Established as a distinct academic discipline at the end of the second world war, International Relations has above all been concerned with analysing relations between sovereign states - in the first instance, the causes of war between them and alternative forms of cooperation. Throughout its history, IR has been dominated by 'realism', an approach based on a juridical totalizing concept of the state. This denies the relevance of factors located within polities and societies and stresses the primacy of security issues in inter-state relations. More recent work in the field has sought to analyse the interaction of the domestic and the international and to explore the interaction of security with other, most evidently economic, factors. The relation of IR to political science is defined by the shared concern with the 'pertinence' of the international; that is, how far specific political and social systems are, and are not, affected and determined by factors beyond their frontiers and how these forms of international influence are changing in the contemporary world.

Contrary to widely held beliefs and expectations during both the 'twenty years' crisis' and the postwar era, the gulf between international co-operation and neutrality has proved to be significantly narrower in practice than in theory. Neutrality has evolved into a dynamic, enterprising policy emphasising participation and activism in international life. Broadly speaking, participation in universal organisations, particularly in the United Nations, has been a major asset for the neutral states, enabling them to institutionalise their neutrality in the international consciousness as a 'universal' policy divorced from inter-bloc rivalries. Participation in regional co-operation has led to the diminution, in varying degrees, of the credibility of neutrality. From the early 1970s onwards the small states have skillfully capitalised on the evolution of detente to play an important role in the European arena through the Conference on Security and Co-operation in Europe (CSCE). Thus they have proved that if neutrality and collective security are indeed mutually exclusive concepts, then there is definitely much more of neutrality and less of collective security in international political life.
Den politischen Instanzen in den Industrieländern fällt es immer schwerer, die Freizügigkeit im internationalen Warenaustausch aufrechtzuerhalten. Die seit den siebziger Jahren auftretende allgemeine Wachstumsschwäche und der — verglichen mit früher — ausgeprägtere interne Verteilungskampf haben in vielen Branchen das Verlangen nach Protektion erheblich verstärkt. ) Die Bereitschaft, den Protektionswünschen nachzukommen, steigt in dem Maße, wie es gelingt, die Kosten von Protektionsmaßnahmen zu verschleiern. Hierzu erweisen sich die subtilen Formen des "Neuen Protektionismus' als besonders geeignet. Seine Varianten reichen von offenen und versteckten Einkommenstransfers über "freiwillige" Exportselbstbeschränkungsabkommen und Marktordnungen bis hin zum Grenzausgleich für Agrarerzeugnisse. ) In der Tokio-Runde wurde versucht, die nicht-tarifären Handelshemmnisse einzugrenzen und eine bislang offene Flanke der internationalen Handelspolitik zu sichern. Dabei wurden die internationalen Regeln für den Welthandel revidiert und neue Kodizes über die Vergabe von Staatsaufträgen und Einfuhrlizenzen sowie über die Festsetzung von technischen Standards und Zollwerten vereinbart. ) Die in der Tokio-Runde geschaffenen Kodizes haben jedoch weder bestehende nichttarifäre Handelshemmnisse abgeschafft, noch können sie einem weiteren Umsichgreifen solcher Hemmnisse einen Riegel vorschieben. ) Die Tokio-Runde ist handelspolitisch relevanten Problemen aber auch ausgewichen, — weil das Verhandlungsergebnis die besonders aktuellen Bestrebungen, Märkte durch Regierungsvereinbarungen quasi hoheitlich zu "ordnen", überhaupt nicht erfaßt und die vielfach praktizierten Schutzklauseln ganz ausklammert; — weil der Agrarprotektionismus weitgehend ausgespart worden ist; — weil die neuen Kodizes kaum Spielraum für die erforderliche Sonderbehandlung von Entwicklungsländern lassen. ) Das internationale handelspolitische Klima ist gegenwärtig wohl zu ungünstig, um im Rahmen des GATT eine Liberalisierungsstrategie des "großen Sprunges" einzuleiten. Erfolgversprechender ist es, in einem ersten Schritt durch eine Strategie des Nachbesserns wenigstens jenes Liberalisierungspotential zu sichern, das mit den neuen Kodizes erschlossen werden könnte. Erst in einem zweiten Schritt sollte dann versucht werden, die als besonders heikel angesehenen Schutzklauseln in Angriff zu nehmen.

Simmons untersucht die Verrechtlichungsprozesse innerhalb der internationalen Währungsordnung vom Ende des 19. Jahrhunderts bis in die Zeit nach dem Ende von Bretton Woods. Im Zentrum steht dabei die Frage, wann und warum Staaten internationalen Währungsinstitutionen und -ordnungen beitreten, sich ihren Normen unterwerfen und sie (nicht) konsequent einhalten. Die Autorin kommt zu dem Schluss, dass die jeweilige regionale Rechtskultur und die nationale Rechtsordnung bestimmend für die Akzeptanz internationaler Normen sind. Diese Diplomarbeit befasst sich mit dem Thema "Anspruchsverfristung im internationalen Gütertransport aus österreichischer Sicht." Das Transportrecht ist eine zersplitterte Materie, welche insbesondere völkerrechtlich geprägt ist. Für jeden Verkehrsträger, also Straße, Schiene, Luft, Hohe See und Binnengewässer existieren internationale Übereinkommen. Dabei handelt es sich um die CMR, die CIM, das Montrealer Übereinkommen, die Hamburger Regeln und die CMNI, welche alle letzten Endes die Rechtsvereinheitlichung zum Ziel haben. Als Annex zu den Haftungsregeln haben natürlicherweise Verfristungsregeln wie die Verjährung oder der Verfall eine herausragende Bedeutung für die Rechtsausübung und die Rechtsdurchsetzung. Ziel dieser Diplomarbeit ist es die Verfristungsbestimmungen im internationalen Gütertransport umfassend darzustellen und anhand dieser Darstellung einen detaillierten Überblick dieser Bestimmungen aus Sicht der österreichischen Rechtsordnung zu gewähren. Anfänglich wird eine kurze Darstellung der transportrechtlichen Grundbegriffe vorgenommen, woraufhin sich der Hauptteil mit den Verfristungsbestimmungen der verschiedenen internationalen Übereinkommen und jenen des österreichischen UGB sowie der Allgemeinen Österreichischen Spediteurbedingungen befasst. Dabei wird auf jedes dieser Übereinkommen einzeln eingegangen. Da sich der Straßengütertransport über die letzten Jahre und Jahrzehnte zum weitaus Bedeutendsten der verschiedenen Verkehrsmittel entwickelt hat, liegt das Hauptaugenmerk dieser Diplomarbeit auf der CMR. Zudem soll umfassend auf den Multimodaltransport und insbesondere auf die "österreichische Sicht" zu Verjährungsfristverkürzungen mittels AGB bzw mittels der AÖSp beim Multimodaltransport eingegangen werden. Letztlich erfolgt ein Resümee, in welchem die Ergebnisse der Arbeit gegenübergestellt werden. ; This diploma thesis deals with the topic Limitation of claims in international goods transport from the Austrian perspective. Transport law is a fragmented matter, which is particularly influenced by international law. International agreements exist for each mode of transport, i.e. road, rail, air, high seas and inland waters. These are the CMR, the CIM, the Montreal Convention, the Hamburg Rules and the CMNI, all of which ultimately aim to unify the law. As an annex to the liability rules, limitation rules such as the statute of limitations or forfeiture naturally have outstanding significance for the exercise and enforcement of rights. The aim of this diploma thesis is to present the limitation rules in international freight transport in a comprehensive way and to give a detailed overview of these rules from the perspective of the Austrian legal system. At the beginning, a short presentation of the basic concepts of transport law is given, followed by a main part dealing with the limitation period provisions of the various international conventions and those of the Austrian Commercial Code and the General Austrian Forwarders' Terms and Conditions (AOESp). Each of these conventions is dealt with individually. Since road freight transport has developed over the last years and decades to become by far the most important of the various means of transport, the main focus of this thesis is on the CMR. In addition, the multimodal transport and especially the "Austrian view" on the shortening of the limitation period by means of general terms and conditions or by means of the AOESp for multimodal transport will be dealt with in detail.
