Advocates claim that market-assisted land reform (MALR) promotes economic development and reduces poverty by improving the security of private property rights and the efficiency of land markets. However, scholars argue that MALR often benefits elites at the expense of the disadvantaged and forces intended beneficiaries to resist or make difficult compromises. Nevertheless, this critical literature largely glosses everyday processes of implementation that help this policy get traction in particular locations. This paper examines the work of regularizing (titling) land in the context of a World-Bank-funded MALR project in northern Guatemala. Specifically, the focus is on the meaning-making work of field technicians who seek to convince campesinos (peasants) to participate in this regularization project. In their recruiting efforts, these technicians creatively link neoliberal slogans, human rights narratives, and exclusionary visions of nation, race, and property. By examining how technicians elaborate knowledge in the field and on the fly, this study reveals spheres of politics where regularization could be modestly contested or transformed. Such politics are worth attending to because in northern Guatemala and elsewhere, regularization contributes to conditions for land grabs.
Der vorliegende Kommentar behandelt die in den 1990er und 2000er Jahren von den sog. neuen Ländern mit den evangelischen Landeskirchen und dem Heiligen Stuhl geschlossenen Verträge auf der Basis des Wittenberger Vertrages von 1993, der – stil- wie inhaltsprägend – zum Modell für alle weiteren staatskirchenrechtlichen Verträge der dritten Generation geworden ist. Damit wird das in seiner Bedeutung teils über- teils unterschätzte Vertragsstaatskirchenrecht der jüngsten Generation erstmals in der klassischen Form der Kommentierung rechtsdogmatisch durchdrungen und zugleich praxisgerecht aufbereitet. -- Kommentiert wird unter Berücksichtigung seiner Entstehungsgeschichte in erster Linie der Wittenberger Vertrag. Die vergleichbaren Bestimmungen der übrigen Verträge werden ergänzend herangezogen. Eine vorangestellte Synopse erleichtert das Auffinden der jeweils einschlägigen Regelungen. / This commentary deals with the treaties concluded after the reunification of Germany by the eastern states with the Protestant regional churches and the Holy See on the basis of the Wittenberg Treaty of 1993, which – in terms of both style and content – has become the model for all further treaties between state and church(es). Thus, the current treaty law of state-church relations is comprehensively presented from a legal point of view and in a practice-oriented manner.

Die Demonstrationen und Streiks in Südkorea haben die Machthaber im Land zu weitergehenden Zugeständnissen gezwungen bis hin zu Präsidentschaftswahlen. Die langfristige Konsolidierungsfähigkeit der demokratischen Errungenschaften ist jedoch überaus unsicher. Neben einigen Meilensteinen der südkoreanischen Geschichte konzentriert sich das Buch vor allem auf die "Kultur des Widerstands" und analysiert die streitbaren Arbeitsbeziehungen und insbesondere die innenpolitischen Kämpfe seit dem Amtsantritt Chun Doo Hwans 1979. There is a continuous debate as to whether indigenous land tenure systems in sub-Saharan Africa can support market-based decisions. Whether or not this is the case is crucial to the quest for appropriate institutional frameworks to harness the potential of the real estate sector. This paper, using evidence from Accra, Ghana, argues that well-defined markets in land exist where property rights are traded within the indigenous system of land ownership. Furthermore, such markets perform better in terms of land delivery and pricing than the market for state-owned lands, and are responsive to the land needs of all segments of the population.
