The article treats various problems of boundaries between the new states of the former Yugoslavia. International law shows that boundaries are a very important subject in political relationships between states. The disintegration of the former Yugoslavia & international recognition of the new states on its territory have opened the question of boundaries. The international community has clearly defined its position; ie, it laid down the criteria & manner in which these problems should be solved. Croatia accepted the method of resolving matters of external & international boundaries of the former SFRY according to the principles of international law. Der Tokioter Prozeß (1946-1948) gegen die japanischen Hauptkriegsverbrecher im Zweiten Weltkrieg hat bislang - anders als die Nürnberger Kriegsverbrecherprozesse - kaum Beachtung gefunden. Dies gilt besonders für seine Rezeption in der Straf- und Völkerrechtswissenschaft. In Tokio bildete der Straftatbestand der "Verbrechen gegen den Frieden" den Schwerpunkt der Anklage. Zu einer Verurteilung aufgrund von "Verbrechen gegen die Menschlichkeit" kam es hingegen nicht. Auch führte die besatzungspolitisch motivierte Anklageverschonung des japanischen Kaisers im Prozeßverlauf zur systematischen Ausblendung eines zentralen Bereichs des japanischen Kriegs- und Systemunrechts. Die vorliegende Arbeit stellt erstmalig die Rechtsprobleme und historischen Hintergründe des Verfahrens sowie seine Rolle in der Entwicklung des Völkerstrafrechts dar und analysiert zugleich die Reaktionen der japanischen Rechtswissenschaft auf den Tokioter Prozeß. Der japanische Umgang mit vergangenem Unrecht wird darüber hinaus im Lichte der Haltung Japans zum heutigen Völkerstrafrecht und zum Internationalen Strafgerichtshof untersucht. Die Arbeit beschäftigt sich jedoch nicht nur mit einem von der deutschen, japanischen und internationalen Forschung bisher weitgehend vernachlässigten Prozeß und seiner Rezeption. Sie zeigt auch am Beispiel Japans auf, wie sich langfristig der weitgehende Verzicht auf eine eigenständige Auseinandersetzung mit Unrechtsvergangenheit juristisch, gesellschaftlich und politisch auswirken kann.Für die Arbeit wurde der Autor 2003 mit dem Akademiestipendium der Berlin-Brandenburgischen Akademie der Wissenschaften ausgezeichnet.

Argues that recent clan warfare in Somalia is the result of a history of international intervention in the area rather than intrinsic traits of the Somali people, & that, in fact, much indigenous self-help activity has begun in response to the disorder. A brief history of such international intervention is presented, followed by a discussion of examples of indigenous self-help activity. It is suggested that the UN peace-keeping effort has further shattered the everyday life of Somalis because it has remained insensitive to local cultural needs & ways of living. It is hoped that the West will learn important lessons from the end of this particular intervention in 1995 & work to build on local initiatives rather than to undermine them. D. M. Smith

TO ASSESS THE IMPORTANCE OF ECONOMIC INTERDEPENDENCE AND THE POTENTIAL GAINS FROM POLICY COORDINATION IN EUROPE, THIS PAPER ANALYZES THE INTERNATIONAL TRANSMISSION OF POLICIES AND DISTURBANCES IN A RATIONAL EXPECTATION DYNAMIC GENERAL EQUILIBRIUM SIMULATION MODEL OF THE WORLD ECONOMY AND APPLIES THE ANALYSIS TO THE EUROPEAN MONETARY SYSTEM. INTERNATIONAL SPILLOVER EFFECTS AND POTENTIAL GAINS FROM COORDINATION APPEAR TO BE SMALL UNDER THE ASSUMPTION OF FLEXIBLE EXCHANGE RATES IN THE EUROPEAN AREA. THE IMPLICATIONS OF A FIXED-RATE EMS WITH GERMAN LEADERSHIP ARE COMPARED WITH THOSE OF A COOPERATIVE FIXED EXCHANGE RATE REGIME. FINALLY, CAPITAL CONTROLS UNDER FIXED RATES FAIL TO INSURE POLICY AUTONOMY AND INSULATION FROM EXTERNAL DISTURBANCES FOR THE COUNTRIES THAT RESTRICT THE CAPITAL MOVEMENTS.
