"At the opening of the twenty-first century, while obviously the world is still struggling with violence and conflict, many commentators argue that there are many reasons for supposing that restrictions on the use of force are growing. The establishment of the ICC, the growing sophistication of international humanitarian law and the 'rebirth' of the just war tradition over the last fifty years are all taken as signs of this trend. This book argues that, on the contrary, the just war tradition, allied to a historically powerful and increasingly dominant conception of politics in general, is complicit with an expansion of the grounds of supposedly legitimate force, rather than a restriction of it. In offering a critique of this trajectory, Just War and International Order also seeks to illuminate a worrying trend for international order more generally and consider what, if any, alternative there might be to it"--

AbstractThe role of UN missions in post-conflict societies has progressed through peace-keeping and peace-making to a more recent emphasis on peace-building. To accompany this new focus, the UN has articulated a rule of law agenda, two central components of which are promoting international norms and standards and facilitating national ownership. This paper explores the self-sanctioned role the UN has awarded itself in promoting the rule of law in post-conflict societies by exploring each one of these two central components and their interaction.Meritorious in their own right, the potential of these two components of the rule of law agenda may position the UN in situations where both cannot be satisfied contemporaneously. In implementing its rule of law agenda, the United Nations will likely come to face the prospect of a local authority seeking to differ from international norms and standards. In such circumstances, the UN's rule of law agenda makes conflictual promises. The choices and prioritization that the UN will be called upon to make in such circumstances will reveal much about how it conceptualizes its role in promoting the rule of law in post-conflict societies. This paper seeks to delineate the nature of the choices confronting the United Nations in pursuit of its rule of law agenda.

Mittlere Mächte sind einflussreiche Akteure in der internationalen Politik. Auf den Angriffskrieg Russlands gegen die Ukraine oder auf den Gaza-Krieg reagierten gewichtige Staaten Lateinamerikas oder Afrikas - so Brasilien oder Südafrika - nicht im Einklang mit westlicher Politik. Die zwölf mittleren Mächte, die in dieser Studie behandelt und auch als middle-ground powers, Mittelmächte oder swing states bezeichnet werden, weisen zwar viele Unterschiede auf. Doch wird ihnen allen eine (poten­tiell) wichtige regionale oder internationale Rolle und Handlungsmacht zugeschrieben, die sie von anderen Staaten abhebt. Sie bringen eine spe­zifische Kombination von Merkmalen mit wie Geographie, Demographie, Wirtschaftsleistung, Rohstoffreichtum, militärische Macht oder politische Ausstrahlung. Die Kooperation und der Austausch mit diesen mittleren Mächten sind für Deutschland und die EU von großer Bedeutung, sei es um gemeinsam Krisen zu begegnen, Politiken zu gestalten oder geoökonomische Risiken durch Diversifizierung der außenpolitischen Beziehungen zu minimieren. Die zwölf Staaten teilen drei Gemeinsamkeiten: die überragende Bedeu­tung wirtschaftlicher Entwicklung, wobei Fragen von sozialer und wirtschaftlicher Gleichheit und globaler Gerechtigkeit zentral sind; die starke Betonung von Stabilität und Sicherheit, wobei in deren Interessenhorizonten das Völkerrecht und seine liberale Interpretation an Bindungskraft verliert; ein Streben nach strategischer Autonomie, um wirtschaft­liche Entwicklung und Regimestabilität durch flexible Kooperationen und Optionenvielfalt im Sinne nationaler Belange abzusichern. Mit Blick auf zentrale Politikfelder - UN-Reform, globale Rohstoff-, Ener­gie-, Klima-, Gesundheits- und Migrationspolitik - zeigt Deutschland ein differenziertes Verhältnis zu mittleren Mächten. Nicht zuletzt der aus­geprägte Transaktionalismus und die Tendenz zum »multi-alignment« mittlerer Mächte zwingen Deutschland dazu, sich stärker mit den mate­riellen Interessen und ordnungspolitischen Vorstellungen mittlerer Mächte auseinanderzusetzen. Das müsste sich in der Konzeption und Durch­führung von Dialogformaten, bi- und internationalen Verhandlungen vor allem über Regulierungsfragen und neue Lastenteilungen niederschlagen.
