or the Great Syrian Desert, for example, reach a point in which they can
no longer support their farmers, contributing to impoverishment, migration to
cities, slumnization and waves of protest that might contribute to the eruption
of armed conflict. These layers call for a form of architectural analysis able
to shift and synthesize information at different scales—from single incidents
as they are registered in the immediate spatial setting, through patterns of
violations across the entire urban terrain to 'environmental violence'
articulated in the transformation of large territories.
Eyal Weizman is an architect, Professor of Visual Cultures and director
of the Centre for Research Architecture at Goldsmiths, University of London.
Since 2011 he also directs the European Research Council funded project, Forensic
Architecture - on the place of architecture in international
humanitarian law. Since 2007 he is a founding member of the architectural
collective DAAR in Beit
Sahour/Palestine. Weizman has been a professor of architecture at the Academy
of Fine Arts in Vienna and has also taught at the Bartlett (UCL) in London at
the Stadel School in Frankfurt and is a Professeur invité at the École des
hautes études en sciences sociales (EHESS) in Paris. He lectured, curated and
organised conferences in many institutions worldwide. His books include Mengele's

Summary of the Study Introduction Sudan is the third largest country on the African continent with a total area of 1,882,000 sq km. before the secession of South Sudan in 2011; Sudan was the largest country in Africa, covering I million square miles. Sudan is unique and complex in its climate, politics, environment, languages, cultures, religion and ethnicities. Demographically, Africans are the majority (52%), with Arab and Beja tribes constituting 38% and 6% of the population, respectively. Over 597 tribes live in Sudan that speak more than 400 dialects and practice different religions, live in Sudan. Muslims make up 70% of the total population of Sudan, followers of indigenous beliefs comprise 25% and Christians constitute 5% of the population. The complex mixture of the Sudanese social fabric renders it neither distinctly African nor Arab country. The Sudanese, however, have long disagreed about Sudan's identity. For some, Sudan should be Arab and Muslim. Other believe that the country should respect and accommodate all the cultures, religions and minorities within its territory. Most of Sudan constitutions stated that Islam and Arabic language should define the national identity. Politically, since the independence, Sudan has experienced a fluctuation between military rule and democratic rule. In fact, Sudan spent thirty years under the military rule, and only twelve years under democratically elected governments. The successive governments have frequently made use of emergency legislation to broaden the executive powers. These legislative measures have contributed to conflict and facilitated a range of human rights violations. In addition to the political instability, Sudan has the distinction in Africa in enduring a devastating civil war: that is: Sudan's north-south civil war. The conflict started just a year before the independence of Sudan, in 1956. The cumulative impact of that conflict has been massive. The conflict has caused horrendous loss of life in any interstate war, and has produced the largest internally displaced population (IDP) in the world. Sudan north-south conflict has long been perceived as ethnic or even religious conflict between the north and the south. Ethnicity has been used generously in the description of that conflict. Yet, a closer look at the history of the conflict reveals that the root-causes of that conflict are highly complex. But, this is by no means to say that conflict has had no ethnic, racial and religious overtones. The eruption of the north-south conflict was the result of a combination of factors. One could trace the root-causes of the conflict to the invasion of the south from the north by Turkiyya that expanded southwards, and the simultaneous development of slave trade. Thereafter, the British rule contributed in different ways to the crystallizing of the north-south dichotomy. After the independence of Sudan, successive governments, were unsuccessful in handling the growing southern problem, ranging from neglect to attempts to reverse the British isolation by enforced Arabisation and Islamization of the southern Sudan. The north-south conflict ended, in 1972, when Addis Ababa Agreement was signed by then President Nimeiry. But, the conflict broke out again, in 1983, when the Addis Ababa Agreement was abrogated by the then President Nimeiry. After a series of peace talks (which witnessed 'start and stop'), a Comprehensive Peace Agreement (CPA) was concluded, in 9 January 2005, between the Government of Sudan (GoS) and the Southern Sudan People's Liberation Movement (SPLM/SPLA) to end the conflict. The CPA provides for a temporary solution for the conflict through, inter alia, the distribution of the power between the north and the south of Sudan by establishing a decentralised system of government with a significant devolution of powers within which the Southern Sudan is to enjoy a regional autonomy and share half of the resources with north Sudan for a period of six years. Furthermore, the CPA creates joint institutions, such as, the Government of the National Unity (GoNU) in which the Southern Sudan participate and share ministerial posts. The CPA also provides for the establishment of a number of commissions for implementing and monitoring the CPA, for instance, the Evaluation and Monitoring Commission, the National Human Rights Commission, etc. At the end of the interim period, a referendum on the self-determination is to be held, in 2011, in which the people of the Southern Sudan will decide whether to remain within a united Sudan or to secede and form an independent State. The Aim of the Study The significance of this study derives from the conclusion of the CPA and the adoption of the Interim National Constitution (INC) that called for democratic transformation so as to bring an end to Sudan north-south conflict. While the CPA ended Sudan's north-south conflict, a lasting peace and a democratic transformation, in Sudan, may prove elusive unless the CPA provisions are translated into reality, especially the implementation of constitutional, legislative and institutional reforms, including human rights protection and respect for the rule of law. The study aims to answer whether the CPA and INC can fulfil their roles in securing peace and establishing a framework in which the constitutional protection of human rights are recognised and effectively implemented through the availability of the various mechanisms. In this respect, the CPA provided for the adoption of a new constitution (INC), with a view to embedding constitutionalism, rule of law promotion, and protection of human rights. It is, therefore, this study is meant to analyze the constitutional, legislative and institutional reforms of the CPA and INC with a view to examining whether such constitutional reforms may be conducive for a lasting peace, in Sudan, that is based on human rights protection, constitutionalism and the rule of law. The CPA stipulated the need for institutional and legislative changes to reduce the risk of recurrence of human rights violations. To this end, the CPA mandated the adoption of a bill of right (for the promotion and protection of human rights) and provided for re-restructuring of the courts system. Such institutional reforms are aimed at embedding constitutionalism. That is to say: establishing a system in which the constitution provides an agreed upon framework for the exercise of powers and the protection of human rights. In this respect, the study examines whether the outcome of the constitutional reforms process (to recognise, implement, and protect human rights as provided for in the INC) have been reflected in institutional and legislative reforms to protect and prevent human rights violations and address past violations and systemic factors that have contributed to violations. To that end, the human right jurisprudence of the constitutional court will be examined. The Organization of the Study a) The Structure of the Political/Governance System in Sudan under the INC With the devolution of the powers and resources to the Southern Sudan level and other States, the governance system, under the INC, is structured with four levels of government: the national level at the apex, the Government of South Sudan level, the State level (25 States), the local level. Now, the government responsibilities are decentralized and the national government allocates a significant proportion of revenues to the States. It is, therefore, that the first question that this study poses is: What is the impact of the current governance in giving greater equity of representation and decision-making influence to communities across Sudan, thereby facilitating conflict management to achieve a lasting peace in Sudan? In Sudan, previously appropriate design of institutions to ensure political accommodations for all social groups has not been established in a way that would give them the chance to function properly. Now, the INC restructures the prevailing governance system by establishing a decentralized system of government that bears the characteristics of asymmetrical/symmetrical federalism - asymmetrical in the structure and responsibilities of subunits, with the level of South Sudan having more powers and resources than other States across Sudan. Establishment of a federal structure may constitute a mechanism for preventing a relapse into conflict through the devolution of the powers to the State level. For a federal to work effectively, it requires a functional court system to decide on the jurisdictional limits of the different levels of government. Nevertheless, the relevance of the court system in resolving the intractably political contentions in federal countries, especially in transition situations, is uncertain. Noticeably missing from the literature is the study and analysis of the impact of the role of court system in post conflict countries. That said, the role of the court system in preserving democracy has grown in importance with the increase recognition of the judicial review of the constitutionality of the acts of the government organs and the recognition and the protection of human rights provisions. It is, therefore, that the involvement of the courts is necessary to ensure the successful operation of the federalism and thus the failure or the success of federalism is contingent on the implementation of the federal system by the courts. According to some scholars, 'federalism means legalism – the predominance of the judiciary in the constitution- the prevalence of a spirit of legality among the people'. As '[the] courts …are actually telling a government how far it can go with its assigned constitutional rights'. This leads to the second question that this study addresses which relates to the analysis of the constitutional reform as provided for in the INC, in general, but with a special focus on the role of the court system, through the application of judicial review and protection of human rights, to resolve not only disputes in litigations between private parties, but also to prevent the arbitrary exercise of the government power. b) The Structure of the Legal System (Court System) in Sudan under the INC The available literature presents different views as to the role of the court system in new democracies. On one hand, one view assumes that the courts have a fairly wide discretion to decide the outcome of the controversial cases to the needs of the political moment. The other view, on the other hand, takes the position that political actors do not exert any kind of influence at all on the way judges make their decisions. A third source, and with which I agree, argues that legal rules do put constrains over the exercise of the judicial discretion in controversial cases. A fourth view argues that in new fragile democracies constitutional courts/supreme courts should not be involved in judicial review, especially on adjudicating issues related to social and economic rights, which may profoundly affect the allocations of resources and violate the doctrine of separation of powers. In this respect, the study considers whether the court system, as restructured in the INC, and other constitutional guarantees introduced to the legal system as a whole, offer good prospects for constitutionalism that may control the power of the government so as not act arbitrarily. The role of court system in resolving disputes is highly contingent on the substantive law and the institutional structure within which the courts apply laws. Thus, this study examines to what extent the current structure of the legal system under the INC and the protection of human rights through the application of the Bill of Rights by the courts may signal the State's commitment to constitutionalism and respect to the rule of law. It is, therefore, that the role of the court system (in contributing to democratic transformation in Sudan) should be evaluated against the legal framework: that is the INC, with a focus on the independence of the judiciary, the application of the Bill of Rights and the rules governing the judicial review. c) The Legislative and Institutional Reforms under the INC The functions of the courts, in developing countries, have experienced increasingly transformative role as institutions that can hold the government organs accountable. The study aims to examine the practice of constitutionalism: that is, the implementation of the INC constitutional, institutional and legislative reforms, especially the compliance with the provisions of the INC and the CPA, in particular the role of the constitutional court as "a positive legislator". In this regard, the Sudanese Constitutional Court may play an important role in the law reform process given its power to annul laws found unconstitutional. This entails the non-applicability of such laws and, as a result, would compel the government institution/organ concerned to adopt new legislation that is in conformity with the INC. Thus far, the Sudanese constitutional court, under the INC, has received a number of human rights cases that involved issues related to violations of human rights or related to the constitutionality of key legislation, such as counter-terrorism laws, immunities for officials and statutes of limitation for torture. So what role the constitutional court has played in the law reform process under the INC? For the court system to play a role in the democratic reform, a comprehensive law reform process is seen as a prerequisite to bring the existing laws in line with the provisions of the INC and enacting new laws. Therefore, this study identifies what legislative and institutional reforms that have been undertaken by the parties to the CPA during the interim period to address human rights violations, root-causes of the conflict; inequality; marginalization, rule of law vacuum and weak democratic structures. Furthermore, this study offers empirical evidence for the judicial behavior of the Sudanese constitutional court through a systematic examination of selected human rights jurisprudence of the constitutional court to gauge its role in the law reform process in Sudan since the adoption of the INC. Overview of the Study and the Main Findings of the Study Introductory Chapter: Overview of the Study The Introductory Chapter provides an overview of the study, including, the key features of the State of Sudan, the aim of the study, the main objectives of the study, and a general overview of the study. Chapter One: A Historical Background of Sudan's North-South Conflict Chapter One gives a rich and deep account of Sudan north-south conflict. It looks at the root-causes of the conflict by elaborating on different factors that directly and indirectly contributed in making that conflict protracted. Chapter one moves on to consider the end of the first Sudan's north-south conflict which was ended when Addis Ababa Agreement was signed in 1972. Chapter one further elaborates on Sudan's second north-south conflict which broke out in 1983. Finally, Chapter one touches on the various peace initiatives that ended by the conclusion of the CPA. Chapter One concludes by analysing the CPA. In the final analysis, the CPA made significant changes the prevailing governance and legal systems in Sudan by establishing a federal system, introduced a dual legal system a bill of rights, provided for the right to self-determination for the south Sudan, established institutions for the protection of human rights by establishing mechanisms such as National Human rights Commission, and distributed the wealth equally between the north and the south. However, the CPA failed to include the Sudanese people in the talks leading to the conclusion of the CPA, as the CPA was bilateral reflecting the views of the north and the south. Chapter Two: The Structure of the Governance System under the INC The INC describes Sudan as a decentralized State with different levels of government: the national level, the Southern Sudan level, the State level and the local level. It further grants the Southern Sudan autonomy status. A careful analysis of the current governance arrangements reveals that the INC provides for asymmetric/symmetrical federalism system of governance. Chapter Two discusses the allocation of legislative powers between the national government, the Southern Sudan and the rest of the country and the nature of the constitutional design of the INC to manage diversity of Sudan (ethnic, linguistic, religious and cultural diversity). At the outset of Chapter Three provides an overview the fundamental principles of federalism and provides a brief historical background of federalism in Sudan and how federalism arrangements can play a role as a tool for peace-building. In the final analysis, in contract with old constitutions of Sudan, the INC establishes a federal system, with four levels of government; national, south Sudan, State and local levels. The INC federal system guarantees the special characteristics of all ethnic and religious groups in Sudan through the creation of the Council of the States. However, all the States in Sudan are not treated equally, because (1) two States have special status (South Kordofan and Blue Nile States), and (2) between the ten States in the South and the national level, the Government of South Sudan (GoSS) is inserted to exercise authority in respect of the ten States at South Sudan level. This means the INC creates asymmetrical/symmetrical federalism, as the South Sudan level enjoys significant autonomy and exclusive authority over ten States in South Sudan. All the States in Sudan are not treated equally, because (1) two States have special status (South Kordofan and Blue Nile States), and (2) between the ten States in the South and the national level, the Government of South Sudan (GoSS) is inserted to exercise authority in respect of the ten States at South Sudan level. This means the INC creates asymmetrical/symmetrical federalism, as the South Sudan level enjoys significant autonomy and exclusive authority over ten States in South Sudan. The INC Schedules (A – C) distribute the exclusive and legislative powers to the national level (A), the GoSS level (B), and the state level (C). Schedule (D) lists the concurrent powers and Schedule (E) allocates the residual powers as per its nature. Schedule (F) is a provision to resolve conflict that might arise under Schedule (D). It should be noted that not all issues listed in the INC schedules are allocated to one level of government only. For example, several substantive issues are granted to the national level as an exclusive competence, to the South Sudan level as an exclusive competence and at the same time to all levels of government as a concurrent power, such as telecommunication. With regard to the legislative powers allocated to the tens states at the South level, the GoSS according to Schedule (B) has the competence to enact a kind of framework with regard to issues that fall under the exclusive South Sudan State competence, thereby limiting the legislative powers of the ten States in South Sudan. Finally, the INC has reinforced existing power relations and failed to provide structural changes for democratic transformation, as the INC asymmetrical federalism accommodates the demands of the South Sudan only. As the INC does not accommodate the demands of the different ethnic and cultural groups in the different regions of Sudan as demonstrated in Darfur Peace Agreement and East Sudan Agreement. Chapter Three: The Structure of the Legal System under the INC The INC altered the Sudanese legal system with a view to accommodating the competing views: Sharia law and secularism. For a proper understanding of the present Sudanese legal system and an assessment of the role of the court system in contributing to democratic governance, a glance at the Sudanese legal history is necessary. Firstly, Chapter Three reviews the constitutional developments in Sudan since the independence to the present day. Secondly, Chapter Three provides overview of the structure of the court system in a decentralized system and focuses on the contribution of the court system to democratic transformation through limiting the acts of the government. Chapter Three further discusses issues that may impact of the role of the court system in contributing to democratic transformation. Yet, the role of the court system in promoting democratic transformation is contingent on the constitution, the substantive law, etc. For instance, instituting the principles of constitutionalism is contingent on the independence of the judiciary, as an independent judiciary is required for the protection of constitutional rights and to restrain the actions of the government. Thus, it is important to understand under what conditions the court system develops such accountability functions: that is, what conditions favor the ability of the court system to exercise an effective accountability functions. It is, therefore, Chapter Three examines (a) how the INC re-structures the court system in the north and the south of Sudan so as to give effect to the principles of the federalism and legal pluralism; (b) the rules regulating the judicial review, and (c) the protection of human rights through the implementation of the bill of rights by the court, all of which signal the commitment of the State to establish democratic governance. Finally, Chapter Three attempts to evaluate the independence of the judiciary and the rules that govern the judicial review before and after the adoption of the INC with a view to assessing the fidelity of the government to the principles of constitutionalism, and whether the limitations observed in the actual conduct of the government. In the final analysis, the INC constitution making process was bilateral reflecting the views of the parties to the CPA and lacked inclusiveness, but provides for a pluralism legal system by providing for a constitution for south Sudan and 25 State constitutions. The INC introduces State judiciary and South Sudan judiciary and opted for an integrated the court system. That is: the State courts apply the State laws, the national laws and the South Sudan laws. In the North, the State courts are still organized by the national level, although the NC provides for the establishment of the State judiciary. At the South Sudan level, all State courts are organized and financed at the level. Towards the South Sudan, the National Supreme Court is the final court of on matters arising under national laws The INC emphasizes the importance of protecting; respecting and promoting human rights through the inclusion a bill of right and incorporation via Art. 27(3) of the INC all human rights treaties that Sudan has ratified, thereby the human rights contained in the INC directly applicable before the Sudanese courts. Also, the implementation of some human rights requires revision of the existing statutory laws. To date there has been limited legislative reforms to address human rights violations. A few laws have been reformed but fall short of Sudan international obligations, such as Criminal Act, Security Laws, Immunity Laws, etc. The INC differentiates between the north and the south regarding the sources of legislation. Art. 5 of the INC lists Sharia as one of the sources of legislation along with the consensus of the people at the national level. Art. 5(2) of the INC names popular consensus and the values and the customs of the people of Sudan as the sources of legislation in South Sudan. The INC contains special rules for national legislation if its source is religion or custom. In that case, a state where the majority of residents do not practice such religion or customs may introduce different legislation allows practices or establishes institutions in that State that are consistent with its own religion or customs. The INC establishes human rights commission for the implementation of the bill of rights as well as a commission for the protection of non-Muslims in the Capital. The INC has chosen a concentrated system of judicial review and a hybrid system of judicial review with respect to the South Sudan as the Supreme Court of South Sudan acts as a constitutional court and a high court of Appeal with respect to South Sudan. The newly enacted Judicial and Administrative of 2005 does not provide for concrete judicial review of law and bars the court from question the constitutionality of law by way of making referral to the constitutional court, thereby renders the judiciary unable to deal with crucial constitutional issues. Chapter Four: Institutional and Legislative Reform: Practice of Constitutionalism In order to understand whether the adoption of the INC has brought any changes may enhance the role of the court system in contributing to democratic transformation; Chapter Four scrutinizes the compliance of the statutory law with the provisions of the INC, the law reform process in Sudan and the implementation of law in practice. Chapter Four further presents an analysis of more pertinent provisions of civil and political rights in the light of the laws and practices prevailing in the country to assess the extent to which the principles laid down in the INC are complied with. It further assesses the involvement of the Sudan constitutional court in the law reform process by reviewing a selected human rights jurisprudence of the constitutional court. Finally, Chapter Four makes a reference to the jurisprudence of other constitutional courts (the German constitutional court, the Indian Supreme Court and the South African constitutional court) by way of comparison. In the final analysis, a) the INC does not set out procedure for concrete review and access to the court is not free; b) The court has a broad power to consider and adjudge and annual any law in contravention with the constitution and restitute the right to the aggrieved person and compensate for the harm. The court may also order interim measures to avoid any harm. As such, the court can abolish laws and compel the government to enact new law; c) the constitutional court has reviewed a number of cases that alleged the violation of human rights. The court has demonstrated reluctance to declare legislation unconstitutional. Interpretation of the bill of rights and reference to international human rights lacked consistency and the court has taken deference to the executive; d) the constitutional, legislative and institutional changes did not acknowledge past human rights violations through mechanisms that would question the way of governance and persisting inequalities and injustices; e) the constitutional court has institutional weaknesses and its jurisprudence has largely upheld existing laws such as immunities laws and the constitutional court made limited reference to international human rights law; f) the constitutional, legal and institutional reforms failed to generate the sense of constitutionalism and the fundamental change that were to remove the causes for human rights violations and provide effective remedies. A number of laws contravening the human rights are still in force, such as, Public Order Act, Immunity of police, security and army officers, inadequate laws for the protection of women's rights; and finally, the implementation of CPA as a means of democratic transformation left an unreformed government virtually intact Chapter Five: Post- Referendum Sudan Chapter Five looks at the constitutional developments after the secession of South Sudan, with a focus on constitution making process in Sudan. The Southern Sudan Referendum for self-determination, held in July 2011, clearly indicated that the absolute majority of those who participated in the referendum for the Southern Sudan favour separation of the Southern Sudan from Sudan. The secession of the South Sudan on July 9, 2011, as a result of the referendum on self-determination provided by the CPA has created a new reality in Sudan with far reaching economic, political and social implications. Economic and financial losses related to the secession are substantial and have affected all sectors of the economy. Sudan has lost three-quarters of its largest source of foreign exchange (oil), half of its fiscal revenues and about two-thirds of its international payment capacity. In general, the secession of South Sudan resulted in a 36.5% structural decrease in overall government revenues. The unresolved issue of Abyei constitutes a trigger for potential violent tension in the future between Sudan and South Susan. Abyei status is yet to be decided, as both Sudan and South Sudan claiming it as part of its territory. Its final status will be decided by a Referendum for which implementation mechanisms have not yet been agreed upon by the two countries. The end of the CPA necessitated a constitutional review process to decide on the new constitution to replace the INC. However, for a constitution to be able to win the affections of the citizens of the State, it will be necessary to involve those citizens in the constitution-making process that establishes such a constitution, so as to ensure that the process is inclusive and reflects the aspirations of the Sudanese people at large. It is, therefore, important to increase public involvement in the constitution-making process by inviting public participation. In order for the design of a constitution and its constitution-making process to play an important role in the governance system, the design of the constitution has to be responsive to the aspirations of the ordinary people. A constitutional review process is currently under way but has not resulted in any clear proposals. That said, since 2011, a constitutional review has been underway in Sudan. The constitutional review process has not been participatory or inclusive. Lively debates on the new constitution in general, and the Bill of Rights and human rights protection in particular, have nevertheless ensued. These debates have been driven by a keen awareness of the importance of constitutional rights. These debates reflect both traditional concerns over the protection of civil and political rights, particularly in the administration of justice, and other issues that have also become a cause of acute concern. These include the desire for the realization of economic, social and cultural rights, and the rights of members of groups who suffer discrimination, particular women, religious and ethnic minorities and persons with disabilities. Currently, public debate over the new constitution is proceeding, although the Government has not yet announced a timeframe for the constitution making process, amid a polarization of views on diverse issues such as the decentralization of power and wealth sharing between the different regions of Sudan. Since 2011, the Government of Sudan, in collaboration with the UNDP and other UN agencies, initiated the forum on public participation in constitution making to facilitate open and public dialogue. This approach has been based on the need to pursue the constitutional process/review inclusively, transparently and participatory to ensure all sectors of society including civil society organizations and opposition political groups participate fully in the process.
BASE
