Unlike in the sixties, today's clash of generations is not about creating (post-)materialistic values. It is about human species survival. The fear of decay (of the Empire through war) and the hope of revolution ( coming back a new to a starting configuration) are similar. Social State´s financial sustainability or the new generation of energy sources are partial problems. How to have justice for all, including the environment?, that´s a global problem. The main and also repressed question is about how climate change will impose new ways of living on us all.Political and cognitive alienation from the main human problems is pushing emotional responses in different directions. Alienation closes political systems from population and from it springs populist irrationality in politics, racist and sexist scapegoating, consumers street uprisings, etc. Considering the regulatory function of the law over technology, social exclusion, war, one can assess the way modern law focuses on intergeneration relationships and how a healthy environment has been dismissed as a human right. Marine species are highly susceptible to climate change as demonstrated by several studies. However, most of these studies focus on few species or on restricted geographical areas. Within this context, the main goal of my dissertation is to characterize global patterns and forecast the effects of climate change on marine biodiversity. This work is the first macroecological approach to investigate the effects of climate change in the marine realm on key commercial marine groups, namely coastal lobsters (125 species), cephalopods (161 species) and small pelagic fish (103 species). Here I aimed to improve our understanding of how projected changes in species distribution might affect key marine species diversity, body size, assemblage composition, variations in catch, and finally infer on the potential impacts for fisheries worldwide. Using Ecological Niche Models (ENMs) the projected global diversity patterns of the analyzed species generally showed higher values in tropical areas and lower values in higher latitudes. Nonetheless, these patterns were projected to change significantly by the end of the century, with a general tendency of species tracking adequate habitat suitability to higher latitudes. The results obtained provide critical information to anticipate negative impacts of climate change on marine biodiversity and should be considered in future studies, as they highlight climate hot-spot areas or with highly vulnerable species. Ultimately, it is crucial to evaluate species adaptation potential and develop hybrid models that better can guide future political decisions on conservation and management measures; RESUMO: Padrões globais da biodiversidade marinha e o potencial impacto das alterações climáticas As espécies marinhas são altamente suscetíveis às alterações climáticas, como demonstrado em numerosos estudos. Porém muitos desses estudos focam-se num número reduzido de espécies ou numa determinada área geográfica (local ou regional). Neste contexto, a presente dissertação tem como objetivo investigar os padrões globais de biodiversidade marinha e projetar como estes poderão estar modificados no final do século. Este trabalho constitui a primeira abordagem macroecológica que investiga, numa escala global, os impactos das alterações climáticas em taxa marinhos com alto interesse económico, como lagostas (125 espécies), cefalópodes (161 espécies) e pequenos peixes pelágicos (103 espécies). Os padrões globais de biodiversidade marinha para todos os taxa analisados mostram maior riqueza na zona dos trópicos e menor número de espécies nas maiores latitudes. No entanto, estes padrões podem sofrer modificações significativas até ao final do século verificando-se uma tendência generalizada das espécies migrarem para latitudes maiores de forma a encontrarem refúgio em áreas com boa adequação ambiental. Os modelos usados nesta tese (modelos de nicho ecológico) projetam alterações significativas na distribuição das espécies analisadas, com impactos profundos na riqueza e abundância em áreas vitais para a saúde dos oceanos e para as pescas, a longo prazo. Esta dissertação representa um contributo importante para o conhecimento dos padrões globais da biodiversidade nos oceanos futuros. Servindo os seus resultados para orientar estudos pormenorizados em áreas de risco elevado ou com espécies mais vulneráveis e informar a tomada de decisões com vista a proteção de espécies marinhas com elevado valor económico e ambiental. Contudo, atendendo aos efeitos das alterações climáticas já sentidos nos oceanos, é crucial avaliar a capacidade de adaptação destas espécies e encontrar modelos híbridos que melhor nos permitam orientar medidas de gestão e conservação futuras.

Intellectual Property rights are expanding and, thus, overlapping more than ever before. This poses challenges to a system devised as comprising a set of isolated compartments, each with its defined purpose.The diverging rules concerning ownership and entitlement can lead to different rights on the same object being owned by different persons. What happens then? This question is addressed under European law, focusing on the existing corpus of EU primary and secondary legislation and jurisprudence and the national laws of France, Germany and the UK.Five specific cases are considereded: trade marks and designs, trade marks and copyright, designs and copyright, data-base sui generis right and copyright and copyright and patents in the field of computer programs.Some solutions to the problem, namely convergence of ownership rules, avoidance of overlaps, prevalence of the closest regime, abuse of rights, implied licences, and expanding copyright solutions by analogy, are analysed.

Case C-34/10 Brüstle v. Greenpeace1.Article 6(2)(c) of Directive 98/44/EC of the European Parliament and of the Council of 6 July 1998 on the legal protection of biotechnological inventions must be interpreted as meaning that:–any human ovum after fertilisation, any non-fertilised human ovum into which the cell nucleus from a mature human cell has been transplanted, and any non-fertilised human ovum whose division and further development have been stimulated by parthenogenesis constitute a 'human embryo';–it is for the referring court to ascertain, in the light of scientific developments, whether a stem cell obtained from a human embryo at the blastocyst stage constitutes a 'human embryo' within the meaning of Article 6(2)(c) of Directive 98/44.2.The exclusion from patentability concerning the use of human embryos for industrial or commercial purposes set out in Article 6(2)(c) of Directive 98/44 also covers the use of human embryos for purposes of scientific research, only use for therapeutic or diagnostic purposes which is applied to the human embryo and is useful to it being patentable.3.Article 6(2)(c) of Directive 98/44 excludes an invention from patentability where the technical teaching which is the subject-matter of the patent application requires the prior destruction of human embryos or their use as base material, whatever the stage at which that takes place and even if the description of the technical teaching claimed does not refer to the use of human embryos.
Stock Markets are one of today ́s greatest asset for investors, nonetheless, Political Events can be one of today ́s biggest challenge, as they add a crucial component: Uncertainty. This study aims to understand the impact of (Portuguese) Political Events on the Portuguese Stock Market. Specifically, it investigates the complex relations between these concepts, while analyzing how developments in each field both influence and are influenced by each other. To provide relevant conclusions, an extensive literature review regarding classical theories and past academic works was carried, as well as, considerations regarding a more recent approach to stock markets: Sentimental Analysis. Furthermore, a statistical analysis was performed using two different methodologies; Event Study and the Regression Analysis. The results obtained show that are significant influences and connections between Political Events and the Portuguese Stock Index (PSI-Geral): On this basis, conclusions were drawn such as Regional Elections impact positively the Index, on the other hand, European Elections have a negative impact. Another main conclusion is that Negative Political News have more weight that Positive Political News. This study intends to provide relevant information to market investors in the evaluation process for future investments. ; As Bolsas de Valores são um dos maiores trunfos atuais para os investidores, no entanto, os Eventos Políticos podem ser um dos maiores desafios atuais, uma vez que acrescentam uma componente crucial: Incerteza. Este estudo visa compreender o impacto dos Eventos Políticos (portugueses) na Bolsa de Valores Portuguesa. Especificamente, investiga as complexas relações entre estes conceitos, analisando ao mesmo tempo como os desenvolvimentos em cada campo influenciam e são influenciados um pelo outro. De modo a obter conclusões relevantes, foi feita uma extensa revisão bibliográfica sobre teorias clássicas e trabalhos académicos passados, bem como considerações sobre uma abordagem mais recente aos mercados bolsistas: Análise Sentimental. Além disso, foi realizada uma análise estatística utilizando duas metodologias diferentes: o Estudo de Eventos e a Análise de Regressão. Os resultados obtidos indicam que de facto, existem influências e ligações significativas entre Eventos Políticos e o Índice Geral para o mercado acionista Português (PSI-Geral): Nesta base, foram retiradas conclusões, tais como: o impacto positivo das Eleições Autárquicas no Índice e por outro lado, o impacto negativo das Eleições Europeias no Índice. Outra conclusão a mencionar, as Notícias Políticas Negativas têm mais peso que as Notícias Políticas Positivas. Este estudo pretende fornecer informações relevantes aos investidores do mercado no processo de avaliação para investimentos futuros.

Para um destino que pretenda construir um forte relacionamento com o consumidor LGBT é vital o conhecimento do mercado. O envolvimento e atração do mercado LGBT, independentemente da sua motivação, deve ter como foco central a criação de um ambiente seguro e acolhedor para os viajantes LGBT, interagindo com compreensão e respeito. Este estudo pretende analisar as especificidades deste segmento e a sua aceitação no domínio da oferta de alojamento no Norte de Portugal, através de contactos por e-mail por parte de dois casais ficcionados e distintos – um LGBT e outro heterossexual. Mediante a solicitação de informação e disponibilidade de alojamento por parte destes casais, obtiveram-se resultados que indiciam condutas discriminatórias perante a homossexualidade manifestadas pela não resposta/negação ao acesso ao alojamento. Não obstante, quando obtendo resposta não se observam comportamentos menos amigáveis, afetuosos, atenciosos ou hospitaleiros, nem sequer deficit de qualidade nas respostas.
