In 1998, the international community decided to establish the first permanent International Criminal Court (ICC) with jurisdiction over persons for the most serious crimes of international concern, as referred to in the Rome Statute. As noted by many observers, some of the specific crimes within the Rome Statute are not grounded on customary international law but are more germane to treaty-based crimes. Thus, the exercise of treaty-based jurisdiction over non-party States would conflict with the principle pacta tertiis nec nocent nec prosunt. While the ICC jurisdiction is limited to crimes committed in the territory or by nationals of its States Parties, the Court may, where a situation is referred by the UN Security Council under Chapter VII of the UN Charter, exercise jurisdiction over crimes committed in the territory and by nationals of States not party to the Statute. Since the Rome Statute may go beyond existing applicable law, the referrals to the ICC are thus normative in their character. They impose new rules to be observed by any actors in the situations referred. This paper argues that this feature of a Security Council referral fits the definition of an international legislative act. The paper also inquires whether the obligation to cooperate fully with the Court arising from the Security Council resolution and the principle of complementarity require the State to modify its domestic law.

The thesis offers a critical analysis of legislative acts of the European Union. The objective of the thesis is to determine what concept of legislative act obtains in EU law, and whether the objectives which were sought to be achieved by means of introduction of "language of legislation" into EU law have been achieved. The thesis concentrates on analysis of Articles 289 – 291 TFEU. After analysing ordinary and special legislative procedures, delegated and implementing acts, and legislative acts, it is concluded that no single concept of legislative act currently exists in EU law; the constitutive treaties offer none. The objectives (set forth in the Laeken Declaration) which were sought to be achieved by means of introduction of "language of legislation" into EU law have not been met. Aside from terminological changes the legal position currently obtaining under the Lisbon Treaty does not differ conceptually from that which obtained under the Treaty of Nice. The term "legislative act" employed in Article 289(3) TFEU is just a shorthand denoting an act adopted via a particular procedure.

En el presente artículo se hace un análisis histórico de la competencia de objeción a reformas constitucionales, se observa en un ejercicio de análisis de referentes las disposiciones constitucionales de algunos países de América Latina sobre dicha atribución, se desarrolla una carga argumentativa de las razones de improcedencia, además de examinar sentencias de los tribunales antes mencionados en lo que respecta al tema de investigación. ; In 2012, after the President of the day objected to the Legislative Act of Reform of Justice, one of the most important constitutional debates of the moment was opened, which was known by the high court's such as the Constitutional Court and the Council. of State. In the present article, a historical analysis of the competence of objection to constitutional reforms is made, it is observed in an exercise of analysis of referents the constitutional dispositions of some Latin American countries on said attribution, an argumentative load of the reasons of inadmissibility, in addition to examining judgments of the aforementioned Courts with regard to the subject of investigation.

The article presents a fragment of research on univerbation in its relation to text integrity. The study is fulfilled on the material of the modern German language. Univerbation is considered as formation of root compounds and synthetic compounds. The study material includes 120 word-formation contexts selected from modern German press, fiction and legislative acts of the FRG taken from criminal, civil and public codes. The article focuses on the problem of cataphoric univerbation widely spread in press texts and law acts. The highest frequency of compounds with cataphorically oriented intratext links is detected in newspaper and journal headlines and titles of law articles. From pragmatic point of view polylexemic univerbs function in the titles of law articles as terminological condensates and as segmentation markers of the whole law text. In press headlines one of the main reasons of univerb creation and its use is compacting. The pragmatic focus on compacting is successfully manifested also in the titles of law articles. However, in contrast to press it has not a coherent, but a strongly marked cohesive nature. Showy, memorable, unusual headline univerbs can also stimulate the interest to read the main text. The existence of subheading or overheading alongside with the main headline is typical of some newspaper and journal articles. Due to this fact the content- and information-related support among univerbs is provided. In speech reality a high degree of language economy in the univerb structure results in lexical redundancy which is to guarantee the correct decoding of the condensate's semantics. ; У статті представлено фрагмент дослідження універбації в плані цілісності тексту. Роботу виконано на матеріалі сучасної німецької мови, зокрема, взято до уваги 120 словотворчих контекстів, відібраних із сучасної німецької преси, художньої літератури та законодавчих актів ФРН, запозичених із кримінального, цивільного та публічного кодексів. Універбація – це утворення складних і складнопохідних слів. У статті розглянуто проблему катафоричної універбації, яка дуже поширена в текстах преси і правових актах. Найбільша частотність композитів із катафорично орієнтованими внутрішньотекстовими зв'язками виявлена в газетно-журнальних заголовках і в назвах статей законів. З прагматичного погляду полілексемні універби виступають у назвах статей закону як термінологічні конденсати, а також виконують функцію маркерів сегментації всього тексту закону. У заголовках у пресі одним із чільних мотивів створення і використання універба є компактування. Прагматична установка на компактування успішно реалізується і в заголовках статей німецьких законів. Однак, на відміну від преси, вона має не когерентний, а яскраво виражений когезивний характер. Стимулювати зацікавленість читача до прочитання основного тексту може також помітність, запам'ятовуваність, незвичайність заголовкового універбу. Для деяких газетно-журнальних статей характерна наявність, крім основної назви статті, ще під- або надзаголовка. Завдяки цьому відбувається змістовноінформаційна підтримка по лінії "універб – універб" на рівні заголовків статті. Високий ступінь економії в універбі спричиняє в мовній реальності лексичну надлишковість, покликану гарантувати правильне декодування семантики конденсату.

The problems of studying, preservation and rational use of natural resources in modern conditions are no less relevant than the issues of politics and economics, and are absolutely connected with them. The analysis of regulatory and legislative acts on the conservation of the planet's biodiversity is made.

The article examines the genesis of the Constitution of New Zealand, the formation of its constituent parts and the main sources of constitutional law; it generally profiles the Constitution. The article shows the mutual influence and interweaving of the components of the unconsolidated Constitution of New Zealand in contemporary conditions. In particular, the constitutional provisions presented in the Treaty of Waitangi are examined, and attention is focused on the contemporary problems of its current interpretation and application, although the historical context of its drafting and conclusion is shown. The article deals with the interpretation of some basic constitutional terms when using different official languages of New Zealand, first of all Maori and English tongues. In this regard, one of the urgent issues, which are being discussed quite widely in New Zealand, is the discrepancies found in the wording of fundamental constitutional provisions in the official texts of the Treaty of Waitangi in these two languages. The article examines a number of court decisions containing constitutionally significant precedents (stare decisis), including those on the application of the Treaty of Waitangi. The article shows how, as a result of the judicial complex interpretation of the Treaty of Waitangi and the legislation, the principles of the said Treaty have been developed. The article provides a general characterization of the laws and other regulatory legal acts that together form part of the unconsolidated Constitution of New Zealand. Special attention is paid to the 1986 Act of Constitution because of the importance of the constitutional issues regulated by this statute. The development of constitutional provisions in the 1986 Act of Constitution in comparison with the previous 1852 Act of Constitution is presented. At the same time, the laws, which are considered in New Zealand as an integral part of the Constitution, are summarized. The place and role of the laws of the United Kingdom of Great Britain and Northern Ireland in the modern Constitution of New Zealand are determined. Along with this, other regulatory legal acts that form part of the Constitution are being investigated, in particular, the Letters Patent and the Cabinet Manual. The article also presents New Zealand customs, which have constitutional significance, including conventional norms, and the peculiarities of their application.
