It is perhaps of the nature of wars that they should hasten developments endemic in a society and bring to pass in a few short years what would also have happened under conditions of peace, but in a much longer span of time. This at least has been in some measure the effect of the recent war on Great Britain's position in the world. It is now apparent and generally recognized that the situation of privilege if not domination which was the lot of the English people from the time before the Seven Years War—or from the middle of the eighteenth century onwards—has come to an end. Perhaps this change in England's position has been recognized for some while in the United States. On the other hand Americans have perhaps never realized the striking contrast in the past between the standard of living and the stability and security of this island and that of the larger continental countries and centers of force—France and Germany.

Fast so alt wie die Bundesrepublik ist die fortdauernde Debatte um die Frage, wem in der rechtsstaatlich verfassten Demokratie des Grundgesetzes die Verwaltung der Gerichte zustehen sollte. Angesichts eines zunehmenden Ökonomisierungsdrucks an den Gerichten stellt sich heute mehr denn je die Frage, ob es sich empfiehlt, an der traditionellen Dominanz der Exekutive in der Gerichtsverwaltung festzuhalten. Zur Beantwortung dieser Frage blickt die vorliegende Arbeit nach England und illustriert die dortigen Entwicklungen auf dem Gebiet der Gerichtsverwaltung. Die englische Gerichtsverwaltung wurde ab dem Jahr 2005 umfassend reformiert, wobei die Einflussmöglichkeiten der Richterschaft erheblich erweitert wurden. Vor dem Hintergrund dieser Reform untersucht die Arbeit, inwieweit die englische Gerichtsverwaltung als Vorbild für die deutsche dienen kann. / »Court Administration in Germany and England« -- In light of the increasing economization of the German judicial system the question arises as to whether the traditionally dominant role of the executive in the German court administration should be retained. To answer this question this thesis takes a look at the English court administration and analyses whether parts of the English court administration can serve as an example for the German court administration.
