The literary reception of Brecht's theatre in Greece took place in several stages in correlation with the often difficult political situation of the country. Brecht's theatre stood and still stands today in an area of tension between art and politics. Especially the conservative theatre people leaning towards tradition criticize his stance and the political implications of his plays while at the same time they try to redeem the latter as works of art. This ambivalent relationship is reflected in stage productions, in which the Aristotelian tradition is played off against the Brechtian intention to set in motion a train of independent thought on the part of the audience.
In den Jahren 2005−2006 bemühte sich Israel (zum ersten Mal) ernsthaft um eine Verfassung. Sie war als Erweiterung der beiden Grundgesetze, die in den 1990er Jahren verabschiedet worden waren, gedacht: "Grundgesetz: Freiheit der Berufswahl" und "Grundgesetz: Menschenwürde und Freiheit". Darüber hinaus sollte sie das politische Chaos eindämmen, das entstanden war, als dem Gesetzgeber die Konsequenzen dieser beiden Grundgesetze klar wurden. Seitdem erlebt der Staat Israel einen kulturellen Verfassungskrieg. Dabei bemüht sich der Oberste Gerichtshof, eine klassisch liberale Haltung gegenüber anhaltenden Attacken gegen das Völkerrecht und die Menschenrechte zu vertreten. Beide Seiten - diejenigen, die eine liberale Verfassung befürworten, und diejenigen, die dagegen sind - begründen ihre Haltung mit dem Argument des "Staats im Ausnahmezustand", nach welchem sich der Staat Israel gegen wiederkehrende Angriffswellen an seinen Grenzen von außen oder gegen subversive Elemente von innen verteidigen muss. Wie ich im folgenden zeigen werde, hat die Grundordnung, die wir Verfassung nennen, eine retroaktive Struktur und ist infolgedessen paradox, da sie versucht, die Überreste einer Demokratie zu verteidigen, die sich seit ihrer Entstehung in einem permanenten Ausnahmezustand befindet. In dieser Sichtweise fußt das Denken sowohl der Befürworter einer Verfassung als auch ihrer Gegner auf einer zentristischen und defensiven Logik oder, Hans Kelsens Rechtstheorie zufolge, auf einer rückwirkenden, konsensorientierten und normativen Rechtsstruktur, nicht aber auf einer progressiven oder revolutionären Struktur, wie Hannah Arendt und eine Reihe zeitgenössischer Verfassungstheoretiker sie erörtert haben.
Abstract How the wise Accursius was taken for a fool: the story of a misunderstood jest. Against the backdrop of the alleged 'legal transfer' from the Greeks to the Romans during the process of drafting the XII Tables, at which Pomponius hints in D. 1,2,2,4, Accursius reports (Gl. constitui) the well-known dialogue in gestures between a wise Greek and a Roman fool. In this story he also seems to make a paradoxical reference to the dogma of Trinity. This passage has been subjected during the centuries to three different approaches: 1) it is a fabula, which Accursius believes to be historia, revealing his total ignorance of ancient history; 2) it is historia not only in Accursius' opinion, but also for some later scholars, who follow his authority on the matter; 3) Accursius knows it is a fabula, a iocus, a nuga, and he wittingly tells it as such. An accurate analysis of the gloss shows that the third interpretation is the soundest: Accursius was acquainted with the ancient tradition about the embassy to Athens and considered it to be no more than a fabula. He tells this 'dialogue of mutes' with the purpose of stressing the pre-eminence of Roman law over Greek law.
