ABSTRACT
This article argues that international human rights (quasi-)adjudicatory institutions should do better in considering the best interests of the child and freedom of religion in cases involving human rights aspects of alternative care and adoption. The European Court of Human Rights, particularly, has been using obscure and contradictory standards, which ultimately do not privilege the child's best interests in matters affecting them directly. Recent Grand Chamber jurisprudence instead puts parents' interests above the child's. A child-centred approach where children are not objectified, but treated as autonomous, rights-bearing, legal persons, with independent interests that may override those of other stakeholders is needed. This article explores general international and European rules governing children's religious rights in alternative care and adoption to expose the Court's pitfalls in centring children in decision-making involving religion particularly. It generally promotes adoption of a child-centred approach in international human rights courts, and particularly highlights existing hurdles in such approach where the decision-making involves conflicting interests concerning religion.

Abstract
This article shows how antifeminism manifested during the covid-19 pandemic and played an integrative role for pandemic-deniers. It first explains how antifeminism was understood and shows that antifeminist actors often used alleged concerns about child welfare to legitimize and morally enhance their own political views. Subsequently, the results of a systematic study of various antifeminist actors such as Birgit Kelle, Beatrix von Storch, Demo für Alle (Protest for all), and Eltern Stehen Auf (Parents Rise) from the pandemic denial spectrum are presented and compared to each other. Further analyses of the Querdenken protests make it clear that some narratives of antifeminist actors were also taken up by Querdenken members, and that in this way various alliances were able to emerge.

The Children and Families Act 2014 has introduced a 26-week timeline for Children Act 1989 care and supervision court cases. This article discusses the risks and possible ramifications for children and parents of this measure, which halves the average length of care proceedings. This is to be set against evidence that faster resolution of children's cases is possible without prejudicing the quality of court decision making; however, careful monitoring is indicated to ensure that child welfare is at the forefront in the decision making process and the individual rights of all concerned are protected.

AbstractNew York Domestic Relations Law Section 110, which outlines who can adopt, precludes married petitioners from adopting without their spouse joining in the adoption petition, even when all parties involved support the adoption, and it is in the child's best interests. Some judges have prioritized the child's best interests and granted adoptions in such cases, while others have rigidly construed the statute and denied them. Amending the statute so that anyone can adopt, regardless of marital status, if it is in the child's best interests would ensure the child's best interests are the judicial system's primary consideration in approving adoptions.

The article is devoted to the study of the concept "best interests of the child" and their providing in the court proceedings on adoption. Analyzes the international and national documents in the field of adoption in terms of the normative consolidation this concept. It is noted that the highest priority is given to the best interests of the child, established in Art. 3 of the Convention on the Rights of the Child. This is an included principle underlying the implementation of all rights enshrined in the Convention. Thus, in the recommendations of the Committee of Ministers of the Council of Europe, guaranteeing the best interests of the child is considered by the court as a guideline for the all actions concerning children and adoption also.Methodological basis for this study is a set of scientific methods, among which the main are the methods of system and comparative legal analysis, logical comparison, and matching.Due to the absence of a complete content of "best interests of the child" in the national legislation, examples of the definition this principle by the domestic scientists are given. The author makes a scientific supposition about the legal nature of "best interests of the child" in the civil process. The national judicial practice of application and interpretation of the principle of "best interests of the child" in the case of adoption cases is analyzed.The result of the study is the discovery of disagreements in the terminology of the national legal framework, and therefore the author concludes that there is a need to make appropriate modifications in order to formulate a uniform judicial practice and further scientific research of the "best interests of the child" at the review of cases on adoption by the court. ; В статье рассматривается содержание понятия «наилучшие интересы ребенка» и его нормативное закрепление в национальном и международном праве. Исходя из отсутствия закрепления исчерпывающего содержания данного принципа в нормативно-правовых актах, наводятся примеры определения «содержание наилучших интересов ребенка» отечественных ученых. Анализируется судебная практика применения и интерпретации принципа при рассмотрение судами дел об усыновлении. Автор приходит к выводу о том, что необходимо откорректировать терминологию национальной законодательной базы во избежание неодинакового практического применения и дальнейшего научного исследования данного принципа ; У статті розглядається зміст поняття «найкращі інтереси дитини» та його нормативне закріплення в національному і міжнародному праві. Виходячи з відсутності закріплення вичерпного змісту «найкращих інтересів дитини» в національному законодавстві, наводяться приклади визначення даного принципу вітчизняних вчених. Автором робиться наукове припущення щодо правової природи «найкращих інтересів дитини» у цивільному процесі. Аналізується національна судова практика застосування та інтерпретації принципу «найкращих інтересів дитини» при розгляді справ про усиновлення. Автор приходить до висновку про необхідність внесення змін до національної законодавчої бази з метою формування єдиної судової практики і подальшого наукового дослідження даного принципу при розгляді судом справ про усиновлення.
