"Over the last few decades, interest in white-collar crime has tended to take a back seat to ""street"" offenses in terms of theory and research. In response, and reflecting the rising general interest in business and middle/ upper class lawbreaking, The Criminology of White-Collar Crime brings the study of white-collar offending back into the criminology mainstream, analyzing why members of higher social strata resort to criminal activity and offering psychosocial, life course, methodological, and prevention perspectives. Leading scholars expand on the pioneering work of Edwin Sutherland, delving into the variables, situations, and cultural contexts that differentiate white-collar crime from more traditional criminal areas as well as into those that coincide with them. This book asks not only how the study of white-collar crime can enrich our understanding of crime and justice more generally, but also how criminological advances over the last few decades can enhance our understanding of white-collar criminality. To that end, the volume brings together a distinguished group of criminologists, drawn from leaders in the study of white-collar crime as well as important scholars that have advanced criminology more generally and that turn their attention to the problem of white-collar crime for this book."

Science du droit, science sociale et le problème des valeurs en conflit Il s'agit, dans cet article, d'un point particulier où les sciences juridiques et sociales se rencontrent. Les disciplines sont toutes deux concernées par les conflits entre valeurs morales. Il y a plusieurs manières dont ce conflit est saisi. L'une s'inspire d'une orientation qui prend comme point de départ la perspective du participant au sein d'un système social ou juridique, adoptant le point de vue interne ; tandis que l'autre évite cette démarche comme étant trop étroite, ne fournissant pas les outils pour comprendre les conflits fondamentaux entre valeurs dans un même système. Si nous observons la structure des différents conflits entre valeurs — champ d'investigation du présent article —, nous pouvons apprécier, selon l'auteur, les mérites de cette deuxième approche. Une science sociale pluraliste peut ainsi informer une science juridique pluraliste, mais c'est un pluralisme de forme unique qui se dessine.

It is held that sci & technology themselves have become problematic. Sci'ts can either continue to insist on a narrow professional division of work & escape their responsibilities by pretending that sci'fic objectivity has nothing to do with commitment, or change their fundamental assumptions about the nature of their task & replace previously dominant ideas of positive sci with the conception of a critical sci & its methodology. In the latter case, their traditional detachment & aloofness must give way to a very serious concern about all misuses of sci'fic findings for non-humane purposes. Past trends aimed at eliminating from sci all value judgments & reduced soc inquiry to the description & explication of factual situations. The dominant philosophies in the 1930's & 1940's construed all value statements as mere expressions of emotion without any cognitive meaning. But the very concept of value-free sci'fic inquiry is misleading. Certain values & norms are always present in any soc res. Cognitive & non-cognitive values are invariably implicit in the theoretical & methodological presuppositions of soc sci'ts, no matter how neutral they pretend to be. Functionalists assume that society is a stable system with well integrated parts, definite functions, & the goal of conserving that system. Certain ethical values are implicit in the very concepts of objectivity & rationality on which the sci'fic method is based. An objective & rational sci can serve inhumane purposes. But recently a new internat'l solidarity of intellectuals has begun to emerge & a critical consciousness is developing which tends to transcend the limitations of nation, race, class, or religion & assume a humanist position. An active commitment against the abuse of knowledge is seen as part of such a humanist orientation. M. Maxfield.
