학위논문 (석사)-- 서울대학교 대학원 : 국제학과(국제협력전공), 2012. 2. 신성호. ; 이 논문은 다음의 두 가지 연구 문제를 다루고 있다. 첫째, 인신매매 금지 규범은 한국으로 전파되는 과정에서 지역화되었는가? 둘째, 한국의 인신매매 특별법안과 관련하여 인신매매 금지 규범은 어떤 경로를 통해 전파되었는가? 이 두 질문에 대답하기 위해 본 논문은 문헌 연구, 관련 법률 검토, 인터뷰 등의 방법을 사용하였다. 위와 같은 방법을 통해 모은 자료의 해석은 Acharya의 규범의 지역화에 관한 이론을 중심으로 하였다. 이러한 방법을 토대로 이 논문은 한국에서의 인신매매 금지 규범의 전반적인 흐름을 파악하려 하였다. 연구 결과 한국에는 두 번에 걸친 인신매매 금지 규범의 전파, 혹은 지역화가 존재하였다. 첫 번째 지역화는 1951년에서 1961년에 걸쳐 발생하였고, 두 번째 지역화는 2000년에서 2011 현재까지 발생하고 있다. 첫 번째 지역화는 1951년에 '인신매매 금지 및 타인의 성매매의 착취 금지에 관한 협약의 발효가 발단이 되었다. 이 첫 번째 지역화는 규범 지역화의 첫 번째 단계인 '무관심' 단계(indifference stage)가 10년이나 지속되었다는 특징이 있다. 또한 인신매매 금지 규범의 확산 경로는 박정희 정권의 정략적 이해관계였다. 이 지역화의 결과로 1961년의 윤락행위등방지법이 만들어졌다. 이 법은 가부장제라는 한국의 전통적 사상에 의해 인신매매 금지 규범을 지역화하였으며, 그 결과 이 법은 피해자가 인신매매의 목적에 동의한 경우, 인신매매의 성립을 부정하기에 이르렀다. 즉 '강제성'이 인신매매의 성립 여부를 결정하는 중요한 요소로 규정되었다. 두 번째 지역화는 2000년에 UN 인신매매 방지 의정서가 발효되었을 때 시작되었다. 이 지역화는 규범 지역화 과정의 두 번째 단계인 '지역적 선도' 단계(local initiative stage)를 두 차례 겪었다. 2000년대 초의 첫 번째 지역적 선도는 성매매 특별법으로, 2000년대 후반의 두 번째 지역적 선도는 3개의 인신매매 특별법안으로 이어졌다. 성매매 특별법은 가부장제와 '인신매매는 곧 성매매와 같다'는 인식에 의해 인신매매 규범을 지역화하였다. 그 결과 이 법은 성적 착취를 목적으로 하는 인신매매만을 다루게 되었으며, 윤락행위등방지법과 마찬가지로 강제성을 인신매매의 중요한 요소로 보았다. 인신매매 특별법안의 경우 강제 결혼, 특히 요즘 한국에서 큰 이슈가 되고 있는 국제 결혼의 실태를 반영하여 인신매매 금지 규범을 지역화하였다. 그 결과 인신매매 특별법안은 결혼을 가장한 인신매매를 규정하고 있다. 두 번째 연구 문제에 대한 연구 결과, 2010년 이후 인신매매 금지 규범은 초국가자문연계망(TAN)에 의해 한국으로 전파된 것으로 밝혀졌다. 주목하여야 할 점은, 이러한 경로가 1960년대에 이 규범이 따랐던 경로와 확연히 다르다는 점이다. 한국이 권위주의 국가였던 1960년대의 인신매매 금지 규범은 군사 정권의 정략적 이해를 통해 한국으로 전파되었다. 반면 한국이 이미 민주화를 경험한 후인 2010, 2011년도에는 규범의 전파에 시민 사회가 큰 역할을 수행하였다. 즉, 한국의 국내 정치 체제의 변화가 국제 규범의 확산 경로에 영향을 미친 것이다. ; This dissertation tries to answer two research questions: first, "has the anti-human trafficking norm been localized in the process of diffusion into the ROK?" and second, "what pathway has the diffusion of the anti-human trafficking norm followed in the ROK regarding the Korean Preventive Act of Human Trafficking?" In order to answer these puzzles, this dissertation used a number of research methods such as archival research, review of related acts, and interviews. In interpreting the collected data, I relied on the theory of constitutive norm localization of Acharya, and tried to see the whole process of diffusion of the anti-human trafficking norm into the ROK. According to my research, it turned out that the ROK experienced two localizations of the anti-human trafficking norm - the first one from 1951 to 1961, and the second one from 2000 till 2011. The first one was triggered when the Convention for the Suppression of the Traffic in Persons and of the Exploitation of the Prostitution of Others came into effect in 1951. This localization features a long indifference stage of 10 years, and the pathway that the norm followed was the political interest of the military government. The Preventive Act of Prostitution was made as a result of norm diffusion, and it localized the norm in accordance with the patriarchy. As a result, "coercion" became an important factor of human trafficking and the act did not punish human trafficking if the victim initially agreed to work as prostitutes. The second localization started when the Protocol to Prevent, Suppress, and Punish Trafficking in Persons, Especially Women and Children entered into force in 2000. This localization features two local initiative stages. The first local initiative stage in the early 2000s led to the enactment of the Korean Preventive Act of Prostitution, and the second one in the late 2000s to Rep. Choon-jin Kim and Jeong-hee Lee's legislative bills on human trafficking (the Korean Preventive Act of Human Trafficking). The former localized the norm according to patriarchy and the perception that human trafficking equals prostitution. The corollary is that the Korean Preventive Act of Prostitution considers coercion as a necessary factor of human trafficking, and that it deals with human trafficking only for the purpose of prostitution. The Korean Preventive Act of Human Trafficking also localized the norm in accordance with the cognitive prior that forced marriage, especially international marriage of Korean men, should be seen as human trafficking. As a result, the bills regulate human trafficking on the pretext of marriage. As for the second question, it turned out that the Transnational Advocacy Network helped the anti-human trafficking norm diffuse into the ROK in 2010 and 2011. What is important in terms of international politics is that the pathway that the norm followed in the early 2010s is fundamentally different from that in the 1960s. In the 1960s, when the ROK was an authoritarian state, the norm was able to diffuse into it because of the political interest of the government, while in the 2010s, when the ROK had been democratized, the civil society enabled the norm to diffuse into it. In short, the change in the domestic political systems is associated with that in the pathways of norm diffusion. ; Master
