Der Zeitpunkt der Errichtung eines Post-Apartheid-Südafrika rückt näher. Antworten auf die Frage, wie dieses Südafrika ggf. aussehen wird, werden deshalb dringender. Der Beitrag diskutiert die Rahmenbedingungen, Mechanismen, Probleme und Alternativen im Hinblick auf die Frage, ob das zukünftige nicht-rassistische Südafrika sozialistisch werden könnte. Zusammenfassung der gegenwärtigen Debatte. Problematik des politischen und wirtschaftlichen Übergangs und der Identifizierung des Kapitalismus mit der Apartheid. Soziale Aspekte. Die internationale Diskussion des Südafrika-Konflikts. Ergebnis: ein Post-Apartheid-Südafrika hat verschiedene Optionen. Ein möglicher Weg ist derjenige zu einem speziellen südafrikanischen Sozialismus, der sich am 'Dritte-Welt-Sozialismus' orientiert. (DÜI-Hlb)

The article examines the problem of the development of the doctrine of natural human rights and its implementation in the constitutional acts of the Ukrainian National Republic of 1917-1918. Following article explains the reasons for the changes in relation to the problem of protecting natural human rights at the beginning of the twentieth century. The leaders of the Ukrainian Central Rada were well aware that the revival of national statehood is impossible without a clear legal definition of the status of a citizen of Ukraine. This problem became especially urgent after the proclamation of the third Universal, when the announcement of the revival of the Ukrainian state took place. The Ukrainian government stood up to protect human life and dignity, freedom of speech, press, religion. The citizens of the country were guaranteed certain political and social rights without distinction of gender and age of citizens. But introducing innovative views for that time, members of the Ukrainian Central Rada found it difficult to finally resolve the issue of applying the "labour principle". It actually introduced inequality of citizens of the state on the basis of their social-class origin, what is a blatant violation of the basic principle of the constitutional state - the equality of all citizens before the law. Some of the decisions implemented in the constitutional acts of the UNR, such as, for example, the introduction of the nationalization of land, private factories, factories and banks, when the private owner remained defenceless against the state, cannot be called legal. The content of many constitutional acts issued by the UCR contains provisions on the protection of the rights of representatives of national minorities, and this is not accidental, because the UNR was well aware of the need to resolve the "national question" as one of the most difficult in the country. But on the way to the successful development of the doctrine of the protection of fundamental human and civil rights in the Ukrainian National Republic were not only such factors as a lack of lawyers and low legal awareness of citizens of the country. The real restriction of human and civil rightsin the Ukrainian National Republic was introduced by the command of the German occupation forces against the will of the Ukrainian legitimate government. ; У статті досліджено питання розвитку доктрини природного права людини та його реалізації в конституційних актах Української Народної Республіки 1917-1918 років. У статті були пояснені причини змін у ставленні до проблеми захисту природних прав людини на початку ХХ ст. Керівники Української Центральної Ради добре розуміли, що відродження національної державності є неможливим без чіткого юридичного визначення статусу громадянина України. Особливо актуальною ця проблема стала після проголошення Третього універсалу, коли відбулось оголошення про відродження Української держави. Українська влада встала на захист життя людини та її гідності, свободи слова, друку, віросповідання. Громадянам країни гарантувались певні політичні і соціальні права без різниці статі та віку громадян. Але впроваджуючи новаторські для того часу погляди, члени Української Центральної Ради вагалися стосовно остаточного вирішення питання застосування «трудового принципу». Він фактично впроваджував нерівність громадян держави за ознаками їх соціально-класового походження, що є відвертим порушенням основного принципу правової держави - рівності усіх громадян перед законом. Частина рішень, реалізованих у конституційних актах УНР, таких, наприклад, як запровадження націоналізації землі, приватних фабрик, заводів і банків, коли приватний власник лишався беззахисним перед державою, неможливо назвати правовими. Зміст багатьох конституційних актів, виданих УЦР, містить положення щодо захисту прав представників національних меншин і це невипадково, бо в УНР добре усвідомлювали необхідність врегулювання «національного питання» як одного з найскладніших у державі. Але на заваді успішного розвитку доктрини захисту основних прав людини і громадянина в Українській Народній Республіці постали не тільки такі чинники, як брак правників та низька правова обізнаність громадян країни. Реальне обмеження прав людини і громадянина в Українській Народній Республіці було запроваджено командуванням німецьких окупаційних військ всупереч волі українського легітимного уряду.

The proposed study is part of a series of the author's articles, united by the issues of tragic pages in the history of individual ethnic groups living in Southern Bessarabia in the first year of Soviet rule in the region. It is a common fact that Southern Bessarabia (the Ukrainian Danube Region, Budzhak, southern districts of Odesa region) is quite an ethnically diverse region. For several centuries, these lands were home to many nations - Ukrainians and Moldovans, Bulgarians and Greeks, Albanians and Germans, Poles and Russians. Interestingly, the polyethnic composition of the region's population did not lead to ethnic or religious contradictions: the locals managed almost next to impossible - to preserve their national identity, traditions, faith, culture and at the same time to find consensus with neighbors. The peculiarities of the historical development of Southern Bessarabia, the frequent transition of these lands from one state to another contributed to the tolerant attitude of the local population to any government, which was reflected in the restrained attitude towards the administration. This scenario was used many times until the Soviet regime came to Southern Bessarabia, which brought with it repression, torture, nationalization, and so on. The tragic events affected many residents of the region, but to date the exact number of people who passed through the grip of the Soviet totalitarian-repressive machine has not been established. Among those affected by the Soviet repression in southern Bessarabia were members of the Jewish ethnic community. On the basis of archival documents, cases of rehabilitated residents of the region, an attempt has been made to find out the number of Jews affected by Soviet totalitarianism, to name their names, to assess the material damage of the repressed. Traders and doctors, pharmacists and restaurateurs, owners of mills and businesses - representatives of each of these categories were included in the list of the repressed. The Jewish population of the region, which was engaged in trade, suffered the most; the share of Jews among the nationalized trade enterprises was almost 80%. The total number of Jews repressed between July 1940 and June 1941 amounts to 204, or 26.7% of the total number of the people who were repressed during this period. ; Запропоноване дослідження входить до циклу статей автора, об'єднаних проблематикою питань трагічних сторінок історії окремих народів Південної Бессарабії у перший рік радянського панування в регіоні. Як відомо, Південна Бессарабія (Українське Придунав'я, Буджак, південні райони Одеської області) доволі строкатий в етнічному відношенні край. Протягом кількох століть ці землі були домівкою для представників багатьох народів – українців і молдован, болгар і греків, албанців і німців, поляків і росіян. Важливо, що поліетнічний склад населення регіону не призвів до виникнення етнічних або релігійних протиріч: місцевим мешканцям вдавалося майже неможливе – зберегти свою національну ідентичність, традиції, віру, культуру й при цьому знаходити консенсус із сусідами. Особливості історичного розвитку Південної Бессарабії, частий перехід цих земель від однієї держави до іншої сприяв толерантному ставленню місцевого населення до будь-якої влади, що відбивалося у стриманому відношенні до адміністрації. Такий сценарій неодноразово використовувався, але до тих пір, поки в Південну Бессарабію не прийшла радянська влада, яка принесла з собою репресії, тортури, націоналізацію тощо. Трагічні події торкнулися доль багатьох мешканців регіону, однак до сьогодні не встановлена точна кількість людей, що пройшли через лещата радянської тоталітарно-репресивної машини. Серед тих, хто постраждав у наслідок радянських репресій в Південній Бессарабії значне місце займали представники єврейської етнічної громади. На підставі архівних документів, справ реабілітованих мешканців регіону зроблено спробу з'ясувати кількість постраждалих від радянського тоталітаризму євреїв, назвати їх імена та прізвища, оцінити матеріальні збитки репресованих. Торговці та лікарі, аптекарі та ресторатори, власники млинів та підприємств – представники кожної з названих категорій потрапили до списку репресованих. Серед найбільш постраждалих –представники єврейського населення регіону, що займалися торгівельною справою: частка репресованих євреїв у цьому сегменті становила майже 80%. Загальна кількість репресованих євреїв за період з липня 1940 по червень 1941 рр. становить 204 особи, або 26,7% від загальної кількості репресованих за цей період.

Justice is a fundamental principle that interests theorists and legal practitioners. A question of justice is examined by philosophers and lawyers. In his article, the author explores the place and importance of justice system principles of law. Justice is a generally rights principle of which in his the works wrote Aristotle, V. Nersesyants. The right is associated with justice. These are two categories that complement each other. The content of the rights inheres justice. The law must be fair, as it is a criterion of its legitimacy. Justice is a moral category. Morality is the source of the principle of fairness. Consider justice as a philosophical-ethical category, and as a legal category. Justice is dynamic. It contains elements of injustice, but it depends on the legal, economic, political and other relations. Often justice is compared with equality. This is stated in the universal Declaration of human rights. Justice is very important in the practice of law. The question of fair or unfair is painful for Ukrainians. An example is the market of the Ukrainian land, nationalization of PJSC CB «PrivatBank» unfair wages in Ukraine. The problem in practice is that in the case when the legal norm is incompatible with the principle of justice the state has the opportunity to realize unjust legal rules applying state coercion. In this case, the rights and freedoms of the individual are not protected. Often in practice, fairness is treated rather formally. Courts of General jurisdiction shall actively implement this principle in the administration of justice. So, the constitutional Court of Ukraine often refers in its decisions to the principle of justice. The requirement of justice is equal application of the law to persons in similar situations and differentiated to subjects who are in different situations. Justice is often being speculated. All laws and judgments must be fair. Otherwise they are not perceived in society and this leads to legal nihilism. The principle of justice is a fundamental principle for all areas of the law. Justice stands on the pedestal of law principles. Therefore, when solving concrete problems lawyers must act fairly, in accordance with the requirements of the law. ; Справедливість – це основоположний принцип, який цікавить теоретиків права та юристів-практиків. Питання справедливості досліджується як філософами, так і юристами. У своїй статті автор досліджує місце та значення справедливості у системі принципів права. Справедливість – загальноправовий принцип, про який писали у своїх працях Аристотель, В. Нерсесянц. Право пов'язане зі справедливістю. Це дві категорії, які взаємно доповнюють одна одну. У змісті права закладена справедливість. Закон повинен бути справедливим, оскільки це є критерієм його легітимності. Справедливість – це і моральна категорія. Мораль є витоком принципу справедливості. Розглядають справедливість і як філософсько-етичну категорію, і як правову категорію. Справедливість динамічна. Вона містить у собі елементи несправедливості, але це залежить від правових, економічних, політичних та інших відносин. Часто справедливість ототожнюють з рівністю. Про це йдеться і в Загальній декларації прав людини. Справедливість має досить важливе значення в юридичній практиці. Питання «справедливо-несправедливо» є болючим для українців. Прикладом є ринок української землі, націоналізація ПАТ КБ «Приватбанк», несправедливі заробітні плати в Україні. Проблемним питанням на практиці є те, що у випадку, коли правова норма не відповідає принципу справедливості, держава має можливість реалізувати несправедливі правові норми, застосовуючи державний примус. У такому випадку права та свободи людини не захищаються. Часто на практиці до принципу справедливості ставляться досить формально. Суди загальної юрисдикції повинні активно реалізовувати даний принцип при здійсненні правосуддя. Так, Конституційний Суд України часто посилається у своїх рішеннях на принцип справедливості. Вимогою справедливості є однакове застосування закону до осіб, які знаходяться в однакових ситуаціях і диференційованого – до суб'єктів, які знаходяться в різних ситуаціях. Справедливістю часто спекулюють. Усі закони та судові рішення повинні бути справедливими. В іншому випадку вони не сприймаються в суспільстві, і це призводить до правового нігілізму. Принцип справедливості – це основоположний принцип для всіх галузей права. Справедливість стоїть на п'єдесталі принципів права. Тому під час вирішення конкретної проблеми юристи мають діяти справедливо, відповідно до вимог права.

The specificity of settlements in the territory of the former Ostroh district during the second half of the 19th and the first half of the 20th centuries is described in the article. Particular attention is paid to the territorial and administrative divisions of these territories during their stay in the Russian Empire, the Second Polish Republic and the Ukrainian SSR. The dynamics of the number of settlements and their types in the territory of the former Ostroh uyezd during the specified period are analyzed.Thus, the Ostroh uyezd was a part of the Volhynian Governorate in the administrative-territorial sphere in the second half of the 19th and the beginning of the 20th centuries. After the First World War, the largest part of the Ostroh uyezd was included into the Volhynian Voivodeship of the Republic of Poland, and smaller part was included into the Ukrainian SSR. Since the beginning of the Second World War, the Soviet administrative system had been implemented in these territories and the territorial division into the voivodships, the powiats, and the gminys was abolished. Instead, the division into the regions and districts was implemented. The territory of the former Ostroh district of the 1911 model became part of the Hoshcha, Zdolbuniw, Mezhyritch and Ostroh districts of the Rivne region. During the second half of 19th and the first half of the 20th century, significant changes occurred in the network of settlements on the territory of the Ostroh district. A large number of new settlements of different types appeared. The main social types of rural settlements were the village, the khutir, and the hamlet. The increase in the number of settlements was significantly dependent on certain administrative measures. The changes in the structure of the settlements were accompanied by the resettlement of villages to the new settlements – khutir. There were some typical farming methods for khutir. In many cases, the quantitative data indicate only the difference between the numbers of settlements in different years, whereas the amplitude of their occurrence/disappearance/change of status is much bigger.The absolute number of settlements increased by 123 units, that is by 40.3%, while from 1910 to 1946 it decreased by 50 units (by 11.6%) during 1880–1910 on the territory of Ostroh county.Since 1921, the ethnographic massif of Volhynia was divided by the political boundary between the Second Polish Republic and the Soviet Union. The distinct socio-political and economic conditions of the two states led to the differences in the processes that influenced the development of settlements. The immigration had a significant impact on the emergence of new settlements. This process was encouraged in the 19th century by the Russian government and in the interwar period by the Second Polish Republic. The main composition of foreign settlers first included the Czech and German, and later – the Polish colonists. Foreign colonists formed settlements with the status of colonies. In the part of the Ukrainian SSR, the decrease in the number of settlements was caused by collectivization, during which the peasants were forced to concentrate in larger settlements. Nationalization of land resources deprived the economic basis for the development of farm-type settlements. ; Наукові студії над поселеннями на території українських земель – одна із важливих складових етнічної історії України, позаяк ця проблематика перебуває на стику історії та етнології. Без її розуміння неможливе об'єктивне дослідження як історичних подій, явищ та процесів, так і традиційної культури. У пропонованій статті, на основі матеріалів з Державних архівів Волинської, Рівненської та Житомирської областей, а також опублікованих статистичних джерел, охарактеризовано специфіку поселень на території колишнього Острозького повіту впродовж другої половини ХІХ – першої половини ХХ ст. Особливу увагу звернено на територіально- адміністративний поділ зазначених теренів у час їх перебування в складі Російської імперії, Другої Речі Посполитої та УСРР-УРСР. Проаналізовано динаміку кількості поселень на території колишнього Острозького повіту за вказаний період та їхню статистику за соціально-економічними типами.

(належать мерові міста А. Садовому).Наголошено на повному штилі висвітлення цієї гостро актуальної проблематики в центральних засобах масової інформації.Розвінчуються міти про Львів як П'ємонт України, що пов'язано з маніпулятивною заанґажованістю інформаційного простору, продажністю окремих журналістів та дуже низьким рівнем політичної культури українського суспільства. Розкриваються основні вияви історичного та новітнього гібридного москвофільства.Авторка спростовує ці міти та стереотипи крізь персоналістичну призму історичних особистостей та сучасних львівських політиків, що стали у Верховній Раді основними рупорами москвофільських ідей. Трактує це як типовий приклад хвороби колоніялізму, що отримала цілющий виклик від історії вилікуватися саме через війну, але в цей великий час застала дуже малих людей передусім у проводі нашої держави.Привид москвофільства під легким камуфляжем лібералізму й глобалізму стрімко вийшов на поверхню саме під час Майдану 2014 року, зреалізувавшись в ідеологічному гаслі чинної післямайданівської влади «єдина країна — єдіная страна» та магістральному посилі: «скасування мовного закону Ківалова-Колесниченка НЕ НА ЧАСІ».Усі й центральні, й місцеві ЗМІ надали цим згубним москвофільським гаслам максимальної популяризації та промоції. Саме в цій вербальній упаковці гасла «модерного москвофільства» (Д. Донцов) озвучені місцевою владою Львова під час анексії Криму та початку московсько-української війни 2014 року. Центр їхнього зародження — середовище львівської мерії (передусім її інформаційного супроводу). Саме звідси розганялися медійні хвилі про несвоєчасність скасування путінського мовного закону Ківалова-Колесниченка 23 лютого 2014 року, й тут формувалася ідеологія «примусового замирення» з ворогом через мовний чинник. ; The article reveals the social and political phenomenon of historical and contemporary Lviv moskvofilstvo (that is the creation of ideological and information foundation for de-nationalization of the Western Ukraine) and its threats to the national security of the Ukrainian state against the background of exceptional contribution by oligarchic local mass media: tele- and radio company «Liuks», 24th Channel, internet-resource zaxid.net and others (all of them belong to Lviv mayor A. Sadovyi).The author stresses the fact that the central mass media do not pay the least attention to this dangerous range of problems. They kept and keep to dead calm. The myths about Lviv as Ukrainian Piedmont are taken down from a pedestal that is connected with manipulative engagement of information space, venality, corruption of some journalists and very low level of political culture of Ukrainian society. New manifistations of historical and present-day hybrid moskvofilstvo are highlighted.The author disproves these myths and stereotypes through the prizm of historic personalities and present-day Lviv politicians, who became chief speaking trumpet of moskvofilstvo ideas in Verkhovna Rada. She treats this fact as a typical example of colonialism disease, which received a curative challenge from history to recover just through the war, but at this great time it has found very «little people» mainly among the authorities of our state.The ghost of moskvofilstvo under a light camouflage of literalism and globalizm steeply came out to the surface just in the times of Maidan, 2014, having found its realization in the ideological slogan of the official after-Maidan power authorities «yedyna kraina – yedinaia strana» and main-line premise: «the time for Cancellation of Kivalov-Kolesnichenko's law on language has not come yet».All the central and local mass media gave maximum popularization and promotion to these destructive, fatal moskvofil slogans. Just in this verbal presentation the slogan of «modern moskvofilstvo» (D. Dontsov) was made public by Lviv local authorities of the time of Crimea annexation and the beginning of Moscow-Ukrainian war of 2014. The centre of their origin and formation is Lviv city administration (mainly its information escort). Just from here media information waves about the impertinence of Kivalov-Kolesnichenko's language law cancellation were dispelled and just here the ideology of «forced reconciliation» with the enemy through the language factor was formed.

Садовому).Наголошено на повному штилі висвітлення цієї гостро актуальної проблематики в центральних засобах масової інформації.Розвінчуються міти про Львів як П'ємонт України, що пов'язано з маніпулятивною заанґажованістю інформаційного простору, продажністю окремих журналістів та дуже низьким рівнем політичної культури українського суспільства. Розкриваються основні вияви історичного та новітнього гібридного москвофільства.Авторка спростовує ці міти та стереотипи крізь персоналістичну призму історичних особистостей та сучасних львівських політиків, що стали у Верховній Раді основними рупорами москвофільських ідей. The myths about Lviv as Ukrainian Piedmont are taken down from a pedestal that is connected with manipulative engagement of information space, venality, corruption of some journalists and very low level of political culture of Ukrainian society. New manifistations of historical and present-day hybrid moskvofilstvo are highlighted.The author disproves these myths and stereotypes through the prizm of historic personalities and present-day Lviv politicians, who became chief speaking trumpet of moskvofilstvo ideas in Verkhovna Rada. She treats this fact as a typical example of colonialism disease, which received a curative challenge from history to recover just through the war, but at this great time it has found very «little people» mainly among the authorities of our state.The ghost of moskvofilstvo under a light camouflage of literalism and globalizm steeply came out to the surface just in the times of Maidan, 2014, having found its realization in the ideological slogan of the official after-Maidan power authorities «yedyna kraina – yedinaia strana» and main-line premise: «the time for Cancellation of Kivalov-Kolesnichenko's law on language has not come yet».All the central and local mass media gave maximum popularization and promotion to these destructive, fatal moskvofil slogans. Just in this verbal presentation the slogan of «modern moskvofilstvo» (D. Dontsov) was made public by Lviv local authorities of the time of Crimea annexation and the beginning of Moscow-Ukrainian war of 2014. The centre of their origin and formation is Lviv city administration (mainly its information escort). Just from here media information waves about the impertinence of Kivalov-Kolesnichenko's language law cancellation were dispelled and just here the ideology of «forced reconciliation» with the enemy through the language factor was formed.

Urgency of the research.The article presents the metaphysical understanding of the national idea, which reflects events, concepts, dreams are very important in order to remain on the position of "objective observer" in the work of spiritual coryphaeus.
