Uganda is in the process of enacting a competition law. Like most developing countries, it faces a unique adoption process, local circumstances and concerns that makes the competition law and enforcement practices distinguishable from other jurisdictions. This research will analyse the need for development of a successful competition regime in Uganda by highlighting the factors that should inform the law and policy. The study will analyse the adequacy of the current competition bill 2004 in comparison with the competition laws of Kenya, Tanzania and South Africa and propose that Uganda needs to develop a competition regime that is suited to its local development needs. The East African Community (EAC) aimed at enhancing trade liberalisation and development, among other sectors adopted the East African Competition Policy in 2004 and subsequently the East African Legislative Assembly enacted the East African Competition Act in 2006. However to date an East African Community Competition Authority has not been established and the law is not yet operational. The study will further appraise the challenges to the operationalisation and implementation of the East African Community Competition Act and suggest that apart from the fact that Uganda has not enacted a competition law as required by the East African community Protocol, there are other significant challenges hindering the operationalisation and implementation of the East African Community Competition Act.

The subject of the study was the East African Commonwealth, an economic association that currently unites Kenya, Tanzania, Uganda, Burundi, Rwanda and Southern Sudan. Particular attention is paid to the integration processes in Africa in the post-colonial period, the doctrine of federalism in the political discourse of African countries, the causes of the crisis and the dissolution of the EAC in the seventies of the last century, as well as the economic and political reasons for reintegration of YOU. Special attention is paid to the evolution of the EAC from an economic alliance to a political one and the prospect of forming a federative state on the basis of the SAC. The author identifies the factors that led to the economic consolidation of the EAC, as well as those determinants of development of the commonwealth, which make it extremely difficult to form a unified federal state in East Africa. It is concluded that the further regionalization of the African continent and the realization of the federal project in East Africa will be hindered by such factors as the high level of conflict in the EAC member countries, tribalism, cultural, confessional and linguistic heterogeneity, and the ambition of leaders and political elites. ; Объектом исследования стало Восточноафриканское содружество (ВАС) — экономическая ассоциация, объединяющая в настоящее время Кению, Танзанию, Уганду, Бурунди, Руанду и Южный Судан. Особое внимание уделяется рассмотрению интеграционных процессов в регионе в постколониаль-ный период, доктрине регионализма и федерализма в политическом дискурсе этих африканских стран. Рассмотрены причины, побудившие названные страны к консолидации, факторы, обусловившие кризис и распад ВАС в семидесятые годы прошлого столетия, а также экономические и политические причины реинтеграции ВАС. Особое внимание уделяется процессу эволюции ВАС от экономического альянса к политическому объединению и перспективе формирования на его основе федеративного государства. Автор выясняет факторы, обусловившие экономическую консолидацию ВАС, а также те детерминанты развития содружества, которые крайне затрудняют образование единого федеративного государства в Восточной Африке. Сделан вывод о том, что дальнейшей регионализации африканского континента и реализации федеративного проекта в Восточной Африке будут препятствовать такие факторы, как высокий уровень конфликтности в странах-участницах ВАС, трайбализм, культурная, конфессиональная и языковая неоднородность, амбициозность лидеров и политических элит.

Entwurf zur Einführung für eine umfassende Bibliographie der englisch-sprachigen Literatur über die Wirtschaftslage der Staaten der East African Community

The East African Community (EAC)'s Information and Communication Technology (ICT) sector has been confronted with the convergence phenomenon. This is a concept that describes the trend of blurring boundaries between the traditionally distinct ICT sectors, namely: Information Technology (IT), broadcasting and telecommunications. This is significant for the EAC since the driving force behind this convergence phenomenon is that of efficiency. It necessitates the need to rethink the current legislative and regulatory frameworks in the ICT sector in order to cope with this phenomenon. The need to address this is pertinent since adapting to legislative and regulatory frameworks that are fully converged will expand access to ICT, stimulate economic growth, technological advancement, and also faster integration process of the EAC. Therefore this paper aims to demonstrate the following: Implications and challenges of this trend for the EAC legislative and regulatory frameworks; the need for a common legislative and regulatory framework that is fully converged. It therefore focuses on the inadequacies of the existing legislative and regulatory frameworks and reveals the lacunae in the present frameworks and how they fail to adequately address convergence phenomenon. The paper recommends effective, workable and consistent proposals on how to address the inadequacies. This brings awareness and deepens the understanding of the regulatory convergence issues to the ICT stakeholders in the region and the challenges of convergence on the existing frameworks. This will contribute to better legislative and regulatory frameworks in the EAC ICT market. It will therefore enable the region to enjoy the benefits of convergence and minimise instances of inefficiency in regulation of these converged ICT markets.
