The 1954, May 4th disaster of the Ribolla mine is one of the worst mine accidents ever happened in Italy. Italian mine activity has never been comparable to that in the most important industrialised countries. The lack of minerals has always been one of the greatest problems hindering industrial development. However, in the first half of the twentieth century and until the '70s, mineral extraction was a significant part of the national economy, employing many thousands of workers. More specifically, at first copper mines, later mainly pyrite ones, represented the basis for the development of Montecatini, the big Italian chemical monopoly. The Ribolla lignite mine was owned by the Montecatini company. The mine had a remarkable development during the Second World War and 1200 miners still worked there in 1954. The firedamp explosion caused 43 deaths and was matter of huge controversy and debate among trade unions and left political parties on the one hand and the Montecatini company on the other. Before the disaster, the miners' union had reported serious safety problems with regard to working methods. A deeper insight into the event began to emerge only many years later. In particular, studies based on part of the documents made available from the trial against Montecatini were published in 2005. After the disaster, Montecatini was forced to adopt safety measures and to invest money to improve the working conditions, particularly ventilation in the tunnels. However, the mine's life had come to an end and some years later it was closed. My study will show how the mining company, trade unions, political parties and local governments acted after the mining disaster. For example, how industrial relations changed in the still open mines. In a social environment dominated by the left, the Montecatini had to abandon the authoritarian behaviour, which was probably derived from the fascist era. The left, on the other hand, had to renounce the most radical elements of their programmes, such as the nationalization of the mines.
La actividad minera italiana nunca ha sido comparable a la de los países industrializados más importantes. La falta de minerales siempre ha sido uno de los mayores problemas que han obtaculizado el desarrollo industrial. Sin embargo, en la primera mitad del siglo XX y hasta los años 70, la extracción de minerales fue una parte importante de la economía nacional, empleando a miles de trabajadores. Más específicamente, al principio las minas de cobre, luego principalmente las de pirita, representaron la base para el desarrollo de Montecatini, el gran monopolio químico italiano. La mina de lignito Ribolla, en la parte sur de la Toscana, también era propiedad de la Compañía Montecatini. La mina tuvo un desarrollo notable durante la Segunda Guerra Mundial y en mayo de 1954 todavía trabajaban 1.200 mineros. El desastre del 4 de mayo de 1954 en esa mina es uno de los peores accidentes mineros jamás ocurridos en Italia. La explosión de grisú provocó 43 muertos y fue motivo de gran polémica y debate entre sindicatos y partidos políticos de izquierda, por un lado, y la empresa Montecatini, por otro. Antes del desastre, el Sindicato de Mineros había denunciado serios problemas de seguridad por los métodos de trabajo. Una visión más profunda del evento comenzó a surgir solo muchos años después. En particular, en 2005 se publicaron estudios basados en parte de los documentos disponibles del juicio contra Montecatini. Después del desastre, Montecatini se vio obligado a adoptar medidas de seguridad e invertir dinero para mejorar las condiciones de trabajo, en particular la ventilación de los túneles. Sin embargo, la vida de la mina había llegado a su fin y algunos años después se cerró. Mi estudio mostrará cómo la empresa minera, los sindicatos, los partidos políticos y los gobiernos locales actuaron después del desastre minero. Por ejemplo, cómo cambiaron las relaciones laborales en las minas aún abiertas. En un ambiente social dominado por la izquierda, los Montecatini tuvieron que abandonar el comportamiento autoritario, que probablemente se derivaba de la era fascista. La izquierda, en cambio, tuvo que renunciar a los elementos más radicales de sus programas, como la nacionalización de las minas.
Arbitration has evolved from a pragmatic, de casu ad casum applied mechanism, towards a growing self-recognition as a method of transnational system of administration of justice. The development of international arbitration towards an autonomous legal order is one of the most remarkable institution buildings at the global level. The autonomous view sees arbitration as deriving its original legitimacy not from a consent within a specific legal order or orders, but rather from a general, initial authorization offered by the community of the States, and later fulfilled by the arbitral tribunals without further States' intervention, and thus detached from a national order. This conceptualization has been connected with general theories pointing to the development of "global legal order(s)", free from traditional intervention and control exercised by the States. For instance, Gunther Teubner's characterization of the new lex mercatoria as a model global law without a State was based on its formulation and application independently from domestic legal systems thanks to arbitral decision-making. In this context, how will an authoritarian state like China react to the trends of trans-nationalization and autonomization of arbitration? What role will China play in the development of international dispute resolution mechanism? Is China showing signs of adapting to the current trend of transnational standards? On the other hand, will the Chinese legal culture and practice characterized by informalism and flexibility offer a counter-force to the increasing proceduralization, formalization, judicialization of arbitration, or the colonization of arbitration by litigation, and thus influence the future direction of transnational norms?This article will highlight the recent developments of China's commercial dispute resolution mechanism, and illustrate China's two-way adaptations towards transnational standards, as a result of the constant interplay between the global formal regulation and local informal practice, predictable regulation and flexible practice, and the clashes between the increasingly cosmopolitan professional culture in the arbitration community and deeply rooted demands of national culture. On the one hand, China is following the trend of harmonization, making adaptations to global norms. This move is essentially driven by the market force, when "economic actors seek more predictability through reliance on formalized processes for managing transactions, and also to seek more formal limits on state power". Arbitration is developed through the practice within the community, rather than imposed top-down from outside the community. While States have to endorse and embrace the norms, the norms then developed independently, based on the expectations of the users, rather than requiring arbitration to adapt to the specific requirements of the State. Despite the limitations on party-autonomy in the legislation, other non-state actors (i.e., arbitration institutions and individuals such as judges, arbitrators, case managers and lawyers) also exert an essential influence on the arbitration reforms in China. In order to make China a more appealing hub of dispute resolution to meet the needs of users, various stakeholders have made various innovations and adaptations to bring the practice of arbitration more in line with transnational standards, as a result of the marketization of arbitration in China.On the other hand, China is also taking an increasingly active role in shaping the global norms. Signs of China's "selective reshaping" of institutions and rules have been found in trade, investment, and international finance. In the field of dispute resolution, China's deeply rooted tradition of informal means of dispute resolution may be of value to the practice in other jurisdictions. The users' constant search for predictability has led to the increasing judicialization of arbitration, when the international commercial arbitration laws and procedures increasingly replicate national judicial procedures, national laws and their legal intricacies, which departs from arbitration's original purpose of offering an alternative resolution to the court proceedings. This has resulted in an opposing trend of hybrid processes and mixed mode dispute resolution, with China playing a leading role in this trend. Such a form of impact onto arbitration proceedings can be seen as further extending the space free from States' control and thus contributing to the processes of autonomization of arbitration. These recent developments show China's efforts to balance the globalization and localization of its commercial arbitration and mediation practice, including both localized globalism and globalized localism—the "glocalization" process.

The article outlines the concept of public wealth as a part of national wealth that consists of resources, values and goods that belong to the whole society. The composition of public wealth is determined: public assets (property and values that are in state and communal ownership); potential public resources; social human capital. The expediency of dividing human capital into individual human capital (which concerns exclusively his private existence) and social human capital (in the sphere of collective interaction) is indicated.The necessity of the analysis of public wealth from the standpoint of assets is proved. It is stated that public property can be a liability for budgets, returning losses to the state and local government. The necessity of taking into account potential public resources (lands, forests, roads, subsoil) is substantiated. The paper attempts to estimate the public wealth in Ukraine and identifies it in excess of 10 annual GDP.It is pointed out that in Ukraine the relations of state-owned enterprises with suppliers, contractors and buyers often increase the cost and cut their revenues. This system is characterized as a process of flowing public wealth into private hands - the nationalization of losses and privatization of profits by business structures close to state-owned enterprises. It is argued that the streamlining of public wealth management should provide for maximum involvement in the economic turnover of natural resources, ensuring openness and creating market conditions, privatization and lease. The advantages of using best practices in the field of state property management by creating holding companies that represent the interests of taxpayers and carry out professional corporate asset management are shown. ; В статье обозначен концепт общественного богатства, как части национального богатства, находящегося за пределами частной сферы и состоящего из ресурсов, ценностей и благ, принадлежащих всему обществу. Определен состав общественного богатства: общественные активы (имущество и ценности, которые находятся в государственной и коммунальной собственности); потенциальные общественные ресурсы; социальный человеческий капитал. Указана целесообразность разграничения человеческого капитала на индивидуальный человеческий капитал отдельного лица (который касается исключительно ее частного существования) и социальный человеческий капитал (в сфере коллективного взаимодействия).Доказана необходимость анализа общественного богатства с позиций активов. Указано, что общественная собственность может выступать пассивом для бюджетов, возвращаясь убытками для государства и местного самоуправления. Обоснована необходимость взятия в расчет потенциальных общественных ресурсов (земель, лесов, дорог, недр). В работе предпринята попытка ориентировочной оценки общественного богатства в Украине и определен его объем в размере превышающем 10 ежегодных ВВП.Указано, что в Украине отношения государственных предприятий с поставщиками, подрядчиками и покупателями, нередко увеличивают себестоимость и подрезают их доходы. Эту систему обозначено как процесс перетекания общественного богатства в частные руки - национализации убытков и приватизации прибылей приближенными к государственным предприятиям бизнес структурами. Аргументировано, что упорядочение управления общественным богатством должно предусматривать максимальное привлечение в экономический оборот природных ресурсов, обеспечение открытости и создание рыночных условий, разгосударствление и передачу в аренду. Показаны преимущества использования передового опыта в сфере управления государственной собственностью путем создания холдинговых компаний, представляющих интересы налогоплательщиков и осуществляющих профессиональное корпоративное управление активами. ; У статті окреслено концепт суспільного багатства, як частини національного багатства, що знаходиться за межами приватної сфери і складається із ресурсів, цінностей та благ, що належать усьому суспільству. Визначено склад суспільного багатства: суспільні активи (майно та цінності, які знаходяться у державній і комунальній власності); потенційні суспільні ресурси; соціальний людський капітал. Зазначено доцільність розмежування людського капіталу на індивідуальний людський капітал окремої особи (який стосується виключно її приватного існування) та соціальний людський капітал (у сфері колективної взаємодії).Доведено необхідність аналізу суспільного багатства із позицій активів. Вказано, що суспільна власність може виступати пасивом для бюджетів, повертаючись збитками для держави та місцевого самоврядування. Обґрунтовано необхідність взяття у розрахунок потенційних суспільних ресурсів (земель, лісів, доріг, надр). У роботі здійснено спробу орієнтовної оцінки суспільного багатства в Україні і визначено його в обсязі, що перевищує 10 щорічних ВВП. Вказано, що в Україні відносини державних підприємств із постачальниками, підрядниками та покупцями, нерідко збільшують собівартість і підрізають їх доходи. Цю систему характеризовано як процес перетікання суспільного багатства до приватних рук – націоналізацію збитків та приватизацію прибутків наближеними до державних підприємств бізнес структурами. Аргументовано, що впорядкування управління суспільним багатством має передбачати максимальне залучення у економічний оборот природних ресурсів, забезпечення відкритості та створення ринкових умов, роздержавлення та передачу в оренду. Показано переваги використання передового досвіду в сфері управління державною власністю шляхом створення холдингових компаній, які представляють інтереси платників податків і здійснюють професійне корпоративне управління активами.

The purpose of the article is to analyse the agrarianist by their content approaches and practices of solving the agrarian issue as a realization in practice of peasants' hopes and ideas about their just future; to establish criteria for clarifying the agrarianist essence of practices for solving the agrarian issue, to determine the types of these practices; show the dynamics of changes in peasant agrarian approaches and practices under different forms of government during the Ukrainian Revolution of 1917 – 1921. The research methodology is a socio-cultural approach, which allows to explain how Ukrainian peasantry's mental guidelines, ways of seeing the solution of the agrarian issue affected the practices of solving the land issue and influenced the emergence of domestic agrarianism in 1917 – 1921. The scientific novelty consists in the following: it has been substantiated that during the revolutionary period of 1917 – 1921 there was a dynamic change in peasant agrarianist approaches and practices to solve the agrarian issue: from socialization policy based on the rejection of private ownership of land, free requisition of land from the owners and its transfer to the peasants for cultivation, to the inclination of the peasant community to receive land in private ownership for redemption to the state. The Conclusions. The following criteria for the agrarianist essence of approaches and practices for solving the agrarian issue during the revolution of 1917 – 1921 have been defined: if we consider the Bolshevik-Communist model, it is a denial of the nationalization of land and collective management on it; if we consider the bourgeois and capitalist model, it is a denial of large private ownership of land. Since in the grain growers' mentality the fundamental principle of land ownership or use was personal work on it, the main peasant agrarian approaches and practices to solve the agrarian question during the revolution of 1917 – 1921 were: 1. preservation of small peasant private ownership of land; 2. transfer of land for life with the right of inheritance (which in the understanding of the peasantry was close to the right of private property in addition to the possibility of selling land). At the same time, a large part of the peasantry saw socialization as a certain transition period to private property, which had to go through the following stages: confiscation of land from landlords – its transfer to peasants for life – legitimization of peasant private ownership of this land. ; Мета статті – проаналізувати аграристські за змістом підходи та практики розв'язання аграрного питання як реалізацію на практиці селянських сподівань і уявлень про їхнє справедливе майбутнє; встановити критерії для з'ясування аграристської сутності практик із розв'язання аграрного питання, визначити різновиди цих практик; показати динаміку зміни селянських аграристських підходів та практик за різних форм влади у період Української революції 1917 – 1921 рр. Методологією дослідження є соціокультурний підхід, що дає можливість пояснити, як ментальні настанови, способи бачення розв'язання аграрного питання українського селянства, позначилися на практиках розв'язання земельної проблеми та вплинули на появу вітчизняного аграризму в 1917 – 1921 рр. Наукова новизна полягає в обґрунтуванні того, що протягом революційного періоду 1917–1921рр. спостерігається динаміка зміни селянських аграристських підходів та практик розв'язання аграрної проблеми: від політики соціалізації, базованої на відмові від приватної власності на землю, безоплатної реквізиції землі у власників та передачі її селянам у користування, до схиляння селянського загалу отримати землю у приватну власність за викуп державі. Висновки. Визначено такі критерії аграристської сутності підходів та практик із розв'язання аграрної проблеми в період революції 1917 – 1921 рр.: якщо брати більшовицько-комуністичну модель – це заперечення одержавлення землі та колективного господарювання на ній; якщо брати буржуазно-капіталістичну – це заперечення великої приватної власності на землю. Оскільки у хліборобській ментальності фундаментальною засадою володіння чи користування землею була особиста праця на ній, основними селянськими аграристськими підходами та практиками із розв'язання аграрного питання у період революції 1917 – 1921рр. були: 1) збереження дрібної селянської приватної власності на землю; 2) передача землі у пожиттєве користування з правом успадкування (що у розумінні селянства було близьке до права приватної власності крім можливості землю продавати). Водночас значною частиною селянства соціалізація вбачалася як певний перехідний період до приватної власності, яка мала пройти такі етапи: конфіскація землі у поміщиків – передача її селянам у довічне користування – легітимізація селянської приватної власності на цю землю.

Мain objective of the study is to analyze endogenous destabilizing and disintegration tendencies within the framework of the European Monetary Union crisis, which grew into a crisis of a real economy, which simultaneously involved several EU member-states. Achieving this goal requires addressing a number of theoretical and historical lessons that highlight an important dilemma for the survival of the European project in the future. Research methods are systematic, procedural and situational approaches to the study of the Euro-zone countries, participants in the integration project and disintegration influences; institutional approach to the detection and analysis of dysfunctional institutional configuration within the framework of the European Monetary Union. Of great importance for the study of the economic integration and disintegration's problems is the use of the universal scientific methodology principles, including an integrated approach to problem solving, envisaging a general vision of the movement of capital in the context of the European integration project, as well as the application of methods of logical models, induction and deduction, the unity of logical and historical in the development of a research object confirming the synergistic effect of historical and theoretical lessons. The main results and conclusions of the study are to formulate a clear and important dilemma for the survival of the European economic project: the creation of a political union with a functioning institutional configuration of the federal states, or the re-nationalization of many political spheres (financial control and restrictions, monetary sovereignty, trade policy, etc.). Taking into account the history of the Euro-zone, it is important to understand that there is a situation that more closely resembles a non-conflict but latent disintegration, which, instead of a single outbreak of conflicts, has been observed and lasted for a long period. ; Цель исследования – анализ эндогенных дестабилизирующих и дезинтеграционных тенденций в рамках кризиса Европейского валютного союза, который перерос в кризис реальной экономики, охвативший одновременно несколько стран-членов ЕС. Реализация данной цели требует обращения к ряду теоретических и исторических уроков, которые указывают на важную дилемму для выживания европейского проекта в будущем. Методы исследования: системный к исследованию стран-субъектов Еврозоны, участников интеграционного проекта и дезинтеграционных воздействий; институциональный подход к выявлению и анализу дисфункциональной институциональной конфигурации в рамках Европейского валютного союза. Важное значение для исследования проблем экономической интеграции и дезинтеграции имело использование принципов общенаучной методологии, включающее комплексный подход к решению проблем, который предусматривает общее видение движения капитала в контексте европейского интеграционного проекта, а еще применение методов логических моделей, индукции и дедукции, единства логического и исторического в развитии объекта исследования, чтобы подтвердить синергический эффект исторических и теоретических уроков. Главные результаты и выводы исследования заключаются в том, что сформулировано четкую и важную дилемму для выживания европейского экономического проекта: создание политического союза с функционирующей институциональной конфигурации федеральных государств, или повторная национализация множества политических сфер (финансовый контроль и ограничения, денежный суверенитет, торговая политика и т. д.). Принимая во внимание историю Еврозоны, важно понимать, что возникшая ситуация больше напоминает не конфликтную, а латентную дезинтеграцию, и вместо однократной вспышки конфликтов наблюдается и тянется длительный период. ; Мета дослідження – аналіз ендогенних дестабілізуючих і дезінтеграційних тенденцій в рамках кризи Європейського валютного союзу, яка переросла в кризу реальної економіки, що охопила водночас декілька країн-членів ЄС. Досягнення даної мети потребує звернення до низки теоретичних та історичних уроків, які вказують на важливу дилему для виживання європейського проекту в майбутньому. Of great importance for the study of the economic integration and disintegration's problems is the use of the universal scientific methodology principles, including an integrated approach to problem solving, envisaging a general vision of the movement of capital in the context of the European integration project, as well as the application of methods of logical models, induction and deduction, the unity of logical and historical in the development of a research object confirming the synergistic effect of historical and theoretical lessons. The main results and conclusions of the study are to formulate a clear and important dilemma for the survival of the European economic project: the creation of a political union with a functioning institutional configuration of the federal states, or the re-nationalization of many political spheres (financial control and restrictions, monetary sovereignty, trade policy, etc.). Forests cover 28% of the land area of Romania and, they are important from the ecological, economic and social perspectives. Political initiatives to restore property to its pre-nationalization (1948) forest owners became a reality, after the fall of communism. Compared to the other former communist countries from Central and Eastern Europe, the forest restitution process in Romania took a longer time and has been legally implemented via three successive restitution laws in a period of 15years: Law 18/1991, Law 1/2000and Law 457/2005. By the successive implementation of these forest restitution laws, the total forest area restituted to the non-state forest owners reached 3.15million ha at the beginning of 2017, representing about half of the total forest area in Romania. The institutional changes in the forestry sector have been politically influenced (both by the Government and European Union) and not always responsive to the sector needs, realities and evolution. Whilst during the communist period, all typical sectoral functions such as regulatory, supervisory, management and ownership were under the responsibility of the same entity– the Ministry of Forests, in early 1990sthe regulatory and supervisory functions of the state were separated from the management function as the National Forest Administration (NFA)-Romsilva was established as the management entity of state forests, mainly with a commercial mandate. The move of the Department of Forests (the public authority responsible for forests in Romania) under different ministries in the last three decades was accompanied by many changes of the subordinated units and disruptions in the normal activity of its staff. Regarding the forest control and supervisory functions at regional level, 7regional Forest Inspectorates were established in 1999, their number being increased to 16in 2001. After 2003they have had a tumultuous evolution, with several changes of mission and subordination and in 2015, the Forest Inspectorates were transformed into Forest Guards. A significant institutional milestone in the post-communist development of the forestry sector in Romania was the establishment of the first "private" forest districts (administrative/management legal entities for non-state forests, similar to those of NFA-Romsilva) in 2002: their number reached 145in 2017, managing more than 1.7million ha of forests. The radical change in forest ownership continues to pose a high pressure on the restructuring of the forest institutions, administration and management structures. Внаслідок послідовного впровадження цих законів про реституцію лісів загальна кількість лісових ресурсів, що відшкодована власникам недержавних лісів, на початок 2017р. сягала 3,15млн га, що становить близько половини від загальної площі лісів Румунії. Інституційні зміни в секторі лісового господарства зазнали політичного впливу (як уряду, так і Європейського Союзу), який не завжди відповідав потребам, реаліям та розвитку галузі. Хоча впродовж комуністичного періоду всі типові галузеві функції, зокрема регуляторні, наглядові, управлінські та майнові були під відповідальністю одного і того ж суб'єкта– Міністерства лісів, на початку 1990р. регуляторні та наглядові функції держави було відокремлено від управлінських функцій, оскільки Національну лісову адміністрацію (НЛА)– Ромсільва – було створено як суб'єкт господарювання державних лісів, головно з комерційним мандатом. Перехід Департаменту лісів (державний орган, відповідальний за ліси в Румунії) у підпорядкування різних міністерств упродовж останніх трьох десятиліть супроводжувався багатьма змінами підпорядкованих підрозділів і порушенням нормальної діяльності його персоналу. Стосовно контролю за лісами та наглядових функцій на регіональному рівні, варто зазначити, що у 1999р. було створено 7регіональних лісових інспекцій, кількість яких збільшилася до 16у 2001р. Після 2003р. вони зазнали бурхливого розвитку, з кількома змінами місії та підпорядкування, а у 2015р. Лісові інспекції було реорганізовано в Лісову охорону. Значною інституційною віхою в період посткомуністичного розвитку лісового сектору Румунії було створення перших "приватних" лісових районів (адміністративних/управлінських юридичних осіб для недержавних лісів, аналогічних NFA-Romsilva) у 2002р., їх кількість досягла 145у 2017р., впорядковуючи більш ніж 1,7млн га лісів. Радикальні зміни у власності лісів продовжують створювати високий тиск на реструктуризацію лісових установ, адміністративних та управлінських структур. Очікують, що децентралізація та зменшення ролі держави в управлінні лісами продовжуватимуться і в наступному десятилітті.

The article deals with the problem of the of Habsburg heritage in the Second Polish Republic (II Rzeczpospolita) in the sphere of local political administration. Generally, the scholars are interpreting the history of the interwar Galicia as a "nationalization" of a post-imperial public space, and as a place where conflicting national narratives had successfully replaced the Habsburg traditions and practices, particularly in the field of policy. Without denying the achievements of the described historiographical approaches, in our opinion, another methodological perspective is relevant today – we have to define, classify and explain the preservation of Habsburg heritage in the Second Polish Republic after 1918. Thus, this article is an attempt to discover the motives, separate the components and explain the significance of the imperial heritage that was present in the local administrations of four provinces – "voivodeships", that existed on the territory of the former Habsburg province of Galicia – the voivodeships of Krakow, Lviv, Stanislaviv (now – Ivano-Frankivsk) and Ternopil. The main thesis of the article is focused on the analysis of the structure of Habsburg power models after 1918 under the design of unified power system of the Second Polish Republic; on the other hand, special focus is paid to a comparative analysis of the status of Galician governor and the Polish voivode.Analysis of the legal framework of the Polish State indicates two important things. Firstly, the imperial government and general administration of the second instance ("voivodeship") were based on a common model, the main components of which can be expressed in three principles: the principle of personal responsibility of the head of the administration, the principle of supreme control subjects on the administrative unit and the principle of immediate intervention in resonant cases. Secondly, the author analyzes the status of administration of four "Galician" voivodeships. Despite the aim of unification and a number of laws and regulations acts that were declared by Polish politicians and officials, it continued to be governed by separate regulations (mainly Ordinance 1921), which preserved the elements of Habsburg system.During the comparative analysis of the legal status of Galician and Polish governors, author strongly focuses on the relationship of their public status, and the reliance of the Franz Joseph's management style – the concept of a "strong hand". Like the models of the Habsburg official, governor and "voivode" granted solely responsible for the welfare and safety of the citizens. Their policies were expressed in paternalistic care and supervision of the subjects of the institutions and bodies with a marked predominance of representative and self-governing bodies, so that the total administration in Galicia was very similar to the political administration of Habsburg period. In authors opinion, the explanation of Habsburg successful adaptation of the system to the all management model can be understood through two main factors. First, the models of governship in both States were based on so-called theory of cameralism, that had its roots in the Age of lightenment. According to this theory, only a strong ruler, who would use the law and special officials could be effective in providing prosperity to his country and citizens. Secondly, it is necessary to consider the significant impact Galician lawyers, mainly the students of the Austrian school of law (especially Roman Hausner and Wladyslaw Leopold Jaworski) who had influence in the process of forming a unified system of the interwar Polish State.In conclusion, it should be emphasized that the change of political boundaries do not necessarily mean further successive transformations in State policy. The control system in the public space of the interwar Galicia continued to appeal to the Habsburg imperial model of so called "strong hand", that was based on the responsibility of the leader, and his supreme supervision that can be seen in the best way, if we look on the cases and material of local administrations of the voivodeships. ; У статті розглянуто роль габсбурзької моделі влади у публічному просторі міжвоєнної Галичини. На підставі аналізу законодавчих актів, тогочасної публіцистики й преси окреслено головні елементи імперської системи управління на рівні місцевої адміністрації південно-східних воєводств (краківського, львівського, станіславівського й тернопільського) Польської держави, розкрито мотиви та значення такої наслідуваності (характеристика структури габсбурзької системи влади на законодавчому рівні до і після 1918 року). Окрему увагу приділено порівняльній характеристиці публічних становищ галицького намісника та польського воєводи. Виділено ключові принципи функціонування влади на воєводському рівні, зокрема персональної відповідальності, верховного контролю у межах адміністративно-територіальної одиниці, негайного втручання керівника у резонансні справи.

L'intervention de l'État dans l'économie vise à améliorer les conditions du développement des activités économiques sur un territoire donné. Saisir les mutations juridiques de l'action économique des personnes publiques requiert d'abord la description des moyens de l'intervention étatique tels qu'ils furent utilisés en période d'économie dirigée. Discrétionnaires, ils s'appuyaient sur la nationalisation, la planification, le contrôle des entreprises et la réglementation étatique des prix. Ensuite, il est montré comment la crise économique des années soixante-dix, l'Union européenne, les institutions financières internationales, le poids croissant des collectivités locales ont détruit la légitimité du monopole d'action de l'État. Ce sont globalement les facteurs qui expliquent le déclin des prétentions de l'État à diriger l'économie et agir globalement sur le territoire national pour favoriser le développement économique. La nouvelle action économique participe plus largement à un nouveau type de régulation publique de l'économie. L'intervention de l'État dans l'économie questionne aussi sur la façon dont l'État peut ou doit-il intervenir par le biais de sa Constitution, vis à vis des acteurs économiques, vis à vis du marché, vis à vis de l'État. Il s'agit de savoir en quoi ce principe a-t-il ou non un rôle un jouer dans l'économie de marché et dans l'interventionnisme étatique. À travers notre analyse, nous pouvons conclure que l'efficacité de l'État dans le développement économique résulte de son intervention pour améliorer l'efficacité organisationnelle du marché. C'est ainsi que l'économie française a réussi à minimiser la possibilité de l'aléa moral et des activités de « rent-seeking » en orientant les ressources vers les secteurs plus productifs. En Tunisie, l'intervention de l'État qui ne se conformait pas aux règles de la mondialisation a été une cause importante de la révolution de 2011 par son action négative sur l'efficacité organisationnelle du marché. Then, it is shown how the economic crisis of the seventies, the European Union, the international financial institutions, the growing weight of the local authorities destroyed the legitimacy of the monopoly of action of the State. These are the factors that explain the decline of the state's claims to lead the economy and act globally on the national territory to promote economic development. The new economic action participates more widely in a new type of public regulation of the economy. State intervention in the economy also questions how the state can or should it intervene through its constitution, vis-à-vis economic actors, vis-à-vis the market, vis-à-vis the state. It is a matter of knowing in what way this principle does or does not have a role to play in the market economy and in state interventionism. Through our analysis, we can conclude that the effectiveness of the state in economic development results from its intervention to improve the organizational efficiency of the market. Thus, the French economy has managed to minimize the possibility of moral hazard and rent-seeking activities by channeling resources towards the more productive sectors. In Tunisia, state intervention that did not conform to the rules of globalization was a major cause of the 2011 revolution because of its negative effect on the organizational efficiency of the market. It is imperative today to introduce fundamental reforms at the level of the state and its organizations, to encourage private initiative, to ensure a restriction of the old institutions and to promote the participation of all citizens in the construction of the new Tunisia. without exclusiveness or marginalization.

Legal historians describe this as a transition from an "absolute" to a "restrictive" practice of sovereign immunity, and one dominant narrative explains the transition as a pragmatic move away from an obsolete model of "territorial sovereignty" to a more flexible, "de-territorialized" or even "de-spatialized" sovereignty better suited for a globalized economy. Through tracing key U.S. legal changes involving foreign sovereign governments from 1898 to 2014, with a focus on sovereign debt law, I argue that transnational sovereign economic activity in fact remains dependent as ever on national borders — albeit borders that are continually reconfigured through minute changes in U.S. common law. Far from representing a homogeneous de-territorialization of the contemporary international legal order, I show that there has been an uneven re-territorialization that reduces the authority of most countries over their own economic decisions while expanding the judicial reach of a few — primarily the United States — and that New York state law has been especially important in this process. This has resulted not in a general restriction of state sovereignty in the face of "globalization," but in a differential displacement of economic sovereignty from post-colonial, poor and indebted states to rich, industrialized ones. The legal structures developed since the 1960s have aimed at entrenching and extending U.S. dominance over the global capitalist order and presently function to perpetuate exploitative relations between sovereign debtors and private creditors. U.S. judicial power has been a crucial and largely overlooked pillar of post-war U.S hegemony. I show how judicial transformations of the past half-century have occurred in relation to changing economic conditions, including threats to U.S. property posed by Third World nationalizations in the 1950s to the 1970s, rising indebtedness since the 1970s, and an ongoing overaccumulation crisis. The expansion of U.S. judicial power has simultaneously been driven at every step by U.S. geopolitical interests, including, importantly, the desire to contain Communism and maintain the colonial status quo in the context of the Cold War, widespread de-colonization and Third Worldist movements, and the reconstruction of U.S. dollar hegemony in the 1980s. I argue that the expansion of U.S. judicial power in the past half-century should be understood as territorial insofar as it has defined the space over which the state (in the form of courts) may exercise authority. Through a critical analysis of this legal history I show how the reconceptualization of key legal dichotomies — most importantly, foreign/domestic, public/private, and political/legal — has been a fundamental spatial mechanism through which these legal territories are produced and contested. Since the 1960s, U.S. — especially New York — courts have increasingly reclassified foreign sovereign transnational activities as "private" (rather than "public" or "sovereign") and therefore as properly within the scope of U.S. judicial ("legal") rather than executive ("political") authority. Foreign sovereign activities have also increasingly been reclassified from "foreign" (meaning outside the United States) to "domestic" (meaning inside the United States). Together, these interlinked changes have been used to bring activity that would previously have been considered beyond the authority of U.S. courts within U.S. judicial reach. This has expanded U.S. authority as a whole through the modality of judicial power, while simultaneously de-politicizing important social questions and removing them from even the possibility of democratic debate. Until recently, this process has unfolded with explicit support from the U.S. executive branch, but tensions between the interests of the U.S. executive and those of the U.S. judiciary have grown. In NML Capital v. Argentina, despite strenuous objections from the executive branch, the New York and U.S. Supreme Courts inverted the reigning spatial logic of U.S. law in order to extend U.S. judicial authority over most of the world outside Argentina – with important ramifications for U.S. economic and geopolitical interests, for sovereign debt crises and restructurings, and for the global financial order. The critical genealogy of the expansion of U.S. juridico-economic territory since WWII that I present in this dissertation is crucial for understanding the transnational operation of U.S. judicial power today and how it might most effectively be contested.

In the era of strengthening and accelerating globalization processes the necessity of establishing intercultural dialogue is becoming of high priority, significantly altering its fundamental principles and objectives of its creation. After the end of the era of bipolarity the new concepts of world order are emerging and spreading. There is a need to find new tools for the competitive development of states and other approaches for international relations. In this context the role of flexible factors increases together with the effectiveness of «soft» influence instruments on the system of international relations by promoting a positive image of a country based on the attractiveness of the values and culture of the nation.Analysis of the specifics of cultural diplomacy functioning in different EU countries reveals the following three traditional European models, each of which is characterized by the specificity of national political strategies of France, Britain and Germany.Thus, the first model reflects the foreign policy of France that systematically includes intercultural cooperation in the practice of international relations. Cultural diplomacy of France is characterized by a rigid centralization and direct state control.The second model – British – is based on the principle of indirect control (so called principle of «arm's length») when intercultural collaboration is funded wholly or partly by the government, usually via the Foreign Office, while the administrative and coordinating functions delegated to non-governmental institutions (such as the British Council, which has departments worldwide) .A kind of intermediate option between French and British models is German decentralized organizational model. On the one hand, it is partly controlled be the state and international cultural activities are partially centralized, and on the other – is based on the principle of power distance («Staatsferne»), characteristic feature of the federal government of Germany.Creation of the brand «Europe» is directed towards the development of mode of thinking across the whole Union and positioning «Europe in the world» format. At the same time it is not directed towards searching and focusing on the differences and peculiarities of the individual European countries. In this respect, it is important to actively develop new areas of cultural dialogue and exchange both within the Union and beyond.The realities of European societies have such peculiar features as the multifaceted contributions of other cultures and civilizations; localization and nationalization of cultures; linguistic and ethnocultural pluralism as a result of the historical formation of the European nation-states; deepening current presence of other cultures in Europe; and finally, the cultural diversity of European society. These features require appropriate solutions, strategies and programs in the field of establishment and further development of cultural diplomacy at European as well as on the national levels.European cultural diplomacy will always be dealing with the sum of individual national cultures, languages, historical heritage. Moreover, the cultural programs of all 27 Member States are very actively and almost autonomously developing. On the one hand, it can be seen as enrichment and enhancement of European culture and subsequently diplomacy; on the other hand, it gives rise to the emergence of discussions about its absence and utopianism. At present Europe is cannot be seen as an example of goal-oriented and effective common cultural diplomacy, but the potential for this is significant. The main thing for the EU in this context is not to turn into a «giant museum», caring only about preservation and maintenance of cultural sites of individual countries. Taking all this into consideration, the question of what should be the European cultural diplomacy in the modern era is now considered the most controversial. ; В статье освещаются основные принципы и специфика реализации культурной дипломатии европейских государств на современном этапе развития.
