В сьогоднішніх політичних умовах обґрунтованою і виправданою є необхідність розробки і упровадження Економічної Конституції України (ЕКУ) – Основного Економічного Закону держави, згідно з яким функціонування національної економіки повинно забезпечувати: планово-економічне і фінансове бачення перспектив розвитку конкурентних галузей національної економіки з науково обґрунтованими податковими можливостями регіонів; економічний захист вітчизняного товаровиробник; соціальний захист громадян; чесний, вчасний і справедливий розподіл і перерозподіл прибутків, сукупного суспільного продукту; створення умов і зацікавленості у творчій праці; реалізації соціальної політики. In modern political conditions the necessity of the development and inculcation of Economic Constitution of Ukraine (ECU) – the main economic law of the state is grounded and acquited. According to the law the functioning of national economy should ensure: planned-economic and financial seeing of perspectives of compete branches of national economy with scientifically grounded taxing possibilities of regions, economic protection of national producer, social protection of citizens; honest, well-timed and just distribution and re- distribution of profit social product, creation of conditions for creative labour; realization of social politics.
The article describes how the features of the First Czechoslovak Republic state formation corresponded to democratic principles; it is examined the influence of external factors and tendencies to the constitutional process; it is investigated the implementation of the fundamental principles of democracy in the norms of the Czechoslovak Constitution of 1920. It should be stressed that the foundation of Czechoslovakia was influenced by democratic values, but also it was directly influenced by the interests of the Entente Powers, especially Great Britain and France. It manifested itself in the fact that representatives of the Czechoslovak national movement sought the support of the Entente states in the process of creating an independent state of Czechs and Slovaks in territories over which the pre-war sovereignty of the Austro-Hungarian Empire was recognized. Members of the Czechoslovak national missions were negotiating with representatives of foregin politics at this period. Czechoslovak national corps were created, fought on the side of the Entente states and formed the basis of the future army of the state, whose project was actively promoted. However, total control and dependence on Entente's strategic interests which sometimes went against the established principles of democracy was the other side of the Entente's support for the Czechoslovak national movement. For this reason, the democratic principles of state formation violated, and this especially concerned the solution of the national question. Features of the Czechoslovak state formation were of direct importance for the constitutional process. As a result, the democratic nature of the norms that regulated the status of national minorities, the legal meaning of the concept of "the Czechoslovak people", the authority of the President of Czechoslovakia, can be questioned. Nevertheless, the author comes to the conclusion that the Constitution consistently contained norms on human rights and freedoms, and it regulated the mechanism of legal restriction of state power. Therefore, conclusions are drawn that the constitution of the Czechoslovak Republic was democratic. ; У статті досліджено особливості процесу державотворення Першої Чехословацької республіки з погляду їхньої відповідності демократичним цінностям; визначено вплив зовнішніх чинників та тенденцій на конституційний процес шляхом аналізу норм Конституції Чехословацької республіки 1920 року на предмет утілення фундаментальних принципів демократії. Автором доведено, що процес створення Чехословаччини проводився під егідою демократичних ідей, проте на нього безпосередній вплив мали інтереси держав Антанти, передусім Великобританії та Франції. Досліджено основні етапи конституційного процесу в Україні у період існування Української Центральної Ради. Висвітлено історію розробки та прийняття Конституції Української Народної Республіки. Проаналізовано її зміст. Показано розходження науковців в оцінках Основного Закону УНР, що пояснюється різними підходами та критеріями до визначення її сутності та значення. Зроблено висновок, що, хоча Конституція УНР була прийнята в останній день існування Центральної Ради і не діяла жодного дня, це не може применшити її значення в історії вітчизняного революційного конституціоналізму. Текст Основного Закону не тільки враховував найкращі досягнення світової та національно-правової думки, а й за рівнем демократичності багато в чому і перевищував усі сучасні йому конституції. Не поступався він чинним тоді основним законам і за рівнем правової культури та юридичної техніки. ; The main stages of the constitutional process in Ukraine in the period of the Ukrainian Central Rada have been studied. The history of the development and adoption of the Constitution of Ukrainian People's Republic has been highlighted. Its content has been analyzed. The author has demonstrated the differences in scholars' estimations of the Basic Law of UPR that is explained by different approaches and criteria to determine its nature and significance. It has been concluded that although the Constitution of UPR was adopted on the last day of existence of the Central Rada and did not act any single day, it can not diminish its significance in the history of the national revolutionary constitutionalism. The text of the Basic Law not only took into account the best achievements of the world and national and legal thought, but according to the level of democracy exceeded all contemporary constitutions in many aspects. It was not worse than the current the Basic Laws by the level of legal culture and legal technology. Having established the democracy through the legislative agency and declared a parliamentary republic with democratic governments (three branches) and management, the Constitution provided the features of a legal state to UPR. As the current Constitution of Ukraine, the Basic Law of 1918 also declared the territory of Ukrainian People's Republic as united and integral. Development and adoption of the Constitution of UPR were important stages in Ukrainian constitutionalism, which created the basis for future legislative activity. ; Исследованы основные этапы конституционного процесса в Украине периода Центральной Рады. Раскрыта история подготовки и принятия Конституции Украинской Народной Республики. Проанализировано её содержание. Показаны расхождения исследователей в оценках Основного Закона УНР, что объясняется разными подходами и критериями к определению её сущности и значения. Сделан вывод, что, хотя Конституция УНР была принята в последний день существования Центральной Рады и не стала действующей, это не может уменьшить её значение в истории отечественного революционного конституционализма. Текст Основного Закона не только учитывал лучшие достижения мировой и национально-правовой мысли, но и по уровню демократичности во многом превосходил все конституциитого времени. Не уступал он и по уровню правовой культуры и юридической техники.
The modeling of social processes in rulemaking is still not perfect. The aim of the article is to improve the normative regulation of crime prevention measures. The purpose of the article is to analyze the Constitution of Ukraine as a verbal model of the state system of Ukraine. We justify the Constitution as a pragmatic verbal model of the system of the state of Ukraine on the basis of the theory of system engineering.A model is a specially designed object for research and problem solving (material or abstract) that has the required degree of similarity to the modeled object and is adequate for the purpose of the study. Pragmatic models are a form of organizing (displaying) knowledge of the intended (created) object system. Therefore, the Constitution of Ukraine, laws and regulations are pragmatic verbal models.The construction of a model of the system can be carried out subject to the preliminary definition of: 1) the context of the model; 2) the author's point of view; 3) modeling goals.The system model should have the following properties: 1) simplicity; 2) limited; 3) adequacy; 4) loyalty. In the Constitution of Ukraine as a model of the state system, these properties are provided in different ways. Adequate is called a model where completeness, accuracy, and truthfulness are realized to the extent that ensures the achievement of the goal of modeling.The purpose of constitutional modeling is to build a verbal model of the state system that would reflect the compelling circumstances in which the system functions - the purpose, elements, and relationships. As a goal of the system of the state of Ukraine, Article 3 of the Constitution outlines human rights and freedoms.Elements of the System of State Ukraine are: Verkhovna Rada of Ukraine, President of Ukraine, National Security and Defense Council of Ukraine, Cabinet of Ministers of Ukraine, local state administrations, courts, Constitutional Court of Ukraine. Connections of elements of the system of the State of Ukraine. The article is devoted preconditions adoption and content analysis of the first French Constitution of 1791.It was also considered the role of the Declaration of Human and Peoples Rights 1789 in determining the political and legal parameters of the Constitution, among which are the leading philosophical, social and legal ideas of thinkers XVII-XVIII centuries, especially Locke, Montesquieu and Rousseau.Was found the role of a prominent figure of the French Revolution Mounier, who came from the theory of natural law, the social contract and national suvernitet. In Declaration to the human rights he determined: liberty, property, security and resistance to violence. This made it possible to lay the foundation for the development of French constitutionalism as they related to the social compromise that included at the appropriate stage of social development.The paper also analyzes the structure and main provisions of the constitution of 1971 ‑ the first constitution of France. The form of government in France was proclaimed a constitutional monarchy. The Constitution consists of Introduction and seven chapters, each of which is divided into chapters and sections of chapters.It also made an analysis of the structure of the government, its individual organs. It is concluded that the constitution of France in 1791 was the first step in achieving effective social compromise in society, it was listed basic rights and freedoms defined polity, public authorities and their competence, etc.The Constitution was significantly different from the Declaration of the Human Rights, replacing revolutionary romanticism of this manifesto carefully and skillfully ordered legal articles that provided the best conditions for contemporary bourgeois rule. ; Розглянуто роль Декларації прав людини та громадянина 1789 р. у визначенні політико-правових параметрів конституції, серед яких простежуємо провідні філософські, соціальні та правові ідеї мислителів ХVII-XVIII ст., насамперед Локка, Монтеск'є та Русо. There are functions of the State and its purpose and objectives defined by the needs and challenges facing it. In the current study at state functions tend to understand key areas of the state, due to the appointment of the state in society. To date, there are different classifications of state functions. As a rule, allocate internal and external functions. In the chosen discourse study enough to handle the basic internal functions, where the implementation of control and supervision is most clearly. In a number of current research in the field of constitutional law, the use of «control» and «supervision», in the context of independent terms, and as synonyms. It should be noted that from a theoretical point of control and supervision have some specific features. Along with the specific features of control and supervision have several features in common. The bottom line is the same in the control and supervision is primarily manifested in the observation conditioned public positions of authority compliance corporations and individuals legislation and issued by the various rules (norms), checking their observance and application within the established competence of the various measures, with the optional' necessarily talking about direct government coercion on behalf of the state. Based on the above it can be concluded about the essential unity of control and supervision in connection with which such activities should be considered as a single function of government. It seems fair to assume supervision of a specific kind of controls to ensure compliance with the law. However, due to the fact that the concepts discussed in theoretical terms have specific features, it is necessary to differentiate the control and supervision (and the corresponding powers of conducting them ) within a single function. However, because the control is a broader concept which accommodates supervision of such a function within the state mechanism is reflected precisely control functions. In the control procedure, there are three different stages: development of standards and criteria, comparing actual results with them and take the necessary corrective action. Monitoring and surveillance are part of the organizational structure of the mechanism of the modern state. To date, only the prosecutor, constitutional bodies and other traditionally existing for the public authorities involved in the supervision and control procedures , it involved almost all government agencies. At the same time, there are special agencies for which the control and supervision is the main activity. One of the characteristic features of these bodies is foreign (non-departmental) focus their activities. In Ukraine, the control function is characterized, above all, the President of Ukraine (presidential control). Institute of presidential control is the leading element of state control, as under the provisions of Art. 102 of the Constitution of Ukraine, the President is the guarantor of the Constitution of Ukraine and the constitutional order. In the implementation of the control functions the President of Ukraine takes direct personal involvement or indirectly through specially created in its structure bodies, such as the President's representative in the Crimea. Control functions shall also Verkhovna Rada of Ukraine (parliamentary control ). The control functions of the Parliament established by the Constitution of Ukraine (Article 85, 98, 101). In addition, the Parliament exercises control in the process of legislative activity, as well as through their bodies , committees and commissions. An essential part of the control function in the state mechanism is different executive bodies, among which are departmental structures related to central authorities (customs, tax control). The judicial power exercise judicial power inherent in the functional ability to control that is characteristic of any court in any legal family. Kind of quintessential control exercised by the courts was constitutional control. Constitutional Court of Ukraine decides the case on the constitutionality of Ukraine, legal acts in accordance with Art. 147 of the Constitution. In addition to this government control function is implemented by a special competence: Accounting Chamber, Parliament Commissioner for Human Rights Prosecutor. One important feature of this form of exercise is a procurator. Prosecutors intended to perform the tasks assigned to it by the state, to represent and protect the interests of citizens, society and state. Summary of Public Prosecutions, resulting in enforcing the Constitution of Ukraine and the execution of the laws in force in the State, indicates that this type of government is a separate and independent, because it is associated with any branch (legislative, executive, judicial ) power. In particular, this is confirmed by the positioning of the prosecution in the Basic Law. However, more appropriate in the context of constitutional reform held in Ukraine, given the European experience, it would be referring to the prosecution of the executive.

The legal framework for political parties, which defines their place within the system of state power, creates the basis for the functioning of the party system as well as the state. Considering that political parties are important participants of the political process and one of the key actors of the state decision-making, regulation of the legal status and activities of this institution is a prerequisite for the democratic development of the state. In this regard, this article examines the case of Germany and Ukraine in the process of constitutionalization of political parties. Through analysis of the relevant provisions of the constitutions of both countries, the article defines the place of political parties in the state system. In addition, the article considers the methodology of measuring the level of constitutionalization of political parties. Based on the data on the level of constitutionalization of political parties in Germany and Ukraine, the author attempts to determine the role of the constitutionalization of political parties in the process of their institutionalization. The article finds that the process of constitutionalization shapes the institutional role of political parties in the state and provides the parties with the core principles of their functioning. Although constitutions of both Germany and Ukraine embed provisions regulating political parties, only the Basic Law of Germany covers the issue of the institutional capacity of political parties and their place within the state policy. Considering that the Constitution of Ukraine does not determine the place of political parties in the system of the state power, further research shall be conducted to define the impact of constitutionalization on the process of party institutionalization in Ukraine.Article received 27.02.2019 ; Законодавче закріплення регулювання діяльності політичних партій та визначення їхнього місця в системі державної влади є фундаментом для функціонування партійної системи та держави загалом. The legal framework for political parties, which defines their place within the system of state power, creates the basis for the functioning of the party system as well as the state. Considering that political parties are important participants of the political process and one of the key actors of the state decision-making, regulation of the legal status and activities of this institution is a prerequisite for the democratic development of the state. In this regard, this article examines the case of Germany and Ukraine in the process of constitutionalization of political parties. Through analysis of the relevant provisions of the constitutions of both countries, the article defines the place of political parties in the state system. In addition, the article considers the methodology of measuring the level of constitutionalization of political parties. Based on the data on the level of constitutionalization of political parties in Germany and Ukraine, the author attempts to determine the role of the constitutionalization of political parties in the process of their institutionalization.
