RESUMO Introdução: As doenças crónicas são a principal causa de mortalidade em toda a Europa. O aumento da prevalência de doenças crónicas está a gerar a necessidade de reformas nos sistemas de saúde. Estas reformas abordam a gestão de doenças crónicas com base em equipas multidisciplinares, com novos papéis atribuídos a profissionais não-médicos, como enfermeiros e farmacêuticos comunitários (CP). A comunicação entre profissionais e cidadãos é fundamental em todos os modelos multidisciplinares, o que torna o uso de Sistemas e Tecnologias de Informação (IST) cada vez mais indispensável. É de extrema importância para a ciência e a sociedade entender como serviços suportados por IST - eHealth - podem ser desenvolvidos e utilizados para enfrentar os constrangimentos e desafios dos futuros sistemas de saúde. Objetivo: O objetivo principal deste projeto foi o de desenvolver, implementar e avaliar um serviço farmacêutico de gestão de doença suportado por IST, no contexto da farmácia comunitária, utilizando a metodologia Design Science Research (DSRM) como metodologia de investigação. Métodos: A aplicação de DSRM decorre em seis fases, desde a definição e caracterização do problema até à avaliação da solução (ou artefacto). A primeira fase foi constituída por um exercício de cenarização, um estudo observacional de tempo e movimento e um questionário de preenchimento online, para avaliar as futuras possibilidades para os farmacêuticos comunitários no sistema de saúde, e a atual prestação de serviços farmacêuticos suportados por IST em farmácia comunitária. Na segunda fase, foram realizadas entrevistas qualitativas com utentes de serviços de saúde. Estas duas fases informaram o desenho da plataforma web de suporte ao serviço, que foi o objetivo da terceira fase. De seguida, nas duas etapas seguintes, a plataforma web foi testada e a usabilidade avaliada através de um estudo de caso com utentes selecionados numa universidade sénior. Resultados: A partir do exercício de cenarização, foi possível identificar as incertezas críticas que serão os "motores da mudança" para os farmacêuticos comunitários. Estas são a "capacidade de inovar e desenvolver serviços" e o "ambiente legislativo". Tanto no estudo observacional como no inquérito, verificou-se que todas as farmácias utilizam os IST para a dispensa de medicamentos e tarefas administrativas; apenas 15% das farmácias respondentes usam os IST para responder a questões de saúde dos utentes; 50% do tempo diário do farmacêutico é despendido em interação com os utentes da farmácia e 38% em tarefas administrativas. Em média, os farmacêuticos observados têm 54 minutos de tempo livre por dia, maioritariamente em micropausas distribuídas pelo dia de trabalho. Os custos calculados para os serviços farmacêuticos observados foram muito semelhantes nas três farmácias. O custo médio do serviço de dispensa de medicamentos foi de €3,66 e do serviço de aconselhamento €1,34. Dos utentes entrevistados, 46% admitiram que procuraram o farmacêutico para informações sobre questões de saúde ligeiras antes de ir a um médico, enquanto a entrega de medicamentos ao domicílio foi o novo serviço mais solicitado. Na fase de demonstração da plataforma, verificou-se que o registo, monitorização e armazenamento de dados bioquímicos e fisiológicos, tanto pelo utente como pelo farmacêutico, contribuiu para aumentar o interesse comum na gestão da doença, o que poderá permitir uma melhoria nos resultados da saúde. Na avaliação de usabilidade, verificou-se a necessidade de melhorar o acesso rápido à informação, bem como a vi necessidade de melhorar a legibilidade da informação para melhorar a experiência de utilização dos utentes seniores. Conclusão: Atualmente, o uso de IST nas farmácias comunitárias portuguesas está principalmente focado na dispensa de medicamentos. Parece existir uma necessidade de reorganização interna das farmácias de forma a permitir aumentar a eficiência da prestação de serviços farmacêuticos e permitir a prestação de serviços farmacêuticos de eHealth. Para os serviços farmacêuticos de eHealth estarem mais integrados no modelo de negócio atual, é necessário melhorar o marketing do serviço, de forma a aumentar o recrutamento de utentes e demonstrar o valor do serviço para os doentes crónicos e médicos. A qualidade e usabilidade da plataforma eHealth é fundamental. No entanto, também o acompanhamento por um profissional de saúde e a integração dos serviços farmacêuticos com os cuidados de saúde primários são importantes para uma melhor gestão da doença. A DSRM demonstrou ser útil no desenvolvimento e implementação de serviços de eHealth, proporcionando um maior envolvimento dos utilizadores, aumentando a utilidade percebida do serviço. No próximo ciclo de DSRM, vão ser necessários os inputs de médicos de cuidados primários e outros profissionais de saúde, de modo a desenvolver um novo artefacto, para testar e avaliar o valor clínico e económico dos serviços farmacêuticos eHealth. ; Background: Chronic diseases are the main cause of mortality throughout Europe. The increasing prevalence of chronic diseases is leading to the necessity of health system reforms. These reforms address chronic-disease management based on multidisciplinary teams, with major roles for non-physicians, such as nurses and community pharmacists (CP). A cornerstone on every multidisciplinary model is the communication between stakeholders, for which the use of Information Systems and Technologies (IST) is increasingly indispensable. It is of importance to science and society to understand how IST supported services – eHealth - could be developed and used to address the challenges and constrains of future health systems. Aim: The main goal of this project was to design, implement and evaluate a disease management web-based interactive pharmaceutical service, within a community pharmacy setting, using Design Science Research Methodologies (DSRM). Methods: The application of DSRM six stages' is described, from the definition and characterization of the problem to the evaluation of the artefact. The first stage consisted of a scenario exercise, a time and motion observational study and an online survey, to assess future roles for community pharmacists and current pharmaceutical services provision supported by IST in community pharmacy. In the second stage, qualitative interviews with health services' users were performed. These two stages helped to inform the design of the web-platform, which was the goal in the third stage. After this, the web-platform was tested and the usability evaluated in the two following stages, through a case study with selected patients from the participant pharmacies and from a senior university. Results: The scenario exercise allowed to identify the critical uncertainties that will be the drivers of change for the Community Pharmacists. These were found to be the "Ability to develop Services", and the "Legislative Environment". From both the survey and observational study, it was found that pharmacies' IST is mainly used for dispensing medicines and administrative tasks with only 15% of the respondent pharmacies using IST to answer patients' queries; 50% of pharmacists daily time is spent with patients, 38% on administrative tasks, while still having an average of 54 minutes of idle time spread through the day, mainly in micro-pauses. The overall costs of Pharmaceutical services across three pharmacies were found to be very similar, with the average dispensing service cost at €3.66 and €1.34 for the counselling service; 46% of the interviewed users admitted that they sought healthcare provision with the CP for minor issues before going to a physician, while home delivery was the most requested new service. In the demonstration stage, we found that the registration, monitoring and storage of biochemical and physiological data, recorded by the CP and the patients in the platform, contributed to a common interest that may allow an improvement in patients' health outcomes. From the usability evaluation, concerns about the quick access to information were perceived as well as the need to improve legibility, addressing senior users' difficulties. Conclusion: The current state of IST usage in Portuguese community pharmacies is mainly focused on medicine dispensing. There seems to exist a need for internal reorganization of pharmacies allowing for more efficient pharmaceutical services provision and to enable eHealth pharmaceutical services provision. To make eHealthpharmaceutical services more integrated in the current pharmacy daily business, marketing efforts need to be done, to recruit and demonstrate value to the chronic patients and physicians. The quality and usability of the web-based platform is critical, as is the close professional follow-up and integration of pharmacy and primary care services focused in disease management. DSRM helps in developing and implementing eHealth services through a higher involvement of the stakeholders, increasing the perceived usefulness of the service. The next DSRM cycle will need to use the input of primary care physicians and other health professionals in order to develop an artifact to test and evaluate the clinical and economic value of eHealth pharmaceutical services.

Dottorato di ricerca in Diritto dei contratti pubblici e privati ; La trattazione vuole offrire un inquadramento generale della cessione di cubatura a seguito dell'emanazione della legge 12 luglio 2011 n. 106 di conversione del d.l. 13 maggio 2011 n. 70. La normativa ha introdotto all'articolo 2643 c.c. rubricato ‹‹atti soggetti a trascrizione››, il numero 2-bis che ha disposto in modo del tutto innovativo la necessità di trascrivere ‹‹i contratti che trasferiscono, costituiscono o modificano i diritti edificatori comunque denominati, previsti da normative statali, regionali o da strumenti di pianificazione territoriale›› . I problemi teorici e applicativi posti dalla novella sono numerosi e particolarmente complessi. L'espressione utilizzata dal n. 2-bis, infatti, pur definendo la disciplina pubblicitaria, non esplicita né quali siano i caratteri essenziali di cui si compone il contratto che trasferisce la volumetria, né la natura dei ‹‹diritti edificatori››. L'obiettivo dello studio è pertanto quello di identificare oltre ai tratti caratteristici della cessione di cubatura, un modello contrattuale idoneo a garantire la circolazione della potenzialità edificatoria e soluzioni operative che possano rimanere immuni ai mutamenti giurisprudenziali, con la finalità precipua di verificare se il n. 2–bis, abbia posto le basi per un mercato dei ‹‹diritti edificatori›› volto ad un più efficace sfruttamento della proprietà immobiliare. Per farlo, nel Capitolo I si è ritenuto opportuno prendere le mosse da problematiche antiche e mai del tutto risolte inerenti agli accordi di ‹‹micropianificazione ad iniziativa privata›› (di cui la cessione di cubatura è espressione) ed allo ius aedificandi, al fine di individuare i limiti e le modalità di esercizio del potere di costruire soprattutto con riferimento ai rapporti con la p. a. La disamina non ha inoltre potuto prescidere da un'analisi dei più recenti strumenti di perequazione, compensazione ed incentivazione che rappresentano un'evoluzione rispetto all'originaria prassi applicativa. Indagato il ‹‹contenuto complesso›› dello ius aedificandi e la natura giuridica del permesso di costruire, si è potuta affrontare nel Capitolo II la spinosa problematica della natura giuridica dei trasferimenti di volumetria. A seguito di un esame dei principali teorizzazioni come ‹‹bene immateriale››, come ‹‹chance›› e come nuovo ‹‹diritto reale tipizzato›› si è potuto rilevare, anche attraverso un'analisi applicativa dell'istituto a vari negozi tipici ed ai diritti di godimento e di garanzia (Capitolo III), come la sola ricostruzione che possa assicurare un effettivo utilizzo dell'istituto è quella che riesca a farne interagire la natura privatistica e pubblicistica in uno sforzo di integrazione coerente tra le diverse materie. Pertanto, sul presupposto che l'interprete debba, prima di tutto, attenersi al dettato della norma, la soluzione di un nuovo diritto reale, caratterizzato da un'imprescindibile connessione con il provvedimento amministrativo, è apparsa maggiormente in linea con il dettato normativo ed in grado di assicurare un ampio utilizzo dell'istituto. Nel Capitolo IV l'attenzione si è quindi focalizzata sui caratteri costitutivi del contratto. In primis si è sottolineata l'importanza dell'accordo privatistico quale momento genetico della vicenda circolatoria attraverso una nuova lettura del tradizionale rapporto soggetto-oggetto, in cui l'autonomia negoziale assume una forza creatrice divenendo il veicolo mediante il quale si sostanzia il processo creativo voluto dalle parti atto a ‹‹generare l'oggetto del contratto›› (la cubatura). In secundis si è tentato di individuare il modo in cui diritto privato e diritto amministrativo convivono all'interno della cessione di cubatura, rinvenendo la chiave di congiunzione nell'elemento accidentale della ‹‹condizione››, rappresentata dal provvedimento amministrativo. Ne è emerso un istituto complesso che si compone necessariamente di due momenti: uno genetico (regolato dal diritto privato) ed uno applicativo (disciplinato dal diritto amministrativo). La particolare struttura dell'istituto esprime d'altra parte una tendenza sempre più diffusa a considerare l'ordinamento come un unicum, in cui i distinti sistemi normativi ‹‹perdono›› il proprio primato se collocati all'interno dell'ordinamento giuridico unitario. Stabilito in che termini diritto privato e diritto amministrativo dialogano tra loro e superato l'impasse della qualificazione giuridica, è stato possibile valutare le prospettive future di un mercato dei trasferimenti di volumetria. Considerato il quadro generale esistente in Italia e facendo tesoro delle considerazioni che sono derivate da uno studio del TDRs statunitense (Capitolo V), si è giunti a ritenere come agli intenti ambiziosi dei lavori preparatori non sia corrisposta un'opera di codificazione all'altezza dei propositi perseguiti a causa della mancanza di un framework di principi comuni da imporre su scala nazionale. In una prospettiva de iure condendo si è dunque tentato di ovviare alla carenza di un (auspicabile) intervento legislativo volto a definire più chiaramente i caratteri dell'istituto, proponendo alcune soluzioni applicative e teorizzando le possibili modifiche normative da introdurre nel codice civile per assicurare un maggiore e più sicuro utilizzo dei trasferimenti di volumetria. ; The Ph.D. thesis aims to provide a general framework of the transfer of development rights, following the issuance of the law 12 July 2011 n. 106 of converting d. l. 13 May 2011 n. 70. The legislation introduced in article 2643 c.c. entitled ‹‹instruments subject to registration››, the number 2-bis which places, in a completely innovative way, the need to record in a public register ‹‹contracts that transfer, constitute or modify the development rights, however denominated, provided by State or regional regulations, or by planning instruments››. The theoretical and applied problems posed by the new provision are numerous and very complex. In fact, the expression used by n. 2-bis does not express what are the essential characteristics of the contract which transfers the ‹‹development rights›› and their legal status. Therefore the aim of the thesis is to identify the characteristic features of the institute and also a contract scheme that could be able to ensure the transmission of the development rights for finding practical solutions, immune to judicial decisions. The principal aim is to verify whether the n. 2-bis has laid the foundations for a market of development rights, for a more efficient use of real estate. The Chapter I deals with ancient and never fully resolved problems related to the microplanning agreements (of which transfer of development rights is an expression) and related to the power to built, in order to identify the limits and procedures for exercising the right to build, especially in relation to the powers of the public administration. Moreover the analysis does not leave aside the latest tools of equalization, compensation and incentives that represent an evolution from the original archetype. After reviewing the complex content of the right to build and the legal status of building permits issued by the municipality, the Chapter II deals with the issue of the legal status of transfer of development rights. The analysis of the main theories as an ‹‹immaterial good››, such as ‹‹chance›› and as a ‹‹new land right›› show that the only feasible solution that can ensure an effective use of the transfer of development rights is the one that can make interact the private nature and public one in an effort of coherent integration between the different fields of law. On the assumption that the interpreter must, first of all, follow the wording of the rule, the solution of a new land right, characterized by an essential connection with the administrative measure, it appear nearer with the provision of the law and can ensure wide use of the institute. Therefore in Chapter IV, attention is focused on the characteristics of the contract. In the first place it is emphasized the importance of private agreement like ‹‹fundamental moment›› of transfer of development rights, through a new interpretation of the traditional relationship between ‹‹subject›› and ‹‹object››, in which the contractual autonomy has a creative force and became the vehicle through which the land rights is generated. Second attempt is made to identify the way in which private law and administrative law coexist, finding the key junction of the two moments in the element of the accidental ‹‹condition››, represented by building permit. What emerges from the examination is a complex institution that consists of two parts: one governed by private law and one determined by administrative law. The particular structure of the institute shows that the two areas of law, lose their primacy if placed within the unit legal system. After determining how private and administrative law interact with each other and overcoming the deadlock of the legal status, it is possible to assess the future prospects of a market of transfer of development rights. Based on the current Italian situation and building on the considerations that are derived from a study of the USA TDRs (Chapter V), it can be argued that the number 2-bis is not able to achieve the ambitious goals that the legislator wanted to accomplish, due to the lack of a framework of common principles to be imposed at national level. In the concluding remarks, in a proactive perspective, are proposed some application solutions and are theorized some possible legislative changes to be introduced in the Civil Code, to ensure a greater and safer use of development rights.

Context, Objectives and Entrepreneurship Intervention In the context of labour market issues, unemployment rates constitute, undoubtedly a major concern, especially under an economic and financial crisis situation, such as the currently faced by many European countries, since 2008. Unemployment rates are an important structural indicator, displaying both economic and social dimensions. An increase of unemployment might imply a loss of talent and unique human capital out of the labour force, culminating in social exclusion, disintegration and substantial raise of government expenditures (social benefits and ALMPs). Nowadays, stimulating entrepreneurship through active labour market policies is widely recognized as manner of combating unemployment and improving innovation and job creation. The primary role of the present research is to infer whether a entrepreneurship training contributes to employment, full-employment and self-employment rates of targeted individuals. Therefore, it includes the measurement of 4 main groups of outcomes: 1). Networking and job's offers applications; 2). Employment, self-employment's plans, full-time employment and job seeking strategies; 3). Complementary training and pro-activity 4). Confidence and optimism levels. The scope of analysis was focused on the emerging reality of the Portuguese unemployed people with graduate degrees, despite remaining unemployed for an uncertain length of time and in what extent entrepreneurship training programmes contribute to reduce the unemployment rates among the participants and to engage them on creating their own businesses. Nevertheless, more than merely analysing the impact of training on employment or self-employment likelihoods, this intervention aims at understanding if individuals who benefited by the program change positively their behaviour relative to networking and job offers applications, due precisely to that participation. The acknowledge of the best labour policies to mitigate structural unemployment, to correspond to unemployed needs and characteristics and to enhance a better match between labour's supply and demand is determinant on current days. This necessity, at the moment, is not only applied for low-skilled workers, but also, in an increasing rate, to high-skilled workers. These last ones are in general much less targeted to training programs than the low-skilled individuals. Most of active labour market policies are developed and provided to the most disadvantaged groups who face the greatest barriers and incentives to become employed. Therefore, a research gap in what respects the best labour market policies concerning this particular group of unemployed still remains to explore. European and Portuguese Active Labour Market Policies (ALMP's) The improvement regarding effectiveness of labour market policies in Europe entails the undertake of programmes at an early stage, so that it can prevent the occurrence of long-term unemployment; the need to establish an adequate profile of the participants to infer their specific weaknesses, skill's needs and to allocate them to the most suitable programme, the targeting of wage subsidies might be run at a small-scale basis, and the existence of appropriate incentives for employers to retain workers after the subsidy's expiration. The European Commission defines the different ALMPs into several categories, such as: Labour market services (category 1): job-search assistance; Training (category 2); Employment incentives (category 4): hiring incentives for firms; Supported employment and direct jobs (categories 5&6): target particularly long term unemployed, youth or groups facing problems of inclusion and integration in regular labour market and Start-ups incentives (category 7). The Portuguese institutions that implement and reinforce the labour market policies, with overall responsibility of the Ministry of Solidarity, Labour and Social Affairs are the Institute for the Innovation and Training (Instituto para a Inovação na Formação) and specially the Institute for Employment and Vocational Training (IEFP-Instituto do Emprego e Formação Profissional). The main goal of this organism is to promote the creation and quality of employment and mitigate unemployment spells, through the conduction of ALMPs, namely vocational training. Some of the most relevant active labour market policies involve: Stimulus to employment or employment subsidy, Employment's internships, National Plan of implementation of a young's guarantee, Active youth employment, Youth Investment Program, Youth Boost Program, Active Life Program and Vocational Education and Training (VET). Data and Methodology A randomized field experiment was conducted in order to analyse the causal impact of entrepreneurship training on labour market outcomes of graduate unemployed individuals in a manner as rigorous as possible. This training program, inserted in the program Active Life – Educate and Integrate was implemented through a partnership between Nova School of Business and Economics and Institute for Employment and Vocational Training (IEFP) - one of the main Portuguese institutions promoting active labour market policies and reintegrating the unemployed in labour market. The dataset used in this study is from Batista, C. (2013). One makes use of data on 94 unemployed individuals with higher education from IEFP's database. These data include the main demographic characteristics of project participants, such as name, age, email, personal contacts, current address, degree level, other qualifications or training participation and the main motivation for participating on this project. The intervention was implemented in October and November of 2012. From the 120 individuals of IEFP's initial dataset, 50 were randomly selected to the program, thus composing, the treatment group of those, who received the entrepreneurship training. The eligibility criteria for the participation in this program was based on the requirement that the involved individuals displayed at least one diploma of higher education not intrinsically or directly related to Management or Business issues. This experiment differs from the previous ones conducted on this field, in the sense that evolves exclusively graduate unemployed and the training is focused on entrepreneurial skills' improvement and their repercussion, among other outcomes, on individual's behavioural measures of networking, self-employment and employment probabilities. Main outcomes of the research and study's limitations To estimate the impact of entrepreneurship training, one should compare the outcomes of interest in the treatment and in the control group, with and without the baseline controls and other covariates. Individuals of both groups were followed –up through surveys at 3 and 6 months after the intervention. Due to the fact that only 94 individuals responded to both surveys, one excluded from the initial sample the remaining participants that were just followed up once. The most significant results of this study concerns the impact of training of behavioural measures of networking. Training's participants are significantly more likely to use LinkedIn for providing comments, likes or posts and also for adding connections (after three months of the intervention) or changing profiles (after six months of the intervention). Participants use at least every week the LinkedIn for essentially these purposes. Nonetheless, there was no evidence that the training enabled participants to distinguish more or less suitable job offers of Vida Activa or shared more these offers among them. The results of this experiment suggested that individuals who participated in training are not significantly more likely to become employed or full –time employed when compared to non-participants. There is no evidence that the training influenced substantially job seeking strategies of the beneficiaries compared to non- beneficiaries. There is evidence that the intention to become self-employed is positive but only of short-term and lose significance across time, which is congruent with existing literature. The same conclusion can be drawn from confidence levels' analysis. Confidence levels are no static, are reliable on conjecture indicators and may depend on opportunities to put in practice the new knowledge acquired. Some explanations behind the non-significance of the results on employment were provided, including the eminent economic and financial crisis, the rigidity and segmentation of Portuguese labour market prior to 2012's labour market reform, the learning curves and signalling theories and the skills mismatch present on labour market. For the self-employment results, those might be explained by the perceptions of uncertainty, market information asymmetry or unavailability, credit constraints, lack of financial incentives and risk inherent to the creation of a business as well as its sustainability over time, in particular under economic downturns evidenced on the context of this study. Implications for future research The main implications for future research comprise the insertion of risk aversion and entrepreneur's characteristics measures in order to obtain better results or understanding of other components that interfere on self-employment decisions. Additionally, conducting a qualitative research as a complement to the quantitative one is also important. This qualitative research might include measures of participants' satisfaction and suggestions for program's improvement. Lastly, in order to acquire significant results on employment rates, the classroom training, in which this entrepreneurship training is based, should be complemented with other types of training namely in -company training due to its benefits for future employment likelihood and acquisition of managerial skills and competences, also determinant for self-employment. ; Master [120] en sciences de gestion, Université catholique de Louvain, 2015

European and Portuguese Active Labour Market Policies (ALMP's) The improvement regarding effectiveness of labour market policies in Europe entails the undertake of programmes at an early stage, so that it can prevent the occurrence of long-term unemployment; the need to establish an adequate profile of the participants to infer their specific weaknesses, skill's needs and to allocate them to the most suitable programme, the targeting of wage subsidies might be run at a small-scale basis, and the existence of appropriate incentives for employers to retain workers after the subsidy's expiration. The European Commission defines the different ALMPs into several categories, such as: Labour market services (category 1): job-search assistance; Training (category 2); Employment incentives (category 4): hiring incentives for firms; Supported employment and direct jobs (categories 5&6): target particularly long term unemployed, youth or groups facing problems of inclusion and integration in regular labour market and Start-ups incentives (category 7). The Portuguese institutions that implement and reinforce the labour market policies, with overall responsibility of the Ministry of Solidarity, Labour and Social Affairs are the Institute for the Innovation and Training (Instituto para a Inovação na Formação) and specially the Institute for Employment and Vocational Training (IEFP-Instituto do Emprego e Formação Profissional). The main goal of this organism is to promote the creation and quality of employment and mitigate unemployment spells, through the conduction of ALMPs, namely vocational training. Some of the most relevant active labour market policies involve: Stimulus to employment or employment subsidy, Employment's internships, National Plan of implementation of a young's guarantee, Active youth employment, Youth Investment Program, Youth Boost Program, Active Life Program and Vocational Education and Training (VET). Data and Methodology A randomized field experiment was conducted in order to analyse the causal impact of entrepreneurship training on labour market outcomes of graduate unemployed individuals in a manner as rigorous as possible. This training program, inserted in the program Active Life – Educate and Integrate was implemented through a partnership between Nova School of Business and Economics and Institute for Employment and Vocational Training (IEFP) - one of the main Portuguese institutions promoting active labour market policies and reintegrating the unemployed in labour market. The dataset used in this study is from Batista, C. (2013). One makes use of data on 94 unemployed individuals with higher education from IEFP's database. These data include the main demographic characteristics of project participants, such as name, age, email, personal contacts, current address, degree level, other qualifications or training participation and the main motivation for participating on this project. The intervention was implemented in October and November of 2012. From the 120 individuals of IEFP's initial dataset, 50 were randomly selected to the program, thus composing, the treatment group of those, who received the entrepreneurship training. The eligibility criteria for the participation in this program was based on the requirement that the involved individuals displayed at least one diploma of higher education not intrinsically or directly related to Management or Business issues. This experiment differs from the previous ones conducted on this field, in the sense that evolves exclusively graduate unemployed and the training is focused on entrepreneurial skills' improvement and their repercussion, among other outcomes, on individual's behavioural measures of networking, self-employment and employment probabilities. Main outcomes of the research and study's limitations To estimate the impact of entrepreneurship training, one should compare the outcomes of interest in the treatment and in the control group, with and without the baseline controls and other covariates. Individuals of both groups were followed –up through surveys at 3 and 6 months after the intervention. Due to the fact that only 94 individuals responded to both surveys, one excluded from the initial sample the remaining participants that were just followed up once. The most significant results of this study concerns the impact of training of behavioural measures of networking. Training's participants are significantly more likely to use LinkedIn for providing comments, likes or posts and also for adding connections (after three months of the intervention) or changing profiles (after six months of the intervention). Participants use at least every week the LinkedIn for essentially these purposes. Nonetheless, there was no evidence that the training enabled participants to distinguish more or less suitable job offers of Vida Activa or shared more these offers among them. The results of this experiment suggested that individuals who participated in training are not significantly more likely to become employed or full –time employed when compared to non-participants. There is no evidence that the training influenced substantially job seeking strategies of the beneficiaries compared to non- beneficiaries. There is evidence that the intention to become self-employed is positive but only of short-term and lose significance across time, which is congruent with existing literature. The same conclusion can be drawn from confidence levels' analysis. Confidence levels are no static, are reliable on conjecture indicators and may depend on opportunities to put in practice the new knowledge acquired. Some explanations behind the non-significance of the results on employment were provided, including the eminent economic and financial crisis, the rigidity and segmentation of Portuguese labour market prior to 2012's labour market reform, the learning curves and signalling theories and the skills mismatch present on labour market. For the self-employment results, those might be explained by the perceptions of uncertainty, market information asymmetry or unavailability, credit constraints, lack of financial incentives and risk inherent to the creation of a business as well as its sustainability over time, in particular under economic downturns evidenced on the context of this study. Implications for future research The main implications for future research comprise the insertion of risk aversion and entrepreneur's characteristics measures in order to obtain better results or understanding of other components that interfere on self-employment decisions. Additionally, conducting a qualitative research as a complement to the quantitative one is also important. This qualitative research might include measures of participants' satisfaction and suggestions for program's improvement. Fecha de lectura: 25-06-2015 ; Almost a quarter century ago, the LEADER approach - Liaisons Entre Activités de Developpement de l´Economie Rural - was launched in the European Union, based on nine main approaches: the area-based approach, bottom-up approach, Partnership approach and the Local Action Group, innovation, integrated and multi-sectoral approach, Networking and cooperation between areas, and Local financing. LEADER what started as a community initiative, since 2007 became part of the fourth axis of the rural development policy in the European Union (EU). The aim of this study is to shed light on the transformation of rural economies, from the following claims: 1) Identify the endogenous and exogenous factors highlighted in the current local development policies, especially those related to equity and the trilogy strategy, territory and partnership; 2) Establish baselines between the LEADER (European Union) and Support Program for the Sustainable Development of the North Forest Zone of Pernambuco - PROMATA (Brasil) programs, seeking to contribute to the expansion of the panorama of the experiences of endogenous local development; 3) Conduct a SWOT analysis as applied to the study of territories, focusing on nine key aspects of the LEADER approach. For field research in the European Union were considered less developed areas, and the Rural Development Groups (Spain) - Local Development Associations (Portugal) who attended at least one of the first two stages of LEADER . Thus, the survey was conducted in the region of Andalusia, in the provinces of Córdoba, Granada and Jaén; and in the region of Trás-os- Montes, Alentejo and Algarve. In Brazil, the search includes the five municipalities in the Territory Pilot PROMATA - Aliança, Buenos Aires, Nazaré da Mata, Tracunhaém and Vicência - located in the Zona da Mata Norte of Pernambuco. Since the implementation of the LEADER approach to the analysis of PROMATA, followed by a comparative study between LEADER and PROMATA is possible to infer that the LEADER methodology, based on the theory of endogenous development, can be transferred to other Local Development Strategies (LDS) out of European Union. The territorial approach requires a dynamic space, less tied to their political and administrative structure, and more identified with the socio-cultural issues. In this context, there is no room to deny the past, nor to deny the changes and develop the future. It is also necessary to realize the elasticity of the binder, as may be necessary to choose a strong transversal theme, for an extended area. You can also confirm the importance of bottom-up approach to strengthen the LDS, through community empowerment and effective participation in local development solutions. We conclude that the participation of different local actors effectively inserted into the social and cultural context is essential to create a critical mass for both the implementation of the LDS. Still, we need tools that expand the capacity of perception of positive impacts in the areas of intervention, especially that which have better quality of life, before the action of the Development Strategies. For the integrated and multisectoral approach in LEADER is possible to observe a strong vertical integration between different levels of government, favored by the political and administrative structure of the European Union. Not so in Brazil, where the EDL have reduced their ability to respond, because they are not connected in a systemic way to further initiatives. For the success of the projects supported, and the presence of a Local Action Group (LAG) experienced and strengthened, it is necessary to take into account the state of the local business culture and fostering entrepreneurship through appropriate technical assistance and capacity building for development business plans, which must precede the initiatives. While in EU actions in favor of equity it seeks to promote equal opportunities for minority groups in Brazil is sought primarily to ensure access of the economically disadvantaged population to basic care services. Finally, it is observed that a lower level of education and institutionalization leads the greater difficulty in performing follow-up actions and Local Development Strategies evaluation. ; Hace casi un cuarto de siglo que la metodología Leader -Liaisons Entre Activités de Developpement de l´Economie Rural, en francés- se puso en marcha en la Unión Europea. Sus aspectos esenciales son el enfoque territorial, el enfoque ascendente, el partenariado y los grupos de acción local, la innovación, el enfoque integrado y multisectorial, la puesta en red, la dinamización y la cooperación y la descentralización financiera. El Leader, que empezó como una iniciativa comunitaria, desde 2007 pasó a integrar el cuarto eje de la política de desarrollo rural en la Unión Europea (UE). El objetivo general de la presente tesis es arrojar luz sobre la transformación de las economías rurales a partir de los siguientes objetivos: 1) identificar los factores endógenos y exógenos de relieve en las actuales políticas de desarrollo local, principalmente los relacionados con la equidad y la trilogía estrategia, territorio y partenariado; 2) establecer puntos de comparación entre los programas Leader (Unión Europea) y Programa de Apoyo al Desarrollo Sostenible de la Zona da Mata de Pernambuco-Promata (Brasil), buscando contribuir a la ampliación del panorama sobre las experiencias de desarrollo local endógeno; 3) realizar un análisis DAFO aplicado a los territorios de estudio, centrándose en los aspectos esenciales de la metodología Leader. Para la investigación de campo, en la Unión Europea han sido considerados los territorios menos desarrollados, y los grupos de desarrollo rural (España) y asociaciones de desarrollo local (Portugal) que participaron en por lo menos una de las dos primeras etapas de Leader. De manera que la investigación se ha llevado a cabo en la comunidad autónoma de Andalucía, en las provincias de Córdoba, Granada y Jaén, y en la región de Trás-Os-Montes, Alentejo y Algarve. El enfoque territorial presupone un espacio dinámico, menos vinculado a su estructura político-administrativa, y más identificado con las cuestiones socioculturales. En este contexto, no hay espacio para negar el pasado, ni tampoco para negar los cambios que construyen el futuro. Además, es necesario también percibir la elasticidad del elemento aglutinante, una vez que puede ser necesario elegir un tema fuerte transversal, en relación a un territorio ampliado. También es posible confirmar la importancia del enfoque ascendente para fortalecer la EDL, por medio del empoderamiento de la comunidad y su efectiva participación en las soluciones para el desarrollo local. Se concluye que la participación de los diferentes actores locales efectivamente insertos en el contexto social y cultural es fundamental para crear una masa crítica para la aplicación de la EDL. Todavía faltan instrumentos que amplíen la capacidad de percepción de los impactos positivos en las zonas de intervención, principalmente en las que dispongan de mejor calidad de vida, antes de la acción de las estrategias de desarrollo. En cuanto al enfoque integrado y multisectorial, en Leader es posible observar la fuerte integración vertical entre los distintos niveles de gobierno, favorecida por la estructura político-administrativa de la Unión Europea. Eso no sucede en Brasil, donde el potencial de intervención de las EDL se ve reducido porque estas no están conectadas de manera sistemática a las demás iniciativas. Para el éxito de los proyectos apoyados, además de la presencia de un grupo de acción local (GAL) experimentado y fortalecido, es necesario tener en cuenta el estado de la cultura emprendedora local y el fomento del emprendimiento, por medio de una adecuada asistencia técnica y capacitación para la elaboración de planes de negocios, que deben preceder a las iniciativas. Mientras que en las acciones de la UE en favor de la equidad se busca promover la igualdad de oportunidades para los grupos minoritarios, en Brasil se busca en primer lugar garantizar el acceso de la población económicamente desfavorecida a los servicios de asistencia básica. Por último, se observa que un menor nivel de educación y de institucionalización lleva a una mayor dificultad para realizar las acciones de acompañamiento y evaluación de las estrategias de desarrollo local

The aim of the thesis is to provide a convincing theoretical argument able to identify what are the policy problems that demand lawmakers' attention, but also to test this empirically for France, Denmark, Spain and the United Kingdom between 1980 and 2008. This research shows how accounting for the way in which lawmakers deal with competing policy problems integrate two major accounts of the way in which governments set their priorities: party mandate approaches and public policy approaches. The thesis does so by suggesting that given their double role of representatives and administrators, lawmakers have to deliver policies consistent both with electoral and non-electoral mandates. In this framework, parties' promises, administrative commitments, and the priorities of the public originate policy problems that compete for lawmakers' attention to enter the policy agenda. Compared to classic party mandate approaches, this research does not conceive parties as being the key actors of the game or the major agenda-setters. Compared to public policy approaches, the study does not dismiss the role of parties. The theory argues that a problem-solving approach is key to account for lawmakers' priorities and for the way in which lawmakers select policy problems that need to be addressed in the policy agenda. In this framework, different policy problems demand lawmakers' attention and problems-solving scholars have illustrated that the types of issues that need to be addressed are different in "nature". Existing accounts of the composition of policy agendas distinguish between problems ranging from "compulsory" to "discretionary" concerns (Walker 1977; Adler and Wilkerson 2012) where the former derive from "periodically recurring demands " and the latter from "chosen problems" (Walker 1977:425). Building on these contributions, the theoretical model of the dissertation discusses the "nature" of different policy problems by identifying some 'ideal types' that originate from the double functions that lawmakers shall perform in contemporary democracies as "representatives" of voters' interests and as "responsible" administrators (Mair 2009). In this sense, the dissertation contends that different policy problems emerge from the electoral promises of the governing parties, from commitments related to the responsibility of being in office, and from the 'external world', and that the balance between them determines the composition of the policy agenda. 13 There are four propositions of this study to existing knowledge in the field of policy agendas. The first is that the content of the policy agenda is stable across countries with different institutional settings. Lawmakers' priorities are no less stable in institutional systems that are more 'open' to accommodating policy problems brought by the electoral promises of the parties. At the same time stability persists even when elections approach, questioning the long-lasting assumption that lawmakers may manipulate policies to their will in order to assure re-election. The second is that policy problems brought by the electoral promises of the governing parties impact lawmakers' priorities, but this is only half of an old story. The results show that the policy problems originating from the electoral promises of the opposition influence the content of the policy agenda confirming that the agenda-setting power of parties is not limited to those who are in office. The third proposition is a theoretical effort and empirical contribution to conceptualise and measure "policy commitments". Studies of public policy have stressed the importance of inherited commitments in everyday law making (Rose 1994; Adler and Wilkerson 2012) since some decisions take longer than a legislature to be realised. Classic analyses have emphasised the importance of budgetary constraints on policy agendas, but the thesis suggests that there is also another striking case of policy commitments for European polities: EU integration, since decisions on EU affairs and delegation of powers taken from previous governments are hard (if not impossible) to reverse by their successors. In this sense, EU decisions are inherited by all governments, and they add complexity to the problem-solving capacity of Member States because they produce extra policy problems that require lawmakers' attention. For lawmakers respecting legally binding EU decisions, this is a way to avoid "reckless and illegal decision making" (Mair 2009). The results highlight that when reflecting on the divisions of competences between the Union and its Member States (MSs), policy commitments derived from the EU directives are concentrated on a narrow set of policy areas. The results show that in most fields where commitments are higher, the agenda-setting power of parties' electoral promises is weakened. Finally, this research suggests that policy problems originating from the agenda of the public (as approximated by media coverage) are another explanatory factor of policy priorities, but in a very narrow set of policy areas. Media effects appear to be limited to policy areas with the special characteristics of newsworthiness and sensationalism (Soroka 2002) that contribute to boost their policy appeal. In addition, the findings highlight that the agenda-setting power of the media is mediated by the interaction with the electoral promises of the opposition, probably as a result of a blame avoidance game to discredit incumbents. 14 Chapter 1 introduces the concepts of policy agenda and policy problem before summarising existing accounts of the content of policy agendas. Two theoretical traditions are identified. The first one is the "partisan account" highlighting the importance of partisan preferences for lawmakers' priorities. The second is made up of the "public policy accounts" proposing incrementalist and agenda-setting approaches to representatives' priorities. Chapter 2 sets up the theoretical framework that will be tested in this research. Drawing upon theories of "representative and responsible" government (Mair 2009) the research provides an encompassing model of how different policy problems compete for attention in order to enter the agendas of lawmakers. The thesis highlights that different agenda-setters have to be considered as creating policy problems: the electoral promises of the governing parties, the demands addressed to lawmakers by the EU agenda, and the issues that are important for the public as reported by the media. Starting from existing typologies of problems that must be addressed in the policy agenda (Walker 1977; Adler and Wilkerson 2012), the research roughly distinguishes between discretionary and compulsory policy problems, discussing how the three agenda-setters considered in this study fit into those ideal types, as well as the incentives for lawmakers to prioritise one over the other. Chapter 3 presents the data, models and methods that are used to test the theoretical framework. The dissertation relies on data from the Comparative Agendas Project modelled in the form of time series cross sectional models. Chapter 4 introduces the empirical investigation of the content of the policy agenda. It focuses on stability and change in lawmakers' priorities, to understand the extent to which priorities change (or remain the same) across elections. Chapter 5 moves a step further and will assess the connection between policy problems brought by parties' electoral promises and the content of the policy agenda. Chapter 6 will account for one of the most debated sources of policy problems among public policy scholars: policy commitments. This chapter will test the agenda-setting power of policy commitments deriving from the content of the EU directives on lawmakers' priorities and proposing an "EU acquiescence index" to shed light on the 'overlaps' between EU and domestic policy agendas. Finally, Chapter 7 aims at analysing the connection between lawmakers' priorities and media coverage (in terms of print and, where appropriate, audio media) and each of the two relevant types of policy problems competing for lawmakers' attention identified in the previous chapters. In sum the thesis offers a theory of the composition of policy agendas grounded in a problem-solving understanding of politics, and an empirical assessment of its validity. In this sense the study is about how policy problems originating from the dual role of lawmakers in 15 contemporary democracies (representation and administration) affect everyday policy making. More precisely the thesis considers the impact of different agenda venues (parties, EU commitments, and the media) on the way in which lawmakers deliver policies.

Resumen: Este trabajo analiza la acción colectiva sindical postnacional en el MERCOSUR en un período histórico signado por profundas mutaciones políticas, económicas, y productivas sociales (1991-2012) a partir de los relatos y representaciones de sus protagonistas. El trabajo cualitativo intentará explicar la configuración del sindicalismo internacional en la globalización, y describir las estrategias del movimiento obrero mercosureño. La metodología cualitativa ilustra un trabajo de campo a partir de entrevistas en profundidad a 34 sindicalistas del Mercosur, y entrevistas adicionales a tres representantes de la Confederación Sindical de las Américas, dos empresarios del Mercosur, un especialista académico en la dimensión sociolaboral de la integración regional y un representante de la OIT en la región. La metodología de análisis e interpretación de dichas entrevistas ha sido la teoría fundamentada, entendida como la técnica más idónea de aprehender los procesos sociales a través de las voces de los líderes obreros, comprender su realidad, sus representaciones y sistema de valores, sus ideas y su acción colectiva. La literatura de los movimientos sociales en la globalización capitalista ha puesto el énfasis en la emergencia de nuevos colectivos cuyos reclamos se concentran en el reconocimiento (Fraser y Honneth, 2006) de sus identidades que el modelo fordista de producción pareció invisibilizar y soslayar ante la primacía de las prácticas económicas y demandas distributivas. Esta tesis conjuga una perspectiva dualista y demuestra que las estrategias de reconocimiento y las reivindicaciones de redistribución de tipo clasista se resignificaron en el escenario postnacional a través de la Coordinadora de Centrales Sindicales del Cono Sur –CCSCS- (subregional) y, con un desarrollo menor: los Sindicatos Globales (FSI, GUFs) en la acción sectorial [1991-2012]. Para arribar al núcleo configurativo de sus representaciones y su sistema de valores, la investigación transitó por los sentidos y significados del trabajo, las mutaciones productivas y de las condiciones del trabajo, las teorías del fin del trabajo, la precarización y la representación de los trabajadores más frágiles: mujeres, jóvenes y migrantes. En un segundo orden se interpeló sobre la gobernanza mundial, los organismos internacionales, el régimen normativo internacional, la civilización capitalista, para luego abordar el estudio específico del Mercosur y la acción obrera en dicho proceso. El núcleo determinó que para los representantes obreros la acción colectiva sindical debe ser postnacional y su objetivo es limitar la globalización capitalista neoliberal. La CCSCS conformó desde sus inicios un movimiento capaz de elevarse al rango supranacional para representar la voz de los trabajadores del MERCOSUR. La pluralidad configuró su mayor virtud durante sus primeros 20 años, reconociendo una experiencia de aprendizaje de tolerancia y respeto, que ellos definen como la unidad en la diversidad. Esta entidad constituye un patrimonio único como paradigma del sindicalismo postnacional. Los sindicatos del Cono Sur adoptaron diversas modalidades de acción colectiva: a) reactiva (con repertorios de insubordinación, de lucha y resistencia al modelo neoliberal), b) proactiva (con repertorios de incidencia normativa en el MERCOSUR) y c) participativa (con repertorios de producción propositiva de incidencia en la dimensión social del MERCOSUR). Su acción colectiva reactiva, normativa y propositiva fue eficaz a mediano plazo para participar e incidir en el MERCOSUR, crear una dimensión social del bloque y dotar de derechos normativos a los ciudadanos de la región. Su acción tuvo un sentido político de gran poder instituyente, con capacidad movilización y alta exposición pública. Sin embargo, en la segunda década su lógica de construcción quedó subordinada a los procesos nacionales y a los partidos gobernantes, dejó de ser performativa y de creación política, dirimiéndose en la esfera social junto a otros movimientos sociales emergentes, y provocó un ciclo de desmovilización. Simultáneamente, emergió con fuerza otra modalidad de sindicalismo postnacional con la fusión y refundación de los Sindicatos Globales. Su acción sectorial contribuye a restaurar las demandas de distribución que habían quedado soslayadas, pero esta tesis manifiesta que los protagonistas afirman que sus marcos de acción colectiva deberán ser conjuntos para ser exitosa. El sindicalismo postnacional en el MERCOSUR se define a sí mismos como agente de desarrollo, protagonista del modelo socioproductivo, pero también como vehículo partícipe de la democracia y de una matriz sustentable de desarrollo ; Abstract: This thesis analyzes the post-national trade union collective action within MERCOSUR in a historical period marked by profound political, economic, and social-productive changes (1991-2012) arising from the accounts and representations of its protagonists. This qualitative paper will attempt to explain the configuration of international unionism in globalization times, and describe strategies of the MERCOSUR labor movement. The qualitative methodology illustrates a fieldwork that arose from 34 in-depth interviews with MERCOSUR trade union leaders, and additional interviews with three representatives of the Trade Union Confederation of the Americas, two MERCOSUR executives, an academic specialist on the social and labor dimensions of regional integration and a representative of the ILO in the region. The methodology of analysis and interpretation of those interviews has been the grounded theory, which is understood as the most suitable technique to apprehend the social processes through the voices of trade union leaders, understand their realities, their representations and system of values, ideas and collective action. The bibliography of social movements in capitalist globalization has focused on the emergence of new groups whose demands are concentrated on the recognition (Fraser and Honneth, 2006) of their identities, which the Fordist production model seemed to neglect and make it invisible before the supremacy of economic practices and distributive demands. This thesis combines a dualistic perspective and demonstrates that strategies for recognition and class-based redistribution policies have been redefined in the post-national scenario through the South Cone Trade Unions Coordination -CCSCS- (sub-regional) and with less progress: Global Unions (FSI, GUFs) in sectorial action [1991-2012]. In order to get to the organizational core of its representations and system of values, this research paper run through the purposes and meanings of labor, productive changes and working conditions, theories of the end of labor, precarious work and representation of the most vulnerable workers: women, youth and migrants. On a second matter, this paper questions about global governance, international organizations, international regulatory framework, capitalist civilization, and then addresses the specific field of study of Mercosur and the labor action in its process. The core determined that for labor representatives the trade union collective action should be post-national and its purpose is to limit the neoliberal capitalist globalization. The CCSCS established since its beginning a movement able of rising to the supranational level in order to represent the voice of workers in MERCOSUR. Plurality was its greatest virtue during its first 20 years, while recognizing a learning experience of tolerance and respect, which they define as unity in diversity. This entity constitutes a unique heritage serving as a paradigm of post-national trade unionism. Trade unions of the South Cone adopted various forms of collective action: a) reactive (consisting of a set of insubordination, struggle and resistance to the neoliberal model), b) proactive (consisting of a set of regulatory impact on MERCOSUR) and c) participatory (consisting of a set of purposeful production impact on the social dimension of MERCOSUR). Its reactive, proactive and participatory collective action was effective, in the medium term, in order to participate and influence on MERCOSUR, create a social dimension of the block and provide a regulatory framework for the citizens in the region. Its action had a great sense of institutive political power, with a mobilization capacity and high public exposure. However, in the second decade, its logic of creation remained subjected to the national processes and ruling parties, it started losing its performative and policy creation qualities, settling in the social sphere with other emerging social movements causing a cycle of demobilization. Simultaneously, it strongly emerged another form of post-national trade unionism with the merger and restoring of Global Unions. Its sectorial action contributes to restore distributive demands that had been neglected, but this thesis states that the leading players claim that their collective action frameworks should be jointed in order to be successful. Post-national trade unionism in MERCOSUR defines itself as a developing agent, a protagonist of the social productive model, but also as a vehicle to engage in democracy and in a sustainable development matrix

Ce travail se propose de mettre en évidence l'importance des approvisionnements des produits alimentaires en provenance du district de Rusizi (Rwanda) dans la sécurité alimentaire de la ville de Bukavu. Pour cela, il s'est alors avéré nécessaire de connaître leurs ampleurs et déterminants ainsi que leurs conséquences qui restent insuffisantes en raison de leur caractère informel, afin de définir des politiques visant à améliorer la situation et pouvant faciliter l'intégration sous-régionale. Le travail de terrain a consisté en deux séries d'investigations : d'une part les pointages des flux des produits alimentaires pour trois mois (mai, juin et juillet 2010) et par axe d'approvisionnement de la ville de Bukavu, d'autre part une enquête par questionnaire sur un échantillon de 233 ménages dont 76 ménages-consommateurs et 157 ménages-revendeurs. Le pointage des flux des produits alimentaires montre que 2.021 ménages en moyenne traversent chaque jour les deux frontières pour y effectuer leurs approvisionnements alimentaires dont 661 ménages (32,7%) sont des consommateurs directs des produits alimentaires et 1.360 ménages (67,3%) sont des revendeurs. Excepté le manioc qui est une culture traditionnelle du Sud-Kivu, les bananes plantains à cause du problème de conservation, provenant beaucoup plus de l'intérieur de la province, et le haricot provenant beaucoup plus du Nord-Kivu, les pointages des flux des produits alimentaires, ont montré que les taux de dépendance au Rwanda restent fort élevés pour les produits comme le maïs (66%), la pomme de terre (82%), le sorgho (73%), l'arachide (69%), la patate douce (98%), le riz (70%) et les viandes de bœuf et porc (85%). Avec ces taux de dépendance, la ville de Bukavu constitue l'un des grands marchés des produits alimentaires du district de Rusizi (Rwanda), ce qui est loin d'être confirmé par les statistiques officielles des importations de l'Office Congolais de Contrôle (OCC/Sud-Kivu) qui, excepté pour le riz, sous-estiment les flux frontaliers d'une grande partie des produits alimentaires de base. Les produits de base concernés fournissent à la population de la ville de Bukavu 1.027 kcal par personne et par jour dont 593,5 kcal, 338,9 kcal et 92,4 kcal sont fournis par les produits en provenance respectivement du Rwanda, du Nord-Kivu et de l'intérieur de la province du Sud-Kivu. Les calories consommées dans la ville de Bukavu sont essentiellement d'origine végétale dominées par le maïs (563,1 kcal), le manioc (120 kcal) et le haricot (167,1 kcal) qui jouent un rôle stratégique étant donné leur importance dans les habitudes alimentaires de la ville de Bukavu. Les flux importants des approvisionnements alimentaires en provenance du district de Rusizi font vivre des milliers de familles dans la ville de Bukavu. Il se dégage que tous les produits approvisionnés du district de Rusizi par les ménages-revendeurs réalisent des résultats positifs par mois qui constituent la rémunération non seulement du capital mais aussi de l'effort et du temps investis par les ménages-revendeurs pour leur activité (en moyenne 5,67 heures). Plus de 68% des ménages-revendeurs affirment être satisfaits du résultat de cette activité et l'orientent principalement à couvrir les besoins de subsistance. L'analyse du budget des ménages-consommateurs montre que 69,1% des dépenses alimentaires et 48,8% des dépenses totales des ménages-consommateurs traversent les frontières. L'impact significatif des approvisionnements alimentaires issus du district de Rusizi sur la réduction de l'état de pauvreté monétaire des ménages-consommateurs, témoigne de l'intérêt du commerce frontalier qui ne fait que renforcer le déclin structurel et relatif du secteur agricole du Sud-Kivu, déjà confronté à divers problèmes. La politique de libre-échange prônée par un grand nombre de groupements sous-régionaux et régionaux comme la CEPGL et le COMESA permettra de rendre efficace les approvisionnements alimentaires de la ville de Bukavu en provenance du district de Rusizi, mais cette dernière reste une solution à court terme pour la sécurité alimentaire de la ville de Bukavu en particulier et la province du Sud-Kivu en général. A long terme, il convient de stimuler la production et de favoriser le commerce des produits alimentaires locaux. Pour cela, il faut investir dans le secteur agricole. C'est à ce prix-là qu'on peut parvenir à relancer le secteur agricole du Sud-Kivu et atteindre le seuil de l'autosuffisance, voire réaliser un surplus à exporter. Certes, cette solution posera alors le problème de reconversion des ménages-revendeurs et ménages-consommateurs qu'il conviendra de repenser dès le début. ; This thesis aims at highlighting the importance of food supply from the Rusizi District (Rwanda) in the food security of the city Bukavu (Democratic Republic of Congo). Due to the informal nature of this supply, it was necessary to characterize its magnitude, drivers, and consequences as well as to develop policies that are likely to improve this supply and facilitate regional integration. The fieldwork consisted of two series of investigations. The first series of data collection included scoring the flow of food supply from Rusizi District during three months and for each of the food supply axes of Bukavu city. Secondly, a questionnaire was administered to a sample of 233 households, wherein 76 consuming households and 157 reselling households. Results from the scoring exercise show that 2,021 households on average cross both borders (Rusizi 1 and Ruzizi 2) for their food supply daily. A total of 661 of these households (about 32.7%) are direct food consumers and 1,360 households (about 67.3%) are food resellers. Excepted for cassava (which is a traditional staple of South Kivu), plantains (because of conservation problem, much more coming from within the province), and beans (much more from North Kivu), other major food products are imported from Ruzizi district in Rwanda. In this regard, the dependency ratios towards Rwanda remain much higher for products such as maize (66%), potatoes (82%), sorghum (73%), groundnut (69%), sweet potato (98%), rice (70%), and beef and pork meat (85%). With such dependency ratios, Bukavu is a major food market of the Rusizi District (Rwanda) food products. This is however far from being confirmed by official import statistics of the Congolese Control Office (CC0) which, except for rice, underestimates the border trade for a large portion of food commodities flows. The commodities analyzed provide the population of the city of Bukavu 1027 kcal per person per day from which 593.5 kcal, 338.9 kcal and 92.4 kcal are provided by products respectively from Rwanda, North-Kivu and South-Kivu. The calories consumed in the city of Bukavu are mainly of vegetable origin dominated by maize (563.1 kcal), cassava (120 kcal) and beans (167.1 kcal), which play a strategic role given their importance in the food habits of Bukavu. The significant flows of food supplies from Rusizi district are a major contribution to the livelihood of thousands of families in the city of Bukavu. It emerges that all products supplied from Rusizi district by reselling households generate positive return per month demonstrating a positive remuneration not only for the invested capital, but also for the time and effort invested in the activity (average 5.67 hours). More than 68 % of reselling households claim are satisfied with the result of this activity and allocate the generated income mainly to cover subsistence needs. In this sense, the economic impact of border trade on incomes of reselling households is a reality. The analysis of budgets of consuming households shows that 69.1% of food expenditure and 48.8% of total expenditure of consuming households cross the border. The significant impact of food supplies from the Rusizi district on reducing households' income poverty, reflects the interests of border trade which only reinforces the structural and relative decline of the agricultural sector in South Kivu already confronted to various problems. The free trade policy advocated by a large number of sub-regional and regional communities such as CEPGL and COMESA will make the Rusizi originating food supply of Bukavu more efficient, but it remains a short-term solution of food security of the city and the province in general. In the long term, it would be better to stimulate the production and promote local food trade. To achieve this, investments need to be channeled to the agricultural sector. It is at this price that the agricultural sector in South-Kivu can be revived and reach the threshold of self-sufficiency, and even create a surplus for export. Admittedly, this solution then poses the problem of reconversion of consuming households and sellers-households that we should rethink from the outset.

Aboriginal representatives contemplating an open argument with the Aboriginal and Torres Strait Islander Commission(ATSIC) about funding or representation sometimes caution each other:'don't shoot the banker'. There is little doubt that this volume of essays on ATSIC will be taken in some quarters to be doing just that, but they are intended, and should be viewed, in a more constructive light. They are a collective attempt to analyse this complex organisation after six years of its operation, and to open up debate about reform. The writers adopt a variety of perspectives on the role and impact of ATSIC, and they do not agree with each other on all points. The volume as a whole concentrates on the representative role of ATSIC, its presentation of itself as the supreme Aboriginal representative and political body. It does not echo the fairly common, and often misplaced, criticisms of waste and inefficiency of ATSIC as a development program funding organisation. The writers understand the difficulties faced by staff, councillors and Commissioners in meeting the massive problem of Aboriginal material advancement. They would all feel, however, that ATSIC can also make its problems greater by ignoring much of the advice, experience and community knowledge of other Aboriginal organisations and individuals. The essays in this book span the wide area in Aboriginal politics that ATSIC itself covers. HC (Nugget) Coombs opens the volume with a reminder of the history and origin of the present structure, which is a far cry from the recommendations of his report that led to the abolition of its predecessor, the National Aboriginal Conference (NAC). He is particularly critical of ATSIC's electoral system which neglects to include existing community-based representative organisations. Several of the chapters are concerned with problems of ATSIC Regional Councils. In particular, Rowse's examination of the emerging political consciousness of Regional Councillors complements Finlayson and Dales's analysis of the frustrations of Regional Planning from the participants' perspective, and the tensions this produces between the Regional Councils and ATSIC itself. Smith's chapter concerns the problem of dealing with Aboriginal cultural complexity and diversity in a single structure. The chapter places the regional concerns examined by Rowse, and Finlayson and Dale, in the context of ATSIC's national funding and policy strategies. Both my chapter and Dillon's are concerned also with these 'big picture' issues. I examine ATSIC's role as the political representative of a distinct and separate people which, due to Australia's international obligations, has a right of political self-determination in association with the nation state. I find it is not constituted to perform this well, and has its effectiveness further reduced by having the incompatible responsibility of Aboriginal development and welfare funding. Dillon looks for the reasons for confusion and ineffectiveness of ATSIC's many roles in the turbulent history of its foundation, and the complexities of Aboriginal political life. He concludes ATSIC would do better if it did less, backed off from its claim to be supremely representative, and made better use of its unique position within government, rather than distinct from it. The range of these essays shows clearly one immediate problem with assessing ATSIC - it has no single and easily grasped corporate nature. Any statement about ATSIC must suffer from being aimed at only one of the manifestations of this highly complex organisation to the neglect of others. This is as true for an outside observer as for the varied participants. Even a Regional Council Chairperson may from time to time be heard to refer to their Council's 'trouble with ATSIC', as if they were not themselves ATSIC. Thus, there is a danger of allowing critical points levelled at one aspect of the organisation to overshadow or neglect contradictory elements of the same organisation that are moving in alternative directions. In comparison with previous administrative arrangements ATSIC has been an enormous step forward for indigenous control of important aspects of life. Equally, it has over its first six years of operation provided a proving ground for much indigenous expertise and raised, wittingly or not, high expectations. It is the voices of those pushing at the outer limits of ATSIC's capabilities that, by and large, the authors of the essays in this volume are used to hearing. From these essays on diverse regions and areas of ATSIC's operation some common themes emerge. All papers reveal that greater regionalisation of the ATSIC structure and greater integration with Aboriginal communities and their organisations is called for. Regionalisation is now recognised to be a positive step by many people within ATSIC itself, but this needs to go further than simply increasing local control over development plans. Most of the papers, but in particular Rowse's analysis of the opinions of Regional Councillors, and Finlayson and Dale's description of their planning problems, lead to the conclusion that: • Funding needs to be aggregated much more than at present. Blocks of funds for broad purposes should be made rather than the multitude of single project schemes that now abound. Many block grants could be allocated on at least a triennial basis rather than following the present annual bidding cycle. Problems of accountability can be overcome, as they are in other publicly-funded organisations. • Regional Councils should be integrated much more firmly with existing regional and local community organisations. • If this is done, Regional Councils must be better resourced to act as regional representatives. Regional Plans must be seen as part of the political accommodation between whites and Aborigines in a particular region, not just as money grant wish-lists. This requires greater use of Regional Office resources, and a reexamination of the role of the Regional Office itself. Changes of this nature are being increasingly driven by the need for better representation of Aboriginal interests in the regions, particularly as a result of the Native Title Act 1993 and the mediation requirements of the National Native Title Tribunal. More powerful regional bodies, with more security of funding, which gain a wider role for themselves as representatives, rather than simple distributors of funds, would bring into question ATSIC's national role. While firmly defending itself from outside criticism, ATSIC nationally often does not seem to have a clear policy about its role. • Is it the cradle-to-grave care provider it often suggests it ought be? • Is it the Aboriginal parliament its original conservative critics feared it would be? • Or should it simply be a coordinating and consultation body to render more effective development programs administered by other bodies? The confusion of functions, and resultant frustration, revealed in many of the chapters in this book lead to the conclusion that ATSIC should not try to be all of these things it is neither possible nor required. Its representative structure relies too much on rather simple and formal electoral principles at the national Board level, providing no means of ensuring the necessary synthesis and balancing of community voices. To have a 'representative structure' is not the same as to actually be politically representative. Nor does ATSIC's control of Aboriginal material development programs mean that Aborigines are at last running their own affairs. There is more to self-determination than this. In practical terms as well it cannot fund and administer every aspect of Aboriginal development. It does not have the expertise, and if it were to acquire it this would be a wasteful duplication. As presently structured, it is equally far from being able to offer Aborigines self-government, either regionally or nationally. Self­ government must necessarily develop regionally. Even if the regional developments suggested here do occur, this will not automatically make the elected board, or the bureaucratic office­ holders, more authentically representative of Aboriginal voices. A broader forum is required for this. One in which Regional Councils and community organisations can directly participate, as my chapter suggests. Mike Dillon also points out, ATSIC would be more effective accepting itself as part of government - a rather privileged and potentially influential part. It should use its power of closeness to government, coupled with its relative independence, to influence more effectively the other Commonwealth program and policy providers. It could then strategically allow the emergence of a more independent forum for the diversity of Aboriginal political views. This may be the role it eventually accepts at the national level- the coordinator of national Aboriginal development policy. With a regional structure more effectively empowered to reflect regional needs it could perform this function well, and contribute its voice as the arm of Aboriginal material development - one powerful voice among many of the legitimate Aboriginal representative organisations throughout the country.

Sosialistisessa T ekkoslovakiassa yksilöiden ammatilliset ja henkilökohtaiset selviytymisstrategiat olivat monipuolisempia kuin on yleensä ajateltu. Toimintamallit ja vaikutuskeinot eivät aina noudata stereotyypistä jakoa kommunisteihin ja ei-kommunisteihin. Tutkimus analysoi tunnettujen t ekkoslovakialaisten luonnontieteilijöiden toimintaa kylmän sodan aikana. Luonnontieteet on tutkimuksessa esimerkki rautaesiripun lävistäneestä yhteistyöstä. Yksilötason tarkastelu hahmottaa yhteistyön muotoja, haasteita ja tuloksia. Tutkimus tarkastelee sosialistisen maan tieteentekijöiden toimintaa kansallisessa ja kansainvälisessä tutkijayhteisössä sekä heidän erilaisia selviytymismallejaan pitkällä aikaväillä vuosina 1945 1989. Luonnontieteilijät nousevat tutkimuksessa esiin niin menestyneinä keksijöinä, tieteen managereina, yhteiskunnallisina kriitikkoina kuin myös salaisen poliisin vainoamina epähenkilöinä. Henkilöesimerkkeinä on kaksi kemistiä, Franti ek orm ja Otto Wichterle. orm oli T ekkoslovakian tiedeakatemian puheenjohtaja 1960-luvulla ja Wichterle tunnetaan erityisesti pehmeiden piilolinssien keksijänä. Molemmat olivat tietoisia kansainvälisen yhteistyön ja liikkuvuuden merkityksestä heidän tutkimukselleen. Kommunistiselle puolueelle kansainvälinen yhteistyö oli sen sijaan ongelma. Todistellakseen lojaalisuuttaan Neuvostoliitolle T ekkoslovakian oli rajoitettava omien tutkijoiden yhteistyötä länsimaisten tieteentekijöiden kanssa. Vapauden määrään, jonka puolue oli luonnontieteilijöille valmis sallimaan, vaikuttivat paitsi poliittiset suhdanteet myös taloudelliset tekijät. Näitä muutoksia kuvaa Wichterlen esimerkki. Wichterle ei ollut kommunistisen puolueen jäsen ja hän kritisoi avoimesti tieteen paikallisia käytäntöjä. Siitä huolimatta hän toimi tiedeakatemian alaisen instituutin johtajana, ministeriön neuvonantajana, kansainvälisen tiedeorganisaation aktiivisena jäsenenä sekä Prahan kevään aikana poliittisena vaikuttajana. T ekkoslovakian halukkuus osallistua tieteellis-teknologiseen vallankumoukseen ja tieteen kansainväliseen kilpailuun kiihtyi 1960-luvulla. Prahan kevään aikaisista tieteen uudistuspyrkimyksistä tärkeimpiä oli kansainvälisen liikkuvuuden lisääminen. Tutkimus osoittaa, että yksilöt, joilla oli riittävästi auktoriteettia, ammatillista osaamista ja vaikuttamisväyliä, kykenivät vaikuttamaan tiedepolitiikkaan. Neuvottelu vallanpitäjien kanssa oli edellytys sille, että tutkimuksen tekemisen ehdot paranivat. Myös puolue oli riippuvainen luonnontieteilijöiden osaamisesta. Heitä konsultoitiin mm. taloudellisesti merkittävissä kysymyksissä. Luonnontieteilijöiden ammatillinen osaaminen sai 1960-luvun lopussa suuremman painoarvon tiedemaailmassa kuin puoluekirja. Muuttuneet realiteetit ja tiedemiesten aktiivisuus mahdollistivat yhden menestyksekkäimmistä idästä länteen suuntautuneista teknologiasiirroista eli pehmeiden piilolinssien lisenssin myymisen Yhdysvaltoihin vuonna 1965. T ekkoslovakian miehitys elokuussa 1968 oli vakava takaisku t ekkoslovakialaiselle tiedeyhteisölle. Miehitys ja sitä seurannut normalisointi vaikeuttivat ja rajoittivat tieteentekijöiden ammatillisia mahdollisuuksia ja liikkumavapautta. Yksilötasolla Prahan kevään ajatukset jäivät elämään ja pohjustivat samettivallankumouksen jälkeisiä uudistuksia. ; This research analyses the activities of prominent scientists in Czechoslovakia during the Cold War. The research highlights the active role of individual scientists and investigates their participation in national and international scientific communities as well as their manifold survival strategies and room for manoeuvre. The role of natural scientists in society is illustrated by case studies of two chemists, Franti ek orm the President of the Academy of the Czechoslovak Sciences and Otto Wichterle the inventor of the soft contact lens. The individual scientists recognised the dependence of their research on world science. They had to engage in constant negotiations with the state, which in turn attempted to limit this necessity because of its own political and ideological dependency on the Soviet Union. As the case studies exemplify, individuals with sufficient authority, scientific capacity and access to the Party structures could, however, use their bargaining powers to influence science policy. At the level of the natural sciences the Communist Party was dependent on the expertise of scientists and had to consult them on issues that were relevant among others for solving larger economic questions. The strategies of the two scientists to navigate in their professional lives do not always fit the stereotypical dichotomy of communist and non-communist but are far more nuanced. The study argues that the amount of the freedom granted to natural scientists varied in time and was a consequence of many factors. One of the historical events influencing the scientists' amount of freedom was the Czechoslovak invasion in August 1968. It had dramatic consequences for Czechoslovak society for years to come. It forced the case study scientists to give up their highly ambitious professional careers. The world-class scientists became persona non gratae and were followed by the State Security Police. In this research, the August 1968 occupation of the country by the Warsaw pact forces and its aftermath presents itself as a historical watershed. The study is divided into three parts. The first part offers a historical background with a particular emphasis on the period of the Nazi occupation and the subsequent period of socialism until 1960. From the era of relative autarky and restricted contacts with the outside world in the 1950s, Czechoslovakia went further than other countries of the socialist bloc in its aspiration to improve Western cooperation. International cooperation was one of the priorities of Czechoslovak natural scientists. When the opportunity was given, scientists published in international journals, participated in conferences, organised them, and were involved in international scientific organisations. The second part covers the gradual liberalisation of the 1960s and the events of the Prague Spring in 1968. Czechoslovakia gradually acknowledged the necessity to cooperate with Western universities and scientific communities. Moreover, problems in the intra-bloc cooperation worked as a catalyst for further Western cooperation. Through participation in these scientific communities scientists gained Western recognition. In order to maintain its international reputation Czechoslovakia had to acknowledge the meaning of those organisations. The third part of this study investigates the consequences of the occupation and the era of so-called normalisation until the collapse of communism in 1989. By the end of the 1960s from the point of view of the Soviet Union Czechoslovakia had crossed the line of what was permitted. The invasion and its aftermath were an example of how politics forcefully interfered in the realm of science and influenced the life of individual scientists. The research relies on empirical and critical qualitative analysis of sources. The research uses social and political history approaches by setting the case study examples into the wider social and political context of the time. It thus looks at Czechoslovak society through the prism of academia. The research focuses on cooperation, interactions and attempts to avoid divisions into polar categorisations. Instead of opting exclusively for either a macro or micro level perspective, three levels are used in the analysis: a micro level (individual level), a middle level (the Academy of Sciences) and a macro level (the state and international level). The case studies of prominent chemists exemplify all three levels as well the interactions between the respective levels. Macro level source material used in this study consist mainly of the documents of the Central Committee of the Communist Party of Czechoslovakia, the Ministry of Foreign Affairs and the State Security Police. At the middle level this study uses material from the archives of the Academy of Sciences such as reports on science policies and foreign exchanges, documents of chemical institutes, the patent department and travel reports of scientists. At the micro level, correspondence, biographies, autobiographies and interviews are the most important sources. In this study, the innovation of the soft contact lens represents a high-level Eastern achievement in science and technology. The study shows how the liberalisation process of Czechoslovak society created conditions for technology transfers from East to West as happened with the soft contact lens. The transfer required both government support and an opening up towards the West. Without these conditions the transfer of the lens would have not been realised, but Otto Wichterle was someone who rose to the challenge. The licence for the soft contact lens was sold to the USA in 1965 and after that it revolutionised the contact lens industry worldwide. Hence, in this study the natural sciences are used as an example of a phenomenon of penetration of the Iron Curtain from East to West. The focus is on forms of cooperation without direct relation to Cold War competition in armaments production. These forms of scientific cooperation therefore rather supported further and more efficient contacts and connected the two societal systems. In Czechoslovakia, the desire to succeed in the worldwide revolution of science took more radical form in the late 1960s than elsewhere in Eastern Europe. Concepts like the Scientific and Technological Revolution and the integration of world science began to appear in the official rhetoric on scientific issues from the mid-1960s onwards. It seems that Czechoslovakia grasped the opportunity offered by the notion of the Scientific and Technological Revolution. As a result of the Warsaw Pact invasion and the following normalisation, these ideas supporting academic freedom were shelved for two decades. However, at the level of individual scientists, these ideas which had been allowed to be expressed openly in the late 1960s survived symbolised by the election of Otto Wichterle as the President of the Czechoslovak Academy of Sciences after the Velvet Revolution. After 1989 Czechoslovakia began to rapidly re-establish academic contacts with Western scientific communities. At least at the level of freedom of movement, the ideas and hopes of the Prague Spring reformers of science were finally fulfilled.

Einleitung: Die Verfassungswidrigkeit der ARGEn und das Erfordernis, die Grundsicherung für Arbeitsuchende neu zu regeln: Eine der umfangreichsten Sozialreformen in der Geschichte der Bundesrepublik Deutschland trat in Form des Sozialgesetzbuches II, der Grundsicherung für Arbeitsuchende, am 01.01.2005 in Kraft und führte die vormals bestehende Sozialhilfe nach dem BSHG mit der Arbeitslosenhilfe nach dem SGB III zusammen. Ziel der Reform war unter anderem, das Nebeneinander mehrerer Transferleistungen zu beenden und die Hilfen aus einer Hand zu gewährleisten. Der während des Gesetzgebungsverfahrens entbrannte politische Streit, wer Träger dieser neu geschaffenen Leistungen sein sollte und wie die organisatorische Umsetzung auszusehen habe, konnte nur durch einen Kompromiss im Vermittlungsausschuss zwischen Bundestag und Bundesrat beigelegt werden, mit dessen Folgen sich diese Masterthesis in weiten Teilen beschäftigt. Während die damalige Regierungskoalition die Bundesagentur für Arbeit als alleinigen Grundsicherungsträger in den Gesetzesentwurf einbrachte, sah die Opposition die Aufgabe bei den Kommunen besser aufgehoben. Das verabschiedete Gesetz schrieb in der Folge sowohl dem Bund als auch den Kommunen Aufgaben nach dem SGB II zu, was zu gemeinsamen Grundsicherungsstellen, den so genannten Arbeitsgemeinschaften (ARGEn) als Regelmodell im Rahmen einer Mischverwaltung führte. Zusätzlich, als zunächst zeitlich begrenztes Experiment, wurde 69 Kommunen die alleinige Grundsicherungsträgerschaft als zugelassene kommunale Träger (zkT) übertragen, um Aussagen darüber gewinnen zu können, welche Trägerform die bessere sei. Vom Gesetzgeber ungewollt, etablierte sich eine dritte Umsetzungsform in Gebieten, in denen sich Kommunen und lokale Agenturen für Arbeit nicht auf eine Arbeitsgemeinschaft einigen konnten: die Aufgabenwahrnehmung in getrennter Trägerschaft (gAw), bei denen jeder Grundsicherungsträger die ihm jeweils zugeschriebenen Aufgaben in eigener Zuständigkeit erbringt. Knapp drei Jahre nach Einführung dieser Organisationsmodelle erklärte das Bundesverfassungsgericht in seinem Urteil vom 20.12.2007 die Mischverwaltung, und damit das im Bundesgebiet weit überwiegend umgesetzte Regelmodell der ARGE, für verfassungswidrig und gab dem Gesetzgeber bis zum 31.12.2010 Zeit, um unter Einbeziehung der Ergebnisse der gesetzlich verankerten Wirkungsforschung die Betreuung der Hilfebedürftigen neu zu regeln. Seitdem entstehen in schneller Abfolge sich je nach politischer Grundposition gegenseitig ausschließende Umsetzungsvarianten, die alle dem Prinzip des alten Weins in neuen Schläuchen, also der Beibehaltung der bisherigen Positionierungen zu folgen scheinen. Aus Sicht der Verfasser nähern sich die politischen Haltungen kaum an und es steht zu befürchten, dass die Grundsicherung für Arbeitsuchende wiederum Opfer eines Kompromisses wird, der inhaltlich kaum besser ausgestaltet ist als bisher und dem Willen des Gesetzes nach einheitlicher und bürgernaher Leistungsgewährung nach wie vor nicht gerecht wird. Es gilt deshalb, und das ist das Anliegen dieser Masterthesis, einen vom bisherigen, mittlerweile mehr als fünf Jahre andauernden politischen 'Machtgerangel' unabhängigen, überwiegend an inhaltlichen Kriterien orientierten Lösungsansatz für eine neue Organisationsform des SGB II zu entwickeln. Konkretes Vorgehen bei der Entwicklung einer funktionierenden Organisation: Ausgehend von den rechtlichen Hintergründen der Verfassungswidrigkeit der ARGEn, über die das Urteil des Bundesverfassungsgerichts Auskunft gibt, wird zunächst der Gesetzentwurf ('Hartz IV-Gesetz') und damit verbunden der ursprüngliche Wille des Gesetzgebers untersucht, der in dem neu zu entwickelnden Umsetzungsmodell Berücksichtigung finden soll. Des Weiteren wird die Entstehungsgeschichte der Grundsicherung für Arbeitsuchende beschrieben und die normative Kraft des Faktischen in Bezug auf die etablierten drei Umsetzungsmodelle kritisch hinterfragt. Es folgt eine differenzierte Analyse des bisherigen Standes der Evaluations- und Wirkungsforschung, aus der sich folgende zentrale Zwischenergebnisse ableiten lassen: Es lassen sich auf Bundesebene bislang keine systematischen Vorteile eines bestimmten Umsetzungsmodells erkennen. Die Unterschiede innerhalb jedes der drei Umsetzungsmodelle sind mindestens so vielfältig wie zwischen den Formen der Aufgabenwahrnehmung. Unterschiedliche Wirtschaftsräume scheinen einen größeren Einfluss auf die operativen Ergebnisse zu haben als die Modelle selbst. Zum einen veranlassen diese Resultate die Verfasser zu der Annahme, dass ein 'Festhalten' der Entscheidungsträger an Option, ARGE oder getrennter Aufgabenwahrnehmung unter wissenschaftlichen Aspekten wenig sinnvoll erscheint; zum anderen wird der Frage nachgegangen, inwiefern sich auf der Mikroebene in einem möglichst homogenen Wirtschaftsraum unterschiedliche Rahmenbedingungen minimieren und Vorteile entweder eines Modells oder bestimmter organisatorischer Ausgestaltungsformen finden lassen. Anhand der Resultate verschiedener Studien wird in einem ersten Schritt die Region Bodensee-Oberschwaben (speziell die Landkreise Ravensburg, Konstanz und Bodenseekreis) als weitgehend homogener Wirtschaftsraum identifiziert, in dem zudem alle drei Organisationsformen in unmittelbarer Nachbarschaft vorzufinden sind. Um vergleichbare operative Ergebnisse der drei Grundsicherungseinheiten zu erhalten, werden die umfangreichen statistischen Datenbanken der Bundesagentur für Arbeit genutzt, ausgewertet und aufbereitet, dabei die Parameter 'Aktivierung der Hilfebedürftigen' und 'Übergang in sozialversicherungspflichtige Beschäftigung' als wesentliche Indikatoren für erfolgreiche Arbeit der Grundsicherungseinheiten herangezogen. Festzustellen ist, dass bezüglich der gewählten Erfolgsparameter in allen drei Kreisen bei vergleichbarem Mitteleinsatz vergleichbar erfolgreich gearbeitet wird, also wiederum keine systematischen Unterschiede zwischen den Umsetzungsmodellen erkennbar sind. Es erscheint daher legitim, sich in der Folge mit der inhaltlichen Arbeit vor Ort im Jobcenter Konstanz, in der gAw in Ravensburg und im Amt 'Hilfen für Arbeit' in Friedrichshafen auseinanderzusetzen und inhaltliche Erfolgsfaktoren sowie hemmende Faktoren zu identifizieren, die sich in ein neues 'funktionierendes' Modell für die Region Bodensee-Oberschwaben integrieren lassen. Eine Erhebung in Form teilstrukturierter Leitfadengespräche bei den drei Grundsicherungsstellen führt zu Aussagen bezüglich der konkreten Ausgestaltung der jeweiligen Organisation und den subjektiv wahrgenommenen Erfolgs- und hemmenden Faktoren bei der Umsetzung des SGB II. Unter Einbeziehung der deskriptiven Forschungsergebnisse sowie organisations- und managementtheoretischer Aspekte wird darauf ein neuartiges regionales Umsetzungsmodell aufgesetzt, das möglichst vielen Kriterien einer erfolgreichen Aufgabenerledigung in Bodensee-Oberschwaben weitgehend Rechnung trägt. Das Modell erscheint durch seine Flexibilität sowohl im Rahmen einer bundesunmittelbaren als auch einer kommunalen Aufsicht funktionsfähig. Methodischer Ansatz: Ansatz dieser Arbeit ist es, einen zum Verständnis der Thematik erforderlichen Überblick über die Chronologie der Ereignisse, die (politischen) Grundpositionen sowie die Zwischenergebnisse der Forschung zu bieten und letztere nicht nur darzustellen, sondern teilweise auch zu integrieren, also als erweiterte Datenbasis für eine eigene, kleinräumige und als solche nicht repräsentative Erhebung bei drei Grundsicherungseinheiten in Bodensee-Oberschwaben zu nutzen. Neuartig ist in diesem Zusammenhang u. a. die Einbeziehung verschiedener operativer Ergebnisse als Indikatoren für die Qualität der Arbeit der drei Organisationseinheiten. Dadurch wird eine Verbindung zwischen einzelnen Forschungsansätzen, die sich entweder auf deskriptive Aussagen oder einzelne operative Ergebnisse beschränken, hergestellt. Es zeigen sich dabei Zusammenhänge; Kausalschlüsse können jedoch nicht gezogen werden. Das auf diese Weise anschließend erarbeitete regionale Lösungsmodell erscheint auf den Bund übertragbar; der Versuch, sowohl die Erfahrungen aus der Praxis als auch die Evaluationsforschung sowie management- und organisationsentwicklungstheoretische Aspekte bei der Entwicklung einer tragfähigen Lösung zu integrieren, stellt dabei die Einzigartigkeit dieses Ansatzes dar. Trotz des relativ hohen Umfangs dieser Arbeit handelt es sich – angesichts Hunderter allein in den letzten Jahren veröffentlichter, inzwischen weit mehr als 50.000 Seiten umfassender Fachbeiträge aus Wissenschaft, Politik und Gesellschaft – um einen Ansatz zur Reduktion von Komplexität und zur Rückbesinnung auf pragmatische Prinzipien des Managements bei der Umgestaltung sozialer Dienstleistungsorganisationen. So fallen kontinuierliche organisatorische Veränderungsprozesse ins Auge sowie die Tatsache, dass sich unterschiedliche organisatorische Ausgestaltungen angesichts der zu verzeichnenden 'atypischen' Ausprägungen größtenteils nicht auf die Art des Trägermodells zurückführen lassen. Unabhängig vom Trägermodell und der (sich noch immer im Wandel befindlichen) Organisationstypologien entwickeln sich im Zeitverlauf in einigen Aspekten anscheinend unterschiedliche, in anderen Aspekten ähnliche Strukturen, Erfolgsfaktoren und Problematiken, unabhängig davon, ob die Organisationsform nun zentral vorgegeben ist, sich dezentral entwickelt hat oder eine 'Mischform' darstellt. Dazu gehört der bei allen Befragten geäußerte Wunsch bzw. die als Erfolgsfaktor benannte Individualisierung im Leistungsprozess, einerseits bei den eingesetzten Maßnahmen, andererseits im persönlichen Beziehungsaufbau zum Kunden, der letztlich auch entgegen vorgegebener Strukturen 'durchgesetzt' wird. Das weiter oben angeführte 'Baden-Württemberg-Paradox' zeigt sich in hohem Maße: Deutlich die Mehrheit der eHb werden als nicht direkt vermittelbar eingestuft und die Notwendigkeit sozial stabilisierender und nicht ausschließlich beschäftigungsorientierter Maßnahmen für diese Klientel in den Vordergrund gerückt. Individualisierung als Erfolgsfaktor im Prozess der Erbringung sozialer Dienstleistungen zeigt sich nicht nur im direkten Umgang mit dem Kunden, sondern ist auch in Aspekten der Mitarbeiterzufriedenheit bzw. der Mitarbeitermotivation, Engagement und Identifikation mit der Aufgabe zu finden, und zwar um so mehr dort, wo Mitarbeitern Gestaltungs- und Entscheidungsfreiheiten eingeräumt werden. Dem stehen andererseits Bemühungen des Gesetzgebers in Richtung zunehmender und größtmöglicher Standardisierung und 'Entpersonalisierung' der Leistungsprozesse entgegen, die durchweg als hemmend und die Arbeit beeinträchtigend erlebt werden. Transparenz, Einheitlichkeit und Einfachheit der Aufbau- und Ablaufstrukturen in der Organisation werden dagegen, ebenso wie eine komfortable und einheitliche EDV-Lösung und transparente, realisierbare geschäftspolitische Ziele als Erfolgsfaktoren wahrgenommen bzw. vermisst, wenn sie nicht vorhanden sind. Eher bzw. 'zu' informelle Strukturen, zu viele Ansprechpartner für die Mitarbeiter innerhalb der Organisation oder für die Kunden werden dagegen wegen der zu verzeichnenden Reibungsverluste und 'Brüche' in der Beziehung zum Kunden sowie der schwierigen Einarbeitung neuer Mitarbeiter eher als hemmend erlebt. Kommunale Strukturen und Netzwerkarbeit werden als Erfolgsfaktoren benannt, am Beispiel der gAw Ravensburg zeigt sich dabei, dass trotz institutionell bedingter Nachteile und entgegen anders lautender bundesweiter Evaluationsergebnisse dennoch ein relativ hohes Maß an Kooperation und Kundenfreundlichkeit sowie auch Netzwerkarbeit möglich ist, wenn die beteiligten Akteure entsprechende Handlungsspielräume erkennen und nutzen. Ganz deutlich wird dem Bedürfnis nach Individualisierung im zkT Bodenseekreis Rechnung getragen, was sich für die Mitarbeiter in einem hohen Beteiligungsgrad einerseits sowie andererseits in einem kaum vorzufindenden quantitativen Controlling zeigt. Auch die 'echte' Sozialarbeit und die wahrgenommene Unterstützung durch die Leitung hinsichtlich der Nicht-Quantifizierbarkeit vieler Ziele werden hervorgehoben. Andererseits sind hier dann auch die Befürchtungen, Gestaltungsspielräume künftig abgeben und sich verstärkt den Reglementierungen des BMAS oder des Bundes 'unterwerfen' zu müssen, am deutlichsten ausgeprägt, während ARGE- und gAw – Mitarbeiter an eine zunehmende Standardisierung eher gewöhnt zu sein scheinen und sich 'Nischen' im System suchen. Bezüglich der Erfolgsindikatoren deuten sich Zusammenhänge mit einzelnen, subjektiv wahrgenommenen Erfolgsfaktoren an, z. B. die Initiative '0 Prozent Jugendarbeitslosigkeit' im Bodenseekreis und die dort zu beobachtende geringe Jugendarbeitslosigkeit, die Betonung präventiver Ansätze und sozial stabilisierender Maßnahmen im Bodenseekreis und der leichte Vorsprung bei der Integration der eHb in Beschäftigung. Andererseits könnte die stärkere Beschäftigungsorientierung in Ravensburg und Konstanz mit der zu verzeichnenden, besseren Integrationsrate von arbeitslosen Hilfebedürftigen in Zusammenhang stehen. Hieraus Kausalzusammenhänge abzuleiten wäre angesichts der schmalen Datenbasis und der sehr schwachen Zusammenhänge jedoch nicht nur vermessen, sondern schlicht falsch. Auch können keine Zusammenhänge zwischen einzelnen Maßnahmen der jeweiligen 'Maßnahmemixe' oder zwischen verschiedenen organisatorischen Ausgestaltungen und 'messbarem' Erfolg festgestellt werden. Auch unter Hinzuziehung der Evaluationsforschung scheint das Modell der Aufgabenwahrnehmung unerheblich zu sein: Innerhalb der Modelle zeigt sich auch in einer kleinräumigen Studie ein derart hohes Maß an Abweichungen und gegenläufigen Tendenzen in mehreren Aspekten, dass letztlich festzuhalten bleibt, dass in Bodensee-Oberschwaben keines der Modelle eine erfolgreiche Wahrnehmung bzw. Umsetzung der sich aus dem SGB II ergebenden Aufgaben 'verhindert' sondern dass sich vielmehr unter Nutzung der Gestaltungsspielräume Abläufe entwickeln, die mehr oder weniger effizient sein mögen, aber – das zeigen die dargestellten Erfolgsparameter – offensichtlich ähnlich effektiv 'funktionieren'. Aus den postulierten Erfolgsfaktoren aller Träger versuchen die Verfasser nun, eine Organisationsform zu entwickeln, die möglichst viele der genannten Aspekte berücksichtigt und Reibungsverluste minimiert.

Aus der Einleitung: 'Heil und rein' mit dieser Überschrift beginnt Gunter Ottos Beitrag zur Kunsterziehung im Nationalsozialismus. Er hätten diesen Beitrag wahrscheinlich kaum treffender betiteln können, denn beide Begriffe ziehen sich wie ein roter Faden durch die komplette Thematik. In ihrer gesamten Bedeutung aber erscheint die Zeit von 1933 bis 1945 alles andere als 'heil' und 'rein'. Denn die faschistische, rassistische und zerstörerische Weltanschauung der Nationalsozialisten führte dabei nicht nur zu einem Empfinden deutscher Überlegenheit in jeglicher Hinsicht, sondern bewirkte auch die Abkehr von humanistischen Prinzipien wie Toleranz, Gewaltfreiheit und Gewissensfreiheit. Die Terrorherrschaft der Nationalsozialisten führte die Menschheit außerdem in die größte Katastrophe des 20. Jahrhunderts, den Zweiten Weltkrieg. Wie sich ein Volk hat derartig verführen lassen durch die kranke und untragbare Weltanschauung eines Mannes, wurde in den letzten 65 Jahren unter nahezu allen Gesichtspunkten erforscht. Vor allem hat man dabei versucht Antworten zu finden. Antworten auf die Fragen einer entsetzten und verstörten, aber gleichzeitig interessierten Nachwelt. Auf der Suche nach Gerechtigkeit und Wiedergutmachtung unternahm man den Versuch Schuldfragen zu klären, gleichzeitig haben damalige Opfer aber auch vergeben und die Welt scheint im Zuge dessen ein kleines Stück näher zusammengerückt zu sein. In unserer heutigen Generation sind das Interesse und das informelle Angebot an jener Zeit so groß wie nie zuvor. Auch wenn die NS-Thematik den wahrscheinlich dunkelsten Teil in der Geschichte der Menschheit ausmacht, so beschäftigen sich nach wie vor Wissenschaft, Medien, Schulen, Privatpersonen und nahezu alle Bereiche des öffentlichen Lebens immer wieder mit diesem Kapitel deutscher Geschichte. Auch während meines Studiums der Kunst und der Geschichte begegnete mir die NS-Thematik immer wieder. Der Nationalsozialismus war und ist ein fester Bestandteil meiner studentischen Arbeit und wird auch im zukünftigen Arbeitsfeld als Lehrer wiederkehren. Ich konnte feststellen, dass sich die Thematik aufgrund ihrer Komplexität, ihrer unmittelbaren zeitlichen Nähe und leider auch wegen ihrer Aktualität durch einen reichhaltigen Fundus an Quellen auszeichnet. Dadurch erweist sich der Nationalsozialismus als eines der am besten aufgearbeiteten Themen der Weltgeschichte und die Fülle an Quellen scheint unaufhörlich zu wachsen. Warum also noch einen Beitrag zu seiner Aufarbeitung leisten? Diese Frage lässt sich für mich recht einfach beantworten: Die NS-Thematik hat mich in vielerlei Hinsicht gefesselt und seit meiner ersten Begegnung im Jahr 1993 nicht mehr losgelassen. Im Laufe der vergangenen Jahre und vor allem im Laufe meines Geschichtsstudiums habe ich gelernt mich reflektierend zu ihm zu äußern. Das Streben nach Objektivität stand immer an oberster Stelle. Das Kunststudium, speziell die künstlerische Praxis, war aber das genaue Gegenteil. Wertende Auslegungen von Sachverhalten, beispielsweise bei Bildanalysen oder Kunstbetrachtungen sowie die eigenen Schöpfungen im Laufe meines Studiums zeichneten sich vor allem durch ein wesentliches Kriterium aus: Subjektivität. In der Geschichte der Fachdidaktik scheinen nun diese beide Aspekte aufeinanderzuprallen. Dabei ist es mir wichtig genau auf dieser reflektierenden Ebene einen Beitrag zur Aufarbeitung der nationalsozialistischen Kunsterziehung zu leisten. In der nun vorliegenden Arbeit zur Kunsterziehung in der Zeit des Nationalsozialismus versuche ich mich daher möglichst reflektierend und neutral zu äußern. Es versteht sich dabei für mich von selbst, dass wir es bei dieser Thematik mit einer faschistischen, rassistischen, zerstörerischen und völlig untragbaren Ideologie zu tun haben, die sich nicht nur heute oder morgen, sondern auch in ferner Zukunft niemals wiederholen darf. Trotz allem Selbstverständnis in einer demokratischen und liberalen Gesellschaft, wie der unseren muss dies betont zum Ausdruck kommen. Auch denke ich, dass es nicht zu meiner Aufgabe gehört von Opfern und Tätern in der Kunsterziehung zu sprechen. Da sich die gesamte Zeit des Nationalsozialismus als ein höchst sensibler und emotionaler Abschnitt deutscher Geschichte erweist, ist es umso wichtiger zugunsten einer wirklich wissenschaftlichen Betrachtung sachlich und fachlich neutral zu formulieren. Ich distanziere mich jedoch klar und bestimmend von auftretenden NS-Parolen, Schlachtrufen und allem Menschenverachtenden, das der Nationalsozialismus mit sich gebracht hat. Inhaltlich habe ich mir folgende Schwerpunkte gesetzt: Alle Betrachtungen sollen die Perspektive der Kunsterzieher jener Zeit reflektieren. Ihnen gilt mein Hauptaugenmerk. Dabei ist es unvermeidbar auch bereichsübergreifende Themen einzubeziehen, denn für die Zeit des Nationalsozialismus im Zusammenhang mit seiner Schule gilt vor allem eine grundlegende Tatsache: Durch das totalitäre System der Nationalsozialisten gibt es keine Trennung zwischen Politik und Schule. Die Schule versteht sich als ein Machtinstrument der Diktatur und wird zu jedem Zeitpunkt meiner Arbeit als solches betrachtet. Ebenso wenig sind Rassismus und die NS-Ideologie voneinander zu trennen. Daher kann das NS-Regime nur unter Einbezug ihrer rassistischen Intentionen betrachtet werden, alles andere wäre verklärend und falsch. Bei der Verwendung bestimmter Begriffe möchte ich jedoch klar differenzieren; allen voran den Begriff 'Kunsterziehung'. Immer wieder begegnet dieser Begriff im Zusammenhang mit 'Zeichnen' oder 'Zeichenunterricht', teilweise gar als 'Zeichnen und Werken'. Dabei versteht sich der Zeichenunterricht als die Kunsterziehung der Volksschulen (Diel 1969, S. 101) und versteht sich als eine hierarchische Ordnung. Zur Zeit des Nationalsozialismus legte man einen besonders großen Wert auf die Erziehung durch die Kunst. Es wird daher im Folgenden die Rede von der 'Kunsterziehung' sein, als welche sich das Fach am besten in die Diktatur einordnen lässt. In diesem Zusammenhang sei auch erwähnt, dass ich mich vordergründig auf der Betrachtungsebene der Volksschulen bewegen werde, da diese die größte Institution für Bildung im Dritten Reich ausmachten. Auf dieser Grundlage habe ich mich dazu entschlossen meine Betrachtungen sukzessiv von allgemeinen hin zu den spezifischen Entwicklungen vorzunehmen. Zunächst wird die Rede vom Kunstverständnis Hitlers und von gesellschaftlichen Entwicklungen sein. Danach wird es um das Kunst- und Kulturverständnis sowie die Politik der Nationalsozialisten gehen, ehe ich konkret auf die Bildungspolitik und die Entwicklungen um die Kunsterziehung im Dritten Reich zu sprechen kommen. Ich gehe diesen Weg deshalb, weil ich die Kunsterziehung immer in ihrem Gesamtkontext und ihrer Situation im Dritten Reich betrachten möchte. Für sie gelten die gleichen Voraussetzungen zu jener Zeit wie für alle anderen Schulfächer im Nationalsozialismus. Trotzdem kommt ihr eine entscheidende und wichtige Rolle zu, welche ich zu ergründen versuche. Von dieser allgemeinen Betrachtungsebene werde ich mich lösen, wenn es um die konkrete Umsetzung des Faches Kunsterziehung geht. Neben den grundlegenden Theorien und Konzepten jener Zeit werde ich die Umsetzung an den Beispielen der Städte München und Leipzig vornehmen. Am Münchner Beispiel möchte ich konkret auf den Unterricht an den Schulen zu sprechen kommen, während für Leipzig eine Lehrplananalyse erfolgt. Im abschließenden Teil der vorliegenden Arbeit möchte ich mit einem kurzen Fazit eine Bewertung der Thematik vornehmen. Zeitgenössische Bewertungen des Faches in jener Zeit kommen darin ebenso zur Ansprache wie mein eigener Standpunkt. Dabei orientierte sich diese 'Neuauslegung' durch Böttcher vordergründig an den Kunstvorstellungen der Nationalsozialisten. Eine klare Aufgabenstellung für den künftigen NS-Kunstunterricht lieferte hingegen der Reichserziehungsminister Bernhard Rust: 'Der Reichserziehungsminister hat dem Kunstunterricht die Aufgabe gestellt, an der Gestaltung des germanisch – deutschen Wesens mitzuwirken. Für den Kunstunterricht ist in diesem Gebot eine Verpflichtung höchster Art enthalten.' Kunst ist nach seiner Auffassung ein Ausdruck von Rasse. Kunstunterricht soll sich aus dem Anschauen der Umwelt und dem Schauen in die Innenwelt gestalten. Kunstunterricht ist demnach Weltanschauung in ihrer ursprünglichsten Art. Robert Böttcher, ab 1935 Leiter der Reichsfachgruppe deutscher Kunsterzieher, versuchte in seinem Zuständigkeitsbereich diese Neuorganisation bis Ende 1935 gezielt und ganz im Sinne der NS-Regierung umzusetzen. Max Herrmann, Böttchers Vorgänger, wurde in diesem Zusammenhang abgesetzt. Die reformerisch-progressiven Elemente des Faches, die angelegt waren an den Gestaltungslehren der Moderne (z.B. Bauhaus, Expressionismus, Impressionismus) fanden keine Beachtung mehr. Was aber blieb ist das Seelenvolle, das Gemeinschaftsfördernde und das Volksnahe. Der ursprüngliche Fachgeist, nämlich das Offene, das Vielseitige und der reformerische Geist ging durch die fortlaufende Vereinnahmung durch die Nationalsozialisten und deren rassistisch – rationale Weltanschauung immer mehr verloren. Die Kunstvermittlung sollte in erster Linie ein Propagandainstrument werden und im Sinne der nationalsozialistischen Weltanschauung erfolgen. Sie sollte entgegen der individualistischen Auswüchse der Moderne wirken und verstand sich genau wie die völkische Schule als ein verlängerter Parteiarm. Entgegen den individuellen Auswüchsen der Moderne verstand sich auch die 'Deutsche Kunst' als eine Massenkunst. Mit Hilfe der Kunsterziehung sollte diese rational ausgelegte Massenbasis erhalten und fortentwickelt werden. Dabei ist zu betonen, dass trotz aller Rückschrittlichkeit und der Ausgrenzung moderner Strömungen auch ein kleiner Teil der geistigen Grundlagen der Moderne erhalten blieb. Die 'Neue Sachlichkeit' etwa galt in der bildenden Kunst des Dritten Reichs zwar als entartet, bestand aber in ihrer philosophischen Dimension ebenso wie die Lebensphilosophie fort. 'Für die Übertragung auf die Kunstpädagogik hieß dies, dass man an den Varianten des Irrationalismus festhielt. Allerdings war die Grenze dieses Irrationalismus dort erreicht, wo die Hinwendung zum Individualismus die faschistische Integrationsideologie störten.' Hier lässt sich deutlich die Instrumentalisierung der Kunsterziehung zu weltanschaulichen und Propagandazwecken erkennen. Der Kollektivgeist und die Massentauglichkeit einer Kunst waren grundlegend für die Integration im Sinne der NS-Ideologie. Individualismus und freies Schöpfertum hatten in diesem Verständnis keinen Platz und reichten als Begründung für die Ablehnung eines Kunststils. Für die Nationalsozialisten bestand kein Interesse an einer freischöpferischen oder an der Individualerziehung ausgelegten Kunstpädagogik. Das neue kunstdidaktische Konzept, auch wenn es das bisher nicht gab, richtete sich also von Anfang an gegen die Theorie Gustav Kolbs, der eine freie Entfaltung des produktiven Kindes und dessen Entwicklung vorsah. Dennoch versuchte Kolb während der Jahre 1933 und 1934 seine Theorie auf den Nationalsozialismus zu übertragen. Er präsentierte seine Theorie vom 'Bildhaften Gestalten als Aufgabe der Volkserziehung' und stellte Leitsätze für die NS-Kunstpädagogik auf. Daraufhin ließ er sie von höheren Funktionären überprüfen. Bereits im Vorwort der vorgelegten zweiten 'verbesserten und erweiterten Auflage' lassen sich jedoch Formulierungen und Vorstellungen Kolbs finden, die nicht mit den totalitären nationalsozialistischen Vorstellungen vereinbar waren. Er schreibt: 'Wer aber in dem Buch Stoffpläne im Sinne der üblichen und üblen 'Leitfäden' zu finden hofft, die die Lehrstoffe womöglich für die einzelnen Lehrstunden des Jahres im voraus festlegen, wird nicht auf seine Rechnung kommen. Wir werden nicht die Totengräber dessen sein, was eben erst zum Leben erwacht. Nichts ist schädlicher als solche Leitfäden, die den Lehrer der Aufgabe entheben wollen, den Unterricht selbst zu gestalten, aus dem Leben der Schule und der Schüler herauswachsen zu lassen.' Genau das sollte aber Kern der nationalsozialistischen Kunsterziehung werden. Es sollte einen strikten Leitfaden geben, der vordergründig der ideologischen Erziehung und Hinwendung zum Nationalsozialismus dienlich war. Der neue Kunstunterricht sollte zwar vom Lehrer gestaltet werden, Schülerinnen und Schüler sollten aber durch ihn vordergründig erzogen und gehorsam im Sinne der NS-Weltanschauung gemacht werden. 'Gestaltung' und 'Herauswachsen' sind demnach Begriffe, die sich mit einem uniformierten Kunstunterricht, wie dem des Dritten Reiches nicht vereinbaren lassen. Ein Individualgeist und der gestalterische Einfluss von Phantasie und Vorstellungskraft seitens der Lehrer und Schüler, wie es Kolb vorschwebte, war nicht gefragt. In der Retrospektive und im ideologischen Verständnis des Nationalsozialismus lässt sich demnach nur auf einen Unterrichtsstil deuten: autoritär, unter klaren Vorgaben und ganz im Sinne der Weltanschauung des Nationalsozialismus. Trotz des gewagten Versuches einer weitestgehend möglichen Umformulierungen, aber gemäß den Vorstellungen seiner Theorie, konnte sich Kolbs Theorie vom 'Bildhaften Gestalten als Aufgabe der Volkserziehung' nicht durchsetzen. Vor allem Kolbs Vorstellungen vom Einfluss der Phantasie auf den gestalterischen Prozess sowie seine Auffassung von Schauen und Wahrnehmen und vom Gestalten und Darstellen waren nicht mit den rationalen Ansichten der Nationalsozialisten zu vereinen. Zwar beruhte Kolbs Theorie u.a. auch auf dem Naturstudium, einer bevorzugten Methode der Nationalsozialisten, aber er erkannte dabei, dass der Mensch ohnehin einem permanenten Strom von Bildern ausgesetzt ist. Jeden Tag dringen Unmengen an Bildern unaufhaltsam und kontinuierlich, ob gewollt oder ungewollt in die menschliche Seele. Er unterschied in Bewusstsein und Unbewusstsein. Kolb formulierte wie folgt: 'Jedes Können erwächst aus dem Unbewussten.' Für ihn hatte die Phantasie einen grundlegenden Einfluss für das eigene Gestalten und sie war wesentlicher Teil des Schöpfungsprozesses. Der Phantasiebegriff zog sich durch die gesamte bildnerische Entwicklung des Heranwachsenden. Außerdem betonte Kolb: 'Die Gefühle sind es, die zu schöpferischen Akten treiben.' Hier werden vor allem die Bezüge zu den verschiedenen Strömungen der Moderne deutlich, welche die NS-Diktatur grundsätzlich ablehnte und verachtete. Außerdem betrachtet er das freie bildnerische Gestalten von Kindern und das der bildenden Künste auf einer Ebene. Er zog hier sogar Vergleiche heran. Auch dies wurde von den Nationalsozialisten abgelehnt, da die Kunst der Moderne vor allem aus den Verwirrungen der Zeit vor 1933 entstanden war und demnach nicht kindlich war. Außerdem begründete sich nach ihrem Schöpfungsverständnis dieser Prozess als die Steigerung vom kindlich-naiven hin zur ästhetischen und technischen Perfektion. Demnach musste sich an dieser Auffassung also auch die NS-Kunsterziehung orientieren. Wie sich später noch zeigen wird, haben letztlich auch die Vermittlungswege im Kunstunterricht des Nationalsozialismus diese Methodik als Grundlage. Freies Gestalten fand nur eine geringe Bedeutung und wurde als Grundlage für höhere, bzw. meisterliche Schöpfungen gesehen. Kolbs Theorie war daher immer wieder der Kritik in der wachsenden Anzahl nationalsozialistischer Gesinnungsträger der kunstpädagogischen Fachkreise ausgesetzt. Im Herbst 1934 kam es schließlich zum Eklat zwischen dem RmfWEV und Gustav Kolb. Womöglich wurde dieser Eklat auch durch das energische, nicht immer verhaltene, aber überzeugte Auftreten Kolbs provoziert. Vermutlich sahen die Nationalsozialisten auch die Gefahr einer völligen Stagnation bei der Konzepterarbeitung für eine NS-Kunsterziehung und dem Kontrollverlust bei der Fachdiskussion um die Neukonzeption des Unterrichts. Auf einer Tagung der Kunsterzieher des Reichs in Frankfurt am Main wurde Kolb öffentlich angegriffen. 'Die allzu hohe Bewertung phantasiegemäßer Bildversuche im vergangenen System, ohne ernste Formenstudien, hätte zu Scheinresultaten geführt, mit denen weder wirkliche Kunst noch das praktische Leben etwas anzufangen wussten.' Daraufhin wurde der Theorie Kolbs endgültig die Absage durch das RMfWEV erteilt. Ein eigenes ideologiekonfirmes Konzept hatte man aber nun auch nicht. Das Fach erstickte fortan in theoretischem Geschwätz und wurde nach 1933 sogar zugunsten des Staatsjugendtages um fast die Hälfte seines Stundenpensums reduziert. Der Kunsterziehung an den Volksschulen tat diese Entwicklung alles andere als gut. Die Folge waren neben der Stundenkürzung auch die Streichung finanzieller Mittel und Materialien, was die Kunsterzieher sehr verärgerte. Wie die Nationalsozialisten in Folge dessen mit Gustav Kolb und seiner offenen Kritik an den herrschenden Zuständen in der Zeitschrift 'Kunst und Jugend' verfuhren, ist bereits erwähnt worden. Es ist dabei ein besonders gutes Beispiel für die rigide Verfahrensweise der Nationalsozialisten mit 'Querdenkern' und 'Störenfrieden', die es offensichtlich in der Kunsterziehung auch gegeben hat.

Dottorato di ricerca in Scienze e tecnologie per la gestione forestale e ambientale ; La Commissione europea ha richiesto, ai paesi membri, una maggiore finalizzazione degli interventi, secondo un percorso logico e conseguente fra analisi dei fabbisogni, strategia di intervento e misure proposte, con il rispetto degli Orientamenti strategici comunitari (OSC) 2007- 2013 per lo sviluppo rurale. L'Italia ha recepito le indicazioni europee delineando un Piano strategico nazionale (PSN) per lo sviluppo rurale la quale finalità è quella di garantire la coerenza strategica tra i piani comunitari, nazionali e regionali e di garantire il raccordo strategico e finanziario tra gli strumenti di sviluppo rurale, la PAC e le politiche di coesione. In esso si definiscono: - L'analisi del contesto; - Le linee di indirizzo generale per le politiche di sviluppo rurale; - La coerenza con le altre politiche di intervento nazionali comunitarie; - Il quadro finanziario comune; - Aspetti comuni per il monitoraggio e la valutazione, controlli e le sanzioni; - I Piani di sviluppo rurale (PSR) e la loro dotazione finanziaria. Nell'ambito del Piano strategico vengono individuate alcune tipologie di indicatori da utilizzare nel processo di programmazione quali strumenti necessari per conoscere i progressi, l'efficienza e l'efficacia dei Programmi di Sviluppo Rurale (PSR). Infatti, oltre ai tradizionali indicatori finanziari, di realizzazione, di risultato e di impatto vengono introdotti gli indicatori di baseline, con i quali è possibile definire la situazione iniziale del contesto su cui agisce il programma, descrivendola anche in termini di punti di forza e debolezza, permettendo così di inquadrare al meglio la strategia d'intervento della politica di sviluppo rurale e creando i parametri su cui valutare successivamente l'efficacia della programmazione. In particolare, per l'analisi della situazione ambientale sono stati proposti i seguenti indicatori baseline: biodiversità: avifauna delle aree agricole, aree ad alto valore naturale, composizione delle specie forestali. Sulla base di questi orientamenti, sia a livello europeo che nazionale, questo lavoro propone una metodologia alternativa alle linee guida proposte dall'EEA, in cui si tenga conto dei fattori strutturali del territorio per l'individuazione delle aree agricole ad alto valore naturalistico (HNVF). Lo scopo principale dell'individuazione delle aree agricole ad alto valore naturalistico è legato al mantenimento della biodiversità nelle aree agricole, ciò implica un aumento del valore paesaggistico e crea allo stesso tempo il mantenimento delle pratiche agricole tradizionali o specifiche. L'individuazione delle HNVF è una questione di notevole rilevanza sia a livello di pianificazione territoriale il cui obiettivo è quello di preservare in un contesto dinamico queste aree per una agricoltura sostenibile, sia a livello esecutivo per redigere piani operativi di intervento e finanziamento. La gestione del territorio dipende da delle decisioni che agiscono a livello spaziale. Per questo motivo si è deciso di utilizzare i Sistemi Spaziali di Supporto alla Decisione (Spatial Decision Support Systems). Sono sistemi informatici che lavorano attraverso un'integrazione di diverse informazioni e determinano l'ordinamento delle alternative sulla base di specifici criteri. Tali strumenti integrano i Sistemi Informativi Geografici, i modelli spaziali e l'Analisi Multicriteriale per arrivare a definire una gestione che rispetti le dinamiche dei sistemi naturali ed esprima una decisione integrante i diversi criteri. Questo studio ha lo scopo di proporre un percorso metodologico per l'individuazione delle aree agricole ad alto valore naturalistico alternativo a quello attualmente proposto dall'EEA. Si prefigge lo scopo di identificare "aree sensibili" della Provincia di Viterbo dove più rilevanti possono essere gli impatti delle attività antropiche e più efficaci le misure di mitigazione, cioè, dove pratiche agricole opportune possono quindi condurre a risultati migliori. Questo obbiettivo può essere raggiunto attraverso una pianificazione per "processi" cioè che tenga conto delle peculiarità del territorio. L'obiettivo della presente ricerca è quello di sviluppare un Sistema Spaziale di Supporto alla Decisione, applicato all'individuazione delle aree agricole di elevato valore naturalistico, che tengano conto della complessità del sistema rurale, ambientale, sociale ed economico e delle relazioni fra le sue variabili. Alle aree rurali viene, quindi, riconosciuto un ruolo all'interno del sistema dinamico ambientale, come elemento di connessione con gli ambienti naturali limitrofi, tale approccio si basa sull'individuare e preservare il rapporto tra sistemi di habitat al fine di migliorare il grado di biodiversità. Principale obiettivo è la realizzazione di una cartografia delle "aree sensibili" ottenuta seguendo una procedura di analisi multicriteriale valutando il grado di influenza dei fattori "strutturali" ambientali e antropici in funzione della loro distanza e densità. ; The European Commission demanded from the member countries a better finalisation of the intervention following a logical and consequent path between analyses of needs, strategy of intervention and proposed measures, regarding the Community Strategic Guidelines 2007-2013. Italy has acknowledged the European guidelines outlining a national strategic plan (Piano strategico nazionale, PSN) for rural development, with the aim to guarantee the strategic coherence between the communitarian, national and regional plans and to guarantee the strategic and financial connection between the instruments of rural development, the PAC and the policies of cohesion. In this strategic national plan are defined the following aspects: - Analysis of the context; - The general guidelines for the policies of rural development, - The coherence between other national communitarian policies of intervention; - The common financial table ; - Common aspect for monitoring evaluations, controls and sanctions; - The national strategic plans of rural development and their financial endowment. In the ambit of the strategic plan are singled out several typologies of indicators, which can be used for the programming process as necessary instruments to understand the progress, the efficiency and efficacy of the programs of rural development (PSR). In fact, in addition to traditional indicators of finance, realisation, result and impact, are being introduced the baseline indicators, with which it is possible to define the initial state of the context in which the program operates, describing it in terms of points of strength and points of weakness. This baseline indicators permits to define in the best possible way the strategy of intervention of the policy of rural development, and creating the parameters, which help to evaluate successively the efficiency of the programming. In particular for the analysis of the environmental state, have been proposed the following baseline indicators: Biodiversity: bird population of the agricultural areas, High Nature Value Farmland, composition of the forest species. Based on this directions, both on the European level and on the National level, this work proposes a alternative methodology to the guidelines proposed by the EEA, in which are taken in account the structural factors of the territory that locates the High Nature Value Farmland (HNVF). The principal aim, to locate the High Nature Value Farmland, is linked to the maintenance of the biodiversity of the agricultural areas. This implicates an increase in the value of the landscape and creates in the same time the maintenance of the traditional, specific and agricultural practices. To locate the High Nature Value Farmland is an important matter both in a territorial planning level, in which the aim is to preserve in a dynamic context these areas for a sustainable agriculture, and in an executive level to draw up the operational plans of intervention and finance. The management of the territory depends on the decision that act in a spatial level. For this reason it has been decided to use Spatial Decision Support Systems. They are information systems that work with the integration of different information and they determine the arrangement of the alternatives based on specific criteria. This instruments integrate the Geographical Information Systems, the Spatial Models and the Multi-Criteria Analyses with the aim to define a management that respects the dynamic of the natural systems and that shows an integrated decision between different criteria. The aim of this thesis is to propose an alternative methodological path for the location of the High Nature Value Farmland, to the actual path proposed by the EEA. It has the aim to identify "sensitive areas" of the province of Viterbo, where the impacts of the anthropic activity can be more relevant and the measures of mitigations more efficient, that is, where opportune agricultural practice can lead to better results. This aim can be reached through planning of "processes", that is taking in account the peculiarity of the territory. The goal of this research is to develop a Spatial Decision Support System, applied to the location of the High Nature Value Farmland that takes in account the complex city of the rural, environmental, social and economical system and of the relation between its variables. To the rural areas then it is recognised a role within the environmental dynamic system as a connecting element with the surrounding environments. This approach is based on locating and preserving the relation between habitat systems with the aim of increasing the level of biodiversity. The main objective is the realisation of a cartography of the sensitive areas obtained following a multi-criteria analysis procedure, evaluating the level of influence of the environmental and anthropic structural factors depending on their distance and density.

2008/2009 ; In light of the negotiations and the accession of Croatia to the European Union in a very near future, a dissertation on this topic presented itself as a very interesting opportunity. Agriculture has been (in case of past candidate countries, now Member States of the EU) and remains one of the most complex, discussed and controversial elements of the said negotiations. The PhD candidate, being a selected official translator and interpreter of the Croatian Ministry of Foreign Affairs and European Integrations and working in particular in the framework of negotiations conducted in Chapter 11 - Agriculture and rural development and Chapter 12 - Food safety, veterinary and phytosanitary policy, observed the need to give an overview of the social and historical context in this respect, describe the most recent developments, as well as to provide for a comprehensive terminology corpus to be used as reference for the translation of a very large number of documents in this sector in order to avoid any imprecision, lack of consistency and ambiguity of terms used. Interpretation and full understanding of EU acts by policy makers is crucial if those acts are to be transposed and implemented at the national level accurately and correctly, and a faithful and correct translation thereof plays a decisive role in this process. The PhD candidate was often faced with texts dealing with the same topic, but presenting significant discrepancies in translation approach and terminology (often errant solutions in spite of the existence of very precise terms in target language), which caused frequent misunderstandings between English- and Croatian-speaking participants and experts and unnecessary delays. The candidate also discovered a major lack of general knowledge by Croatian participants and translators regarding the Common Agricultural Policy and its effects on the Croatian agricultural sector, which has sometimes lead to embarrassing situations. Furthermore, failure to use "user-friendly" terminology, as well as to give less complex explanations of different mechanisms has been perceived by farmers as lack of transparency and fuels their mistrust towards the reforms enforced by the Croatian government. The identification and the use of appropriate terms in the target language should help not only to avoid that their meaning is misunderstood, but also to preserve a national language as is by using its existing resources and without recurring to unnecessary foreign words which might only add up to the vagueness of certain concepts, in particular taking into account that the final users required to apply any given act in this area are not policy-makers, but the general public, more precisely farmers. The choice of restricting the area of interest to agriculture has been done on the basis of the candidate's specialisation therein and due to the fact that agriculture has been one of the most challenging issues of the enlargement of the EU and it will continue to be so in the context of the future enlargements. The present dissertation and its glossary in particular are the result of three years of participation in negotiations at different levels and technical staff meetings, as well as of an equally long translation work and analysis of a large number of EU documents and national legal acts (including ordinances, orders and instructions) by means of which they are transposed into the Croatian legislation, as well as reports and memorandums. The trilingual approach has been selected owing to the experience gained in translating different kinds of EU documents, the English version of which (English has been selected as the source language by the aforementioned Ministry) sometimes presents ambiguities and inconsistencies, which requires a parallel use of the same document written in another language. The choice of Italian as the "control" language is a personal choice of the candidate, who often uses a fourth language, Slovene, for its similarity to Croatian as target language since both belong to the South-Slavic language group. However, Slovene has not been included in the glossary due to the candidate's passive knowledge only. The present dissertation consists in four main parts. The first part (Chapter 2) offers an overview of the history and enlargements of the European Community - from the aftermath of the World War II, the gradual enlargement to different European countries that have very soon realised the advantages of "standing together", evolution of European institutions (how they started and how their powers and responsibilities evolved over time) and the gradual formation of the European Economic and Monetary Union, to the dramatic events of 1989 which gave rise to unprecedented social and political changes of the 20th century and changed forever the face of the world and the course to which the European Community was heading. A separate sub-chapter is dedicated to the fifth enlargement – the largest and the most difficult so far as it included 8 former communist countries in 2004 (plus Malta and Cyprus) followed by Romania and Bulgaria in 2007. The said sub-chapter provides also for an overview of the accession process in general and certain difficulties encountered both by the new Member States and current candidate countries since the accession to the EU is not a goal per se, but an instrument to facilitate the implementation of reforms necessary to complete the transition, which goes far beyond the mere accession. The following sub-chapter deals with Croatia, in particular the timeline of its accession process and the main obstacles therein, which to a certain extent are somewhat different with respect to other candidate countries. The third chapter deals entirely with the agriculture – from the creation of the Common Agricultural Policy, the introduction of the Single Payment Scheme in 2003, representing one of the most substantial reforms in this respect, and the adjustment of the SPS due to the 2004 and 2007 enlargements to countries with a significantly lower standard and level of wellbeing, as well as with a very different economic background which has influenced their agriculture for almost half a century. The introduction of the SPS was an attempt to make the aid schemes in agriculture fairer and simpler. However, the second goal had to be sacrificed for the sake of the first one, which is reflected in numerous exceptions and derogations granted to single Member States on the basis of their particular national situation. An important sub-chapter herein is concerned with the enlargement and its impact on the agriculture of both old and new Member States. For farmers in the EU-15 the enlargement meant the reduction of EU aid, while for farmers in candidate countries it meant higher competition, but also the accessibility of EU funding. Each candidate country defined the conditions thereof in the framework of accession negotiations, which meant that some of them got a better deal than the others. In this sub-chapter particular attention has also been given to the illustration of some of the effects the CAP has had in the Central and Eastern European countries and different kinds of aid and pre-accession programmes available as central part of the CAP in order to prepare them for what is coming after the accession. The fourth chapter is concerned with the Croatian agricultural sector and it gives a general overview of its geography and climate, as well as certain statistical data regarding the current level of development. A sub-chapter is dedicated to a very important aspect, that is the legacies of the socialist past of the country, characterised by collectivism, state ownership, planned production entirely inconsistent with the market demand and low consideration for the environmental protection, but also to certain phenomena, such as the considerable fragmentation of agricultural land, the source of which is to be looked for beyond the past 50 years. A paragraph is also dedicated to cooperatives, which played a significant role in the Croatian agricultural sector before the World War II and which might become the key of the future development in this respect. The last sub-chapter describes the possible consequences and challenges before the Croatia agriculture in view of the accession of this country to the EU. Some of them are common to new Member States and Croatia can certainly learn a lot from their experience, but certain issues must be dealt with by Croatia alone as they concern its particular history, culture, traditions and political and social context. The fifth and the last chapter, which is also the most comprehensive one, is the terminology corpus with appropriate definitions developed by the author of the dissertation during the three-year-long research and containing more than 2100 entries in three languages. This glossary is non-exhaustive, which means that it is not a definitive one, but it will continue to be expanded and amended in parallel with the ongoing translation of Community documents. ; XXI Ciclo
