Am 1. Februar 2022 präsentierte Amnesty International einen umfassenden Bericht, in dem es Israel vorwirft, an den Palästinenserinnen und Palästinensern Apartheid zu verüben und damit ein Verbrechen gegen die Menschlichkeit zu begehen. Der Amnesty-Bericht reiht sich ein in eine Serie von Publikationen palästinensischer, israelischer und internationaler Menschenrechtsorganisationen, die in Israel bzw. den palästinensischen Gebieten nunmehr die Schwelle zur Apartheid überschritten sehen. Dabei gehen die Meinungen in den einzelnen Berichten darüber auseinander, in welchem Gebiet solche Verbrechen gegen die Menschlichkeit begangen werden. Die Bundesregierung sollte sich den Apartheid-Vorwurf nicht ohne sorgfältige Prüfung zu eigen machen, die gravierenden Menschenrechtsverletzungen, die der Amnesty-Bericht dokumentiert, aber ernst nehmen. Daraus erwachsen Deutschland allein schon auf Basis der Genfer Konventionen direkte Rechtspflichten.

On 1 February 2022, Amnesty International released a comprehensive report claiming that Israel is engaged in apartheid against the Palestinians and is thereby committing a crime against humanity. The Amnesty report is one in a series of publications by Palestinian, Israeli and international human rights organizations that see the threshold to apartheid having been crossed in Israel and/or the Palestinian territories, although it should be noted that opinions about where such crimes are being committed differ from report to report. The EU and its member states should not adopt the apartheid claim without legal scrutiny. At the same time, they should take the grave human rights violations documented in the Amnesty report (and elsewhere) seriously. Under the Geneva Conventions, all signatory states incur direct legal obligations to enforce compliance.

2021 verspricht für Palästinenserinnen und Palästinenser nicht nur in den palästinensischen Gebieten, sondern auch weltweit ein Superwahljahr zu werden: Drei Urnengänge für die Institutionen der Palästinensischen Autonomiebehörde (PA) und der Palästinensischen Befreiungsorganisation (PLO) sind angekündigt worden. Noch ist unsicher, ob all diese Wahlgänge auch stattfinden werden. Dabei wären die PA-Wahlen von Bedeutung, um die junge Bevölkerung vor Ort einzubinden, wieder politische Verantwortlichkeit zu etablieren und zu einem gewaltenteiligen Regierungssystem zurückzukehren. Zukunftsweisend wären aber vor allem Wahlen für den Palästinensischen Nationalrat, das Exilparlament der PLO. Denn sie wären entscheidend, um ein repräsentatives Organ und die Basis für eine inklusive Diskussion über die künftige Strategie der Befreiungsbewegung und die Rolle der PA zu schaffen. Die EU und ihre Mitgliedstaaten fordern seit Jahren von der palästinensischen Führung, zum demokratischen Prozess zurückzukehren und die innerpalästinensische Spaltung zu überwinden. Sie sollten die Wahlen daher nicht nur durch Wahlbeobachtung unterstützen, sondern dazu beitragen, dass diese auch unter schwierigen Bedingungen so frei, allgemein, fair und kompetitiv wie möglich ablaufen.

2021 is shaping up to be a year of elections for the Palestinians, both in the Palestinian Territories and across the world. Three ballots are scheduled for the institutions of the Palestinian Authority (PA) and the Palestinian Liberation Organisation (PLO). It is still unclear whether they will all take place as planned. The PA elections certainly have an important role to play in integrating the younger generations in the Territories, restoring political accountability and reinstating democratic checks and balances. The elections to the Palestinian National Council - the PLO's parliament in exile - would be even more significant and a crucial step towards creating a representative organ and establishing the basis for an inclusive discussion about the liberation movement's future strategy and the role of the PA. The EU and its member states have been calling for years for the Palestinian leadership to revive the democratic process and overcome the Fatah/Hamas split. They should therefore not only support the elections with observers but also contribute actively to their being as free, fair and competitive as possible under the difficult circumstances.
