Returning migrants without legal residence status to their countries of origin is high on the political agenda of Germany and the European Union. As well as seeking to increase the number of returns, policy efforts in this area also serve a symbolic function: They demonstrate that the state is upholding the rule of law and are regarded as an important means for stemming the growing popularity of political parties of the extreme right. In practice it is difficult to enforce the obligation to leave. Across Europe, governments succeed in only about one-third of cases. The lack of co­operation by countries of origin is regarded as one of the central reasons for this. The European Union is currently witnessing dynamic developments in the internal and external dimensions of return policy. The objective is to improve cooperation with countries of origin and make European processes more effective. The development, foreign policy and security costs associated with on­going efforts to increase the number of returns are often not adequately accounted for. For example pressure to cooperate on readmissions can endanger democratic transition processes in countries of origin and weaken European bargaining power in other areas. The study calls for a comprehensive cost/benefit analysis of return policy that addresses these potential trade-offs in a systematic manner - and that provides the basis for pragmatic discussions about alternatives to return. Eine Rekordzahl an Gewaltkonflikten verursacht wachsende Bedarfe an humanitärer Hilfe. Besonders deutlich zeigt sich dies in Fluchtkontexten. Angesichts knapper Mit­tel gibt es seit Jahrzehnten Versuche, Betroffene effektiver, effizienter und bedarfs­gerechter zu unterstützen. Dieses Ziel verfolgt auch der Humanitarian-Development-Peace-Nexus (HDP-Nexus), der humanitäre Hilfe und Entwicklung mit Friedensförderung ver­zahnen soll. Für Fluchtkontexte liegt der große Mehrwert des HDP-Nexus in seinem weiter gefassten Friedensanspruch. Dieser geht über soziale Kohäsion hin­aus und schafft Raum für politische Lösungen und Konflikttransformation. Letzteres ist Vor­aus­setzung für dauerhafte Lösungen für Menschen auf der Flucht. Die Bundes­regierung kann hier unter anderem durch Verbreitung und Vertiefung von Nexus-Exper­tise sowie verstärkte Rechenschaftslegung gegenüber Betroffenen aktiv unter­stützen. (Autorenreferat)

Record numbers of violent conflicts are causing growing needs for humanitarian aid, especially in situations of forced displacement. Given the scarcity of resources, many actors seek to provide more effective, efficient and needs-based support. That is also the objective of the humanitarian, development and peace nexus (HDP nexus). The main added value of the HDP nexus in situations of forced displacement lies in its com­prehensive perspective on peace, which extends beyond social cohesion and creates space for political solutions and conflict transformation. The latter is a precondition for durable solutions for forcibly displaced people. The German government can actively support this by disseminating and deepening nexus expertise and improving accountability to affected populations. (author's abstract)

Die EU-Kommission hat angekündigt, während der deutschen EU-Ratspräsidentschaft einen neuen "Pakt für Migration und Asyl" zu präsentieren. Erwartet werden Impulse für die lang ausstehende Reform des Gemeinsamen Europäischen Asylsystems, eine Stärkung der EU-Außengrenzen und die migrationspolitische Kooperation mit Dritt­staaten. Letzteres sehen viele Staaten der EU als besonders dringlich an, um Herkunfts­­länder zur Rückübernahme ausreisepflichtiger Staatsbürger zu bewegen. Neben posi­tiven Anreizen werden zunehmend Sanktionsmöglichkeiten gegenüber kooperations­unwilli­gen Drittstaaten diskutiert. Zwar können Strafmaßnahmen kurzfristig wirken, erschei­nen aber wenig nachhaltig und gefährden weitergehende Ziele der Europäischen Außen- und Entwicklungspolitik. Daher sollte sich Deutschland während seiner Rats­präsidentschaft eher für migrationspolitische Instrumente einsetzen, die einen langfristigen und fairen Interessenausgleich der EU mit Drittstaaten zum Ziel haben. The European Commission has announced plans to present a new "Pact on Migration and Asylum" during the German EU Council Presidency. It is expected to provide im­petus for the long-overdue reform of the Common European Asylum System, for the strengthening of the EU's external borders, and for improved cooperation on migra­tion policy with third countries. Many EU states see the latter as being particularly urgent in order to persuade countries of origin to readmit citizens who are obliged to leave the EU. In addition to positive incentives, sanctions against third countries that are unwilling to cooperate are increasingly being discussed. Although sanctions can have a short-term effect, they do not appear to be sustainable and can jeopardise more far-reaching goals of European foreign and development policy. Therefore, during its Presidency, Germany should instead advocate for migration policy instru­ments that aim to achieve a long-term and fair balance of interests between the EU and third countries. Obwohl sich die Staatengemeinschaft im Dezember 2018 mit dem Globalen Pakt für Flüchtlinge zum internationalen Flüchtlingsschutz bekannt hat, ist die Bereitschaft zur Aufnahme von Flüchtlingen welt­weit gesunken. Bei der Suche nach einem praktikablen Modus der Verantwortungs­teilung gibt es keinen Fortschritt. Mit Ausnahme Deutschlands sind die Hauptaufnahmeländer von Flüchtlingen ausschließlich Schwellen- und Entwicklungsländer. Da jedes Jahr mehr Menschen neu vertrieben werden als in ihre Heimat zurückkehren können, müssen die reicheren Länder mehr Verantwortung übernehmen. Dazu wäre es erforderlich, dass sie mehr Resettlement-Plätze zusagen und auch mehr öffentliche und private Finanzmittel bereitstellen, damit die ärmeren Aufnahmeländer entlastet werden. Hilfsorganisationen können jedoch regelmäßig nur noch einen Teil der benötigten Gelder einwerben. Als zweitgrößter Geber der humanitären Hilfe und Entwicklungszusammenarbeit sollte Deutschland international für eine Erhöhung der Finanzmittel und eine Steigerung der Wirksamkeit werben. Mit keinem der neuen Finanzierungsvorschläge allein wird man der Viel­zahl von Anforderungen gerecht werden können. Deshalb sollten neue und bereits vorhandene Finanzierungsinstrumente kombiniert werden. Die Bundesregierung sollte die Erfahrungen mit unterschiedlichen Finan­zierungsansätzen in der neuen "Fachkommission Fluchtursachen" sammeln und sich beim Globalen Flüchtlingsforum, das im Dezember 2019 erstmals stattfindet, für die Erarbeitung eines Zielkatalogs zu den verschiedenen Finanzierungsquellen einsetzen. The December 2018 Global Compact on Refugees reaffirmed the inter­national community's commitment to refugee protection - yet willing­ness to accept refugees is in decline globally.
No progress has been seen in the search for viable modes of responsibility-sharing. With the exception of Germany, all the main host countries are middle-income or developing countries.
In a situation where more people are forced to leave their homes than are able to return every year, the more affluent countries must shoulder more responsibility. That would mean pledging more resettlement places and increasing public and private funding to relieve the poorer host countries. Aid organisations regularly find themselves faced with funding shortfalls. As the second-largest donor of humanitarian and development funding, Germany should campaign internationally to expand the available finan­cial resources and improve the efficiency of their use. None of the new funding ideas will master the multitude of demands on their own. New and pre-existing financing instruments should therefore be combined.
The German government should collect experiences with the different funding approaches in its new Expert Commission on the Root Causes of Forced Displacement (Fachkommission Fluchtursachen). The Global Refugee Forum, which meets for the first time in December 2019, pro­vides an opportunity to start a discussion on new ways of mobilising the required funds for international refugee protection.
