AbstractA property right, the standard view maintains, is a proper subset of the most complete and comprehensive set of incidents for full ownership of a thing. The subsidiary assumption is that the pieces that are property rights compose the whole that is ownership or property, i.e., that property rights explain property. In reversing the standard view I argue that (1) a custom of intelligent and meaningful human action explains property and that (2) as a custom, property is a historical process of selecting actions conditional on the context. My task is to explain how a physical world of human bodies with minds that feel, think, know, and want gives rise to a custom of property with meaning and purpose. Property is primary because ideas are primary.

Kann Eigentum an Kultur sinnvoll sein? Das Interesse, Cultural Property dem Markt zuzuführen oder dies zu verhindern und hierdurch kollektiven oder individuellen, ideologischen oder ökonomischen Gewinn zu schaffen, gestaltet sich unter den stark divergierenden Bedingungen, die Akteure in einer postkolonialen, spätmodernen Welt vorfinden. Die interdisziplinäre DFG-Forschergruppe zur Konstituierung von Cultural Property beleuchtet diese seit einigen Jahren in der Öffentlichkeit mit wachsender Brisanz verhandelte Frage. Die Forschergruppe fragt nach der Konstituierung von Cultural Property im Spannungsfeld von kulturellen, wirtschaftlichen, juristischen und hiermit auch gesellschaftspolitischen Diskursen. Dies bedingt auch die in dieser fokussierten Form neue Zusammenarbeit von Fachwissenschaftler/innen aus Kultur- und Sozialwissenschaften sowie Rechts-und Wirtschaftswissenschaften. Die Unterschiedlichkeit des disziplinären Zugriffs auf einen Forschungsbereich zeigt sich in den in diesem Band vermittelten ersten Ergebnissen aus der laufenden Forschung genauso deutlich wie die Notwendigkeit, disziplinäre Standpunkte in gemeinsamer Arbeit zusammenzuführen, um den Konstituierungsprozess von Cultural Property zu verstehen.
Property and Practical Reason makes a moral argument for common law property institutions and norms, and challenges the prevailing dichotomy between individual rights and state interests and its assumption that individual preferences and the good of communities must be in conflict. One can understand competing intuitions about private property rights by considering how private property enables owners and their collaborators to exercise practical reason consistent with the requirements of reason, and thereby to become practically reasonable agents of deliberation and choice who promote various aspects of the common good. The plural and mediated domains of property ownership, though imperfect, have moral benefits for all members of the community. They enable communities and institutions of private ordering to pursue plural and incommensurable good ends while specifying the boundaries of property rights consistent with basic moral requirements

Quality and profit are often considered to be connected. The property
market is one in which the concept often arises. For example, the
definition of prime property is a quality judgement. In property
development, the production of high‐quality property may be thought to
improve returns, or to reduce risk. Considers the question whether (and
if so, how) quality in property development (excluding site factors) is
likely to lead to high returns. Recently published work defines quality
as resistance to depreciation, where depreciation is defined in purely
financial (return) terms. Fully considers this work, which concentrates
on offices and industrials. Extends this work, describing new research
which considers the application of the relevant concepts and quality
definitions to shopping centres. Quality and cost are also considered to
be connected. In property development, high construction costs may be
expected to produce quality. This produces a complex subsidiary question
concerning this relationship, which is also addressed here.
