Il presente contributo rappresenta l'intervento del Professor Maffettone al Forum del 2 Aprile 2009. L'autore affrontando il tema della centralitŕ della sostenibilitŕ nei valori della societŕ contemporanea, ripercorre il dibattito sull'etica dell'ambiente e propone la tesi che la sostenibilitŕ presenta gli stessi problemi che giŕ c'erano nell'approccio fondazionale dell'etica ambientalistica.

Résumé La théorie de la guerre juste, issue des élaborations médiévales, s'appuie sur les critères de la juste cause et de l'autorité compétente. La théorie politique moderne reformule les arguments de type moral ou religieux en termes politiques et légalistes tandis que la théorie politique contemporaine doit tenir compte du réalisme nouveau qui s'articule sur la notion de souveraineté et éventuellement le critiquer au nom d'une approche normative libérale. L'auteur analyse ici les éléments de la doctrine classique qui sont susceptibles d'être repris dans le cadre contemporain du paradigme légaliste. Examinant les situations d'intervention justifiées par des situations de violation systématique des droits humains, il énonce les conditions auxquelles une guerre est justifiable juste cause, autorité légitime et intention droite et, les appliquant à l'intervention américaine en Irak, peut avancer que s'il y avait de bonnes raisons de combattre Saddam Hussein, les Etats-Unis n'avaient aucun titre à s'en charger.

The just war theory, which grew out of medieval thought, is based on the criteria of just cause and appropriate authority. Modern political theory reformulates moral or religious arguments in political and legalistic terms, whereas contemporary political theory has to take into account the new realism, which hinges on the notion of sovereignty, and may have to critique it on behalf of a normative liberal approach. In this article, the author analyzes the elements of the classic doctrine that can be incorporated into the contemporary legalistic paradigm. Examining situations in which intervention is justified on the grounds of systematic violation of human rights, he applies the requirements for justifiable war just cause, appropriate authority and right intention to the US intervention in Iraq and finds that, even if there were good reasons for combating Saddam Hussein, the United States was by no means entitled to do so.
