Das nationale Lauterkeitsrecht wird durch die vollharmonisierende UGP-Richtlinie 2005/29/EG in weiten Teilen aus Brüssel vorbestimmt. Das Werk beschäftigt sich erstmals umfassend mit der grundrechtskonformen Auslegung dieser Richtlinie.Zunächst analysiert der Autor dabei die wesentlichen Wertungen der Richtlinie selbst. Da für die grundrechtskonforme Auslegung im Anwendungsbereich der Richtlinie allein europäische Grundrechte heranzuziehen sind, werden in einem nächsten Schritt die mehrschichtige europäische Grundrechtssituation nach Lissabon sowie die einschlägige Rechtsprechung des EuGH und des EGMR differenziert dargestellt. In einer Synthese dieser Erkenntnisse identifiziert der Autor die grundrechtsrelevanten Fallgruppen der UGP-Richtlinie und bewertet diese umfassend aus grundrechtlicher Perspektive.Damit liefert die Monographie sowohl einen Beitrag zur Auslegung eines zentralen Sekundärrechtsaktes als auch zur neuen Grundrechtsarchitektur der EU nach dem Vertrag von Lissabon

Abstract. The International Criminal Judicial Cooperation has been understood as an institution of inter-state solidarity and assurances, necessary to confront the transnationality of contemporary crime. The Criminal Judicial Cooperation of the Mercosur Protocol contains, precisely, both functional and assurance principles. Among the formerwe may find the jurisdictional power to declare the confidentiality of a measure for international criminal judicial cooperation in order to avoid thwarting a particular measure (art. 10 of the Mercosur Protocol). The issue which justifies this contribution is linked to an unlimited or restrictive scope granted to this special institution, since any criminalJurisdictional action, internal or with an international cooperation presupposes a guarantee of the publicity principle, linked to the exercise of Defence in a Democratic System of Law. We believe that the precise admissibility of an exceptional institution such asconfidentiality, can not encroach on the power of a concomitant and ultimate power for control of the technical defence against intrusive law measures which are likely to cause an irreparable damage. ; Resumen. La cooperación judicial penal internacional se ha entendido como un instituto de solidaridad interetática y garantías, imprescindible para enfrentar la transnacionalidad del delito contemporáneo. El Protocolo de Cooperación Judicial Penal delMercosur contiene, precisamente, tanto principios funcionales como de garantía. Entre los primeros se encuentra la facultad jurisdiccional de declarar la confidencialidad de una medida de cooperación judicial penal internacional a efectos de evitar la frustración de una determinada medida (artículo 10 del Protocolo del Mercosur). El tema que justifica esta contribución se vincula al alcance ilimitado o restrictivo que se otorgue a este instituto de naturaleza especial, pues toda actuación jurisdiccional penal, interna o de cooperación internacional, presupone una garantía de publicidad de principio,vinculada al ejercicio de la defensa en un sistema democrático de derecho. Entendemos que la admisibilidad puntual de un instituto excepcional como la confidencialidad de modo alguno puede cercenar la facultad de contralor concomitante y posterior de la defensa técnica frente a medidas intrusivas de derecho susceptibles de provocar daños irreparables.

Der Beitrag erörtert die These, dass neue globale Entwicklungen wie weltweit agierende Unternehmen, ein Internationaler Strafgerichtshof oder Menschen mit verschiedenen Staatsbürgerschaften auf das Entstehen neuartiger Anordnungen hinweisen, die neben älteren Strukturen wie dem Nationalstaat und dem zwischenstaatlichen System bestehen können. Diese Dynamik lässt sich folgendermaßen veranschaulichen: Wir erleben heute den Übergang von einer zentrierten nationalstaatlichen Struktur zu einer wachsenden Anzahl spezialisierter, zentrifugaler Verknüpfungen. Das zeigt, welche grundlegende Bedeutung die bündelnde Kraft des Nationalstaats besaß, wie begrenzt sie auch immer gewesen sein mag. Die Erläuterung umfasst folgende Aspekte: (1) IWF und WTO als neue Instrumente der neuen Ordnung, (2) die Verortung des Staates in der globalen Ordnung, (3) die Rechtsstaatlichkeit als wichtiger Baustein neoliberaler Deregulierungs- und Privatisierungspolitik, (4) die Verschiebung der Macht von der Legislative zur Exekutive am Beispiel der USA, (5) das Demokratiedefizit in den USA, (6) die Privatisierung der exekutiven Macht unter Clinton sowie (7) die wachsende Distanz zwischen Staat und Bürger. Zusammenfassend stellt die Autorin fest, dass das Territorium, die Autorität und die Rechte des Nationalstaats zerfallen und neue Verknüpfungen entstehen, die mit der herkömmlichen Formel 'national unterliegt global' nicht zu erklären sind. Vietnam's membership of ASEAN was driven by pragmatic reasons of economic growth, political independence and regime survival in a post Cold War environment. But in fact the learning process - which made Vietnamese decision-makers through their first-hand experiences more aware of convergent domestic and foreign policy goals between Vietnam and ASEAN - was instrumental in Vietnam's decision to seek ASEAN membership as quickly as possible. The case of Vietnam joining ASEAN then shows that the process of socialization and interactions between Vietnam and ASEAN countries helped improve the awareness of commonalities and promoted cooperative relations. And this is one of the main arguments in the constructivist approach to international cooperation based on the self-other internalization. In this connection, Vietnam joining ASEAN was also part of a broader process in which the country forged a new state identity in the post-Cold War era: Vietnam opted for ASEAN membership to overcome an identity crisis and political isolation. The ideational approach, therefore, offers an additional and more plausible explanation for Vietnam's decision to join ASEAN. Moreover, it helps explain Vietnam's continued satisfaction with and commitment to membership of ASEAN. (Contemp Southeast Asia/GIGA)

This article seeks to analyse the strength and weaknesses of the three main international relations (IR) approaches, namely, neo-realist, liberal institutionalist, and constructivist frameworks, applied to the Vietnam-ASEAN relationship since the mid-1980s. While the making and implementation of Vietnamese foreign policy with regard to ASEAN has shown some clues congruent with both neo-realist and liberal institutionalist frameworks, the constructivist approach also seems to have become an increasingly promising one, providing additional explanations to the Vietnam-ASEAN relationship. Yet, to confirm the plausibility and superiority of any theoretical model depends to a large extent on greater efforts at gaining access to and interpreting various types of sources related to the foreign policy of Vietnam. Spätestens seit dem Amtsantritt von US-Präsident Trump, ist die chinesische Führung zu einem entschiedenen Verfechter eines freien Welthandels geworden. Ebenso unterstützt sie an der Seite Europas die Bemühungen der G20, die jüngste Krise der Globalisierung zu überwinden. Tatsächlich gibt es für China gute Gründe, hier eine konstruktive Rolle zu spielen. Zugleich lässt sich aber erwarten, dass das chinesische Engagement eine Reihe von Beschränkungen für die zukünftige Entwicklung der G20 mit sich bringt.
Im Vergleich zu Indien, einer anderen aufstrebenden Macht, spielt China hier eine deutlich aktivere Rolle. Es setzt eigene Akzente innerhalb der G20-Agenda und arbeitet daran mit, das Forum von einem Krisenreaktions- in einen längerfristigen Mechanismus für Global Governance im Wirtschaftsbereich umzugestalten.
China sieht eine Reihe von Anreizen für sein Engagement: der überschaubare, aber im Vergleich zur G7 erweiterte Mitgliederkreis, die Gelegenheiten zum Statusgewinn und zur Verfolgung von Global Governance-Reformen, das lockere institutionelle Design und der Fokus auf politisch weniger sensible Fragen.
Allerdings gehen damit klare Grenzen für Chinas weiteres Engagement einher: So ist nicht zu erwarten, dass China einer wesentlichen Ausweitung der Agenda zustimmen wird. Und sollten die USA ihr Engagement für Global Governance zurückfahren, so ist nicht damit zu rechnen, dass China bereit wäre, eine visionäre Führungsrolle zu übernehmen und so das entstehende Machtvakuum zu füllen.
Längerfristig scheint es aber vor allem unwahrscheinlich, dass China die Bemühungen der G20 begrüßen dürfte, dem ihr angelasteten Legitimitätsdefizit zu begegnen. Forderungen nach verbindlicheren institutionellen Regeln, mehr Transparenz und Verantwortlichkeit der G20 laufen den Motiven der chinesischen Führung für ein Engagement in diesem Format zuwider.
Die chinesisch-europäische Zusammenarbeit für eine Überwindung der Globalisierungskrise durch die G20 bewegt sich in einem engen Korridor: China wird hier nur so lange ein konstruktiver Partner bleiben, wie sich die Agenda auf finanzielle und wirtschaftliche Kernfragen beschränkt. Wenn die G20 nicht in einen wachsenden Konflikt zwischen Effizienz- und Legitimitätszielen geraten soll, ist es angeraten, parallel auf weitere Reformen der etablierten internationalen Organisationen zu drängen, um den aufstrebenden Mächten eine stärkere Mitsprache zu ermöglichen. Andernfalls wird China wachsende Anreize spüren, seinen Einfluss in alternativen Institutionen geltend zu machen.

One distinguishing feature of the "new" regionalism is its outward orientation – the increased importance of the external dimension of regional cooperation. It makes sense, then, that efforts to manage external perceptions of a region, on the part of policy-relevant actors in that region, might contribute to important changes to regional norms and institutions. By and large, though, existing accounts of normative and institutional change at the regional level do not explicitly conceptualize and theorize collective image consciousness and management. This paper offers an initial attempt to address this conceptual gap, making use of two cases of regional image crisis (post-Cold War Africa and post-1997 Southeast Asia) in order to draw out logics of regional image consciousness and to distinguish among types of regional image management efforts. As regional communities of states, Africa and Southeast Asia promoted and adhered to a relatively strict interpretation of the principle of non-interference during the Cold War period. In the post-Cold War era, the non-interference norm has eroded in both regions. In each, these developments constituted – in part – a collective image management strategy, aimed at external audiences. Reforms to regional institutions were promoted in part as efforts to ameliorate negative international perceptions.
