The author examines the conceptualizations of the notion of "sovereignty" in the written statements of the US and Argentina at the UN International Court of Justice on the question of the accordance of the unilateral declaration of independence of Kosovo with the international law. The analysis relies on the methodology proposed by Michael Freeden for the study of political ideology. The viability of this methodology for the linguistic study of ideological texts and for the study of conceptualizations of political notions is demonstrated.Key words: sovereignty, Kosovo, conceptual analysis, concept, Michael Freeden. ; В статье анализируются варианты концептуализации понятия «суверенитет», представленные в ходе обсуждения Международным судом ООН вопроса о независимости Республики Косово в письменных заявлениях США и Аргентины. Методология анализа соответствует схеме, предложенной Майклом Фриденом для изучения политических идеологий. В статье делается вывод, что данная методология может быть с успехом применена при лингвистическом изучении идеологических текстов и изучении механизмов концептуализации политических понятий.Ключевые слова: суверенитет, Косово, концептуальный анализ, концепт, Майкл Фриден.

This article contends that the World Trade Organization (WTO) rules are affected by the gravity of aggression and the consequences of its prohibition on international law. In this regard, article XXI of the General Agreement on Tariffs and Trade (GATT), by enabling the adoption ofmeasures necessary for the protection of the essential security interests of a State «in times of war», must be interpreted in the light of general provisions on aggression. This objective will necessarily lead us to consider whether the bodies of the WTO dispute settlement system (DSS) are competent to understand, in a situation where an act of aggression has been committed and in general terms, what implications —mainly legal, but also institutional and political in nature— the violation of the jus cogens has in a dispute before the DSS. To this end, this investigation explores the content and scope of GATT's article XXI and its interpretation, in particular, of the meaning of the term «war» in subparagraph b, subsection iii, and then considers the implications of its possible application in the light of international rules on aggression and the jurisdiction of SSD bodies in this regard. The article assesses the alternatives that a panel might face in view of an invocation of article XXI by an aggressor State and, rejecting the possibility of an interpretation and application of the provision isolated of the rules on aggression, explores possible solutions to which the panel may enter, maintaining the balance between the efficacy of the system and the unity of the legal order. ; En este artículo se sostiene que las normas de la Organización Mundial del Comercio (OMC) no resultan ajenas a la gravedad de la agresión ni a las consecuencias de su prohibición en el derecho internacional. En ese sentido, el artículo XXI del Acuerdo General sobre Aranceles Aduaneros y Comercio (GATT, por sus siglas en inglés), al permitir la adopción de medidas necesarias para la protección de los intereses esenciales de la seguridad de un Estado «en tiempos de guerra», debe ser interpretado a la luz de las disposiciones generales en materia de agresión. Este objetivo nos llevará necesariamente a considerar si los órganos del sistema de solución de diferencias (SSD) de la OMC son competentes para entender en una situación en la que se ha cometido un acto de agresión y, en términos generales, qué implicancias —principalmente jurídicas, pero también políticas e institucionales— tiene la violación del ius cogens en una diferencia ante el SSD. Con tal fin, esta investigación explora el contenido y alcance del artículo XXI del GATT y su interpretación, en particular, acerca del significado del término «guerra» en su apartado b, inciso iii, para luego pasar a considerar las implicancias de su posible aplicación a la luz de las normas internacionales en materia de agresión y las competencias de los órganos del SSD al respecto. En relación a esto último, el artículo evalúa las alternativas a las que se podría enfrentar un grupo especial ante una invocación del artículo XXI por un Estado agresor y, rechazando la posibilidad de que se realice una interpretación y aplicación de la disposición aislada de las normas en materia de agresión, se exploran eventuales soluciones a las que el grupo especial puede arribar, manteniendo un equilibrio entre la eficacia del sistema y la unidad del orden jurídico.

The article is based on theoretical overview on the subject of festival with its focus on special occasion having some unique aspect which is important to both the organizers and visitors of the festival. Second part of the article represents a case of International Contemporary Dance Festival. City festival is a traditional cultural expression of the creative industries. Creative city more rapidly develops through festival activities – creative cities use their creative potential in various ways: cultural activities, expressions, experiences, involvement of city inhabitants and visitors, presentation of city cultural heritage assets. A case study presented in the article is based on quantitative survey conducted during International Contemporary Dance Festival "New Baltic Dance" which took part in Vilnius 4–9 May 2010. Survey is designed for five key factors: choosing the festival, frequency of festival visits in Vilnius, transportation type visitors have arrived to the festival, channel visitors have found information about the festival, expenses during the festival period (including entrance ticket, overnight if needed, etc.), and each variable correlation between age, gender and education. Survey also includes fact-finding questions as destination festival visitors have arrived from and if festival visitors have used hotel services. While comparing goals of festival organizers and survey results, a conclusion is made that "New Baltic Dance" is a part of Vilnius city creative industries, meeting aims of the capital city and also of other Lithuanian cities and peripheries, attracting university graduates who have high demand for contemporary culture expressions and interest in contemporary dance process. On the other hand, festival visitors almost have no direct demand for better city tourism infrastructure and their economic input to the city development is very low.

Straipsnyje pristatoma miesto festivalių kaip tradicinės kultūrinės kūrybinių industrijų raiškos koncepcija. Teorinė dalis grindžiama festivalio objekto analize, festivalio kilmės, poveikio, unikalumo ir svarbos bendruomenės nariams, miesto, šalies gyventojams ir svečiams apžvalga. Antroji straipsnio dalis skirta tarptautinio šiuolaikinio šokio festivalio "Naujasis Baltijos šokis" atvejo analizei. Kaip manoma, kūrybinis miestas kur kas greičiau plėtojasi per festivalių veiklas – kūrybiniai miestai naudoja savo kūrybinį potencialą įvairiausiais būdais: plėtodamos kultūrines veiklas, ekspresiją, patirtis, įtraukdamos miestelėnus ir miesto svečius, pristatydamos miesto paveldą. Straipsnyje pristatomas atvejis yra kiekybinio tyrimo fragmentas, atliktas tarptautinio šiuolaikinio šokio festivalio "Naujasis Baltijos šokis" metu 2010 m. gegužės 4–9 d. Tyrimą grindžia šie pagrindiniai veiksniai: priežastys, lėmusios tiriamojo festivalio pasirinkimą; apsilankymo Vilniuje organizuojamuose festivaliuose dažnis; būdas, kaip žiūrovai pasiekė festivalį; kanalas, per kurį žiūrovai sužinojo apie festivalį; išlaidos, kurias patyrė festivalio žiūrovai (įskaitant bilietus į renginius, nakvynės mokesčius ir kt.). Tirta kiekvieno kintamojo koreliacija su sociodemografiniais rodikliais – amžiumi, lytimi ir išsilavinimu. Į tyrimą taip pat buvo įtraukti klausimai apie miestą, iš kurio atvyko žiūrovai, ir ar buvo pasinaudota viešbučių paslaugomis festivalio metu. Lyginant festivalio "Naujasis Baltijos šokis" organizatorių siekius ir tyrimo rezultatus, darytina išvada, kad šis festivalis yra Vilniaus miesto kūrybinių industrijų dalis, jis atitinka sostinės ir šalies periferijos kultūros gyvenimo poreikius, pritraukia aukštą jį išsilavinimą turinčią auditoriją, siekiančią pažinti ir patirti šiuolaikinės kultūros išraiškas, besidominčią šiuolaikinio šokio procesu. Kita vertus, tiriamo festivalio žiūrovai neformuoja poreikio geresnei miesto infrastruktūrai plėtotis ir daro mažą indėlį į miesto ekonomikos augimą.

Der Abzug der Nato-Kampftruppen aus Afghanistan markiert das Ende der Ära langwieriger Landkriege. Maritime Operationen gewinnen stattdessen an Bedeutung. Das zeigen die Pläne für eine Europäische Maritime Sicherheitsstrategie (EMSS) ebenso wie die fortdauernde Pirateriebekämpfung im Indischen Ozean. Die Sicherung der eigenen Handelsbeziehungen, aber auch die Tatsache, dass die USA ihren strategischen Schwerpunkt nach Asien verlagern (»rebalancing«), stellen Europa vor neue maritime Aufgaben. Aktuelle Streitigkeiten im Ost- und Südchinesischen Meer und Russlands Annexion der geostrategisch bedeutsamen Halbinsel Krim illustrieren ebenfalls, wie wichtig die Absicherung kritischer Seewege und der freie Zugang zur offenen See sind. Wenn es um Sanktionspolitik im Zusammenhang mit Russland geht, galt die Aufmerksamkeit europäischer Beobachter bis vor kurzem den Strafmaßnahmen von EU und USA sowie den Gegensanktionen Moskaus. Inzwischen hat sich das geändert. Zum Januar 2016 sind breite Sanktionen Russlands gegen die Ukraine und die Türkei in Kraft getreten. Russland selbst ist das Ziel ukrainischer Sanktionen, die seit September 2015 ständig ausgebaut werden. Dabei ist höchst unwahrscheinlich, dass Moskau und Kiew ihre politischen Ziele auf diesem Wege erreichen werden. Die Sanktionen tragen lediglich dazu bei, dass neue Konflikte entstehen, und sie führen zu hohen wirtschaftlichen Kosten - für alle Staaten, auch jene, die die Maßnahmen verhängen. Problematisch ist das vor allem für ökonomisch ohnehin schon schwache Länder; unter diesem Aspekt erscheint gerade die Lage der Ukraine besorgniserregend. Mit ihrem Sanktionskurs konterkarieren Moskau und Kiew die EU-Politik in der Region - doch die Fähigkeit der EU, mäßigend auf die beiden Länder einzuwirken, ist äußerst gering. (Autorenreferat)

Determining the basis of direct jurisdiction, in compliance with the "second function" of private international law (hereinafter PIL), is key in order to find a solution to the private case with a foreign element. Although, from a Civil Law perspective, our rules first determine the distribution of legislative powers, these cannot be erected without having a legal system of reference, propitiated by a prior idea regarding which judicial authority may assume jurisdiction. It is in view of this fact that we proceed to analyze the provisions of sections 57 to 60 of the General Law of Private International Law 19920, which replaces section 2401 of the repealed Appendix to the Civil Code. We understand that this analysis is essential, since we have gone from having two criteria for the attribution of direct international jurisdiction to having more than twenty, each of which with its peculiarities. ; La determinación de la base de jurisdicción directa, en cumplimiento de la "segunda función" del Derecho Internacional Privado (en adelante DIPr), es trascendental para la configuración de la solución al caso privado con elemento extranjero. Si bien, desde una concepción civilista, nuestras normas primero determinan la distribución de competencias legislativas, estas no pueden erigirse sin tener un ordenamiento jurídico de referencia, propiciado por una prenoción de que autoridad judicial podría asumir competencia. Ante este hecho factico, es que procedemos a analizar las disposiciones de los arts. 57 a 60 de la Ley General de Derecho Internacional privado 19.920, que viene a sustituir al art. 2401 del derogado Apéndice del Código Civil.
