Das Datenschutzrecht beruht nach weit verbreiteter Auffassung auf der Idee der informationellen Selbstbestimmung. Nach der Rechtsprechung des Bundesgerichts handelt es sich dabei gar um ein Grundrecht. Es versteht darunter das Recht der betroffenen Person, grundsätzlich selbst zu bestimmen, ob und zu welchen Zwecken Daten über sie bearbeitet werden dürfen. Diesem Verständnis hat sich der Bundesrat in der Botschaft zum neuen DSG angeschlossen. Die Idee der informationellen Selbstbestimmung leuchtet zwar intuitiv ein, hält einer näheren Betrachtung aber nicht stand. Eine Analyse des DSG zeigt, dass die Idee für die Bearbeitung von Personendaten durch Bundesorgane im DSG überhaupt nicht und für diejenige durch Private nur punktuell umgesetzt worden ist. Tatsächlich lässt sich eine "informationelle Selbstbestimmung" weder sinnvoll rechtlich umsetzen noch überzeugend normativ begründen. Die Idee sollte deshalb aufgegeben und das DSG auf eine tragfähige konzeptionelle Grundlage gestellt werden.
