H. Weiler, European University Institute. ; The intention of my thesis is to shed light on a technique of integration implemented by the European Court of Justice described as 'power-based approach.' Frequently neglected and overlooked, it is distinct from the ECJ traditional rights-based approach. It materializes in a specific range of free movement cases where Member States are suspected of having impinging on the free movement principle – understood as encompassing the four economic freedoms and EU citizenship – when they exercise what the Court deems as being their retained powers. A variety of fields are concerned, such as nationality, direct taxation, social security, or education. My overall claim is that the power-based approach contributes to defining and shaping the contours of the relationship between the European Union and its Member States, of EU interstate relations and, ultimately, of Union membership. I start with an attempt at deconstruction to identify the defining features of the cases concerned by this approach: (i) they revolve around the structural notion of power; (ii) the applicability of the free movement principle stems from the disjunction of the scope of application of EU law from the scope of EU powers; (iii) the settlement of the conflicts at hand amounts to a 'mutual adjustment resolution,' which consists in putting limitations on the exercise of the powers retained by Member States, while the Court itself tends to soften its own approach to protect national autonomy. I then proceed with an effort at reconstruction. First, I identify the jurisdictional implications of the power-based approach. Next, I look into its implications for membership of the Union. Lastly, I provide an overall critical and structural reassessment. I show that the silence of the Court regarding the rationale behind its approach has the effect of weakening its legitimacy and its authority. I finally identify its resulting structural model.

The present thesis deals with industrialization which takes place within press distribution systems in certain countries of European Union., in particular France, Great Britain, Germany, Italy and Spain. It stresses liberalization and regulation of realization operation of titles diffusion according to mechanisms and processes borrowed from industrial logistics and marketing distributor specific to the sector of the current goods distribution. After introduction constraints and specificities related to comparative study of press diffusion markets, firstly we propose an structural analysis of the titles distribution system in order to highlight the managing changes within the chain of edition and diffusion. secondly we analyze relational process and payment model which control the service and exchange work between members in order to emphasize commercial practices. The total resolution framework falls under a methodological prospect developed originally by the industrial economy in order to analyze offer market structure about an industry. Except this theoretical framework, we propose various links study of diffusion chain in their industrial environment by calling on the analysis models of current distribution channels ; La thèse traite de l'industrialisation qui s'opère au sein des systèmes de distribution de la presse dans les pays de l'union européenne, notamment la France, la Grande-Bretagne, l'Allemagne, l'Italie et l'Espagne. L'accent est porté sur la libéralisation et la régulation du processus de diffusion des journaux et magazines selon des mécanismes et procédés empruntés à la logistique industrielle et au marketing distributeur propres au secteur de la distribution des marchandises courantes. Après avoir présenté les contraintes et les spécificités liées à l'étude comparative des marchés de la diffusion de la presse, nous proposons dans un premier temps, une analyse structurelle du système de distribution des titres afin de mettre en évidence les mutations managériales au sein de la chaîne d'édition et de diffusion. Dans un second temps, nous analysons le processus relationnel et de rémunération régulant le travail d'échange et de prestation entre les membres en vue de faire ressortir les pratiques marchandes. Le cadre de résolution globale s'inscrit dans une perspective méthodologique développée à l'origine par l'économie industrielle en vue d'analyser la structure du marché de l'offre d'une industrie, et se réfère également à des approches juridique, financière et de gestion. Hormis ce cadre théorique, la thèse essaie de rendre compte de l'environnement industriel des différents maillons de la chaîne de diffusion en s'appuyant sur les modèles d'analyse des canaux de la distribution courante. En somme, la démarche méthodologique que nous revendiquons se situe à l'intersection de l'économie industrielle et de l'économie de la culture et de la communication.
