Since Emmanuel Le Roy Ladurie's famous 'System of custom' article (Annales, 1972), the problem of customary geographies, an invention of lawyers, has so far become a common territory of historians, ethnologists and legal historians. The present text explores the intellectual origins of this problem in historiography and isolate three major presupposed premisses: the principle of family autonomy, the 'photographic' nature of legal sources and the cultural relativity attributed to the structures which the study of inheritance practices makes it possible to identify. Thus, the culturalist roots led, from Herder to Savigny, from Klimrath to Yver and Le Roy Ladurie itself, to a question about the concept of culture, both as a sign and cause for the geographical differentiation of social organisation norms. ; Ever since the famous article "Système de la coutume" by Emmanuel Le Roy Ladurie (Annales, 1972), the customary geographies issue has become a common ground for historians, ethnologists and legal historians. The present paper explores the intellectual origins of this problematic in historiography and stresses three major underlying aspects: the principle of autonomy of kinship systems, the "photographical" character of legal sources and the cultural relativity associated with the structures which the study of inheritance patterns allows to indentify. The "kind of association" embodied in the civilisation of human rights or human rights does not, as Taine had seen, attach to any of the forms of association that we have used to smild the law: family, community, ethnicity, nation, state or concert of nations. Yes, even the concert of nations, to which it owes its momentum since the Second World War, only determines how and not the essence of this civilisation, which everyone will agree to strike at the right corner of social, beneficial, peaceful and just progress. Who is in favour of the legal legitimacy of inequalities, discrimination, racism and oppression? If we stick to the principles for what they are, then we can seek to identify their causes and aims, beyond the moral dimension that they are. (First paragraph of Article) ; Le « genre d'association » qu'incarne la civilisation des droits de l'homme ou des droits humains ne s'attache, comme l'avait vu Taine, à aucune des formes d'association dont nous avons coutume de faire sourdre le droit : la famille, la communauté, l'ethnie, la nation, l'État ou le concert des nations. Oui, même le concert des nations, auquel elle doit son élan depuis la Seconde Guerre mondiale, ne détermine que les modalités et non l'essence de cette civilisation dont chacun s'accordera à trouver l'avènement frappé au bon coin du progrès social, bénéfique, pacifique et juste. Longtemps vouée aux thèmes ruraux ou « primitifs », l'idée de coutume connaît un regain de validité sur le terrain de la « question sociale » où semble se poursuivre son destin densément paradoxal, riche d'une pluralité de façons d'appréhender le temps et le droit de l'identité collective. Tributaire de la réflexion juridique, la coutume parcourt les siècles comme les théories, innerve en son coeur ou sur ses confins l'analyse historique et politique pour accompagner la genèse de l'anthropologie sociale et culturelle. Principale voie d'accès des profanes dans le domaine du droit, la coutume est en même temps en droit l'horizon conceptuel d'une pensée antidogmatique et antipositiviste. Polysémique, l'idée de coutume désigne aussi bien l'essence du droit que l'essence de la culture -- elle est alors universelle --, elle traduit aussi bien la relativité ethnique et la diversité populaire que le vecteur d'une unification nationale qui fait litière de cette diversité. C'est l'agencement de ces paradoxes que nous souhaitons tenter de restituer dans cet aperçu d'un concept à l'architecture si hospitalière qu'elle héberge volontiers une doctrine positive du droit, la critique de cette doctrine et une alternative anthropologique à la pensée juridique. Long time dedicated to rural or "primitive" themes, the idea of custom is regaining its validity on the ground of the "social issue", where it seems to continue its highly paradoxical destiny, rich in a plurality of ways of understanding time and the right of collective identity. Depending on legal thinking, custom runs through centuries such as theories, innerates historical and political analysis into its core or confines to accompany the genesis of social and cultural anthropology. At the same time, custom is the conceptual horizon of anti-dogmatic and anti-positivist thinking. Polysemic, the idea of custom refers to both the essence of law and the essence of culture — it is universal — it reflects both ethnic relativity and popular diversity as well as the vector of national unification that fosters this diversity. It is the arrangement of these paradoxes that we wish to try to restore in this overview of a concept to architecture so hospital that it is willing to host a positive doctrine of law, criticism of that doctrine and an anthropological alternative to legal thinking.
