Les modalitats electròniques de gestió i resolució de controvèrsies es troben en un moment d'inflexió, a causa de certs obstacles que n'impedeixen, de facto, la perfecta incardinació en el conjunt del sistema judicial. La falta d'interoperabilitat tècnica i jurídica, així com la incertesa sobre el valor dels resultats obtinguts a través d'aquests mètodes, unit a la proliferació de pràctiques, reglaments i normativa molt heterogènia i a vegades fins i tot contradictòria, no contribueixen a la seva consolidació. Per això comença a apreciar-se la necessitat de sistematitzar certs estàndards i principis reconeguts en la pràctica dels ODR i d'identificar models, de manera que es propiciï l'harmonització de processos, amb un tractament particularitzat d'aquells que afectin consumidors. Les lleis model i les guies legislatives, per les seves particulars característiques, poden constituir instruments òptims per a la progressiva harmonització de les pràctiques i les legislacions, una tasca que solament podria portar-se a terme sota els auspicis de la Comissió de les Nacions Unides per al Dret Mercantil Internacional (CNUDMI), institució de màxim prestigi i gran tradició en el desenvolupament de tals instruments. ; Online methods of dispute management and resolution are at a turning point because certain obstacles impede, de facto, their full integration into the legal system. Lack of technical and legal interoperability, uncertainty about the value of the results obtained and the proliferation of methods, rules and heterogeneous, sometimes contradictory, regulations do not bring its consolidation any nearer. For this reason we are beginning to appreciate the need to systematize certain ODR recognised standards and principles and identify models, to further the compatibility of procedures, with particular emphasis on those that affect the consumer. By their nature, model laws and legislative guides can be powerful instruments for the progressive harmonisation of practices and legislation, something that can only be carried out under the auspices of the United Nations Commission on International Trade Law (UNCITRAL), an institution with great prestige and a long tradition in the development of such instruments. ; Las modalidades electrónicas de gestión y resolución de controversias se hallan en un momento de inflexión, debido a ciertos obstáculos que impiden, de facto, su perfecta incardinación en el conjunto del sistema judicial. La falta de interoperabilidad técnica y jurídica, así como la incertidumbre acerca del valor de los resultados obtenidos a través de estos métodos, unido a la proliferación de prácticas, reglamentos y normativa muy heterogénea y en ocasiones hasta contradictoria no contribuyen a su consolidación. Por esa razón empieza a apreciarse la necesidad de sistematizar ciertos estándares y principios reconocidos en la práctica de los ODR y de identificar modelos, de modo que se propicie la armonización de procesos, con tratamiento particularizado de aquellos que afecten a consumidores. Las leyes modelo y las guías legislativas, por sus particulares características, pueden constituir instrumentos óptimos para la progresiva armonización de las prácticas y las legislaciones, una labor que podría llevarse a cabo bajo los auspicios de la Comisión de las Naciones Unidas para el Derecho Mercantil Internacional (CNUDMI), institución del máximo prestigio y gran tradición en el desarrollo de tales instrumentos.

Метою дослідження є визначення міжнародно-правових стандартів у сфері захисту культурної спадщини та правових актів, спрямованих на імплементацію відповідних норм у національне законодавство держави. Методологічна база дослідження поєднує в собі загальнонаукові та спеціальні наукові концепції, теорії і методи. В якості методологічної бази дослідження використовуються такі методи пізнання, як історичний, методи компаративного аналізу, емпіричного узагальнення, моделювання та абстрагування, діалектичний, системний, комплексний та інші. Так, для пізнання юридичного змісту поняття «охорона культурної спадщини» використовується діалектичний метод. Методи моделювання та абстрагування використані в процесі дослідження процесів імплементації міжнародно-правових стандартів охорони культурної спадщини. Широко також використовуються загально-гносеологічні прийоми пізнання – індукції, дедукції, аналізу та синтезу, що дозволило вирішити завдання дослідження онтологічної та практично-праксіологічної парадигми охорони культурної спадщини у сучасних умовах конституційно-правового розвитку. Наукова новизна дослідження полягає у тому, що вперше актуалізовано питання імплементації міжнародно-правових актів у сфері захисту та охорони культурної спадщини в ракурсі сучасних загальносвітових викликів. Висновки. В результаті проведеного дослідження слід відзначити наступні найважливіші характерні ознаки міжнародно-правових стандартів охорони культурної спадщини та їх імплементації до національної правової системи: забезпечення громадян держави юридичними засобами використання норм міжнародних договорів про охорону культурної спадщини; опосередковування національної імплементації міжнародних договорів усіма видами юридичної діяльності держави; необхідність офіційного опублікування імплементованого міжнародного договору про охорону культурної спадщини; насиченість міжнародних договорів про охорону культурної спадщини оціночними поняттями, високий рівень абстрактності їх приписів; вплив на практику реалізації норм досліджуваних міжнародних договорів актів міжнародних правозастосувальних органів; наявність міжнародних механізмів, що здійснюють контроль за впровадженням у життя міжнародних зобов'язань, узятих на себе державами згідно договорів про захист культурної спадщини. ; Целью исследования является определение международно-правовых стандартов в сфере защиты культурного наследия и правовых актов, направленных на имплементацию соответствующих норм в национальное законодательство государства. Методологическая база исследования сочетает в себе общенаучные и специальные научные концепции, теории и методы. В качестве методологической базы исследования используются такие методы познания, как исторический, методы сравнительного анализа, эмпирического обобщения, моделирования и абстрагирования, диалектический, системный, комплексный и другие. Так, для познания юридического содержания понятия «охрана культурного наследия» используется диалектический метод. Методы моделирования и абстрагирования использованы в процессе исследования процессов имплементации международно-правовых стандартов охраны культурного наследия. Широко также используются гносеологические приемы познания - индукции, дедукции, анализа и синтеза, что позволило решить задачу исследования онтологической и практически праксиологической парадигмы культурного наследия в современных условиях конституционно-правового развития. Научная новизна исследования заключается в том, что впервые актуализирован вопрос имплементации международно-правовых актов в сфере защиты и охраны культурного наследия в ракурсе современных общемировых вызовов. Выводы. В результате проведенного исследования следует отметить следующие важнейшие характерные признаки международно-правовых стандартов охраны культурного наследия и их имплементации в национальной правовой системы: обеспечение граждан государства юридическими средствами использования норм международных договоров об охране культурного наследия; опосредствования национальной имплементации международных договоров всеми видами юридической деятельности государства; необходимость официального опубликования реализованы международного договора об охране культурного наследия; насыщенность международных договоров об охране культурного наследия оценочными понятиями, высокий уровень абстрактности их предписаний; влияние на практику реализации норм исследуемых международных договоров актов международных правоприменительных органов; наличие международных механизмов, осуществляющих контроль за внедрением в жизнь международных обязательств, взятых на себя государствами по договорам о защите культурного наследия. ; The aim of the study is to define international legal standards in the field of protection of cultural heritage and legal acts aimed at the implementation of relevant standards in the national legislation of the state. The methodological base of the research combines general scientific and special scientific concepts, theories and methods. Such methods of cognition as historical, comparative analysis, empirical generalization, modeling and abstraction, dialectical, systemic, complex, and others are used as the methodological base of the research. So, for the knowledge of the legal content of the concept "protection of cultural heritage" the dialectic method is used. The methods of modeling and abstraction are used in the process of studying the implementation of international legal standards for the protection of cultural heritage. Gnoseological methods of cognition are also widely used - induction, deduction, analysis and synthesis, which made it possible to solve the problem of studying the ontological and practically praxeological paradigm of cultural heritage in the modern context of constitutional and legal development. The scientific novelty of the research lies in the fact that the issue of the implementation of international legal acts in the field of protection and preservation of cultural heritage from the perspective of contemporary global challenges has been actualized for the first time. Сonclusions. As a result of the study, the following most important characteristics of international legal standards for the protection of cultural heritage and their implementation in the national legal system should be noted: providing citizens of the state with legal means of using the norms of international treaties on the protection of cultural heritage; mediation of the national implementation of international treaties by all types of legal activities of the state; the need for official publication implemented an international treaty on the protection of cultural heritage; the saturation of international treaties on the protection of cultural heritage with evaluative concepts, the high level of abstractness of their requirements; influence on the practice of implementing the norms of the studied international treaties of acts of international law enforcement agencies; the presence of international mechanisms that monitor the implementation of international obligations undertaken by states under treaties for the protection of cultural heritage.

A widespread belief in the field of international relations (IR) is that the first years of the discipline were characterized by a liberal "idealist" theoretical dominance followed by the so-called "first great debate," in which the "idealist" school was intellectually surpassed by a realist tradition. The purpose of this article is to join previous revisionist studies and challenge this conventional narrative. Building primarily on the international thought and work of Norman Angell on imperialism, this article reveals that there was an important intellectual contest preceding the denominated "first great debate." It also shows that even though Angell was not a Marxist, his figure discloses Marxism as an important theoretical force in the genesis of the discipline.

Der stellvertretende Außenminister der Volksrepublik China geht aus seiner Sicht auf die Resultate der Gespräche zwischen dem russischen Präsidenten und dem chinesischen KP-Chef seit 1992 ein, in denen die freundschaftlichen und gutnachbarlichen Beziehungen für die Zukunft festgeschrieben wurden. Einzelbeispiele für die Erfolge der Verhandlungen sind etwa die Frage des Streitkräfteabbaus in den Grenzregionen, Rekordzahlen im Handelsaufkommen sowie die neue Dimension der Zusammenarbeit an sich. Die Beziehungen werden von chinesischer Seite als vielversprechend in jeder Hinsicht bewertet und der Autor weist damit auf ihre Bedeutung für die internationale Gemeinschaft hin. (BIOst-Rgl)

Die Entwicklung des Future Combat Air System (FCAS) ist Europas bedeutendstes Rüstungsvorhaben. Sowohl technologisch als auch militärisch hat das Projekt das Potenzial, neue Standards zu setzen und den Einsatz von Luftstreitkräften zu revolutionieren. Politisch ist das multinationale Vorhaben ein Lackmustest dafür, in­wiefern Europa in der Lage ist, sicherheitspolitisch zusammenzuarbeiten, eigene Fähigkeiten zu entwickeln und zu diesem Zweck nationale Interessen in den Hintergrund zu stellen. Auf Berlin und Paris lastet besondere Verantwortung für den Erfolg des Projekts. Ihre unterschiedlichen Blickwinkel und Verfahren gefährden ihn jedoch - ein Scheitern hätte für alle Beteiligten gravierende Nachteile. (Autorenreferat)

The cracks in the international order that politics and scientific policy advice have been confronted with for several years have widened further as a result of the corona pandemic and its consequences. The outcome of the 2016 Brexit referendum and US President Donald Trump's erratic administration between 2017 and 2021 have already called into question long-held foreign policy assumptions concerning ever-advancing globalisation and rule-based multilateralism. Unsettled by these developments, which go hand in hand with growing populism and the spread of "fake truths", foreign policy think tanks have begun to discuss what effects these will have on scientific policy advice. Relevant contributions to the debate in recent years are presented below, re­volving around key questions such as these: Given the increasingly polarised political environment, what are the challenges scientific policy advice is now facing and how should think tanks position themselves vis-à-vis the public and politics? And how can they maintain their independence and scientific integrity in these uncertain times? (author's abstract)
