The author describes the division of functions among police, public prosecution
and criminal courts within criminal law enforcement in Germany adding some
comparative law remarks. He furthermore provides an overview of structure and
organization of the public prosecution in Germany. He focuses on the relationship and interaction between public prosecution and police in preliminary proceedings emphazising the importance of both being allocated in different ministries of the executive branch. Thus he points out yet another aspect of the constitutional principle of the Rule of Law: the role of public prosecution as guardian of the law towards the police in criminal proceedings." "The article deals with the responsibility of the financial sector under criminal law in Germany. This question has been of special interest since the beginning of the financial crisis. The author argues that the transactions of asset-backed securities based on
American subprime mortgages fulfill all legal elements of the criminal offence 'breach of trust' (Untreue). From the author's point of view, the people's legal loyalty would be severely affected if there were no criminal proceedings against such bankers who purchased those toxic asset-backed securities without sufficient information on their structure and value. Refraining from criminal prosecution even in cases causing high loss would send a dangerous signal towards the investment banking industry." (author's abstract)

Der in der rechtspolitischen Diskussion der 1990er Jahre zunächst abwertend gemeinte, als "Kampfbegriff" verwendete Terminus "Großer Lauschangriff" hat sich inzwischen bei Gegnern und Befürwortern weitgehend durchgesetzt. Er meint den Einsatz technischer Mittel zur akustischen Überwachung von Wohnungen. In dem vorliegenden Beitrag geht es in erster Linie um den "Großen Lauschangriff" als strafprozessuales Ermittlungsinstrument (Art. 13 Abs. 3 GG); jedoch wird die akustische Wohnraumüberwachung als Mittel der Gefahrenabwehr (Art. 13 Abs. 4, 5 GG) einbezogen. In dem Beitrag informiert der Autor aus rechtswissenschaftlicher Perspektive über die Entwicklung der Kriminalitätsbekämpfung in der Bundesrepublik Deutschland. In das Thema einführend werden zur Einordnung der hiesigen kriminalistischen Vorgehensweisen rechtsvergleichende Hinweise zur Entwicklung in den USA geliefert. Dabei wird auf eine wachsende Bedeutung verdeckter Ermittlungen seit Ende der 60er Jahre hingewiesen. Der Hauptteil beschäftigt sich sodann mit der kontinuierlichen Ausweitung verdeckter Ermittlungen in Deutschland seit 1968. Sie erstrecken sich über die Einführung der Telefonüberwachung und die Bekämpfung des Terrorismus ("RAF") sowie der Organisierten Kriminalität (OK) seit Anfang der 90er Jahre. Im Zuge der Bekämpfung der OK bzw. als Mittel der Gefahrenabwehr im Allgemeinen und zur Eigensicherung verdeckt operierender Personen im Besonderen kommt es zur (1) massiven Ausweitung des Ermittlungsinstrumentariums nach Landespolizeirecht, (2) zu Änderungen der Strafprozessordnung, (3) zur Einführung des Großen Lauschangriffs als strafprozessuale Ermittlungsmaßnahme und zur ausdrücklichen Legalisierung des präventiv-polizeilichen Großen Lauschangriffs sowie (4) zum Strafverfahrensänderungsgesetz 1999. In einem Resümee stellt der Autor fest, dass die kontinuierliche Ausweitung des Bereichs verdeckter Ermittlungen zum Zwecke effektiver Bekämpfung der OK, des Terrorismus und anderer schwerer Straftaten Anlass zur Sorge sein mag, zumal diese Ausweitung einhergeht mit einer bedenklichen Extension der Instrumente der Kriminalitätsbekämpfung hinein in den Bereich des Vorfeldes von Anfangsverdacht (als Erfordernis der Strafverfolgung) und konkreter Gefahr (als klassischem Erfordernis präventiv-polizeilicher Eingriffe). Gleichwohl sollte man angesichts der erwähnten kriminalpolitischen Zwänge und insbesondere wegen der tatsächlich effektiven Kontrolle durch unabhängige Gerichte vorsichtig mit dem Vorwurf des "Marsches in den Überwachungsstaat" sein.

The article deals with the untenable overloading of German criminal trial court judges presenting the overloading in detail and analyzing its reasons and consequences. In this context, serious failures by the German federal and state executive and legislative organs as well as undesirable developments of the Federal Constitutional Court's (BVerfG and the Federal Supreme Court of Justice's BGH) case law.

Die Autoren gehen einleitend auf die Bedeutung des vergleichenden Rechts bei strafrechtlichen Verfolgungen am Beispiel der USA und der Bundesrepublik Deutschland als rechtsexportierende Nationen sowie auf die Strafverfolgungen vor dem Hintergrund des NS-Regimes Hitlers im Dritten Reich und der stalinistischen Diktatur in der ehemaligen DDR ein. Im ersten Teil ihres Beitrages untersuchen sie das Strafrechtsverfahren und die Bundesverfassung in Deutschland, indem sie u. a. die Statuten der Konformität innerhalb der Verfassung interpretieren. Im zweiten Teil setzen sie sich ausführlicher mit der Europäischen Konvention zum Schutz der Menschenrechte und Grundfreiheiten auseinander und kommentieren jüngste Entscheidungen des Europäischen Gerichtshofs. Im Anhang ihres Beitrags dokumentieren sie grundlegende Gesetze aus der deutschen Bundesverfassung und der Europäischen Konvention zum Schutz der Menschenrechte. (ICG)

The UN Paris Agreement puts in place a legally binding mechanism to increase mitigation action over time. Countries put forward pledges called nationally determined contributions (NDC) whose impact is assessed in global stocktaking exercises. Subsequently, actions can then be strengthened in light of the Paris climate objective: limiting global mean temperature increase to well below 2 °C and pursuing efforts to limit it further to 1.5 °C. However, pledged actions are currently described ambiguously and this complicates the global stocktaking exercise. Here, we systematically explore possible interpretations of NDC assumptions, and show that this results in estimated emissions for 2030 ranging from 47 to 63 GtCO2e yr−1. We show that this uncertainty has critical implications for the feasibility and cost to limit warming well below 2 °C and further to 1.5 °C. Countries are currently working towards clarifying the modalities of future NDCs. We identify salient avenues to reduce the overall uncertainty by about 10 percentage points through simple, technical clarifications regarding energy accounting rules. Remaining uncertainties depend to a large extent on politically valid choices about how NDCs are expressed, and therefore raise the importance of a thorough and robust process that keeps track of where emissions are heading over time. ; ISSN:2041-1723
