Die Rolle und Stellung der muslimischen Frau wird im Westen größtenteils kritisch betrachtet und gibt immer wieder Anlass für kontroverse Diskussionen, die aber nicht immer auf profundem Hintergrundwissen basieren. Irene Schneider ist Professorin für Arabistik und Islamwissenschaft mit dem Forschungsschwerpunkt Geschlechterforschung und beschreibt auf Grundlage fundierter Quellen die Stellung und die Rechte der Frau im islamischen Kontext. Sie beginnt mit einem historischen Rückblick, erläutert anhand zahlreicher Zitate die Auslegung des Korans und Hadithe und geht auf die heutige Rechtslage ein. Gleichzeitig wirft sie einen Blick auf die derzeitige gesellschaftliche Situation in muslimischen als auch westlichen Ländern. Dabei wird deutlich, dass das Thema facettenreich ist und Problemstellungen aus verschiedenen Perspektiven betrachtet werden müssen. Ein insgesamt wissenschaftlich neutraler Überblick, der aufgrund der Fülle detaillierter Informationen eine intensive Auseinandersetzung mit dem Stoff voraussetzt, aber durch die Aktualität des Themas für eine breite Leserschaft von Interesse ist. Fenomena Perkembangan Islam dan Hukum Islam di Indonesia
Syariat Islam dalam pandangan sebagian masyarakat masih terkesan negatif, padahal syariat Islam dalam konteksnya yang luas dan luwes tampak mencerminkan sisi positif untuk diamalkan, sehingga sampai saat ini masih terjadi pro dan kontra dalam penerapan syariat Islam di Indonesia, yang sekaligus juga masih mempertanyakan apakah syariat Islam di Indonesia sebagai mitos atau fakta? Pro-kontra syariat Islam masa lalu (1945-1959) lebih bersifat politis-ideologis-konstitusionalis, sedangkan pro-kontra pada era 1990-an sampai sekarang lebih bersifat legal formal. Dibalik perdebatan pro-kontra penerapan syariat Islam ini, faktanya telah terjadi proses taqninisasi Hukum islam dan/atau Islamisasi peraturan perundang-undangan yang sudah berlangsung selama kurang lebih 30 tahun, diantaranta adalah lahirnya UU Nomor 1 tahun 1974 tentang Perkawinan, PP No. 9 tahun 1975 tentang Pelaksanaan UU Nomor 1 tentang Perkawinan, Instruksi Presiden Nomor 1 Tahun 1991 tentang Kompilasi Hukum Islam, kemudian berlanjut dengan UU Nomor 7 tahun 1989 tentang Peradilan Agama dan UU Nomor 21 tahun 2008 tentang Perbankan syariah. Berdasarkan fakta yang bersifat akademik ilmiah berupa taqninisasi Hukum Islam dan/atau Islamisasi peraturan perundang-undangan tersebut, penerapan syariat Islam bukanlah mitos tetatpi fakta hukum yang sangat fenomenal (red).

Branding Islam: Islam, Law, and Bureaucracies in Southeast Asia

Islam plays a pivotal political role in Southeast Asian countries, where the governments that have ruled since independence have been concerned with influencing the trajectory, content, hermeneutic and style of the legal traditions of their Muslim citizens and reconciling them with the states' wider policy objectives. This contribution looks at one particular tool for this form of 'guiding' Islam – the codification of Islam – comparing the codes in two Muslim-majority countries (Malaysia and Brunei) and two Muslim-minority countries (Singapore and the Philippines). Utilising comparative law methodologies, this article explores the structure, style and content of the codes in order to explicate their explicit and implied function. These codes are less concerned with being a statement of substantive Islamic law than with setting up a state-sanctioned bureaucracy for the administration of law for Muslims. These bureaucratic institutions were the key instruments for the states to develop their own brand of Islam. In doing so, the state's approach towards socially engineering Islam oscillates among appropriation, accommodation, control and subjugation of Islam in different political and legal frameworks.
