The aim of this dissertation is to identity the sense of citizenship prevalent in the Philippines. Citizenship here is defined in two respects: an active dimension (exercis-ing voice) and a passive dimension (claiming rights or sense of entitlement). Findings from a series of problem-centered interviews with call center agents are complemented by the outcome of several annual surveys by the International Social Survey Programme (ISSP), especially the ISSP surveys on government (2006), social inequality (2009) and citizenship (2004) and validated by the analysis of media col-umns and societal artefacts over the last 10 years. While the first part of the dissertation analyzes why trade unions and other forms of collective interest representation hardly develop in the call center setting (economic citizenship), the second part identifies readiness to political action and expectations towards the state (political citizenship) in the context of an "informal security re-gime" (Geoff Wood). The main part of the study is followed by a postscript offering an outlook on opportunities and limitations of citizenship in the Philippine social and cultural context. The work contains several theoretical discussions of basic concepts and issues arising when sense of citizenship, especially in a non-European context, is analyzed. These include critiques on the theory of citizenship and on precarity, the middle class(es), citizenship in a non-western context, spaces of the political and post-national citizen-ship. In sum, a sense of citizenship is identified as full of requirements so that the stand-by citizen is rather considered the norm. The work comes to the conclusion that there is no general lack of a sense of citizen-ship among Filipinos. However as they have never experienced a comprehensive public service and consider such "unrealistic," their expectations as citizens are in practice low. The state is considered as enabler, not as provider, so that self-help is given priority. Such rather communitarian sense of citizenship is identified as con-niving with a neoliberal governementality of responsibilization. Only among those with a left political socialization can a sense of citizenship, as assumed in most schol-arly literature, be identified, with substantial expectations towards the state, demand of accountability and an identity as political subject (professional citizenship).
Education in general has traditionally been studied from various perspectives from the field of politics, economics, sociology and science education, among others. However, in those areas are not many jobs that seek an approach to education as a fundamental right and provide an analytical framework to reflect and argue about the defense, validity and enforceability of the legal positions and the basic contents present on the right to education. The following pages provide an analytical framework to guide the reader in the development of this thesis. Firstly, we analyze a conceptualization of education as a fundamental right and then its structure will be discussed in terms of contents, from the international law of human rights, resulting in concrete obligations on States. In this task, we analyze in particular the obligational framework under the scheme of "4 A". Finally, we work over some ideas related to the importance of these contents, in terms of obligations of immediate and progressive development, so as to build the "basic floor" of the right to education as a fundamental right ; La educación en general ha sido estudiada tradicionalmente desde diversas perspectivas provenientes del campo de la política, la economía, la sociología y las ciencias de la educación, entre otras. Sin embargo, en aquellos ámbitos no abundan los trabajos que procuren un acercamiento a la educación como derecho fundamental y que brinden paralelamente un marco de análisis para reflexionar y argumentar en torno a la defensa, vigencia y exigibilidad de las posiciones jurídicas y de los contenidos básicos presentes en el derecho a la educación. En las siguientes páginas ofrecemos un marco de análisis que guíe al lector en el desarrollo de esta tesis. Se realizará una conceptualización de la educación como derecho fundamental y seguidamente, se analizará su estructura en términos de contenidos que, desde el derecho internacional de los derechos humanos, se traducen en obligaciones concretas a cargo de los Estados. En esta tarea, se analizará en particular el marco obligacional previsto por el esquema de las "4 A". Finalmente, se formulará una reflexión vinculada con la importancia de estos contenidos, y su traducción en obligaciones de cumplimiento inmediato y progresivo, en tanto fijan el "piso mínimo" del derecho a la educación como derecho fundamental
China estimates the number of people of Chinese origin outside the People's Republic to be 60 million. Beijing considers them all to be nationals of China, regardless of their citizenship. Xi Jinping views overseas Chinese as playing an "irreplaceable role" in China's rise as a world power. Beijing is working hard to harness overseas Chinese resources for its own goals in the fields of economics, science and technology, as well as diplomacy and soft power. Beijing also expects people of Chinese origin in Germany to deepen relations between China and Germany. But not only that: As "unofficial ambassadors", they are also expected to spread China's narratives to the German public, defend China's "core interests", and help with the transfer of knowledge and technology to China. Nevertheless, there are limits to China's diaspora policy: Chinese migrants' reactions to China's ambitions are heterogeneous. They range from willingness to cooperate to disinterest or open rejection. German actors should develop a comprehensive understanding of Chinese diaspora policy and the goals and practices associated with it. Just as in Beijing, diaspora policy should be perceived as an important component of Chinese foreign policy. Only on this basis can answers to China's ambitions be found wherever German interests, legal principles, or social values are affected - without at the same time exposing people of Chinese origin to general suspicion. German actors should also expand their engagement in communities of people with a Chinese migration background instead of leaving this field to Chinese authorities.
Ein Zusatzprotokoll zum deutsch-ägyptischen Kulturabkommen soll eine neue Rechtsgrundlage schaffen, um die Tätigkeit der politischen Stiftungen in Ägypten zu regeln. Es ist jedoch unwahrscheinlich, dass sich ihre Arbeitsmöglichkeiten dadurch tatsächlich verbessern werden. Zum einen beschränkt das Protokoll die Aktivitäten der Stiftungen in entscheidenden Punkten. Zum anderen wird der öffentliche Raum für politische Betätigung in Ägypten ohnehin immer kleiner, weil die Regierung die Repression gegen zivilgesellschaftliche Akteure zunehmend verschärft. Die Stiftungen können deshalb keinen wirksamen Beitrag zur Entwicklung einer unabhängigen Zivilgesellschaft leisten. Voraussetzung dafür wären weniger restriktive Rahmenbedingungen - ein Anliegen, für das sich die deutsche Politik nachdrücklicher als bisher einsetzen sollte. Geschieht dies nicht, trägt das Protokoll nur dazu bei, die politischen und gesellschaftlichen Rückschritte am Nil zu legitimieren. Damit könnte es zum Vorbild für andere autoritäre Regime werden. Bei der 24. Konferenz der Vertragsstaaten (COP24) der VN-Klimarahmenkonvention (UNFCCC), die im Dezember 2018 im polnischen Kattowitz stattfand, verabschiedeten die Teilnehmer ein Regelbuch für die Umsetzung des Pariser Abkommens. Dies war notwendig, damit das neue Klimaregime ab 2020 implementiert werden kann. Die COP befasste sich auch mit den vor 2020 zu ergreifenden Klimaschutzmaßnahmen, die Gegenstand des ein Jahr lang geführten Talanoa-Dialogs waren, eines Plattformdialogs, an der sich auch Vertreter der Zivilgesellschaft beteiligen konnten.
Die Europäische Union (EU) und ihre Mitgliedstaaten gehören zu den wenigen globalen Akteuren, die über die Mittel und die Entschlossenheit verfügen, die internationale Klimaagenda weiterhin zu unterstützen. Im Vorfeld des vom Generalsekretär der Vereinten Nationen, António Guterres, einberufenen Klimagipfels im September 2019 muss die EU unter Beweis stellen, dass sie angesichts der Ziele des Pariser Abkommens ihre Emissionen künftig schneller senken will, als sie das bisher angekündigt hat. Dazu gehört vor allem, dass sie ihre kurz- und langfristigen Klimaziele anpasst. Außerdem gilt es, die armen Länder politisch und finanziell zu unterstützen. Die vom Klimawandel besonders betroffenen Entwicklungsländer zählen auf die EU und ihre Mitgliedstaaten als verlässliche Partner und Vorbilder. Auch angesichts der bevorstehenden Wahlen zum Europäischen Parlament und dem Wechsel in der EU-Kommission wird sich die EU schwertun, diesen Erwartungen gerecht zu werden. Ungeachtet dessen muss die EU die Zusammenarbeit mit den Schwellenländern weiter vertiefen und die Klimapolitik quer durch alle Politikbereiche vorantreiben. (Autorenreferat)
