Although international human rights covenants leave it to each State regulating the expulsion of foreigners this measure should be appropriate to the purpose of other agreements, which set quite precise obligations in the interest of the international community. The prosecution of illicit drug trafficking in its aggravated form, cannot avoid a penalty, purpose never achieved with the expulsion. It is a legislative that in the case of same crime a person belonging to a drug trafficking organization becomes free but the national is convicted and subjected to stricter conditions. ; Aun cuando los pactos internacionales sobre derechos humanos dejan librado a cada Estado la reglamentación de la expulsión de extranjeros esta medida debe adecuarse al objeto y fin de los otros acuerdos vigentes, los que fijan obligaciones bastante precisas en interés de la comunidad internacional. El juzgamiento del tráfico ilícito de estupefacientes en su figura agravada no puede prescindir de una pena suficientemente aleccionadora, finalidad a la que nunca se arriba con la expulsión extintiva de la sanción. Es una incongruencia legislativa que de esta manera, y frente a un mismo delito, una persona integrante de una organización narcotraficante quede libre por ser extranjero en el país que lo ha condenado mientras que el nacional esté sometido a exigencias más estrictas.

Corporate expulsion—the permanent, government-sponsored banishment of a category of subjects beyond the physical boundaries of a political entity—appears to be a characteristic trait of Western European civilization. Elsewhere it occurred only sporadically. Compatible with the European states system that was taking shape during the central Middle Ages, corporate expulsion became a viable mode for coping with perceived internal threats when, from the twelfth century onward, a preoccupation with the defense of purity converged with the tendency of increasingly more efficient rulers to accentuate their responsibility for the wholesomeness of their realms. With the expansion of European civilization to other continents, this type of expulsion struck roots there as well.
The administrative expulsion of immigrants due to the infringements of the legislation on immigration is actually regulated as an administrative sanction and not only as a limitative measure to be adopted by the administrative authorities in order to reorder a certain sector of activity. It is not a simple alternative to economic penalties, which are the main type of administrative sanction, in general terms. The administrative procedure which necessarily has to be followed in order to declare the sanction of expulsion is quite accurate with the general principles and rules of the administrative procedure, although the so called preferent procedure presents reasonable incompatibilities with those principles and legislation. ; La expulsión administrativa de extranjeros por la comisión de las infracciones legalmente recogidas en la LOEX aparece regulada como sanción y no como una genérica medida de gravamen. Su imposición no es exactamente alternativa a la de multa, que sigue contemplándose en la legislación como la sanción paradigmática también en este sector del derecho administrativo sancionador. Finalmente, el procedimiento conducente a su imposición es, como regla general, acorde con los principios y con la regulación positiva del procedimiento administrativo sancionador, si bien el llamado procedimiento preferente ofrece dudas de legalidad en algunos aspectos esenciales para el correcto ejercicio del derecho de defensa del extranjero.
