; The planning of General Chacel Street in the Reina Victoria quarter of Melilla, gives good evidence of the difficulties involved in the planning of any kind of urban expansion, following the Law of Polemical Areas then in force. The space of three hundred metres which was prescribed as a defence zone as a consequence of this Law, meant that this essential road, obviously belonging to the centre of the town, was the last to be developed. An analysis of the building on the available plots brings out, the complex web of legal precepts, building conditions, experts and leading national promotors involved in the growth of Melilla.

In: Economic Analysis of Law in European Legal Scholarship 1
This anthology illustrates how law and economics is developing in Europe and what opportunities and problems - both in general and specific legal fields - are associated with this approach within the legal traditions of European countries. The first part illuminates the differences in the development and reception of the economic analysis of law in the American Common Law system and in the continental European Civil Law system. The second part focuses on the different ways of thinking of lawyers and economists, which clash in economic analysis of law. The third part is devoted to legal transplants, which often accompany the reception of law and economics from the United States. Finally, the fourth part focuses on the role economic analysis plays in the law of the European Union. This anthology with its 14 essays from young European legal scholars is an important milestone in establishing a European law and economics culture and tradition

This volume seeks to revive the field of law and logic, by providing an up-to-date and accessible survey of several relevant issues. Each author is an expert in his or her field, and each chapter offers an analysis of current issues, challenges, problems, limitations and/or developments. -- The general contribution of this book to existing scholarship is threefold. First, it seeks to consolidate current and cutting-edge scholarship by bringing together various approaches and different theories of law and logic in one volume. Secondly, the content is presented in a way that is both stimulating for current debates in the field, and at the same time, accessible to a wider audience (particularly to readers without prior knowledge of formal logic). Finally, this book aims at highlighting the practical applicability, utility and relevance of logic for the study of law, and its application (including legal argumentation).
= The issues associated with the extension of economic integration within the EurAsEC and the planned advance to its next level in 2015 — creation of the Eurasian Economic Union — can be resolved only by forming a qualitatively common legal space on the territory of the Member States, followed by endowing some of the institutions of the Community with the supranational functions. As a result the entire mechanism of decision making and execution within the Community will change; independent law of the EurAsEC will form. The article defines the range of sources of the EurAsEC forming law, methods for their implementation in the Member States, identifies the existing collisions, and gaps in the national implementation mechanisms of these sources into the legislation of the EurAsEC member states. Thus, the legal force of an international treaty as a source of law is significantly different in these countries. The mechanism of implementation of the decisions of the Community bodies into the legislation of the Member States is not defined. As a result, it is concluded that for proper implementation of the Community acts the common rules of the organization for its fulfillment at the national level should be established.

The aim of this study is to investigate popularization strategies in a corpus of Summaries of EU legislation on environmental issues. In particular, the analysis will be divided into two steps. The first step will include the investigation of commitment by the EU towards these issues by means of an analysis of the contextual features of the word 'environment' in the corpus under scrutiny. The second step, instead, will be aimed at comparing the summaries with their source legal texts in order to focus on the strategies employed to 'reformulate' legal concepts for popularising purposes. ; The aim of this study is to investigate popularization strategies in a corpus of Summaries of EU legislation on environmental issues. This paper examines the areas of patent law and copyright law in the context of Britain's exit from the European Union, or "Brexit." Although neither area of intellectual property (IP) is fully harmonized, the United Kingdom's exit from the European Union could nonetheless have a sizable impact on both sets of rights. For patents, Brexit could lead the United Kingdom to diverge from EU principles on biotechnology and supplementary protection certificates, and also puts the United Kingdom's role in the new Unified Patent Court (UPC) system into doubt. In the area of copyright, the United Kingdom could use Brexit as an opportunity to move away from EU standards, including the key definitions of originality and parody. Ultimately, however, this paper argues that the slogan "take back control" is unlikely to lead to dramatic changes in the IP field. Both the European Union and the United Kingdom will likely seek to retain a great deal of regulatory convergence and cooperation over IP.
