Das Werk macht dafür grundlegende Beiträge der deutschen Strafrechtswissenschaft fruchtbar und hinterfragt kritisch die Rechtsprechung des Gerichtshofs zu Täterschaft und ziviler Vorgesetztenverantwortlichkeit.Aus menschenrechtlicher Perspektive legt der Autor dar, in welchem Umfang sozial erwünschte wirtschaftliche Betätigung straffrei zu stellen ist. Ein interdisziplinärer Zugriff auf das rechtspolitische Vorhaben einer völkerrechtlichen Unternehmensstrafbarkeit legt den ungelösten Konflikt zwischen konträren Organisationswirklichkeiten als wichtiges Reformhindernis frei

This article argues against the common view that the International Criminal Court (ICC) prevents peace since rebels will not accept accountability. In the presence of an international criminal authority, accountability may be unavoidable. This is true for rebels, but also for state agents. Should the government renege on agreed provisions, it risks ICC attention on its own actors, including into the future. In this way, the ICC functions as a permanent third-party guarantor of the provisions and reduces the commitment problem for the rebels, conditional on certain circumstances. A case study of Colombia finds support for the theoretical proposals.

This article discusses the connections between legitimacy and the quality of democracy. The multiple dimensions of the quality of democracy are presented and it is shown that legitimacy is at the core of the definition of responsiveness. Citizens' reactions to government policies are analysed. Also stressed are the limits and constraints of considering responsiveness only in relationship to citizens' attitudes towards government and institutions. Other dimensions are taken into account, particularly electoral accountability.
