The article presents the current state of medical and pharmaceutical provision for privileged categories of citizens of Ukraine, which current legislation referred soldiers who took part in anti-terrorist operations. Overviewed forensic and pharmaceutical practice on the availability medicines to privileged contingent of the population (combatants of the counterterrorist operation). Analyzed the current legislation of Ukraine to provide military healthcare.Goal. To conduct an analysis of pharmaceutical provision for servicemen who participated in the fighting by summarizing the forensic and pharmaceutical practice.Methods. During the studies used systemic, legal, questionnaire, documentary and forensic methods for pharmaceutical analysis.Research results. Established that as a result of fighting in Ukraine a large number of soldiers in need of medical and pharmaceutical care. More than 12 thousand people have already been treated in medical institutions of Ukraine, but remains relevant provision of wounded and sick soldiers' necessary pharmacotherapy in the outpatient setting. The current legislation of Ukraine guaranteed the free provision of drugs for combatants. Examples of pharmaceutical and forensic practice in the provision of medical and pharmaceutical care combatants abroad and in Ukraine. A number of organizational and legal measures that make possible to optimize the interaction in the chain "doctor - patient (combatant) - pharmacist" and increase pharmaceutical provision for servicemen who participated in the fighting.Conclusions. During the forensic and pharmaceutical research revealed the problem of delayed medical supply to troops who took part in anti-terrorist operations ; У статті наведено сучасний стан медико-фармацевтичного забезпечення пільгових категорій населення України, до яких чинним законодавством віднесено військовослужбовців, що брали участь у проведенні антитерористичної операції. Узагальнено судово-фармацевтичну практику щодо порушень прав на доступність для пільгового контингенту населення (учасників бойових дій антитерористичної операції) лікарських засобів. Проведено аналіз чинного законодавства України щодо забезпечення військовослужбовців у сфері охорони здоров'я.Мета. Провести аналіз організації фармацевтичного забезпечення військовослужбовців, що брали участь у бойових діях, шляхом узагальнення судово-фармацевтичної практики.Методи. Під час проведення досліджень використовувалися системний, нормативно-правовий, опитувальний, документальний та судово-фармацевтичний методи аналізу.Результати дослідження. Встановлено, що внаслідок проведення бойових дій в Україні велика кількість військовослужбовців потребує медичної та фармацевтичної допомоги. Більше 12 тис. осіб вже пройшли курс лікування у медичних закладах України, проте залишається актуальним забезпечення поранених та хворих військовослужбовців необхідною фармакотерапією в амбулаторних умовах. Чинним законодавством України гарантовано безоплатне надання лікарських засобів учасникам бойових дій. Наведено приклади із судово-фармацевтичної практики щодо надання медико-фармацевтичної допомоги учасникам бойових дій за кордоном та в Україні. Запропоновано ряд організаційно-правових заходів, завдяки яким можливо оптимізувати взаємодію у ланцюзі «лікар – пацієнт (учасник бойових дій) – провізор» та підвищити рівень фармацевтичного забезпечення військовослужбовців, які брали участь у бойових діях.Висновки. В ході судово-фармацевтичних досліджень виявлено проблему несвоєчасного забезпечення лікарськими засобами військовослужбовців, які брали участь в антитерористичній операції

The branches of healthcare of Ukraine today need to modernize in line with EU standards to ensure free access of patients to medical and pharmaceutical care, efficient, high-quality and safe medicines. To analyze some aspects of the modernization of the state of health of Ukraine in accordance with the standards of the EU from the perspective of medical and pharmaceutical law. Materials – forensic and pharmaceutical monitoring data regarding the patients' rights (in particular of the drug addicted patients) in the world, the EU and Ukraine, as well as the legal framework of Ukraine. Methods – normative and legal, documental, system analysis and forensic and pharmaceutical monitoring. Found that membership in the institutions of the European Community provides not only rights but also obligations, particularly for public authorities in relation to the accepted standards regarding the rights of patients to different contingents access to health care and pharmaceutical efficient, high-quality and safe medicines of all the nomenclature and legal classification and legal groups. On the example of drug-dependent patients showed that the measures proposed by the authors extend the approaches to the decriminalization of certain articles of the Criminal Code of Ukraine and expand the rights of patients addicted to their inclusion in the program of substitution maintenance therapy. The analysis of the modernization of the healthcare sector of Ukraine to the standards of the European Community from the perspective of medical and pharmaceutical law was conducted. The measures aimed at combating violations of the legislation on the protection of economic competition in the sphere of circulation (realization) of drugs. ; Отрасли здравоохранения Украины сегодня необходима модернизация в соответствии со стандартами Европейского союза для обеспечения свободного доступа пациентов к медико-фармацевтической помощи, эффективным, качественным и безопасным лекарственным средствам. Цель работы – проанализировать отдельные аспекты состояния модернизации здравоохранения Украины в соответствии со стандартами ЕС с позиции медицинского и фармацевтического права. Материалы – данные судебно-фармацевтического мониторинга относительно прав пациентов (в частности наркозависимых) в мире, ЕС и Украине, а также нормативно-правовая база Украины. Методы – нормативно-правового, документального, системного анализа и судебно-фармацевтического мониторинга. Установлено, что членство в институциях Европейского сообщества предоставляет не только права, но и обязанности, особенно для органов государственной власти, относительно принятых стандартов в обеспечении прав пациентов разных контингентов к доступной, своевременной медико-фармацевтической помощи и эффективным, качественным, безопасным лекарственным средствам всех номенклатурно-правовых и классификационно-правовых групп. На примере наркозависимых пациентов показано, что предложенные авторами меры расширяют подходы к декриминализации отдельных статей Уголовного Кодекса Украини и расширяют права наркозависимых пациентов к включению их в программы заместительной поддерживающей терапии. Проведен анализ модернизации сферы здравоохранения Украины к стандартам ЕС с позиции медицинского и фармацевтического права. Установлены нерешенные вопросы и препятствия модернизации в сфере здравоохранения Украины. Приведены меры, направленные на противодействие нарушениям законодательства о защите экономической конкуренции в сфере обращения (реализации) лекарственных средств.

The last time the questions of location of pharmaceutical right are acquired by more intent attention outside, both legists and organizers of фармации. Thus, actual is fundamental determinations of independence of such field of law as pharmaceutical right. The aim of work is determinations of criteria of existence of pharmaceutical right as a historical and modern going is studied independent industry near classification of criteria of the national system of right. By means of such methods as an analysis, synthesis, it is set that an object and method of the legal adjusting come forward the basic criteria of determination of independence of the field of law. As a job performance the necessity of preparation of project of law of Ukraine is marked «About pharmaceutical activity», that first, was to the pre-lodge authors as early as 2001 and published in a magazine «Pharmacy» (2001–2002). At one time there were many different interpretations of concept «Pharmaceutical activity». It is well-proven that most exhaustive, is determinations of this concept in the release of scientists of the National pharmaceutical university, that gave encyclopedic exposition of interpretation of this concept. Attention is accented, that discussions round a pharmaceutical glossary and, in general to the standards of European Union it is proceeded modernisation, harmonization and имплементации of pharmaceutical right till now. A presence is reasonable at a pharmaceutical right for an independent object and methods. From them an object comes forward basic exactly, and an adjusting method comes forward as an additional criterion. It testifies to existence of pharmaceutical right as independent industry. The reasonable criteria of existence of pharmaceutical right allow in further to pass to consideration of other independent signs – existence of science, industry of legislation, questions of complex branch character of industry and also correlation of pharmaceutical right with other tangents of right by industries, first of all with a medical right. ; В последнее время вопросы определения места фармацевтического права привлекают все более пристальное внимание со стороны как правоведов, так и организаторов фармации. Таким образом, актуальным является принципиальное определения самостоятельности такой отрасли права как фармацевтическое право. Целью работы является определения критериев существования фармацевтического права как самостоятельной отрасли, изучены исторические и современные подходы к классификации критериев национальной системы права. С помощью таких методов как анализ, синтез, историко-правовой установлено, что основными критериями определения самостоятельности отрасли права выступают предмет и метод правового регулирования. В качестве результата работы отмечается необходимость подготовки проекта закона Украины «О фармацевтической деятельности», который впервые был предложен авторами еще в 2001 г. и опубликован в журнале «Аптека» (2001–2002гг.). В свое время были разные толкования понятия «фармацевтическая деятельность». Доказано, что наиболее исчерпывающим является определения этого понятия в редакции ученых Национального фармацевтического университета, которые дали энциклопедическое изложение толкования этого понятия. Акцентируется внимание, что дискуссии вокруг фармацевтического глоссария и, вообще, модернизации, гармонизации и имплементации фармацевтического права к стандартам Европейского Союза продолжаются и до этого времени. Обосновано наличие у фармацевтического права самостоятельного предмета и методов. Из них основным выступает именно предмет, а метод регулирования выступает как дополнительный критерий. Это свидетельствует о существовании фармацевтического права как самостоятельной отрасли.

The constant growth of counterfeiting of the medicines in Ukraine led to the need for ratification of the Convention "Concerning the fight against counterfeit medical products and similar crimes that threaten the health of the population" and the reform of legislation in line with European requirements and standards. The purpose of the work – to examine the structure and content of the Convention from the perspective of forensic pharmacy. Materials – the legal framework of Ukraine to ratify the Convention "Concerning the fight against counterfeit medical products and similar crimes that threaten the health of the population". Methods – forensic and pharmaceutical monitoring, normative and legal analysis. Ratification of the Convention "Concerning the fight against counterfeit medical products and similar crimes that threaten the health of the population" provides for criminal and administrative liability for falsification of drugs or commit crimes that threaten the health of the population. This entails the need for changes in the pharmaceutical, medical and legal legislation of Ukraine. The article highlights the main chapters of the Convention "Concerning the fight against counterfeit medical products and similar crimes that threaten the health of the population", drawn up a list of crimes that fall under its action, and provides the basic penalties for the commission of these crimes from the perspective of forensic pharmacy. ; Постоянный рост фальсификации лекарственных средств в Украине вызвал необходимость ратификации Конвенции «О борьбе с фальсификацией медицинской продукции и сходными преступлениями, угрожающими здоровью населения» и реформирования законодательства в соответствии с европейскими требованиями и стандартами. Цель работы – изучение структуры и содержания Конвенции с позиции судебной фармации. Материалы исследования – нормативно-правовая база Украины по ратификации Конвенции. Использовали методы судебно-фармацевтического мониторинга, нормативно-правового анализа. Ратификация Конвенции предусматривает уголовную и административную ответственность за фальсификацию лекарственных средств или совершение преступлений, угрожающих здоровью населения. Это влечет за собой необходимость внесения изменений в фармацевтическое, медицинское и юридическое законодательство Украины. В статье выделены основные главы Конвенции, составлен перечень преступлений, попадающих под её действие, а также приведены основные санкции за совершение указанных преступлений с позиции судебной фармации.

Background. Formation of mental disorders in the area of military conflict occurs in emergencies, which are fighting, leading to the emergence of stress disorders, and in the future after returning to normal living conditions can lead to decompensation of personality disorders, post-traumatic stress disorder, depression and suicide. The purpose was to conduct clinical and pharmacological, classification and legal, nomenclature and legal distribution of medicines for pharmacotherapy of depression among combatants with determination of parameters of their control regime. Materials and methods. The research used the current normative, legal and methodological documents, the State Register of Medicines of Ukraine, scientific sources, instructions for medical use of medicines, Internet resources. Used regulatory, documentary, forensic and pharmaceutical methods of analysis. Results. The article deals with the clinical and pharmacological, classification and legal, nomenclature and legal distribution of medicines with the determination of parameters of their control regime by ICD-10 codes F32-33 for the pharmacotherapy of depression among patients-combatants who receive medical care and pharmaceutical provision. Conclusions. Established that for pharmacotherapy of depression in healthcare establishments medicines prescribed, which: according to the clinical and pharmacological groups belong to the ATC codes "N04B", "N05A" and "N06A"; by classification and legal group – to the general group; by the nomenclature and legal group – to the prescription group. Determined that the circulation of antidepressant and antipsychotic medicines for the pharmacotherapy of depression among combatants in medical institutions carried out based on a license for medical practice, and in pharmacy establishments – based on a license for wholesale and retail trade of medicines. Implementation of the parameters of the control regime of medicines for pharmacotherapy of depression in the activity of healthcare facilities is relevant for psychiatrists, narcologists and general practitioners, and will ensure the proper organization of the order of their treatment at the stages of appointment, issue, storage, accounting, quality control and release in accordance with the requirements of the current legislation. ; Актуальность. Формирование психических расстройств в зоне военного конфликта происходит в чрезвычайных ситуациях, которыми выступают боевые действия, что приводит к возникновению стрессовых расстройств, а в дальнейшем после возвращения в привычные условия жизни может привести к декомпенсации расстройств личности, посттравматическим стрессовым расстройствам, депрессии, суицидам и самоубийствам. Цель исследования. Провести клинико-фармакологическое, классификационно-правовое и номенклатурно-правовое распределение лекарственных средств для фармакотерапии депрессии у комбатантов с определением параметров их режима контроля. Материалы и методы. Для проведения исследования были использованы действующие нормативно-правовые и инструктивно-методические документы, Государственный реестр лекарственных средств Украины, научные источники, инструкции для медицинского применения лекарственных средств, интернет-ресурсы. Использовались нормативно-правовой, документальный и судебно-фармацевтический методы анализа. Результаты. В статье проведено клинико-фармакологическое, классификационно-правовое и номенклатурно-правовое распределение лекарственных средств с определением параметров их режима контроля по кодам F 32-33 МКБ-10 для фармакотерапии депрессии у пациентов-комбатантов, которые в учреждениях здравоохранения различных уровней получают медицинскую помощь и фармацевтическое обеспечение. Выводы. Установлено, что для фармакотерапии депрессии в учреждениях здравоохранения назначаются лекарственные средства, которые: по клинико-фармакологическому признаку относятся к АТС-кодам «N04B», «N05А» и «N06A»; по классификационно-правовому признаку – к общей группе; по номенклатурно-правовому признаку – к рецептурной группе. Определено, что обращение антидепрессивных и антипсихотических лекарственных средств для фармакотерапии депрессии у комбатантов в медицинских учреждениях осуществляется на основании лицензии на медицинскую практику, а в аптечных учреждениях – на основании лицензии на оптовую и розничную торговлю лекарственными средствами. Внедрение в работу учреждений здравоохранения параметров режима контроля лекарственных средств для фармакотерапии депрессии является актуальным для врачей-психиатров, врачей-наркологов, врачей общей практики и обеспечит надлежащую организацию порядка их обращения на этапах назначения, выписки, хранения, учета, контроля качества и отпуска в соответствии с требованиями действующего законодательства. ; Актуальність. Формування психічних розладів у зоні військового конфлікту відбувається у надзвичайних ситуаціях, якими є бойові дії, що призводить до виникнення стресових розладів, а в подальшому після повернення до звичних умов життя може привести до декомпенсації розладів особистості, посттравматичних стресових розладів, депресії, суїцидів та самогубства. Мета дослідження. Провести клініко-фармакологічний, класифікаційно-правовий та номенклатурно-правовий розподіл лікарських засобів для фармакотерапії депресії у комбатантів з визначенням параметрів їх режиму контролю. Матеріали та методи. Для проведення дослідження було використано чинні нормативно-правові та інструктивно-методичні документи, Державний реєстр лікарських засобів України, наукові джерела, інструкції для медичного застосування лікарських засобів, інтернет-ресурси. Використовувались нормативно-правовий, документальний і судово-фармацевтичний методи аналізу. Результати. У статті проведено клініко-фармакологічний, класифікаційно-правовий та номенклатурно-правовий розподіл лікарських засобів з визначенням параметрів їх режиму контролю за кодами F 32-33 МКХ-10 для фармакотерапії депресії у пацієнтів-комбатантів, які в закладах охорони здоров'я різних рівнів отримують медичну допомогу та фармацевтичне забезпечення. Висновки. Встановлено, що для фармакотерапії депресії в закладах охорони здоров'я призначаються лікарські засоби, які: за клініко-фармакологічною ознакою належать до АТС-кодів «N04B», «N05А» і «N06A»; за класифікаційно-правовою ознакою – до загальної групи; за номенклатурно-правовою ознакою – до рецептурної групи. Визначено, що обіг антидепресивних і антипсихотичних лікарських засобів для фармакотерапії депресії у комбатантів у медичних закладах здійснюється на підставі ліцензії на медичну практику, а в аптечних закладах – на підставі ліцензії на оптову та роздрібну торгівлю лікарськими засобами. Впровадження в діяльність закладів охорони здоров'я параметрів режиму контролю лікарських засобів для фармакотерапії депресії є актуальним для лікарів-психіатрів, лікарів-наркологів, лікарів загальної практики та забезпечить належну організацію порядку їх обігу на етапах призначення, виписування, зберігання, обліку, контролю якості та відпуску відповідно до вимог чинного законодавства.

Background. In recent years, the COVID-19 pandemic has spread and is developing in all countries of the world without exception, affecting not only medical and pharmaceutical, but also social, economic, toxicological and criminal aspects. In such conditions, it is of great importance in the field of healthcare and the pharmaceutical industry of Ukraine to improve the system of legal relations "doctor-patient-pharmacist", based solely on the principles of pharmaceutical and medical law. Among the components of medical and pharmaceutical law there is forensic pharmacy, which studies the causes of offenses in the field of healthcare. The purpose of the study was to analyze history of formation and development of forensic and pharmaceutical researches in Ukraine within the organization of pharmaceutical business, drug technology and pharmaceutical law. Materials and methods. Legislative and regulatory documents were used in the study; scientific publications in the field of "forensic pharmacy"; Internet resources. Normative and legal, documentary, historical, bibliographic, forensic and pharmaceutical, comparative and graphic methods of analysis were used. Results. Forensic pharmacy in the world as a scientific field is known and developed since 1946. The article covers the period of 1990-2004. Prominent scientists of Ukraine were of great importance in the formation of forensic pharmacy. The formation of forensic pharmacy began with the generalization of forensic and pharmaceutical practice in historical retrospect "from police chemistry to forensic chemical and pharmaceutical examination – from forensic pharmacy to pharmaceutical law and medical law" with the support of prof. Chernykh V.P. In the period of 1997-2003, the development of forensic pharmacy took place by improving the regulatory and legal support of the control and licensing system of circulation of medicines. Trends in the prevalence of diseases involving uncontrolled and irrational use and abuse of surfactants have been identified. The causal links between drug addiction, substance abuse and crime have been investigated. The interpretation of "potent", "poisonous" substances in the regulations of Ukraine have been improved. It is substantiated that the main indicator of classifying drugs as "potent" and "poisonous" substance is a forensic criterion that qualifies the consequences of irrational use of drugs by severity of injuries: from mild, moderate to severe injuries, or those that caused fatalities. At the next stage (2003-2004) the scientific and theoretical generalization and the new approach to the decision of a problem which is connected with development of scientifically-based principles of optimization of system of the state control over circulation of narcotic drugs, psychotropic substances and precursors were studied. The possibility of participation of a pharmacy specialist (pharmacist-forensic scientist) at the stages of: investigation, pre-trial investigation in forensic chemical and pharmaceutical studies of physical evidence and participation as a forensic expert in a criminal case in court has been researched. Conclusions. It is substantiated that the formation of forensic and pharmaceutical researches within the organization of pharmaceutical business, drug technology and pharmaceutical law in Ukraine has taken place. Further forensic pharmaceutical research needed to harmonize domestic legislation, international human rights standards in the field of health care, legal regulation of the pharmaceutical market and the medical services market. ; Актуальність. В останні роки пандемія COVID-19 захопила та розвивається у всіх без винятку країнах світу, що зачіпає не тільки медико-фармацевтичні, а й соціально-економічні, токсикологічні та кримінально-правові аспекти. У таких умовах велике значення у сфері охорони здоров'я та фармацевтичній галузі України має удосконалення системи правовідносини «лікар-пацієнт-провізор», що базуються виключно на принципах фармацевтичного і медичного права. Серед складових медичного та фармацевтичного права виступає судова фармація, що вивчає причини вчинення правопорушень у сфері охорони здоров'я. Мета дослідження: аналіз історії становлення та розвитку в Україні судово-фармацевтичних досліджень у межах організації фармацевтичної справи, технології ліків та фармацевтичного права. Матеріали та методи. При проведенні дослідження використовували законодавчі, нормативно-правові документи; наукові публікації за напрямком «судова фармація»; Інтернет-ресурси. Застосовували нормативно-правовий, документальний, історичний, бібліографічний, судово-фармацевтичний, порівняльний та графічний методи аналізу. Результати. Судова фармація у світі як науковий напрямок відома та розвивається з 1946 р. Стаття охоплює період 1990-2004 рр. У становленні судової фармації велике значення мали видатні вчені України. Становлення судової фармації почалося з узагальнення судово-фармацевтичної практики в історичній ретроспективі «від поліцейської хімії до судової хіміко-фармацевтичної експертизи – від судової фармації до фармацевтичного права і медичного права» завдяки підтримці проф. Черних В. П. У період 1997-2003 рр. розвиток судової фармації відбувався шляхом удосконалення нормативно-правового забезпечення контрольно-дозвільної системи обігу лікарських засобів. Установлено тенденції поширеності захворювань, які полягають у безконтрольному та нераціональному вживанні і зловживанні психоактивними речовинами (ПАР). Досліджено причинно-слідчі зв'язки наркоманії, токсикоманії і злочинності. Удосконалено тлумачення «сильнодіюча», «отруйна» речовина у нормативно-правових актах України. Обґрунтовано, що основним показником віднесення лікарських засобів (ЛЗ) до категорії «сильнодіюча» та «отруйна» речовина є судово-медичний критерій, який кваліфікує наслідки нераціонального вживання ЛЗ по тяжкості тілесних ушкоджень: від легких, середньої тяжкості до тяжких тілесних ушкоджень або таких, що спричинили смертельні наслідки. На наступному етапі (2003-2004 рр.) досліджувалося науково-теоретичне узагальнення і новий підхід до вирішення проблеми, яка пов'язана з розробкою науково-обґрунтованих принципів оптимізації системи державного контролю за обігом наркотичних засобів, психотропних речовин і прекурсорів. Вивчено можливість участі спеціаліста фармації (провізора-криміналіста) на стадіях: дослідчої перевірки, досудового слідства при проведенні судових хіміко-фармацевтичних досліджень речових доказів та участі в якості судового-експерта при розгляді кримінальної справи в суді. Висновки. Обґрунтовано, що становлення судово-фармацевтичних досліджень у межах організації фармацевтичної справи, технології ліків та фармацевтичного права в Україні відбулося. Необхідні подальші судово-фармацевтичні дослідження щодо гармонізації вітчизняного законодавства, міжнародно-правових стандартів захисту прав людини у сфері охорони здоров'я, правового регулювання фармацевтичного ринку та ринку медичних послуг.

Current research considers various points of view concerning reformation, modernization, update of pharmaceutical branch of Ukraine. It is indicated that basic principle of lawmaking activity has to second – guess upheaval of emphases on behalf of processed management in handling of objects of law and not in an own way by means of their means, permissions, interdictions, measures of administrative, criminal, authoritative character, which makes available of guarantees of effective implementation of remarked process. ; Данное исследование рассматривает различные точки зрения относительно реформирования, модернизации, обновления фармацевтической отрасли Украины. Показано, что основной принцип законопроектной деятельности должен предусматривать смещение акцентов в пользу процессного менеджмента в управлении объектами права, а не собственно их средствами, разрешениями, запретами, мерами административного, уголовного, авторитарного характера, что предоставляет гарантии эффективной реализации указанного процесса. ; У дослідженні розглянуті різні точки зору відносно реформування фармацевтичної галузі в Україні, її модернізації і оновлення. Обґрунтовано, що основний принцип законопроектної діяльності в фармації повинен зосереджуватися на зміщенні акцентів на користь процесного управління об'єктами права, а не власне їх засобами, дозволами, заборонами, заходами адміністративного, карного, авторитарного характеру, що надає гарантії ефективної реалізації цього процесу.

It is indicated that basic principle of lawmaking activity has to second – guess upheaval of emphases on behalf of processed management in handling of objects of law and not in an own way by means of their means, permissions, interdictions, measures of administrative, criminal, authoritative character, which makes available of guarantees of effective implementation of remarked process. ; Данное исследование рассматривает различные точки зрения относительно реформирования, модернизации, обновления фармацевтической отрасли Украины. Показано, что основной принцип законопроектной деятельности должен предусматривать смещение акцентов в пользу процессного менеджмента в управлении объектами права, а не собственно их средствами, разрешениями, запретами, мерами административного, уголовного, авторитарного характера, что предоставляет гарантии эффективной реализации указанного процесса.

Background. Around the world, drug-related road traffic accidents are one of the leading causes of injury and death among road users. Traffic safety is a system that includes the following components: a person – a person's health condition – the use of dangerous drugs of different classification and legal groups – adverse drug reactions – a vehicle – a road. The share of road traffic accidents under the influence of drugs is more than 75 %, they are also the most socially dangerous, because they have grave consequences, cause irreparable harm to the health and death of the victims. The purpose of the study was to analyze the achievements of forensic and pharmaceutical researches in Ukraine on the impact of drugs on the safety, life and health of road users within the framework of the organization of pharmaceutical business, drug technology, pharmaceutical and medical law in a retrospective aspect. Materials and methods. The materials of the imperative research were legislative, regulatory and legal documents; materials of the formation of the scientific school of forensic pharmacy; scientific publications on the topic of the article; Internet resources, sources of scientific literature. To achieve the set goals, the methods of forensic and pharmaceutical, regulatory, documentary, bibliographic, comparative, historical and graphic analysis were used. Results. The experience of the countries of the world in the prophylaxis and prevention of road traffic accidents under the influence of drugs was analyzed. The causes and conditions for the occurrence and consequences of road traffic accidents are multifactorial in nature and are associated with the victims (driver - pedestrian), vehicle, road conditions, and the use of psychoactive drugs. A system of organizational, regulatory and preventive measures has been developed to provide first medical aid to victims of a road traffic accident. Shown that there is a need for scientifically grounded organizational and legal, clinical and pharmacological, forensic pharmaceutical and socio-economic studies on causal relationships between adverse reactions due to the use of drugs of various classification and legal groups, traffic safety and road traffic accidents. For the first time in Ukraine, a mathematical model was proposed to establish the effect of psychoactive drugs on the driver's condition when driving a vehicle, depending on the calculation of the stopping path of the car in accordance with the selected speed and a decrease in the driver's response. The structure of road traffic accidents under the influence of psychoactive drugs has been investigated. Conclusions. A classification of first-aid kits for providing first medical aid to victims of road traffic accidents was proposed, which made it possible to substantiate the need to improve them both in qualitative and quantitative composition, depending on the type of vehicle and the likelihood of an accident with serious consequences. Recommendations were proposed for providing information on the possibility of obtaining medical care and the signal-calling system on the roads, marking the packages of psychoactive drugs with a special mark in the form of a red triangle. The need for further forensic pharmaceutical research has been proven. ; Актуальність. У всьому світі дорожньо-транспортні пригоди (ДТП) під впливом лікарських засобів (ЛЗ) є однією з головних причин травмувань, смертності серед учасників дорожнього руху. Безпека руху уявляє собою систему, яка включає наступні складові: людина – стан здоров'я людини – вживання небезпечних ліків різних класифікаційно-правових груп (КПГ) – побічні реакції ліків – транспортний засіб – шлях. Частка дорожньо-транспортних пригод під впливом ліків становить понад 75 %, вони є й найбільш суспільно небезпечними, тому що мають тяжкі наслідки, спричиняють невиправну шкоду здоров'ю та смерть потерпілих. Мета дослідження: проаналізувати здобутки судово-фармацевтичних досліджень в Україні щодо впливу ЛЗ на безпеку, життя та здоров'я учасників дорожнього руху в межах організації фармацевтичної справи, технології ліків та фармацевтичного і медичного права в ретроспективному аспекті. Матеріали та методи. Матеріалами імперативного дослідження стали законодавчі, нормативно-правові документи; матеріали становлення наукової школи судової фармації; наукові публікації за темою статті; Інтернет-ресурси, джерела наукової літератури. Для досягнення поставленої мети було застосовано методи судово-фармацевтичного, нормативно-правового, документального, бібліографічного, порівняльного, історичного та графічного аналізу. Результати. Проаналізовано досвід країн світу щодо профілактики та попередження дорожньо-транспортних пригод під впливом ліків. Причини, умови виникнення та наслідки ДТП носять багатофакторний характер і пов'язані з постраждалими (водій-пішохід), транспортним засобом, дорогою, вживанням психоактивних ЛЗ. Розроблено систему організаційно-регуляторних та попереджувальних заходів з надання першої медикаментозної допомоги потерпілим від ДТП. Показано, що існує необхідність проведення науково-обґрунтованих організаційно-правових, клініко-фармакологічних, судово-фармацевтичних та соціально-економічних досліджень щодо причинних зв'язків між побічними реакціями внаслідок вживання ЛЗ різних КПГ, безпекою руху та виникненням ДТП. Вперше в Україні було запропоновано математичну модель щодо встановлення впливу психоактивних ЛЗ на стан водія при керуванні транспортним засобом у залежності від обчислення шляху зупинки автомобіля відповідно до обраної швидкості та зниження реакції водія. Досліджено структуру ДТП, скоєних під впливом психоактивних лікарських препаратів. Висновки. Запропоновано класифікацію медичних аптечок для надання першої медикаментозної допомоги потерпілим при ДТП, яка дозволила обґрунтувати необхідність удосконалення їх як за якісним, так й кількісним складом у залежності від типу транспортного засобу й імовірності виникнення ДТП з тяжкими наслідками. Запропоновано рекомендації стосовно забезпечення інформації про можливість отримання медичної допомоги та систему сигнально-викличного зв'язку на шляхах, маркірування упаковок психоактивних ЛЗ спеціальною позначкою у вигляді червоного трикутника. Доведено про необхідність подальших судово-фармацевтичних досліджень.

In recent years the study of the problem of ill-health and the provision of pharmaceutical services, conflict of interest «doctor-patient» when assigning frequencies for receiving and dispensing drugs, the use of health insurance, payment in carrying of the commercial activities in the provision of medical and pharmaceutical services in healthcare was the subject of numerous studies in Japan, Canada, the EU, Russia, UK, Ukraine and the USA. Declared by the state grace contingent violated, as evidenced by numerous cases that should have criminal defense contingent privileged citizens (patients). The state should contribute to raising the social-economic, financial, medical and pharmaceutical, prosecutors, and legal levels of regional security (protection) concessional of patients with vital medicines that dispensed from the pharmacy network at discounted prescriptions. Conclusion of the research. According to the forensic and pharmaceutical risks studied problem areas that hinder medical supply preferential contingent numerous cases, evidence of violations of the rights of the patient, who declared the state must have a criminal defense contingent privileged citizens. Studying the experience of the EU countries, USA, Canada and others concerning the inadequate provision of medical care (medical errors) requires the need for extensive research. To summarize the problems and improving the coordination of work on the scientific and practical research problems and eliminate the causes and conditions that contribute to ill health and the provision of pharmaceutical care (medical errors) and thereby improve the relationships in the chain «doctor – patient – pharmacist – social worker – state official authorities – forensic doctor – prosecutor – judge – advocate». Proved the necessity of an appeal to the Supreme council of Ukraine on making appropriate amendments to the art. 140 of the Criminal Code of Ukraine as deterrence element of criminal activities in the field of non-performance or improper performance of medical, pharmaceutical or social worker, civil servant or executive bodies of his professional duties as a result of negligent or unfair to them.
