Im Mittelpunkt des im Rahmen der Herbert Krüger- Gedächtnisvorlesung auf der 26. Tagung des Arbeitskreises für Überseeische Verfassungsvergleichung vom 22.-24. Juni 2001 in Heidelberg gehaltenen Vortrags steht die Entwicklung der internationalen Gerichtsbarkeit. Die Autorin stellt zunächst die Grundlagen und Besonderheiten dessen heraus, was als klassische oder traditionelle Gerichtsbarkeit bezeichnet werden kann, um im weiteren die Ursachen und Entwicklungen, aber auch die Gefahren und Grenzen der heutigen modernen Gerichtsbarkeit aufzuzeigen. Sie bezieht sich dabei in erster Linie auf den Internationalen Gerichtshof (IGH) als Hauptrechtsprechungsorgan der Vereinten Nationen, da er bzw. sein Vorgänger - der Ständige Internationale Gerichtshof - das erste ständige internationale Gericht und zudem das einzige Gericht ist, das grundsätzlich allen Staaten für alle Streitigkeiten offen steht. Hinsichtlich der Grundlagen und Besonderheiten der internationalen Gerichtsbarkeit beschreibt sie näher die Einrichtung und die Zuständigkeit internationaler Gerichte sowie die Durchsetzung der Urteile. Sie wirft darüber hinaus einen kurzen Blick auf die beiden wesentlichen neuen Akteure im Völkerrecht, die internationalen Organisationen und die Individuen. (ICI)

The Institut de Droit International has granted the John Westlake prize, established by Mr. James Brown Scott in memory of his mother, to Dr. Anton Roth of Gross-Auheim a/Main, author of an essay prepared upon the subject of "A study of the rules applicable, in cases of international responsibility, to the measure of damages caused to private persons on the territory of a foreign state. The question must be developed principally with regard to international practice and the decisions of international tribunals."
