This Comment will discuss the portion of the legislation that established the system of involuntary civil commitment of violent sexual predators [hereinafter Violent Sexual Predator Commitment System]. This Comment will explore whether the Violent Sexual Predator Commitment System could withstand procedural and substantive due process challenges. Additionally, because the system is premised on a mental disorder of the sexually violent person, the commitment scheme will also be compared with the Involuntary Treatment Act's civil commitment system, to determine whether the Violent Sexual Predator Commitment System violates the equal protection clause of the fourteenth amendment to the United States Constitution. After determining that the Violent Sexual Predator Commitment System would not survive constitutional attack and that it is inconsistent with the purposes of the criminal law, this Comment concludes that the new Violent Sexual Predator Commitment System should not have been enacted. Rather, sexual offenders should be dealt with through the existing criminal justice system.

Starting with the premise that the Aboriginal peoples of Canada have an inherent right of self-government which is constitutionally protected, this article analyzes the issue of whether Aboriginal governments exercising that right are subject to the Canadian Charter of Rights and Freedoms. This issue is examined from a legal perspective based on textual analysis and common law principles. It is concluded that, as a matter of Canadian constitutional law, with the exception of the section 28 gender equality provision, the Charter does not apply to Aboriginal governments. This avoids imposition of the Charter generally on these governments by judicial decree, leaving the more fundamental policy issue of whether the Charter should apply in this context open to negotiation and political agreement with the Aboriginal peoples.

The term startup emerged at the end of the 90s between 1998 and 2000. Many new business entities in the field of information technology have emerged using websites as a means of supporting their business. A business entity built to penetrate the market with rapid development. In 2021 in Indonesia, there will be 1 decacorn startup, namely Gojek and 7 unicorn startups, namely Tokopedia, Grab, Traveloka, OVO, Bukalapak, J&T Express and Lazada. According to Startup Ranking (www.startupranking.com) data, the number of Indonesian startups ranks 5th in the world at around 2,274. This study aims to understand the Indonesian laws and regulations governing startup businesses and the obstacles faced by startup entrepreneurs in starting and running their business activities. Using normative research methods that focus on secondary data. The nature of this research is descriptive by using a qualitative approach to get the symptoms from being studied. The results of this study explain that startup companies to be able to operate legally must comply with the provisions of Law no. 19/2016 which replaced Law No. 11/2008 concerning "Information and Electronic Transactions". Law no. 7/2014 concerning Trade, Presidential Regulation No.74/2017 concerning "Electronic-Based National Trading System Roadmap". The legal breakthrough made by the government is to stipulate Government Regulation no. 20/2019 regarding trading through the online system. The obstacles faced by startups are not registering their business licenses, not paying taxes, forgetting to register intellectual property rights, ignoring the rights and legality of employees. Istilah startup muncul di penghujung era 90-an antara 1998 sampai 2000. Banyak bermunculan badan usaha baru bidang teknologi informasi dengan menggunakan website sebagai sarana pendukung bisnisnya. Suatu badan usaha yang dibangun untuk melakukan penetrasi pasar dengan perkembangan dalam waktu yang cepat. Pada 2021 di Indonesia tercatat ada 1 startup decacorn yaitu Gojek dan 7 startup unicorn, yaitu Tokopedia, Grab, Traveloka, OVO, Bukalapak, J&T Express dan Lazada. Menurut data Startup Ranking (www.startupranking.com) jumlah startup Indonesia terbanyak urutan ke 5 dunia sekitar 2.274. Penelitian ini bertujuan untuk memahami peraturan perundang-undangan Indonesia mengatur usaha startup dan hambatan yang dihadapi pengusaha startup dalam memulai dan menjalankan kegiatan usahanya. Menggunakan metode penelitian normatif yang fokus pada data sekunder. Sifat dari penelitian ini deskriptif dengan menggunakan pendekatan kualitatif untuk mendapatkan gejala- gejala dari yang diteliti. Hasil penelitian ini menjelaskan Perusahaan startup untuk bisa beroperasi secara legal harus memenuhi aturan Undang-Undang No. 19/2016 yang mengganti Peraturan UU No.11/2008 perihal "Informasi dan Transaksi Elektronik". Aturan perundang-undangan No.7/2014 membahas "Perdagangan", Peraturan Presiden No.74/2017 perihal "Peta Jalan Sistem Perdagangan Nasional Berbasis Elektronik". Terobosan hukum yang dilakukan pemerintah yaitu menetapkan Peraturan Pemerintah No. 20/2019 perihal perdagangan melalui sistem online. Kendalanya yang dihadapi startup tidak mendaftarkan ijin bisnisnya, tidak membayar pajak, lupa mendaftarkan HAKI, mengabaikan hak juga legalitas karyawan.

This article deals with the emergence of a new type of crime prevention in
interwar Romania. Inspired by the Italian school of criminal law and by the
Italian Criminal Code "Rocco" (1930), the Romanian Criminal Code "King Carol
II" (1936) formulates a new type of criminal sanctions, explicitly designed to
address and combat the social dangerousness. Regarded as a major challenge to
the classic criminal system based on free will and guilt, the "security measures"
were formalizing new types of offenders defined as such not by their criminal
acts but by their criminal potential, redefining the scope and the goal of the
criminal prevention. Major debates in the epoch reveal the possible threats this
new type of criminal sanctions and of a criminal policy orientated towards risk
prevention, seen as closely connected with authoritarian tendencies, carried for
individual freedom and the rule of law. The legal issues discussed in the epoch prove significant for the current debates regarding the negative consequences the
preventive War on Terror have for individual freedom and the rule of law.

Good afternoon, thank you for having me. My name is Clayton McGahee and I am the Archives Manager for Emory. My colleagues refer to me as the "Roving Archivist" in that I currently work in four archival repositories throughout Emory each week. These four areas consist of the Woodruff Health Sciences Library, Oxford College Library, Pitts Theology Library, and the MacMillan Law Library. I've been at Emory since 2013, and among my duties is that I am responsible for the creation and upload of finding aids for WHSCL, Law, and Oxford College archives.

PREFACEThis Select Bibliography, with Appendices, chronicles the published and unpublished work of Members of the Caribbean Association of Law Libraries (CARALL) over the past 21 years of its existence. In this regard, only materials produced between 1984 and 2005 have been included, with the exception of one item which predates this period. This item is not only a significant and seminal work, but in fact laid the foundation for the establishment of the CARALL, and indeed, the future development of law libraries in the Commonwealth Caribbean. The item, therefore, holds its own place, and could not be omitted.

Adolf Sprudzs, Associate Editor of the International Journal of Legal Information (formerly International Journal of Law Libraries), has a few months ago (on September 19, 1982) celebrated his sixtieth birthday.By common consensus of the Editor-in-Chief and the other Associate Editors this issue of the Journal is dedicated to him as a token of gratitude and appreciation for his incessant efforts to improve and enlarge The International Bookshelf of which he has been the dedicated section editor, as well as in recognition of his achievements in the field of national and international law librarianship.
