International audience ; Due to the Covid-19 pandemic and being one of the most affected countries, Brazil is witnessing a normative inflation. This article lists and analyzes the legal norms that have recently emerged in this area. It provides an overview of the Brazilian federal government's anti-science strategy. ; En raison de la pandémie de Covid-19 et étant l'un des pays les plus touchés, le Brésil assiste à une inflation normative. Cet article répertorie et analyse les normes juridiques récemment dégagées en la matière. Il permet d'avoir une vue d'ensemble de la stratégie du gouvernement fédéral brésilien, ce dernier étant anti-scientifique.

By early-2016, the international community began to pressure Brazil for a stronger policy response to Zika. In contrast to what was seen in the past, however, these international pressures did not elicit such a response. In this article, we explore why this was the case, reviewing the government's policy response and the broader political and economic context shaping this response. The authors used single case study analysis and qualitative sources, such as books, journal articles, and government policy reports to support their empirical claims. We found that despite increased international pressures from the WHO, domestic political factors and economic recession hampered the government's ability to strengthen its health systems response to Zika. Consequently, those states most afflicted by Zika have seen policy initiatives that lack sufficient funding, administrative and human resource capacity. This study revealed that despite a government's deep foreign policy history of positively responding to international pressures through a stronger policy response to health epidemics, a sudden change in government, rising political instability, and economic recession can motivate governments to abandon this foreign policy tradition and undermine its response to new public health threats.

The article probes the origins and content of the Framework of Engagement with Non-State Actors (FENSA) of the World Health Organization (WHO), approved on May 28, 2016, at the 69th World Health Assembly, which established different rules of collaboration to four categories of actors: nongovernmental organizations (NGOs), private sector entities, philanthropic foundations, and academic institutions. Applying the findings of International Legal Theory and based on extensive documentary research, we sought to determine whether FENSA is an appropriate accountability mechanism according to four functions of accountability: constitutional, democratic, epistemic, and populist. The article concludes that there is a risk of the prevalence of the populist function at the expense of the accountability potential that could result from the better use of the other three accountability functions.

A inclusão da saúde pública na ordem do dia dos movimentos sociais, em especial a resistência ao processo de globalização, coincide com um impasse na evolução da liberalização do comércio mundial, diante da inexistência de consenso entre os Estados sobre a questão agrícola. O princípio da precaução surge nessa complexa equação como obstáculo ao livre-comércio ou pode ser interpretado como forma de mascarar o protecionismo que caracteriza os Estados desenvolvidos.

AbstractThe implantation of a public system of universal access to care has been the most significant contribution from the health sector to Brazil's democratization, and its diffusion through foreign policy raised the country to a status as a global health leader. Yet, the rise of a far‐right government impinges a fracture upon this dual process, through the renunciation of leading roles in both regional and wider progressive initiatives. Based on documental and literature analysis guided by exploratory interviews with global health agents, this article introduces the actors responsible for the alignment between foreign policy and the Unified Health System principles and demonstrates that a significant retrenchment of diplomatic activity paved the way for the renunciation of protagonism in progressive agendas. The process began with the shutdown of Unasur Health and public opposition to the sexual and reproductive rights agenda and culminated in the felonious emptying of technical cadres from the Ministry of Health and the change of position on intellectual property issues related to public health during the Covid‐19 pandemic.

La estrategia institucional de propagación de la Covid-19 implementada por el gobierno federal brasileño es una expresión radical del neoliberalismo en el campo de la salud, definida como neoliberalismo epidemiológico. Esta promoción de la inmunización masiva por contagio, considerada científicamente equivocada y éticamente inaceptable, se opone de manera frontal a las recomendaciones de la Organización Mundial de la Salud (oms). La renuncia al liderazgo pretérito de Brasil en temas de salud global y de cooperación regional en salud se explica también por el carácter ideológico de su nueva política exterior y a la militarización del Ministerio de la Salud.

Para responder a esta pergunta, o presente ensaio, situado na interface entre o direito internacional penal e a saúde global, resgata um passado de práticas delituosas no campo sanitário para apontar, no presente, a determinação política e ideológica das respostas nacionais à Covid-19. A seguir, recorre ao pensamento de Hannah Arendt e Mireille Delmas-Marty para tratar do caráter evolutivo dos crimes contra a humanidade, como base para a análise de um caso paradigmático: a resposta brasileira à pandemia de Covid-19, cujas condutas governamentais são apresentadas à luz de elementos como contexto, actus reus e mens rea.

Resumo A Lei n. 13.979, de 6 de fevereiro de 2020, regula medidas de saúde pública relacionadas à emergência do novo coronavírus com alto potencial restritivo de direitos fundamentais, inclusive a quarentena e o isolamento. Esta análise crítica aborda a dimensão internacional da emergência, além da tramitação casuística e antidemocrática da lei brasileira. Com base na legislação epidemiológica em vigor, escrutina estas medidas excepcionais e as salvaguardas à sua implementação.

The deteriorating political and economic situation in Venezuela has ramifications far beyond the Latin American country's borders as almost five million Venezuelans fled and migrated into countries in the region due to the crisis at home. The scarcity of health services, the lack of information sharing, and the absence of reliable data in Venezuela create challenges for confronting developing health emergencies and disease outbreaks. The need for accurate data is especially dire given the current COVID-19 pandemic and evolving movement of refugees. While countries and international organizations came together to form a coordinated response to Venezuela's political and humanitarian crisis, this geopolitical progress is threatened by the rapid spread of COVID-19, and the instinct for countries to focus inwards on domestic response priorities, rather than engage in regional cooperation. It is critical that the international community set aside geopolitical differences and cooperate to seek an accurate picture of the conditions on the ground to improve the welfare of Venezuelan migrants and to provide a more robust response to the current pandemic.

Abstract Among the possible developments of the Covid-19 pandemic at the international and national levels is the advancement of the Global Health Security (GHS) agenda. On the one hand, GHS might be able to give priority to health problems on the political agenda-setting, on the other, however, it might open up space for public security actors in decision-making processes to the detriment of the power of health authorities. This article critically analyzes the concept and the progress of the GHS agenda seeking to demonstrate that there can be no security in matters of public health when sustainability in its multiple dimensions is not taken into account. At the end, sustainability has a twofold responsibility: to maintain the consistency and permanence of emergency response actions, especially with investments in public health systems, with universal access, and to minimize the structural causes of pandemics linked to the environment.
