Weak or dependent states, especially those with histories of colonial and imperial domination, have traditionally been among the strongest advocates for strict institutionalization and observance of the norm of non-interference. These states are vulnerable to international pressure, and they have sought to limit this pressure by "jealously" guarding their sovereignty. Yet, after decades of advocating for strict non-interference, many have begun to delegate extensive interventionist authority to their regional organizations. What explains this change? I explore this question in the case of the decision by Latin American leaders to compromise on non-interference by delegating authority to enforce human rights to the Organization of American States. I argue that they were motivated by attempts to maintain self-determination and resist the imposition of authority. In making this argument, I extend the definition of self-determination to incorporate self-determination over international rules. I show that existing explanations for this development that emphasize norm diffusion or democratization cannot account for important dynamics. These findings offer evidence that the expansion of regionalism in the Global South has been, in part, a subtle strategy to mitigate the undesirable effects of hierarchy and to create an international system based on respect for self-determination.

In her work, Stine von Förster examines the actions of state forces in migration control in Spain, Italy, Greece and Bulgaria. The focus is on the relevance under international criminal law of the handling of migrants in direct connection with irregular entry into the European Union. When examining the events at the borders of the southern EU member states, incidents on the Mediterranean Sea - i.e. before the actual border crossing - as well as the handling of irregular migrants directly following the border crossing are also taken into account. The main subject of the study is the question of whether the handling of irregular migrants at the southern external borders of the EU results in crimes against humanity as defined in Article 7 of the Rome Statute of the International Criminal Court by state forces.

Der Verfasser geht auf die einzelnen vorgesehenen vertrauensbildenden Maßnahmen ein, die vor allem den Militärsektor betreffen, und skizziert die Etappen des Verhandlungsweges seit Ende der 80er Jahre. Modern investment treaties give private arbitrators power to determine whether governments should pay compensation to foreign investors for a wide range of sovereign acts. In recent years, particularly developing countries have incurred significant liabilities from investment treaty arbitration, which begs the question why they signed the treaties in the first place. Through a comprehensive and timely analysis, this book shows that governments in developing countries typically overestimated the economic benefits of investment treaties and practically ignored their risks. Rooted in insights on bounded rationality from behavioural psychology and economics, the analysis highlights how policy-makers often relied on inferential shortcuts when assessing the implications of the treaties, which resulted in systematic deviations from fully rational behaviour. This not only sheds new light on one of the most controversial legal regimes underwriting economic globalization but also provides a novel theoretical account of the often irrational, yet predictable, nature of economic diplomacy

This volume explores the conditions under which regional organizations engage in governance transfer in and to areas of limited statehood. The comparison of 12 regional organizations in Africa, the Americas, Asia, Europe and the Middle East shows that regional organizations have not only institutionalized commitments to human rights, democracy, the rule of law, and the fight against corruption. They have also developed more detailed prescriptions of these 'good' governance standards and established similar instruments to promote and protect them in their member states. The authors argue that a global script of governance transfer by regional organizations is emerging. Rather than developing from a central model, however, this is patched together by regional and national actors who are translating governance standards and instruments into their local context.
