El interés del menor en el ejercicio de la patria potestad. El derecho del menor a ser oído
El objetivo de este trabajo es analizar el ejercicio de la patria potestad cuando existe convivencia de los padres y especialmente cuando no, desde la óptica del interés del menor. La metodología utilizada ha consistido en analizar las principales opiniones doctrinales sobre la cuestión y realizar aportaciones a las mismas. Se ha estudiado la última Jurisprudencia dictada sobre cada una de las materias tratadas, principalmente por el Tribunal Supremo. Para la consecución del mismo lo he dividido en cuatro capítulos. El primero, revisa el concepto de la capacidad de obrar y el del interés del menor. Partiendo que el interés del menor es un concepto jurídico indeterminado y que por tanto se utiliza de forma discrecional para justificar cualquier actuación que tenga como sujeto activo o pasivo al menor, he intentado concretar lo que debe entenderse como tal. En este capítulo desarrollo el sentido que desde mi perspectiva debe tener el interés del menor en clara conexión con el desarrollo evolutivo del mismo. Para concluir que solamente podemos considerar de forma lo más objetiva posible que se esta actuando en interés del menor cuando la acción no perjudique en modo alguno su desarrollo. En el segundo capítulo analizo el ejercicio de la patria potestad en las dos situaciones, tanto cuando existe convivencia de los padres como cuando ésta ha desaparecido. El ejercicio de la patria potestad en situaciones de convivencia no suele revestir problemas, no obstante si aparecen desacuerdos entre los padres, éstos se resolverán de forma consensuada sin necesidad de tener que acudir al Juez. Por el contrario cuando no existe la convivencia de los padres, el ejercicio de la patria potestad se puede convertir en un problema que afectará negativamente a los hijos. Aparece entonces que el ejercicio de determinadas funciones de la patria potestad se transforma para adaptarse a la nueva situación, creando figuras jurídicas nuevas, tales como el derecho de visita, la pensión por alimentos o los problemas del uso de la vivienda familiar. El interés del menor en estas situaciones se verá afectado de forma negativa por la actuación de los padres. Como consecuencia del ejercicio de la patria potestad en situaciones de no convivencia, han surgido dos modelos de guarda y custodia, la denominada exclusiva o la compartida o alterna. Estos modelos los he analizado en el capítulo tercero desde la óptica del interés del menor, de forma lo más objetiva posible. El modelo generalmente adoptado ha sido y és el de la custodia exclusiva. No obstante, existe en la actualidad un incremento creciente de los partidarios de la custodia compartida entre la doctrina y la Jurisprudencia, lo que se traduce en la adopción de este modelo. Ambos modelos son justificados en base a que según sus partidarios son beneficiosos para el menor en función de su interés. He concluido después de analizar los dos, que ninguno de ellos, debe ser considerado en abstracto como beneficioso o perjudicial para el menor desde la perspectiva de su interés. Porque para la correcta determinación de éste con respecto a los modelos de guarda y custodia habrá de hacerse de forma individual y concreta. No es correcto la generalización en abstracto, porque un modelo puede ser beneficioso para un menor y el mismo ser perjudicial para otro. De todas formas el modelo de custodia compartida no debe de ser impuesto de forma obligatoria a los padres cuando ninguno de ellos es partidario de la adopción del mismo. El último capítulo lo he dedicado a analizar el derecho del menor a ser oído. Este derecho se configura como la expresión más significativa de su interés. En los últimos años se ha limitado este derecho por la Jurisprudencia y por el legislador sin que exista una razón lógica para este cambio. Con respecto a la forma actual del desarrollo de la audiencia en el ámbito judicial, he aportado algunas consideraciones con respecto a la forma en la cual se realiza para garantizar su eficacia. Este trabajo tiene bastantes conclusiones, aunque la principal es que el interés del menor debe determinarse en función del beneficio que se produzca para su desarrollo evolutivo. Asimismo y en relación a los distintos modelos de guarda y custodia, ninguno de ellos puede ser considerado en abstracto como beneficioso para el menor, sino que habrá que analizar cada caso concreto. Por último el derecho del menor a ser oído reflejado en la audiencia, debe regularse para evitar la discrecionalidad y fomentarse en todos los ámbitos donde el menor se desarrolle, sin que deba ser confundida su opinión con su interés. DOCTORAL THESIS ABSTRACT The aim of the present work is to analyse the exercise of the parental authority when parental cohabitation exists and especially when not, from the point of view of the interest of the child. The methodology applied consists in analysing the main doctrinal opinions about the issue itself and making some contributions to them. The last Jurisprudence regarding all the topics I deal with and issued mainly by the Supreme Court has been studied. To such achievement I have divided my work into four chapters. The first one reviews the concept of the capacity to act and the interest of the child. Owing to the fact that the interest of the child is a vague legal concept and therefore is used in a discretionary way to justify any action having the child as an active or passive subject, I tried to specify what should be understood as such. This chapter develops the sense that, from my point of view, should have the interest of the child in clear connection with the evolutionary development of the child itself. To conclude that we just can consider that we are acting in the interest of the child when the action is not detrimental in any way to its development. In the second chapter I analyse the exercise of the parental authority in two situations, both when there is parental cohabitation and when it has ceased to exist. The exercise of the parental authority in cases of cohabitation does not usually cause problems, however, if disagreements between parents take place, these will be solved by consensus without having to go to court. On the contrary, when there is no parental cohabitation the exercise of the parental authority may become a problem that will negatively affect the children. Therefore the exercise of certain functions of the parental authority are transformed to adjust to the new situation, creating new legal figures such us visiting rights, alimony, and problems related to the use of the family home. The interest of the child in these situations will be affected by the parents' action. As a result of the exercise of the parental authority in non-cohabitation situations, two models of legal guardianship have emerged; one named sole custody and the other one called joint or shared custody. These models have been analysed in the third chapter from the point of view of the interest of the child, as objectively as possible. The most generally adopted model has been and is the sole custody. Nevertheless, there is nowadays a growing increase of those in favour of the shared custody between doctrine and Jurisprudence, resulting in the adoption of this model. Both models are justified on the basis of that according to its supporters, they are beneficial for the child. I have concluded after having analysed both that none of them should be considered in abstract terms as beneficial or detrimental for the child from the perspective of his interest. To accurately determinate this, it should be done in an individual and specific way. No generalisation in abstract terms is correct because one model can be beneficial for a child and at the same time be detrimental for another different child. In any event the joint custody model should not be compulsory imposed when none of the parents are in favour of adopting it. The last chapter is dedicated to analyse de child's right to be heard. This right is set as the most significant expression of his interest. In the recent years this right has been limited by Jurisprudence and by the legislator without a logical reason for this change. Regarding the current audience development on the legal field, I have made some considerations concerning the way it is accomplished to ensure its effectiveness. This work has several conclusions; even though the main one is that the interest of the child should be delimited depending on the benefit produced for his evolutionary development. Furthermore, and according to the different legal guardianship models none of them can be considered in abstract terms as beneficial for the child, each particular case should be analysed individually. Finally, the child's right to be heard in the audience should be regulated to prevent discretion and to encourage it in all fields where the child develops, not confusing his opinion with his interest.
