AbstractThere have been growing debates about the legitimacy and the future of the G20 (the Group of Twenty) leaders forum despite this forum playing a prominent role in response to the 2008 Global Financial Crisis. While states within the G20 assert the legitimacy of the G20, states outside the G20 actively question this forum's legitimacy. This article contends that while the G20 is important to contemporary global governance and efforts to create a common framework of rules for global capitalism, this ongoing debate demonstrates that the legitimacy of the G20 is fundamentally uncertain and problematic because the G20's membership and connection to existing forms of multilateralism remain contentious. This article contends that G20 leaders need to consider these issues in light of the prevailing expectations of states in contemporary international society.Policy Implications
Given the scale and complexity of global problems and the large number of states and International Organisations (IOs), the G20 is going to be an important forum for timely global agenda setting and decision making at an executive level.
However, the G20 faces a range of challenges in attempting to develop and sustain its legitimacy. Importantly, legitimacy is not an abstract concept, as it derives from the prevailing norms and institutions in international society.
Since the emergence of the G20 there have been ongoing debates about the legitimacy of the G20 in international society, where it is clear that considering the views of nonmember states and the relationship of the G20 to existing forms of multilateralism are important.
Consequently, consideration ought to be given to measures to strengthen the legitimacy of the G20, including stronger connections between the G20 and core multilateral bodies like the UN, as well as developing avenues of interaction between the G20 and the public in its member states, as well as transnational NGOs and business interests.
Die Verhandlungsprotokolle und Materialien des Nürnberger Prozesses gegen die deutschen Hauptkriegsverbrecher wurden auf Anordnung des gerichtsführenden internationalen Militärtribunals unmittelbar nach dem Abschluß der Verhandlungen in zweiundvierzig Bänden publiziert. Mit der sofortigen Veröffentlichung des Prozeßprotokolls suchte der Gerichtshof der Bedeutung Rechnung zu tragen, »die ein authentischer Text des gegen die deutschen Hauptkriegsverbrecher geführten Prozeßverfahrens für die Geschichte besitzt«. Als erste umfassende Bilanz der nationalsozialistischen Verbrechen ist die Dokumentation mit ihrem erdrückenden Beweismaterial ein Zeitzeugnis ersten Ranges. Die digitale Fassung folgt den Bänden 1 bis 23 der amtlichen Textausgabe des Internationalen Militärgerichtshofs in deutscher Sprache, auf die sich auch die Seitenkonkordanz bezieht. In der ersten Abteilung »Dokumente und Materialien« – sie entspricht dem ersten Band der Buchausgabe – finden sich wichtige Vorprozeßdokumente (Konstituierung und Einsetzung des Gerichtshofes, Verfahrensordnung etc.), die Anklageschrift, das Urteil und die verhängten Strafen. Den Kern bildet der volle Wortlaut der 16.000 Buchseiten füllenden Niederschriften der Verhandlungen dieses 218 Tage andauernden Prozesses, beginnend mit der vorbereitenden Sitzung vom 14. November 1945 und endend mit der Schlußsitzung vom 1. Oktober 1946. Der Erschließung dieses Textmassivs dienen schließlich der Sach-, der Personen- und der Dokumentenindex, die als 23. Band den eigentlichen Abschluß der Prozeßdokumentation bilden.

La sous-traitance internationale existe depuis longtemps, mais elle s'est accentuée au cours des dernières décennies. En effet, l'économie globalisée d'aujourd'hui est faite d'une libre-circulation grandissante des marchandises, des services et des capitaux. Il en résulte une forme de division internationale du travail et de spécialisation accrue de certains fabricants ou fournisseurs de services implantés dans différents pays. Afin de réaliser des projets complexes, le recours à la sous-traitance internationale est devenu de plus en plus fréquent, les entrepreneurs principaux ayant recours à des sous-traitants étrangers hautement spécialisés ou dont les services présentent un avantage économique par rapport à des fournisseurs locaux. (.) La multiplication des relations contractuelles qui caractérise en général le phénomène de la sous-traitance s'accompagne, en cas de sous-traitance internationale, d'une multiplication des ordres juridiques susceptibles de régir ces relations. Chaque contrat contribuant à la réalisation de l'objectif commun est susceptible de relever de droits nationaux différents, et de juges nationaux différents. Comme l'écrivent D. Bureau et H. Muir Watt, le droit international privé est l' « instrument de gestion de la diversité des droits » et il est le reflet des tensions qui peuvent naître entre les droits nationaux du fait des différents choix philosophiques et des préférences politiques que ceux-ci mettent en œuvre . As the consequences of science and technology impinge more and more on international relations, states attempt to deal with the promise and dangers implicit in these consequences by the creation of international regimes. The nature and scope of such regimes are justified, in part, by the scientific and technological givens with which they are to deal. Increasingly, however, the process of justification is dominated by constructs and arguments taken from systems theory, thus mixing the epistemological styles of the natural and the social sciences. It is often not clear whether justification in terms of systems theory is rhetoric or based on demonstrated isomorphisms. The article seeks to answer this question by presenting a four-fold typology of systems theories together with their assumptions and relevance to the creation of international regimes. The article then examines three specific proposals for international action on science and technology, prepared under OECD auspices, in order to demonstrate the extent to which they rely on systems theory and to determine how persuasive the systemic justification is. The conclusion: there is an inverse relationship between the elaborateness of the systemic justification and the acceptability of the regime on logical, empirical, and moral grounds.
