В статье рассматриваются некоторые исторические аспекты российского законодательства о вовлечении несовершеннолетнего в совершение преступно - наказуемого деяния, анализируются объективные, субъективные и квалифицирующие признаки данного состава преступления, сложившаяся судебная практика и официальные данные ведомственной статистики Судебного Департамента при Верховном суде Российской федерации и Министерства Внутренних Дел Российской Федерации, в целях разработки предложений по внесению изменений и дополнений в действующее законодательство Российской Федерации, касающегося ответственности за вовлечение несовершеннолетнего в совершение преступления. ; The article discusses some historical aspects of Russian legislation on involving a minor in the commission of a criminal offense, analyzes the objective, subjective and qualifying features of this crime, the prevailing judicial practice and official data of departmental statistics of the Judicial Department under the Supreme Court of the Russian Federation and the Ministry of Internal Affairs of the Russian Federation, in order to develop proposals for amendments and additions to the current legislation of the Russian Federation regarding liability for involving a minor in a crime.

Highlighting and analyzing the existing shortcomings of legislative measures to counteract crimes against the foundations of the constitutional order and security of the state, the author defines the aim of his research as the development of scientifically justified measures aimed at improving criminal legal norms providing for re-sponsibility for relevant criminal acts. This article is devoted to the study of an urgent problem, which consists in clarifying the social and legal validity of the addition of the Criminal Code of the Russian Federation with a new Article 280.4 on responsibility for making public calls to carry out activities directed against the security of the state. Dialectical, systemic, comparative legal, predictive methods, as well as modeling methods were used in the work. The author analyzed the content of this criminal law norm, including taking into account its reflection and justification in the draft of the relevant federal law, formulated conclusions and proposals aimed at improv-ing the legislative regulation of criminal liability for these public appeals.

Abstract
This article seeks to examine and explain the interaction between the substantive and procedural aspects of criminal law protection of human rights in the law of the European Convention of Human Rights. Noting certain theoretical and conceptual lacunae that arise in this context, the article suggests the most appropriate solution for the assessment of the substantive-procedural relationship from the perspective of legal theory and the European Court of Human Rights' case-law. It submits, in particular, that it is always necessary to examine both aspects—substantive and procedural—of the same right and that the procedural aspect should be given primacy both in terms of the order of examination and inferences to be drawn on the question of observance of human rights by states.
