Tämän tutkimuksen keskiössä ovat aluetason hallitusten kansainväliset yhteistyöorganisaatiot. Tutkimuksella valotetaan niiden toimijaroolia Itämeren makroalueen monitasoisessa hallintojärjestelmässä ja sen jatkokehittämiseksi. Tutkimuksen kohteena olevat organisaatiot edustavat aluetason poliittisia päätöksentekoelimiä analysoiden kaksi maaesimerkkiä: vaaleilla suoraan valittuja päätöksentekoelimiä federalistisen Saksan osavaltioissa, ja vaalien perusteella nimitettyjä poliittisia päätöksentekoelimiä unitaristisen Suomen maakuntien liitoissa. Tämä Q-tutkimus selvittää aluetason hallitusten kansainvälisten yhteistyöorganisaatioiden sihteeristöjen sekä saksalaisten ja suomalaisten jäsenalueiden edustajien subjektiivisia näkemyksiä näiden yhteistyöorganisaatioiden roolista alueellisella, kansallisella ja Euroopan unionin tasoilla. Arvioin työssäni monitasoista hallintojärjestelmää erilaisten teoreettisten lähestymistapojen valossa. Samalla peilaan keskustelua monitasoisen hallintojärjestelmän määritelmästä ja sisällöistä suhteessa niistä kirjallisuudessa esitettyihin erilaisiin tulkintoihin ja soveltamistapoihin. Kriittisen tarkastelun kohteena on kolme keskeistä politiikan välinettä, joita käytetään Itämeren makroalueen monitasoisessa hallintojärjestelmässä: kumppanuusperiaate, Euroopan unionin Itämeri-strategia ja Euroopan aluekehittämisen seurantaverkoston (ESPON) käsikirja alueellista hallintajärjestelmää varten. Nämä politiikan välineet luovat sitä empiiristä kontekstia, joka mahdollistaa aluetason hallitusten kansainvälisten yhteistyöorganisaatioiden nykyroolin analysoinnin Itämeren makroalueen monitasoisen hallintojärjestelmän kontekstissa. Samalla yllä mainitut politiikan välineet muodostavat arvokkaan lähdemateriaalin tutkimuksen metodologian tueksi. Aluetason hallitusten kansainvälisten yhteistyöorganisaatioiden sekä niiden suomalaisten ja saksalaisten jäsenalueiden edustajien subjektiivisten näkemysten tutkimiseen käytän Q-metodologiaa. Metodologisen analyysin tulosten perusteella löytyi neljä faktoria (i) "Monitasoisen hallintajärjestelmän rakentajat EU:n Itämeri-strategian avulla", (ii) "Strategisten hankkeiden edistäjät", (iii) "Aluekehittämistavoitteiden edunvalvojat" ja (iv) "Jäsenalueiden älykkään erikoistumisen edistäjät". Faktorit ilmentävät yhteistyöorganisaatioiden tehtäviä, koordinaatio-ongelmia monitasoisessa hallintojärjestelmässä sekä työskentelytapojen muutostarpeita Itämeren makroalueen muuttuvassa operationaalisessa viitekehyksessä. Faktoreille yhteiset konsensusväittämäklusterit toivat esiin lukuisia näiden yhteistyöorganisaatioiden toimintaan liittyviä ongelmia: näkyvyydessä ja sitoutumisessa horisontaaliseen ja vertikaaliseen viestintään; makroalueellisessa koordinaatiossa ja yhteistyössä kansallisen tason hallitustenvälisten yhteistyöorganisaatioiden kanssa; Euroopan unionin rahoitusvälineiden hyödyntämisessä; maantieteellisessä edustavuudessa ja poliittisen legimiteetin puolustamisessa sekä voimavarojen tehokkaammassa käytössä. Tämä tutkimus osoittaa, että aluetason hallitusten kansainväliset yhteistyöorganisaatiot kohtaavat useita ongelmia, ja etteivät ne ole vielä täysin sopeutuneet Itämeren makroalueen muuttuvaan operationaaliseen viitekehykseen, eivätkä Euroopan unionin nykyisiin politiikan välineisiin ja prosesseihin. Tulokset osoittavat myös, että nykyistä Itämeren makroalueen monitasoista hallintojärjestelmää voi luonnehtia melko valtiokeskeiseksi ja ylhäältä alaspäin ohjatuksi. Monitasoinen hallintajärjestelmä ei ole optimaalisesti toimiva aluetason hallitusten kansainvälisten yhteistyöorganisaatioiden eikä niiden jäsenalueiden näkökulmasta. Dikotomia hallitustenvälisyyden ja monitasoisen hallintojärjestelmän teoreettisten lähestymistapojen välillä ilmentää jännitteitä eri politiikan osa-alueilla, eri politiikkojen laadinnassa ja käytäntöön soveltamisessa. Poliittinen ja perustuslaillinen viitekehys vaikuttaa myös selkeästi yhteistyöorganisaatioiden jäsenalueiden valtuuksiin ja vastuisiin omissa maissaan, ja siihen, kuinka ne voivat toimia niissä, sekä siihen millaisen aseman jäsenalueet mahdollistavat näille yhteistyöorganisaatioille monitasoisessa hallintojärjestelmässä. Käynnissä oleva Suomen sosiaali-, terveyspalvelu- ja maakuntauudistus tarjoaa mielenkiintoisen esimerkin siitä, kuinka muutos poliittisessa ja perustuslaillisessa viitekehyksessä voisi vahvistaa maakuntien toimintamahdollisuuksia aluetason hallitusten kansainvälisten yhteistyöorganisaatioiden kautta Itämeren makroalueen monitasoisessa hallintojärjestelmässä. Tutkimuksen tuloksiin pohjautuen esitän lopuksi seitsemän yleisesti sovellettavaa politiikkasuositusta aluetason toimijoille. Suositukset perustuvat tämän Q-tutkimuksen osallistujien subjektiivisiin näkemyksiin, teoreettiseen keskusteluun ja aiempiin tutkimuksiin kansallisen tason hallitusten välisistä yhteistyöorganisaatioista. Politiikkasuositusten tarkoituksena on esittää aloitteita aluetason hallitusten kansainvälisten yhteistyöorganisaatioiden työn jatkokehittämiseen, sekä niiden prioriteettien ja yhteistyömuotojen uudelleen arviointiin monitasoisen hallintojärjestelmän rakenteissa. ; This study has international cooperation organizations of regional governments (ICORGs) in focus and examines their role in the present multi-level governance (MLG) system of the Baltic Sea macro-region while also seeking to develop MLG system further. The study focuses on ICORGs representing regional governments, analysing two specific country-cases: elected political bodies of Länder in the Federal Republic of Germany, and nominated political bodies of Regional Councils in the unitary Republic of Finland. In particular, the study examines the subjective views of representatives of the ICORG secretariats, Finnish regions, and German Länder in relation to the regional, national, and EU levels of MLG. In this work, I evaluate MLG through different theoretical approaches, reflecting the ongoing debate over the definition and contents of MLG arising from different interpretations and applications of the concept in the literature. I critically assess and examine the partnership principle, the EU Strategy for the Baltic Sea Region (EUSBSR), and the European Observation Network for Territorial Development and Cohesion (i.e., European Spatial Planning Observation Network/ESPON) Handbook for Territorial Governance. These policy instruments serve as the empirical context of the study, and hence documents concerning their activities form part of the primary material enabling the methodological analysis of the current role of the ICORGs in the Baltic Sea macro-regional MLG context. I use a Q methodological approach to study the subjective views of representatives of the ICORGs studied and of their Finnish and German member regions. Based on the results of the methodological analysis and the factor interpretation, four factors were extracted: (i) "Builders of the MLG through the EUSBSR," (ii) "Facilitators of Strategic Projects," (iii) "Lobbyists for Regional Development Objectives," and (iv) "Promoters for Smart Specialization in their Member Regions." The factors reveal ICORGs´ tasks, respond to their coordination problems, and meet the need for them to change their working methods within the changing operational context in the Baltic Sea macro-region. The clusters of the "consensus-like-items" shared by all factors opened up for the ICORGs challenges in visibility and commitment to horizontal and vertical communication; in macro-regional coordination and cooperation with intergovernmental organizations (IGOs); in commitment to the EU financing instruments; in geographical representativeness and the political legitimacy; and in efficient use of resources. This study shows that the ICORGs currently suffer from several problems and have not yet fully adapted to the current EU policy instruments and processes or to the changing operational environment in the Baltic Sea macro-region. The findings also make obvious that the current MLG system of the Baltic Sea macro-region can be defined as rather state-centric and top-down driven, and does not function properly from the ICORGs´ and their member regions´ points of view. The tensions indicated by the theoretical dichotomy between intergovernmental and MLG approaches to EU policymaking prevail also in policy practice. Political and constitutional contexts clearly influence the mandates and responsibilities of the ICORG member regions in their respective countries, how they act in the ICORGs, and what kind of position they allow the ICORGs to have in the MLG system. The current reform of health, social services, and regional government in Finland provides an interesting example of how changes in political and constitutional contexts could increase the chances of the regions working through the ICORGs within the MLG system of the Baltic Sea macro-region. Finally, the academic results concerning the subjective views of the respondents, uncovered by means of Q methodology, are discussed on the more practical level to propose seven policy recommendations for regional actors. Earlier research on the IGOs, and the theoretical discussion in the study, also inform this more practical application of the results. These recommendations are made to provide an impetus for the future development of the ICORGs´ work and possibly to inspire them to reconsider their priorities and cooperation schemes within the MLG structure.

The article is devoted to the peculiarities of providing free legal aid in Ukraine and the countries of the European Union. The role and significance of free legal aid in the mechanism of protection of human and civil rights and freedoms, the principles of its provision in the countries of the European Union and in Ukraine are revealed. The international legal standards of the right of a person to free legal aid and their implementation in the legislation of Ukraine are analyzed. The analysis of terminological and theoretical-legal aspects of free legal aid in Ukraine is carried out. It is revealed that the scientific interest in this issue is due to the need for in-depth study of European law within the integration processes taking place in Ukraine, convergence of national legal systems, improving the legal framework of cooperation between Ukraine and the European Union. The article pays special attention to clarifying the peculiarities of the activities of free legal aid entities in Ukraine and the countries of the European Union. Analysis of international experience in the organization and operation of the free legal aid system allows to identify certain features of this institution, directions and trends of its development, which are not yet inherent in the Ukrainian free legal aid system, objectively and critically evaluate the activities of this institution in Ukraine, outline ways to further reform, which will address current issues that have been successfully resolved in most countries of the European Union. An approach is proposed according to which the subjective right to free legal aid includes a positive obligation of the state to provide it, which gives the state a sufficiently wide discretion to control the quality of such assistance, which in turn may pose certain threats to the independence of the legal profession. Prospects for the development of legislative regulation of the free legal aid system in Ukraine in the context of European integration are summarized and prospects for the adaptation of Ukrainian legislation in accordance with the legislation of the European Union are revealed. ; Стаття присвячена особливостям надання безоплатної правової допомоги в Україні та країнах Європейського Союзу. Розкрито роль та значення безоплатної правової допомоги в механізмі захисту прав і свобод людини і громадянина, принципи її надання в країнах Європейського Союзу та в Україні. Проаналізовано міжнародно-правові стандарти права особи на безоплатну правову допомогу та їх імплементацію у законодавстві України. Здійснено аналіз термінологічних та теоретико-правових аспектів безоплатної правової допомоги в Україні. Виявлено, що науковий інтерес до цієї проблематики зумовлений необхідністю поглибленого вивчення особливостей європейського права в межах інтеграційних процесів, що відбуваються в Україні, зближення національних правових систем, вдосконалення правових засад співробітництва між Україною та країнами Європейського Союзу. Особливу увагу у статті приділено з'ясуванню особливостей діяльності суб'єктів надання безоплатної правової допомоги в Україні та країнах Європейського Союзу. Аналіз міжнародного досвіду організації і діяльності системи безоплатної правової допомоги дає змогу виявити певні особливості цього інституту, напрями і тенденції його розвитку, які ще не властиві українській системі безоплатної правової допомоги, об'єктивно і критично оцінити діяльність цього інституту в Україні, встановити переваги й недоліки, окреслити шляхи подальшого реформування, що дозволить вирішити актуальні питання, які успішно врегульовані в більшості країн Європейського Союзу. Запропоновано підхід, згідно з яким суб'єктивне право на безоплатну правову допомогу включає позитивний обов'язок держави з її забезпечення, що надає державі достатньо широкі дискреційні повноваження щодо контролю за якістю такої допомоги, що своєю чергою може створювати певні загрози для незалежності адвокатури. Узагальнено перспективи розвитку законодавчого регулювання системи безоплатної правової допомоги в Україні в контексті європейської інтеграції, та розкриті перспективи адаптації українського законодавства відповідно до законодавчих норм Європейського Союзу.

O objetivo deste artigo é compreender o modus operandi dos instrumentos e mecanismos institucionais no Brasil e nos Estados Unidos de formulação da política de comércio internacional agrícola centrada em três variáveis: a) mobilização de interesses, b) funcionamento de instituições e c) divulgação de informações. Como exemplo, utilizaremos o contencioso do algodão na Organização Mundial do Comércio contra os Estados Unidos, desencadeado por uma coalizão de países em desenvolvimento e Países de Menor Desenvolvimento Relativo sob liderança do Brasil entre 2002 e 2005.

Abstract: This article´s objective is undertand of the modus operandi of the institutional mecanisms and instruments in Brazil and the United States in the formulation of international agricultural trade policy, focused on three variables: a) interest´s mobilization b) institutional management and c) information press. As an example, will be used the cotton dispute on the WTO against the United States, which took place by a strike of the developed countries and the least developed countries under Brazil´s lidership between 2002 and 2005.

In the last three decades, the world has experienced two large, fi rstly since the mid-seventies the advent of a new phase of accumulation in the capitalist system, fueled by the oil crisis and the crisis of the welfare state, among other factors. Furthermore with the fall of the Berlin Wall and the end of the Cold War, was launched a new era in international relations, commonly called the New World Order. This essay argues that the two phenomena are linked through the setup of a new social structure of accumulation of neoliberal character first is global and encompassing economic, social and political levels. ; En las últimas tres décadas el mundo ha vivido dos grandes transformaciones, de una parte desde mediados de los años setentas el advenimiento de una nueva fase de acumulación en el sistema capitalista, atizada por las crisis petroleras y la crisis del Estado de bienestar, entre otros factores. De otra parte, con la caída del muro de Berlín y el fi n de la Guerra Fría se dio inicio a una nueva etapa en las relaciones internacionales, comúnmente denominada el nuevo orden mundial. The article deals with the analysis of the foreign policy and diplomacy of the European states of the early Modern period (XVI-XVIIIcenturies). Particular attention is given to the institutional development of public and political opinion as well as to the institutional and diplomatic practices in Western and Central Europe. The author defines the directions of the theoretical and practical development of diplomacy and foreign policy in Europe of the early Modern period (XVI-XVIIIcenturies) as well as their formation peculiarities in the leading countries of Europe. The Congress of Vienna (1814-1815) as an important historical event for political, diplomatic and institutional development of Europe is analyzed. The attention is paid to the diplomatic tools, national peculiarities of negotiations at the Congress. The results of the Congress of Vienna served as an important stimulus for the further socio-economic, political and diplomatic development of Europe. Practical achievements of the Congress of Vienna and the experience gained by the European diplomacy of the late XVIII – early XIXcentury determined the future institutional development of world diplomacy and international law, having its relevance for today. ; За підсумками компаративного аналізу зовнішньої політики і дипломатії європейських держав раннього Нового часу (XVI-XVIIIст.) подано модель європейської дипломатії досліджуваного періоду. Особлива увага приділяється інституціональному розвиткові суспільно-політичної думки та інституційно-дипломатичної практики в Західній і Центральній Європі. Визначено напрями розвитку теорії та практики зовнішньої політики і дипломатії в Європі раннього Нового часу (XVI-XVIIIст.), особливості їх формування і становлення у провідних державах Європи. У статті проаналізовано Віденський конгрес (1814-1815рр.) як визначну історичну подію для політико-дипломатичного та інституційного розвитку Європи. Увагу акцентовано на дипломатичному інструментарії, національній специфіці та особливостях переговорного процесу європейських держав на конгресі. Підсумки Віденського конгресу слугували важливим стимулом для подальшого соціально-економічного, безпекового, політичного та дипломатичного європейського розвитку. Практичні здобутки Віденського конгресу і досвід, набутий європейською дипломатією кінця XVIII – початку XIX ст., визначили майбутній інституціональний розвиток світової дипломатії та міжнародного права, не втративши своєї актуальності й нині.

Polen scheint fest vertäut im sicheren Hafen des Westens, denn mit der Aufnahme in EU und Nato hat das Land seine außen- und sicherheitspolitischen Fundamentalziele erreicht. Die gefühlte Sicherheit erlaubt jedoch keine gelassene Sorglosigkeit und erst recht keinen sicherheitspolitischen Optimismus. Dies zeigt sich auch in den Überlegungen, die polnische Experten in den vergangenen Monaten zum Thema Sicherheit anstellten. Sei es die westliche Sicherheitsarchitektur in toto oder Europas Sicherheits- und Verteidigungspolitik - Ungewissheit macht sich breit. Zu sehr, so der Tenor, habe man sich auf die formelle Mitgliedschaft in EU und Nato fixiert und sich zu wenig Gedanken über die Substanz und die Rahmenbedingungen dieser Mitgliedschaft gemacht. Auch der Blick über den Atlantik hilft nicht unbedingt weiter. Die Diskussion über eine mögliche Teilnahme Polens an der US-initiierten Raketenabwehr bringt beachtliche Zwiespältigkeiten zum Vorschein - in den Urteilen über einen solchen Schritt, aber auch generell über einen möglichen polnisch-amerikanischen Sonderbund. 'Die Hoffnung auf frischen Wind in den internationalen Klimaverhandlungen war groß, als Barack Obama am 4. November 2008 zum Präsidenten der USA gewählt wurde. Bereits im Wahlkampf hatte er angekündigt, die Treibhausgas-Emissionen der USA bis 2050 um 80 Prozent zu reduzieren, den Anteil erneuerbarer Energien am Energiemix bis 2025 auf 25 Prozent zu steigern und ein bundesweites Emissionshandelssystem einzurichten. Das Jahr 2009 schien zu einem Jahr des Klimaschutzes in den USA zu werden. Nicht nur verabschiedete das Repräsentantenhaus im Juni 2009 ein umfassendes Klimagesetz. Darüber hinaus brachte die Umweltbehörde EPA zusammen mit dem Transportministerium zahlreiche neue Verordnungen auf den Weg. Außerdem beteiligten sich die USA wieder ernsthaft an den multilateralen Verhandlungen der United Nations Framework Convention on Climate Change. Doch nach der anfänglichen Euphorie stellte sich bald Enttäuschung über die Klimapolitik der Obama-Administration ein. Uneinigkeit zwischen den Verhandlungspartnern gibt es nicht nur bei der Höhe konkreter CO2-Reduktionsziele, sondern auch mit Blick auf die grundsätzliche Form des Abkommens. Die Europäer und die Entwicklungsländer halten an einem international verbindlichen Vertrag fest. Die USA hingegen ziehen Klimaziele in Übereinstimmung mit nationalem Recht vor. Dass sich die Verhandlungspartner beim Kopenhagener Klimagipfel im Dezember 2009 nicht auf eine konkrete Absichtserklärung einigen konnten, überraschte daher wenig. Die zentralen Fragen dieser Studie lauten: Wie ist das Verhalten Washingtons bei den internationalen Klimaverhandlungen zu erklären? Wie stehen die Chancen für einen echten klimapolitischen Wandel in den USA? Das Hauptaugenmerk ist dabei auf die innenpolitischen Triebkräfte der Klimapolitik gerichtet.' (Autorenreferat)

Proposals for a Legally Binding Global Convention on Forests, debated and rejected at the 1992 UNCED Earth Summit in Rio de Janiero, re-surface periodically at international fora. The case for concerted global action rests on the existence of 'international problems', where this is the only effective remedy, as conventions are unnecessary and inappropriate for national problems. The global values of forests are biological diversity and as a sink of carbon. There is also widespread international concern about forest clearance and degradation harming the lives and cultures of forest peoples and the loss of traditional knowledge about flora and fauna. This report argues that many of the expressed concerns about forests have local or national origins and consequences. National and sectoral policies have encouraged conversion of forests to alternative uses, and some forestry policies have encouraged overharvesting. The tenure of forest lands is often still unclear, or contested, and forests have frequently been mined as a quick source of capital, subsequently abandoned, or turned over to agricultural colonisers or plantation estates. Most 'global' aspects of the forests agenda are already covered in other UNCED Conventions. Improving the effectiveness of existing agreements and voluntary collaboration may be easier and more effective. Existing legal, economic and political instruments can address the issues. The report examines the feasibility, probability and costs of agreeing on a new instrument, and then of implementing that agreement; and the likely distributional impacts, both between and within countries. Even if not essential, a convention might consolidate existing fragments of international law bearing on forests and provide a forum for analysis and convergence of opinion. Or it could be an excuse for avoiding more effective actions.

Russland hat noch bis zum Mai 2023 den Vorsitz im Arktischen Rat. Aufgrund der russischen Kriegspolitik haben aber sieben der acht Arktisstaaten ihre Mitwirkung im Rat vorläufig eingestellt. Moskau ist davon in mehrfacher Hinsicht betroffen: Politisch wird damit ein Politikfeld beschädigt, in dem die internationale Bedeutung Russlands noch ungebrochen war. Wirtschaftlich steht die Zukunft wichtiger Industrieprojekte und Absatzmärkte Russlands auf dem Spiel. Außerdem tangiert die Unterbrechung der Rats­arbeit auch Interessen anderer Staaten wie China und wirkt sich nachteilig auf die russische Position in der Arktis aus. In Wissenschaft und Forschung haben alle west­lichen Part­ner ihre Kooperation ausgesetzt. Zwar leidet Russland in besonderem Maße unter den Folgen des Klimawandels in der Arktis, doch schadet der zeitweilige Stopp klima­relevanter Forschung letztlich der ganzen Welt. Militärisch suchen Finn­land und Schweden ihren Schutz in der Nato. Das konter­kariert die ursprüngliche Absicht des Kremls, den Einflussbereich der transatlantischen Allianz zurückzudrängen. Zudem wäre Russlands Grenze mit Nato-Staaten dann doppelt so lang wie zuvor. (Autorenreferat)
