Fritz Oser und seine Mitarbeiter und Mitarbeiterinnen werfen seit Jahren Fragen zur politischen Bildung Jugendlicher auf – Schweiz bezogene und international vergleichende. Die in Freiburg weit vorangetriebene Lern-, Lehr-, Fehler-, Bildungs- – kurz Befähigungsforschung und -beratung brachte im Jahr 2000 das von Oser und Roland Reichenbach verfasste Buch zur Situation der politischen Bildung in der Schweiz hervor. Das Fazit fiel damals «sehr ernüchternd» aus: Gefässe – beispielsweise der Geschichtsunterricht –, in denen politische Bildung Eingang in die Lehrpläne findet, seien in den letzten Jahren zugunsten anderer Fächer eingeengt worden. Politische Bildung verschwinde an manchen Orten gänzlich aus dem Curriculum oder werde trotz Positionierung in den Lehrplänen nicht umgesetzt. Auch die vereinzelt verfolgte Strategie eines Mainstreaming politischer Bildung schlage in der Regel fehl. Dies seien sowohl Ursache als auch Symptom der vernachlässigbaren Bedeutung politischer Bildung in der politischen Prioritätenliste wie auch im schulischen Alltag. (DIPF/Orig.)

AbstractHumanitarian actors sometimes have to decide whether to render assistance in situations that put them at risk of liability for aiding and abetting under international criminal law. This is the problem of the virtuous accomplice—the idea that knowingly contributing to the wrongdoing of others might, exceptionally, be the right thing to do. This article explains why the problem arises and clarifies its scope, before turning to criminal law in England and Wales and Germany to assess potential solutions. It argues that the best approach is to accept a defence of necessity—of justified complicity—and shows that such an argument works in international criminal law.

The United Nations Declaration on the Rights of Indigenous Peoples is seen primarily as an international human rights instrument. However, the Declaration also encompasses cultural, social and economic rights. Taken in the context of international trade and investment, the UN Declaration is a valuable tool to support economic self-determination of Indigenous peoples. This volume explores the emergence of Indigenous peoples' participation in international trade and investment, as well as how it is shaping legal instruments in environment and trade, intellectual property and traditional knowledge. One theme that is explored is agency. From amicus interventions at the World Trade Organization to developing a future precedent for a 'Trade and Indigenous Peoples Chapter', Indigenous peoples are asserting their right to patriciate in decision-making.
