The legislation of Ukraine regulating activities related to the development of armaments and military equipment, as well as the performance of international military and technical cooperation, regarding the intellectual property protection, is analyzed. The necessity of the legislation improvement on the regulation of intellectual property protection issues in the defense sphere is noted.The development of military capabilities in the context of Ukraine's defense capacity, to a large extent, depends on the equipment of the Armed Forces of Ukraine with modern weapons and military equipment, which is created on the basis of intellectual property rights objects (hereinafter — IPR objects). The more complex a weapons and military equipment, the more IPR objects are used, which may belong to different subjects of intellectual property rights. Unlawful use of these IPR objects or other violations of intellectual property rights may lead not only to significant financial losses, but also to the loss of IPR objects themselves or to the prohibition of the use of weapons, which will negatively affect the defense capacity of the state.However, the experience has shown that the issues of intellectual property protection, especially in the defense sector, are not fully regulated, so many violations of intellectual property rights occur at each stage of the development of weapons and military equipment. These violations cause not only the mental and material losses of the authors of IPR objects and patent holders, but also affect the defense capacity of the state.
The objects of intellectual property rights that may belong to the national security sphere are considered, and a preliminary quantitative analysis has been carried out to determine the number of patents that could potentially be related to the sphere of national security and defense in the development of weapons and military equipment. For the analysis of patents for inventions and useful models, a specialized database of Ukrpatent «Inventions (useful models) in Ukraine» was used.A preliminary quantitative analysis was carried out to determine the number of patents that could potentially be considered for referring to the sphere of national security and defense, which determined that such objects could be no more than a thousand.The necessity of identifying patents that can be classified as national security and defense is indicated and to ensure proper control by the state for their use in order to prevent the transfer for next to nothing that could threaten national security. ; Рассмотрены объекты права интеллектуальной собственности, которые могут принадлежать к сфере национальной безопасности и обороны, а также проведен предварительный количественный анализ по определению возможного количества патентов, которые потенциально могут рассматриваться на предмет отнесения к сфере национальной безопасности и обороны. Some issues concerning the state administration of intellectual property in the field of national security and defense are considered. The legislation of Ukraine, which defines the principles of the statepolicy on the issues of national security and defense, concerning the intellectual property protection is analyzed. The importance of intellectual property protection and the need to improve the legislation on the regulation of intellectual property management issues in the field of national security and defense are noted. The comprehensive provision of national security and defense is a strategic taskfor the preservation of independence and development of the country nowadays. With the rapid development of scientific and technical as well as technological progress, all kinds of security are gaining the new meaning by including the need to ensure proper protection and management of intellectual property. Therefore, national security is impossible without considering and resolving the intellectual propertyproblems. Intellectual property itself is a connecting element in the chain between science that produces new knowledge and technology, and industrial production, where they are implemented. In addition, intellectual property objects fulfill an important function in ensuring the national defense capability, especially in the developmentof armament and military equipment and the implementation of international military-technical cooperation.Thereby ensuring state security is impossible without improving the system of legal protection and development of state administration in the process of using the objects of intellectual property rights, especially those contained in military and dual-use goods.To resolve this issue, it is necessary to implement into the legislation of Ukraine a set of laws regarding the provision of state intellectual property management that directly affects the national security of Ukraine and protects the interests of the state when creating objects of intellectual property rights in the defense sphere.The owner of such objects of intellectual property rights should be the state, and the administrator (custodian) of the property rights to such intellectual property is the state body with the delegated rights this purpose. Such an authority should have exclusive rights to intellectual property objects created under a public contract for public funds and receive limited rights to technical data related to national securityand received at the expense of the contractor for their use only by public authorities for public needs. ; Рассмотрены некоторые вопросы обеспечения государственного управления интеллектуальной собственностью в сфере национальной безопасности и обороны. In the case of violation of intellectual property rights, its protection is carried out in accordance with the procedure established by administrative, civil and criminal law.However, all these norms do not protect against possible violations of intellectual property rights, and all subjects involved in the development of armaments and military equipment — central executive authorities, acting as customers of the state defense order, enterprises and organizations that are developing (modernizing) of armament and military equipment, and employees of these enterprises, which themselves create objects of intellectual property rights.Responsibility of the customer for a number of violations of intellectual property rights in the development of weapons and military equipment is not defined.For violation of the conditions of the state contract, the parties' liability is stipulated. But the turn if in these conditions are not defined or not clearly defined, requirements for carrying out measures concerning the protection of intellectual property is not provided for liability. As a result, the customer may receive an example of armament and military equipment that is already morally obsolete and also with material claims.The foregoing results in the fact that when the customer executes the control over the execution of the state defense order, namely, measures to protect intellectual property, the availability of patent documentation for products and technology for its production are not verified, and moreover, the use of intellectual property created (used) in the course of execution the state contract, is carried out without a separate contract with the definition of the rights of the customer.The law also does not specify the responsibility of the executor for non-compliance with the requirements related to the protection of intellectual property rights in the execution of a state contract for state defense orders and the further use of intellectual property rights objects.This situation leads to the «leakage» of intellectual property rights from the legal market of goods, to the so-called "shadow" circulation of objects of intellectual property rights.The grounds for possible violations are laid down in the statutory documents of the developer, in particular the absence of a collective contract stacked in the organizations executing the state defense order, the provisions of the protection of intellectual property rights: (the exclusive property right for a service object of intellectual property rights belongs to the employer, and non-property rights belong to the authors who are paid the author's reward, the size, terms and procedure for payment of which are determined by an employment contract (contract) between the author and the employer). This contract in most cases doesn't set up, or there are no position of the size and procedure for payment of the author's remuneration for a service object of intellectual property rights.Uncertainty in collective and labor contract provisions regarding the observance of intellectual property rights leads to the loss of property rights, as well as non-proprietary rights to intellectual property rights, by authors, and non-remuneration for their use.However, the authors themselves may also violate the requirements of the law. Particularly, these violations are notable to the development of weapons and military equipment, as they can lead to the damage of the national interests of Ukraine. To date, the legislation does not define the responsibility of the authors of the service objects of intellectual property rights for the implementation of such violations.Thus, the issue of intellectual property protection, in particular regarding the definition of responsibility for the commission of offenses concerning the use of intellectual property rights in the defense sector, has been paid insufficient attention by our legislators, who have not been able (or not wanted) to solve existing problems in this area. And this is the most fundamental violation for which central (central and executive) central executive authorities responsible for developing state policy in the field of defense and ensuring its implementation, as well as specific officials of these central executive bodies, should be held accountable. After all, the lack of legislative regulation of the problems of intellectual property protection in the development of weapons and military equipment and in the process of military-technical cooperation leads to a number of violations. This is due to only one — the lack of attention and interest from the central executive authorities in ensuring the rights of the state and other entities in relation to objects of intellectual property rights, as is the case in the advanced countries of the world.The current state of intellectual property protection in the defense sector indicates the need to improve the regulation of issues of the formation and implementation of state policy, the principles of state control in this area, as well as the powers and responsibilities of all the subjects involved in the defense sector.The imperfection of the legal framework gives the legal possibility of unauthorized use of objects of intellectual property rights that are created when performing the state defense order, including (especially) the implementation of military-technical cooperation. This is facilitated by the lack of responsibility for actions that create a threat of violation of intellectual property rights or contribute to the violation.In order to warn and prevent violations of intellectual property rights, it is necessary to improve the legislative and normative-legal basis for the regulation of issues of intellectual property protection in the defense sphere.

This is what generates corruption and theft of the budget, even in the war, repairing roads in the rain or snow, and all our other disadvantages. Therefore, as long as we are not responsible for the violations committed, regardless of party affiliation or family and other ties, radical changes in the public life of our state will not occur. This also applies to violations of intellectual property rights.During the years of independence, Ukraine has not really formed a state policy on intellectual property, nor has developed strategies for the development of this important segment of public life. At the beginning, we laid the foundation and built our own structure, and for more than 10 years we reformed what was not completed. There is no strategic vision of what we want to achieve, so all changes and reforms take place in a haphazard and chaotic way. And because of this, the number of violations only increases, so our state can never completely get rid of the stigma of one of the biggest violators of intellectual property rights.The problem of responsibility for violating intellectual property rights is particularly important in the defense sector, although not everyone understands it. Indeed, when developing of armaments and military equipment and its subsequent using, especially when exported to other countries, significant financial losses for authors and producers, as well as image losses for the whole state are possible. And with the transition of our military-industrial complex from the repair and modernization of armaments and military equipment of Soviet standards, to the development of the latest models of own samples of armaments and military equipment or in cooperation with foreign partners, the issue of responsibility for the violation of intellectual property rights has become even more acute.The current state of intellectual property protection in the defense sector indicates the need to improve the regulation of issues of the formation and implementation of state policy, the principles of state control in this area, as well as the powers and responsibilities of all actors involved in the defense sector.The imperfection of the legal framework gives the legal possibility of unauthorized use of objects of intellectual property rights created during the execution of the state defense order, including (especially) the implementation of the military-technical cooperation. This is facilitated by the lack of responsibility for actions that create a threat of violation of intellectual property rights or contribute to the violation.The great amount of all violations can be prevented by state contractors with proper work on a contractual basis in the event of a responsible attitude towards ensuring national interests and proper performance of their functions by public officials. At the moment, possible actions or inaction of state-owned customers that directly violate the norms of intellectual property rights, or indirectly, the commission of which seems to have no direct relation, but leads in the future to serious violations of intellectual property rights.For solution of this problem is necessary to systematically and comprehensively approach the improvement of intellectual property legislation, especially regarding the definition of liability for violations in this area in the development and use of armaments and military equipment.

And with the transition of our military-industrial complex from the repair and modernization of armaments and military equipment of Soviet standards, to the development of the latest models of own samples of armaments and military equipment or in cooperation with foreign partners, the issue of responsibility for the violation of intellectual property rights has become even more acute.The current state of intellectual property protection in the defense sector indicates the need to improve the regulation of issues of the formation and implementation of state policy, the principles of state control in this area, as well as the powers and responsibilities of all actors involved in the defense sector.The imperfection of the legal framework gives the legal possibility of unauthorized use of objects of intellectual property rights created during the execution of the state defense order, including (especially) the implementation of the military-technical cooperation. This is facilitated by the lack of responsibility for actions that create a threat of violation of intellectual property rights or contribute to the violation.The great amount of all violations can be prevented by state contractors with proper work on a contractual basis in the event of a responsible attitude towards ensuring national interests and proper performance of their functions by public officials. At the moment, possible actions or inaction of state-owned customers that directly violate the norms of intellectual property rights, or indirectly, the commission of which seems to have no direct relation, but leads in the future to serious violations of intellectual property rights.For solution of this problem is necessary to systematically and comprehensively approach the improvement of intellectual property legislation, especially regarding the definition of liability for violations in this area in the development and use of armaments and military equipment. ; Рассмотрены положения законодательства Украины, регулирующие деятельность по разработке воружения и военной техники, а также осуществление международного военно-технического сотрудничества, относительно ответственности, предусмотреной за нарушения прав интеллектуальной собственности в оборонной сфере. Указано на важность усовершенствования законодательства касательно урегулирования вопросов ответственности за нарушения прав интеллектуальной собственности в оборонной сфере, а также разработаны предложения относительно его усовершенствования. ; Розглянуто норми законодавства України, що регулює діяльність, пов'язану з розробкою озброєння та військової техніки, а також здійсненням міжнародного військово-технічного співробітництва, щодо відповідальності, передбаченої за порушення прав інтелектуальної власності в оборонній сфері. Зазначено важливість удосконалення законодавства щодо врегулювання питань відповідальності за порушення прав інтелектуальної власності в оборонній сфері та розроблені пропозиції щодо його вдосконалення.
