International audience ; 2018 is the year of reappearance on the Tunisian political scene of the cleavage between Islamists, which is structured around Ennahdha and anti-Islamists, who bring together a motley coalition of "secularists" grouping currents and personalities ranging from extreme left, to the liberals, passing by the left, the Arab nationalists, the bourguibists and certain figures of the former party of Ben Ali, the Constitutional Democratic Rally. In this conjuncture, Ennahdha appears at the beginning of 2019 as the political formation best placed in the electoral race, more particularly for the legislative poll, insofar as its participation in the government as a second partner in a coalition with Nidaa Tounes has been relatively beneficial to him. International audience ; In recent years, to manage the after-effects and disputes inherited from civil wars or authoritarian regimes, many rulers have been led to set up a so-called "transitional" justice. In the standard United Nations concept, the latter refers to the implementation of various practices aimed ultimately at creating the conditions for national reconciliation and democratic stabilization in countries emerging from episodes of political violence. More specifically, the democratization of political regimes is presented by the promoters of transitional justice as the guarantee of non-repetition of human rights violations. In this context, justice reform appears as a prerequisite for the independence of the judiciary and the right of people to a fair trial. Not far from ten years after the outbreak of the Arab revolts, what about the reform of justice and the implementation of transitional justice on the southern shore of the Mediterranean? ; Ces dernières années, pour gérer les séquelles et les contentieux hérités de guerres civiles ou de régimes autoritaires, de nombreux gouvernants ont été conduits à mettre en place une justice dite « transitionnelle ». Dans la conception standard des Nations unies, cette dernière renvoie à la mise en oeuvre de pratiques diverses visant in fine à créer les conditions d'une réconciliation nationale et d'une stabilisation démocratique dans des pays sortant d'épisodes de violence politique. The legal text was adopted following a conflictual process which took place between 2015 and 2016. The final text reflects the interactions between political elites who survived the fall of the Ben Ali regime, and others, often victims of repression but also judges, some of whom had served the authoritarian state as instruments of justice, and lawyers, a discredited profession under Ben Ali, many of whom benefited by supporting the 2010-2011 uprising, thereby gaining in professional stature. In the context of a volatile political scene, situational logic demonstrates how difficult it is to understand the Tunisian legal complex without first understanding the authoritarian trajectory of the Ben Ali regime. ; Cet article explore les mécanismes d'élaboration de la loi instituant le Conseil supérieur de la magistrature (CSM) en Tunisie. International audience ; By exploring the electoral techniques debated by Tunisian political actors, in order to define the conditions of a « good representation » of the « people », this article analyzes the social and political logics underlying the solutions proposed by representatives and rulers of post-Ben Ali Tunisia. Reciprocal relationships between local and national, or more precisely between marginalized regions and the political center, are one of the explanatory factors for the choice of electoral methods made by the rulers of post-Ben Ali Tunisia. The emergence of the « local » in the « national » is translated by the adoption of the first electoral law integrating the issue of the region and by the adoption of a largely decentralized state architecture. The new constitution paved the way for the organization of local collectives directed by elected councils for universal suffrage, and has encouraged actors of the post-Ben Ali political stage to cast a new regard on the effects of electoral methods on the operation of the local as well as national political scene. ; En s'intéressant ici aux techniques électorales débattues par les acteurs politiques tunisiens, cet article se propose d'analyser les logiques sociales et politiques sous-tendant les solutions proposées par les représentants et les gouvernants de la Tunisie post-Ben Ali pour définir les conditions d'une « bonne représentation » du « peuple ». As in 2015, Tunisia's political scene was marked in 2016 by the presidency of the regime. The search for presidential leadership, which had been affirmed in 2015, through the choice of the person to hold primacy, materialised in 2016 by the formation of two new governments, including a government of national union. In calling on his Prime Minister, Habib Essid, to carry out a major ministerial reshuffle, the President of the Republic, Beji Caïd Essebsi, intended to breathe new life into government action, while emphasising presidential leadership in the Executive. A few months later, by taking the initiative to change the head of government and to propose the establishment of a cabinet of national union, President Essebsi wished to position himself again as the master of the political game, the man through which Tunisia's exit from the economic marasme would pass. But that, however, this presidential approach of the regime does not mean the implementation of an effective method of government in the conduct of public action. Throughout the year, the Executive has been constantly overshadowed by recurrent social protests, which it has tried, albeit badly, to extinguish by making promises of employment in the public sector. In addition, the jihadist question was reminded of the good memory of power in early March with an attack by an armed group from Libya on the border city of Ben Guerdane.
