Different starting points, similar processes and different outcomes can be identified when comparing East Central Europe and East and South Asia. The two regions face similar global challenges, follow regional patterns of democratization and face crises. In communist times, East Central Europe was economically marginalized in the world economy, while some parts of Asia integrated well in the global economy under authoritarian rule. Europeanization and a favorable external environment encouraged the former communist countries to opt for the Western-style rule of law and democracy. Different external factors helped the Third Wave democracies in Asia, especially South Korea and Taiwan, which benefited from the support of the United States and other global economic, military and cultural partnerships to develop their human rights culture and democracy while facing their totalitarian counterparts, namely the People's Republic of China and North Korea. The very different positions Taiwan and Hungary have in their respective regions follow from the different capacities of their transformation management since 1988-1989. Taiwan preserved its leading role and stable democracy despite the threat to its sovereignty from the People's Republic of China. Hungary never had such an influential and problematic neighbor and was ensured security and welfare partnership by the European Union, which Taiwan lacked. While Taiwan was less secure, economic and social conditions were more favorable for democratization than those in Hungary. Hungary, in turn, held a leading position in democratization processes in the period of post-communist transition which was lost during the crisis and conflicts of the last decade (after 2006 and especially since 2010). Despite the fact that liberalization prepared the way for peaceful transition in both countries and resulted in similar processes of democratic consolidation in the 1990s, Hungary joined the 'loser' group in its region, whereas Taiwan is among the top 'winning' countries in its region. Taiwan at the moment is starting comprehensive reform processes toward enhanced democracy, civil rights and the rule of law, and Hungarian development is criticized by many external and internal analysts as straying from the path of European-style consolidated democracies towards illiberal trends and hybridization. Western global concepts of democratization may help to identify similarities and differences, and compare stronger and weaker factors in the democratic transitions in Asia and Europe within the Third Wave democracies. ; Porównanie Europy Środkowej i Wschodniej z Azją Południową pozwala określić ich punkty startu obu regionów, podobne procesy i zróżnicowane wyniki. Oba regiony borykają się z podobnymi globalnymi wyzwaniami, realizują regionalne wzorce demokratyzacji i stają w obliczu kryzysów. W czasach komunistycznych Europa Środkowo-Wschodnia była ekonomicznie marginalizowana w gospodarce światowej, podczas gdy niektóre znajdujące się pod rządami autorytarnymi regiony Azji dobrze zintegrowały się z gospodarką globalną. Europeizacja i sprzyjające otoczenie zewnętrzne zachęciły byłe kraje komunistyczne do wyboru rządów prawa i demokracji typu zachodniego. Odmienne pozycje Tajwanu i Węgier w ich regionach wynikają z różnych zdolności zarządzania transformacją w latach 1988-89. Tajwan zdołał zachować swoją wiodącą rolę i utrzymać stabilną demokrację, pomimo zagrożenia suwerenności ze strony Chińskiej Republiki Ludowej. Węgry nigdy nie miały tak wpływowego i problematycznego sąsiada, a gwarantem ich bezpieczeństwa i partnerstwa w drodze do dobrobytu była Unia Europejska - czynnik nieobecny w Tajwanie. Podczas gdy poziom bezpieczeństwa na Tajwanie był niższy, panujące tam warunki ekonomiczne i społeczne były bardziej korzystne dla demokratyzacji niż na Węgrzech. Węgry z kolei miały wiodącą pozycję w procesach demokratyzacji w czasach postkomunistycznej transformacji, którą utraciły w czasie kryzysu i konfliktów w ostatniej dekadzie (po 2006 r., a zwłaszcza od 2010 r.). Mimo że liberalizacja przygotowała grunt pod pokojowe przemiany w obu krajach i doprowadziła do podobnych procesów demokratycznej konsolidacji w latach 90. dwudziestego wieku, Węgry dołączyły do grupy przegranych w swoim regionie, podczas gdy Tajwan jest jednym z głównych liderów w swoim regionie. Tajwan w chwili obecnej rozpoczyna kompleksowe reformy zmierzające do wzmocnienia demokracji, praw obywatelskich i prawo-rządności, a węgierski rozwój jest krytykowany przez wielu zewnętrznych i wewnętrznych analityków jako odejście od ścieżki demokracji skonsolidowanych typu europejskiego w kierunku nieliberalnych trendów i hybrydyzacji. Chapter I, entitled "Indian income inequality dynamics, 1922-2015: From British Raj to Billionaire Raj?" , discusses the methodological issues at stake when reconstructing historical income inequality series in a country as populated as India, but with very scarce data. The chapter shows that despite many important data limitations, one can combine tax data, surveys and national accounts in a systematic manner to reconstruct income inequality estimates robust to a wide range of alternative strategies. In the case of India, the results are striking as they reveal that income inequality is currently at its highest level since the creation of the Indian Income tax in 1922. The top 1% capture more than 22% of national income today, up from 6% in the mid-1980s, when the top 1% captured about 6% of total income. Chapter II, entitled "Building a global income distribution brick by brick" , builds on chapter I (and many other similar endeavors carried out by my colleagues at the WIL) to construct a global distribution of income based on a systematic combination of tax, survey data and national accounts. Our results are notable as some go against preconceived ideas on globalization and its impacts on economic inequality. In particular, we show that the global top 1% captured twice as much global income growth as the bottom 50% since 1980. We demonstrate that inequality increased, rather than decreased between world individuals since 1980, despite strong growth in the emerging world. In other words, rising inequality within countries was stronger than the effect of reduced inequality between countries since 1980. Looking into the future, the chapter also reveals that under "Business as Usual", global inequality is likely to further rise (despite strong growth in emerging regions) contrary to what has been argued in academic and public debates on the matter. The Appendices to the chapter present the details of the method and reveal that our results are robust alternative strategies to account for missing data at the country level.How to move from global income inequality to global environmental inequality? A first step is to understand the role of income and non-income drivers of individual pollution levels within countries. This is the work that is discussed in Chapter III, entitled "Are younger generations higher carbon emitters than their elders?" , which focuses on the determinants of individual level CO2 emissions and focus on the role of income, technology and other factors, such as date of birth. We show that the French baby-boom generation emitted relatively more CO2 than their parents and their children, throughout their lifetime (about 20% more direct CO2 emissions). This is due to a combination of income, technological lock-in and cultural effects. Chapter IV, entitled "Carbon and inequality: From Kyoto to Paris" , builds on the results obtained in the previous chapters to construct a global distribution of carbon emissions. At the time of writing this chapter, global income inequality estimates presented in Chapter II were not available, so we had to rely on work done by other researchers to obtain global income series (Lakner and Milanovic, 2015). These were corrected with tax data and then used to reconstruct a global carbon emissions database. We show that the top 10% emitters account for about 45% of global emissions today and that twenty years ago, global inequality of carbon emissions was essentially a between-country inequality phenomena. Today, the situation is being reversed as within-country emissions inequality accounts for as much of global emissions inequality as the between-country dimension. On the basis of our results, we propose schemes to better share contributions to climate adaptation funds. The history of climate negotiations shows the extreme difficulty to implement any kinds of allocation rules to share a climate burden. ; Cette thèse porte sur la dynamique des inégalités de revenu et de pollution entre individus, à l'intérieur des pays et au niveau mondial. Plus précisément, l'objectif de ces travaux est de mieux mesurer et mieux comprendre les déterminants de la dynamique sur moyen ou long terme des inégalités de revenu à l'échelle d'un pays (chapitre I) ou au niveau mondial (chapitre II). Il s'agit également de mieux comprendre et mesurer les liens articulant les inégalités de revenu aux inégalités environnementales au niveau national (chapitre III) et mondial (chapitre IV). Enfin, la thèse discute de l'impact des indicateurs de mesure des inégalités sur l'action politique (chapitres V et VI).

В статье представлены особенности и проблемы реализации целей устойчивого развития (ЦУР) в области образования. Статья основана на серии вопросов и ответов, направленных на разъяснение ЦУР № 4 «Обеспечение всеобъемлющего и справедливого качественного образования и поощрение возможности обучения на протяжении всей жизни для всех», и содержит информацию для более глубокого понимания места данной цели в содействии мировому развитию на период до 2030 г.Цель. Изложить основные характеристики цели устойчивого развития в области образования, охарактеризовать задачи, конкретизирующие цель, основные принципы ЦУР № 4, смежные цели и задачи, представить механизмы мониторинга и координации целей, основные справочные документы по цели № 4.Метод или методология проведения работы. Основу исследования составляют методы анализа и синтеза материалов исследований, общенаучные методы классификации, обобщения и сравнения.Результаты. Сделаны выводы о том, что поставленные в ЦУР задачи не могут одинаково успешно реализовываться и бедными, и богатыми странами; часть индикаторов образовательных целей зависит от социально-экономического и культурного контекста, и не имеют однозначной интерпретации для развитых и развивающихся стран, более того – в разных условиях интерпретация может иметь противоположный смысл; многие показатели характеризуют деятельность, которая не даст результатов без дополнительных мер, в противном случае, эта деятельность приводит к дополнительным расходам; разработка универсальных систем и индикаторов развития представляется мало реальной, более правильной может показаться задача в области разработки подходов к формированию национальных систем индикаторов исходя из общей глобальной цели. Важно понимать, что универсальной модели образования в интересах устойчивого развития не существует и существовать apriori не может.Область применения результатов. Высказанные в статье мысли – это субъективное мнение авторов статьи. Сами авторы статьи и общество в целом, не сможет наверняка ответить на вопросы об эффективности реализации ЦУР, поскольку накладывает свой отпечаток всем известный факт, что в образовании очень сложно оценить конечные эффекты, т.к. они существенно отложены во времени. К тому же, на результаты образования влияют огромное количество социальных, экономических и политических факторов, и определить истинную роль образования – достаточно сложно. ; The article presents the peculiarities and problems of realizing sustainable development goals (SDG) in the field of education. The article is based on a series of questions and answers aimed at explaining SDG № 4, «Ensuring comprehensive and equitable quality education and promoting lifelong learning opportunities for all», and provides information for a better understanding of the place of this goal in promoting world development for the period up to 2030 year.Purpose. The article outlines the main characteristics of the goal of sustainable development in the field of education, specifies specific tasks that specify the goal, the main principles of SDG № 4, related goals and objectives, mechanisms for monitoring and coordination of goals, basic reference documents for goal 4.Methodology. The basis of the research is made by methods of the analysis and synthesis of materials of researches, general scientific methods of classification, generalization and comparison.Results. Conclusions are drawn that the tasks assigned to the LRC can not be successfully implemented by poor and rich countries; some of the indicators of educational goals depend on the socio-economic and cultural context, and do not have a unique interpretation for developed and developing countries, moreover, in different conditions, interpretation may have the opposite meaning; many indicators characterize activities that will not yield results without additional measures, otherwise, this activity leads to additional costs; the development of universal systems and indicators of development seems to be little real, it may seem more correct to develop approaches to the formation of national systems of indicators based on a common global goal. It is important to understand that there is no universal model of education for sustainable development and can not exist a priori.Practical implications. The thoughts expressed in the article are the subjective opinion of the authors of the article. The authors of the article and the society as a whole, can never be sure of answering questions about the effectiveness of the SDG implementation, as the well-known fact that the formation is very difficult to estimate the final effects leaves its imprint. they are significantly delayed in time. In addition, the results of education are affected by a huge number of social, economic and political factors and determine the true role of education – it is quite difficult.

Il lavoro condotto prende avvio dalle "preoccupazioni" nutrite dai c.d. pessimisti costituzionali in merito alle sorti delle libertà continuamente derogate dalla strategia securitario-emergenziale impiegata nella lotta al terrorismo del tempo ordinario. Tale punto di vista, rapportato all'opposta lettura degli ottimisti costituzionali, dà luogo a un tertium genus tra i due, che consiste nel cogliere le preoccupazioni dei primi, per muovere, sulla scorta dell'insegnamento dei secondi, di cui si accoglie l'idea di crisi come spinta propulsiva ma non la cieca accettazione delle suddette deroghe considerate necessarie e naturali se la sicurezza lo richiede, alla ricerca di misure che rispondano alle esigenze del diritto vivente senza tuttavia tradire i principi su cui si fonda un ordinamento costituzional-democratico, rappresentandone anzi l'attualizzazione. Nel primo capitolo l'attenzione è focalizzata sull'effettiva sussistenza del fattore emergenziale, che viene messa in dubbio. Dopo aver volto lo sguardo, nella sezione prima, a realtà ordinamentali vicine alla nostra per valutare l'opportunità d'insistere sulle tecniche di superamento dell'emergenza (si fa cenno anche all'inserimento di una emergency clause in costituzione), e dopo aver appurato l'incapacità di ciascuna di esse di far fronte al terrorismo odierno, si passa, nella sezione seconda, a rivalutare la natura del fenomeno quale non emergenziale, donde l'impossibilità di affrontarlo come tale senza incorrere in gravi problemi d'illegittimità. Il secondo capitolo è dedicato all'incidenza che l'adozione del paradigma emergenziale ha in concreto sulle libertà costituzionali, passando al vaglio profili d'incostituzionalità insiti nella gran parte delle norme che concorrono a formare la normativa antiterrorismo italiana. L'analisi si concentra sulle disposizioni codicistiche (artt. 270-bis e ss. c.p.) ed extra-codicistiche (art. 4, comma 1, lett. d) e 9 comma 2-bis del d.lgs. n. 159/2011 e altre) che maggiormente incidono sulla libertà di manifestazione del pensiero, sulla libertà religiosa, sulla privacy, sulla libertà personale, sulla libertà di associazione, sulla libertà di circolazione, sacrificandole sull'altare della (speranza della) sicurezza. Le norme in questione, appartenenti principalmente al mondo del penal-preventivo, riservano un ruolo di primo piano alla giurisprudenza, alla quale spetta il compito di recuperare una legittimità al limite determinata dalla smisurata anticipazione della tutela penale rispetto alla condotta delittuosa e dall'indeterminatezza con cui tali disposizioni vengono concepite nell'ambito della svelta riflessione richiesta dalla decretazione d'urgenza. Nel terzo capitolo, che allo stesso tempo completa e conclude il lavoro, si amplia la prospettiva d'indagine aprendo l'analisi ad alcune norme dell'Unione europea in materia di contrasto al terrorismo, nello specifico quelle volte a disciplinare la sorveglianza di massa in funzione securitaria (direttive PNR, data retention, ecc.). Tale digressione consente da un lato di compiere considerazioni in merito alla difficoltà per qualsiasi ordinamento, anche di natura sovranazionale, di sganciarsi dal terror cimbricus tipicamente statunitense e di difendere contestualmente il proprio patrimonio costituzionale, e dall'altro di accertare che non solo terrorista (o presunto tale) è interessato dalla normativa in questione. L'ampliamento della prospettiva oltre il terrorista e oltre il contesto nazionale, fornisce gli strumenti idonei per vagliare ulteriori "preoccupazioni" costituzionali, indotte - questa volta - dalla strategia della sorveglianza di massa. La normalità con cui si accetta di rinunciare in prima persona alla propria sfera privata nell'eccesso di panoptismo, e in generale ai principi su cui si fonda la democrazia nell'eccesso di panpenalismo, conduce alla riflessione conclusiva, oggetto della sezione seconda, in merito al ruolo che gioca lo Stato nella willingness to pay del consociato: nella distorsione del fisiologico andamento di un ordinamento democratico-costituzionale, in cui rispondere alle continue richieste di sicurezza della società assume l'aspetto di un modo nuovo di fare diritto, il consociato diventa infatti parte integrante di uno scambio. Il discorso si sposta quindi sulla denuncia dell'incapacità dimostrata dalle istituzioni di far fronte ad alcune delle situazioni più sentite della nostra epoca, quali immigrazione e integrazione, poiché le cause ultime dello sviluppo di propositi terroristici sono invero di natura socio-culturale. Il cerchio si chiude pertanto con la promozione di risposte maggiormente conformi a un ordinamento democratico costituzionale, risposte che nel tentativo di rimuovere le cause in cui trova terreno fertile lo sviluppo dei suddetti propositi in attuazione del principio solidaristico cui è informato il nostro ordinamento, si rivelano allo stesso tempo potenzialmente più efficaci nella lotta contro il terrorismo e sicuramente più vantaggiose per la democrazia, che sfugge così al paradosso di autodistruggersi per difendersi dallo stesso.

Лиминальность эффективно изучать в аспекте сверхдлинной и сверхкраткой строк. На площадке как сверхдлинной, так и сверхкраткой строки повтор позволяет накопить и перераспределить творческую энергию, создавая зоны и эффект лиминальности, умножающие количество интерпретаций текста и контекстов. В сверхдлинной строке В. Лехциера присутствует лексический и одновременно синтаксический повтор. Явственность и – реже – полярность флангов позволяет средней строке пролегать внутри сверхдлинной. Интересно, что при чтении Виталием Лехциером его стихотворений он стремится озвучить самые длинные строчки (38–42 слога) на одном дыхании как единое целое, подчеркивая натяжение сверхдлинной строки. Это доказывает, что зона лиминальности лежит здесь именно на стыке словесного и внесловесного, а плоскость текста остается цельной. Венделин Мангольд обычно работает на площадке небольшого текста. Его излюбленный прием – создание эффекта лиминальности путем сочетания возвышенного и приземленного. ; The article uses the materials of Our Literature section of the BiZ-Bote magazine of ethno cultural education. The author suggests using the term «liminality zone» for the designation of the zone of apparent transition from one plane to another in perception of literary read and the term «liminality effect» for the designation of the result as a consequence of reception of this transition zone. Studying liminality proves efficient in respect of the aspect of super long and super short lines. Repetition on the ground of both super long and super short lines allows accumulating and redistributing creative energy, building up liminality zones and effect, multiplying the amount of interpretations of texts and contexts. In the super long line by V. Lekhtsier both lexical and semantic repetitions are present. Apparentness and – more rarely – polarity of the flanks allow the middle length line to lie inside the super long. It is interesting that while Vitaly Lekhtsier is reading his verses, he ensues to articulate the longest lines (38–42 syllables) in one breath, emphasizing the tension of super long line. This proves that the liminality zone lies exactly at the juncture of verbal and non-verbal, and the text plane remains integral. Vendelin Mangold usually works in the realm of a small text. His favorite practice is creating the liminality effect by combining exalted and prosaic. W. Mangold's «pyramid poems» («Pyramiden») are of great interest in terms of liminality [Mangold, Hymne auf den Menschen]. Their literal meaning fades through crescent and/or decrescent phrases/words. Visually, the poem is shaped like a pyramid, and both explicit and implicit (phantom) parts of a word/phrase are in the liminality zone. That is how the context of love is severed from the context of egoism through decrescent lines: having started with passionate confessions, only «I love» and, finally, «I» remains. Mangold's «Pyramiden» are characterized by strong or slight paradoxes that create the liminality effect. In case the «pyramid» is first decrescent and then crescent, the liminality effect is created twice: at the apex of the pyramid and in the paradoxical part. Vitaly Lechtzier's extralong stanza ranges from 12 to 42 syllables. The liminality effect emerges through repeating the left and right parts of the verse. This is where variations are formed. Lechtzier's message is overtly political, the author works with imperative forms and disavowed call for «open writing».Vitaly Lechtzier's extralong stanza with its anaphoras, imperative forms, syntactic parallelism, repetitions and escalation is similar to Valery Nugatov's extralong stanza. This affinity did not emerge under direct mutual influence but probably rather through Allen Ginsberg's poetry, who was of interest to both authors: Nugatov used to translate his poems, and Lechtzier mentioned being interested in Ginsberg's works. Nugatov also mentioned Ginsberg in his own works. The syntactic construction in Ginsberg's poems is based on the lyrical «self». The same is true for Nugatov's poems, however, Lechtzier steps away from the «self» completely. Unlike Nugatov, in his opinion, Lechtzier does not resort to deconstruction in his poetry, but instead endeavors to «do positive work with other people's words, create variations within them and make them sound like poerty». Nugatov's works «sound like poetry» in part due to the deconstruction. It is enough to compare some extracts from these three authors' works. The study shows that in case of both extralong and extrashort stanza, repetitions help accumulate and redistribute creative energy, creating the liminality effect and liminality zones that increase the number of potential interpretations and contexts.

En el departamento de Santander la elección de mujeres a cargos públicos locales ha sido baja; las causas de este fenómeno pueden ser diversas, pero se han hecho muy pocas investigaciones para conocer la visión que tienen las mujeres de su ejercicio político y las dificultades que enfrentan al participar en política a nivel local. Esta investigación exploratoria de carácter mixto, tiene como objetivo principal analizar las estrategias para el fortalecimiento de la participación política de las mujeres en Colombia y su incidencia en el desarrollo regional en la Provincia de Soto Norte – Departamento de Santander. La investigación uso como fuentes primarias la información obtenida de entrevistas a mujeres elegidas para cargos públicos locales (alcaldía y concejos municipales) en los municipios de California, Vetas Surata y Matanza (Provincia de Soto Norte), así como los boletines de la Registraduría Departamental y los archivos de las iniciativas presentadas por las mujeres electas durante los años 2003 al 2015. Como resultado se encuentra que en los municipios de la Provincia de Soto Norte actualmente hay un mayor número de mujeres postulándose, pero muy pocas son elegidas, aún no se logra el 30% de representación en concejos municipales y tampoco en las conformaciones de los gabinetes de los alcaldes, sus intereses principales son género, emprendimiento, le siguen medio ambiente y desarrollo social ; INTRODUCCIÓN .6 1. This investigation has as a main goal the analysis of the strategies that need to be follow in order to strengthening the participation of women in the Colombian politics, and in particular to the impact they might bring to the development of the Soto Norte Province – located at the Santander region. The main source of information for this investigation have been multiple interviews performed to women that were elected for public service positions (town mayors and local counselors) at tows such as California, Vetas, Surata and Matanza (Soto Norte Province), as well as newsletters released by the Regional Registry Office and files of the initiatives of the women elected in the region between 2003 and 2015. As a result of this investigation, it is found that nowadays more women are candidates for public service positions at the tows of the Soto Norte Province, where their main proposals and interests are related to gender equality, entrepreneurship opportunities, environmental issues and social developments; nevertheless, they have not been able to be elected and have not even reach at least a 30% of participation on the local councils or cabinets of town mayors

El surgimiento de las nuevas Tecnologías de la Información y de las Comunicaciones ha conllevado multitud de ventajas en los aspectos económicos, culturales y políticos de la sociedad moderna, sin embargo, también han surgido multitud de conflictos y problemas jurídicos que suponen un desafío para el Derecho. Los juristas y otros actores jurídicos asumen el reto de regular estos cambios tecnológicos, los cuales cambian y se transforman a gran velocidad. En este trabajo de investigación se realiza una aproximación histórico-jurídica a la interrelación entre Derecho y Tecnologías de la Información y de las Comunicaciones. Se analiza primero la evolución del Derecho, cuáles son los factores que propician los cambios jurídicos, y las principales teorías que tratan de explicar estos cambios. Este análisis incluye desde las primeras teorías evolutivas sociales que aparecieron en el siglo XIX, pasando por el surgimiento de las teorías doctrinales y económicas que se produjeron en el siglo XX, hasta las más recientes teorías que utilizan presupuestos de la psicología evolutiva y el concepto de trasplante jurídico. Se examina a continuación la evolución de la peculiar relación entre Derecho y tecnología, la influencia diferente de las tecnologías específicas de contexto y las nuevas tecnologías inteligentes. Se analiza el uso indebido de la tecnología, las diferentes formas de regulación de las innovaciones tecnológicas, el dilema del control y la importancia del factor temporal, las características del entorno regulador y las respuestas del Derecho consuetudinario y el estatutario a estas innovaciones. También se considera el fenómeno de la tecno-regulación, es decir la utilización de la propia tecnología como normativa, la esencia del concepto del "código es la norma", sus fuentes y sus contradicciones. Las Tecnologías de la Información y de las Comunicaciones son las que, en gran medida, impulsan la historia. Bajo este punto de vista, se compara la revolución actual de la nueva "Era Digital" con las características de otras revoluciones importantes que ha sufrido la humanidad, y se analizan en detalle cuatro hitos históricos que supusieron grandes revoluciones de la información y la comunicación: la escritura, la imprenta, el telégrafo (tecnologías de la telecomunicación) y las tecnologías digitales. Se analiza el contexto histórico-social, las repercusiones de estas innovaciones tecnológicas y su relación con el Derecho. Se destaca el origen y la evolución de Internet y la creación de la Red Informática Mundial (World Wide Web, WWW), y la aparición de las tecnologías web, como los blogs o las wikis. Se revisa también el fenómeno de las redes sociales y se resalta la importancia de la aparición del Internet de las Cosas ("Internet of Things") y su trascendencia como verdadera evolución real de Internet, y su potencial para mejorar de forma revolucionaria la vida de las personas. Con esta aproximación histórico-jurídica de la evolución del Derecho y de las tecnologías se puede comprobar que las intervenciones legislativas y jurídicas que surgieron con la aparición de otros hitos históricos como la imprenta o el telégrafo pueden ayudar a vislumbrar un conocimiento más profundo sobre las intervenciones actuales y futuras sobre Internet y otras nuevas tecnologías. Uno de los impactos más relevantes que tiene la Red es el que afecta a los derechos fundamentales de la personalidad, pues el uso de las nuevas tecnologías tiene serias implicaciones respecto a la delimitación del derecho al honor, a la intimidad, a la propia imagen o a la libertad de expresión. Con la regulación de los derechos fundamentales de la personalidad han ido surgiendo nuevas figuras jurídicas que son típicas del uso de Internet como el hate speech, la censura digital o el derecho al olvido. El Derecho se configura como el instrumento regulador que debe encajar estas nuevas figuras y derechos en la sociedad actual y también de las que irán surgiendo en un futuro, por ello el Derecho debe adaptarse a las nuevas tecnologías y a los cambios que se irán sucediendo. La regulación jurídica tampoco debe ser unilateral, sino que debe involucrar a todos los actores que pueblan Internet y no limitar su libertad de acceso ni su interacción social. ; Derecho

The present research investigates how the Association of Southeast Asian Nations (ASEAN) and its Member States contribute to and undermine the claim to the universality of human rights. This research contributes to the theoretical discussion on the universality of human rights. ASEAN and its Member States acknowledge that human rights are universal, indivisible, interdependent and interrelated while developing an ASEAN human rights system. At the same time, reference is also made to national and regional particularities and various cultural and historical backgrounds. Due to the previous experience with the Asian values argument in the early 1990s, whereby its proponents argued that values that were upposedly commonly shared in Asia would lead to an 'Asian view' of human rights, these particularities have often been presumed to be detrimental to universal human rights standards. The present research provides a more nuanced and up-to-date picture of particular attitudes that exist within the ASEAN region and investigates whether these attitudes contribute to and undermine the claim to the universality of human rights. In this way, an understanding of the existing instruments and mechanisms, including their limitations, is attained, which is essential when addressing human rights violations in the ASEAN region. In this research, a legal analysis is made of human rights in the ASEAN context at a conceptual level and of the mechanisms installed to protect and promote these rights. The point of substance concerns the room for developing human rights standards based on the context of ASEAN and its Member States. Specifically, the ASEAN Human Rights Declaration, the declarations and reservations to the core human rights instruments of the United Nations to which the ASEAN Member States are party and the fundamental rights in the national constitutions are scrutinised. The procedural part of the research question focuses on ASEAN's regionalism and human rights engagement by also conducting literature research on the 'ASEAN Way', ASEAN's mode of operating, ASEAN's existing mechanisms and the initiatives taken by the National Human Rights Institutions in the region. Field research was scheduled in the early stages of the research in order to gain insight on where ASEAN and its Member States stood with respect to their human rights engagement. In later years, the reports of the organisations the interviewees work for were used to track possible changes in their thinking. The universality of human rights is analysed at three levels: concepts, conceptions and implementation. At the level of concepts, the research analyses which human rights are included in ASEAN's human rights system. The conclusion is drawn that the ASEAN region overall detracts from the universality of human rights at this level while the added value remains limited. Specifically, the ASEAN Human Rights Declaration and the national constitutions of the Member States omit certain human rights standards, including ius cogens norms, that are set in core human rights conventions of the United Nations. The level of conceptions deals with interpretations and restrictions of human rights in the ASEAN region and their conformity to international human rights law. With respect to the ASEAN Human Rights Declaration, the research concludes that the restrictions formulated as general principles and the inclusion of a general limitation clause overall cause a detraction from the universality of human rights at the level of conceptions. In addition, a number of the provisions are subjected to national law. This corresponds to a practice of ASEAN States to subject provisions of core human rights conventions of the United Nations to national law when formulating reservations, which is also contravening international human rights law. The level of implementation focuses on the way in which human rights are legally protected and promoted in ASEAN's human rights system. It is concluded that ASEAN's mechanisms overall lead to a denial of the right to invoke one's human rights and to a detraction of the universality of human rights. This is due to the lack of procedural aspects in human rights standards and the restricted mandate of ASEAN's human rights mechanisms. Together with the 'ASEAN Way' the development of a higher level of human rights protection is hampered. Consequently, ASEAN needs to rely on national legislatures and courts with respect to the implementation and compliance with norms, whereby the mandate of the National Human Rights Institutions that are present in the region could contribute to ASEAN's human rights mechanisms.

The article, Prestige and Powers of "The World of Big Power'', Tanah Papua as Specific Case, the author intends for Subtopic to two and at the same time can also to accommodate the third problem of formulation being raised in dissertation entitled: " Re-Roadmap of the Papuan in State of Papua Courant West : "A Peaceful Solution Recovering of Identityâ€. That is by treading Returning Roadmap, referring to Unilateral Declaration of Independence/UDI of the Papua Nation and the Federal Republic of West Papua/NRFPB on October 19, 2011. The study describes in five main topics, namely, (1) Defining "Hidden Structure" in Melanesian-Papua Social Cultural highlighting Papuanistiecs and Melanesianology; (2) Prestige and Powers of "The World Big Power'', Tanah Papua as Specific Case, reveals how the influence of â€The Giant Powers†to the problem of Papua; (3) Federalism in Indonesia revealing Melanesian-Papua in Tanah Papua as Special Case versus the Unitary Republic of Indonesia; (4) Constitution vis-à -vis Constitution illustrates the philosophical correlation among Indonesian constitution 1945 versus Papua constitution 1999; (5) Unilateral Declaration/UDI of the Papua Nation and NRFPB on October 19, 2011. The background of the study is based on two keys of Morgenthou thoughts: First, Morgenthou (2012) confirmed that, during the 17 years from 1945 to 1962, the process to Indonesia-nizing the Papuans are generally still in the stage of seeding while growing only in some urban areas and the government center. Awareness to be Indonesian-ness was yet to reach all areas of Papua. Morgenthou (2012) that the presence of all Indonesia's past greatly influenced the policies and the approach taken by both the Dutch and Indonesian government through the nationalist's initiators role at that time. Second, study of LIPI in 2007 (Soewarsono, ed.) is still questions to the Indonesian-ness of Papuans reinforces the view of Morgenthou (2012), which states that the process to Indonesian-ness among Papuans still weak. In connection with this, the author is improving the nature of Hidden Structure as Grand Theory. Formulations of the problems might be: (1). How to understand the present of the Melanesian-Papua in Tanah Papua? (2). May the existence of Papua to be returning to the attention of Prestige and Powers of "The World Big Power" for its political status to be reviewed at the UN? (4). Whether, the Melanesian-Papua and the Indonesian in Tanah Papua can together according to the federalist order of Melanesian-Papua? (4). How is the condition of Indonesian society and customs of Melanesian-Papua can be brought together to create a bilateral solidarity for the multilateralbeneficial and usefulness?

Formulation of the problem. The phenomenon of world (global) cities is of considerable interest and is the subject of research of specialists from different spheres. The study of world cities at the present stage of the society's development is complicated by a number of aspects, including complex and dynamic development of the geopolitical and geoeconomic world space, which explains rapid transformation of cities; the complexity of a statistical base formation for the study of world cities, expressed in a large amount of diverse information and limited access to it; lack of a holistic and unique methodology for studying world cities.The purpose of the article. The article studies the human-geographical approach to the formation and development of the concept of world (global) cities in the XX‒XXI centuries.Results. In modern scientific literature there are a number of terms describing the phenomenon of world cities, in particular, including «global city», «world center», «world financial center», «сosmopolis», «information city», «media city», «metropolis», «ecumenopolis», «global city region», «сapitals of capital», «international city», «globalizing city» «megacity», «interactive city», etc. The variety of terms is an indicator that reflects the ambiguity and complexity of this phenomenon in modern science, as well as the diversity of approaches to its study. Definition of «world cities» concept is based on such aspects as economic development, political influence, social significance.Formation of the world cities concept has a fairly long history. A significant contribution to its formation and development was made by P. Geddes, P. Hall, C. Doxiadis, F. Braudel, H. Reed, J. Friedmann, G. Wolff, N. Thrift, S. Sassen, M. Castells, C. Abbott, Y. Jao, A. E. Tschoegl, Y. Cassis, P. Taylor, A. Scott, P. Marcuse, R. Van Kempen, E. Isin, D. Clark, N. A. Slucka, S. McQuayer and others. In their research, the world city is, firstly, as a phenomenon unique and singular; secondly, the scope of its influence clearly has a planetary or, ultimately, macro-regional coverage; thirdly, the world city represents a special force concentrator, whether in the field of ideology, religion, military force, innovation economy, etc.; fourthly, it acts as a hegemon, functions as a governing and controlling element within the framework of another, «subordinate» territorial-social system; fifthly, the spatial organization of such a system has a clearly pronounced center-peripheral character; sixthly, the presence of the dominant one-, two-way links that support the system.Several approaches to identifying the phenomenon of a world city based on different principles can be singled out: geoeconomic, geopolitical, socio-cultural, historical-geographic, geodemographic, information and communication, service, innovation. Human-geographical approach is important as it combines all of the above-mentioned and provides the most comprehensive study of the phenomenon of world cities. ; В статье проведено исследование эволюции концепции мировых городов, выявлено общественно-географические аспекты ее формирования и развития. Мировые (глобальные) города вызывают большой интерес и являются объектом исследования специалистов разных сфер. Дефініції поняття «світові міста» спираються на такі аспекти як економічний розвиток, політичний вплив, соціальна значимість. Можна виділити декілька підходів в ідентифікації феномена світового міста, заснованих на різних принципах, – геоекономічний, геополітичний, соціокультурний, історико-географічний, геодемографічний, інформаційно-комунікаційний, сервісний, інноваційний. Важливим виглядає суспільно-географічний підхід, який поєднує всіх вищеперераховані та забезпечує максимально комплексне дослідження феномену світових міст.

The weakening of the SFRY (Socialist Federative Republic of Yugoslavia) which was followed by its dissolution, had an impact on a wide range of issues, one of them being the degradation of the so called Serbo-Croatian language. Not only did the external political influences contribute to the dissolution of the SFRY, but they also play a part in the linguistic profiling of new standard varieties today. However, as the dissolution of Yugoslavia couldn't have been imagined without consequences for Serbs primarily, the transformation of the 'Serbo-Croatian' language into a series of new language norms-successors of the old ones, cannot take place without challenging the rights of the great number of Serbs who live outside of Serbia. These are the rights that primarily refer to the linguistic and social identity - therefore the national identity. The best illustration of this are the external influences in the domain of linguistic engineering today, and these influences can basically be divided into extensive (e. g. commercials, radio and TV programmes) and intensive (textbooks, handbooks etc). The aim of this study is the analysis of those different kinds of pressures put on the standard variety of the language of Serbs. From the domain of the extensive influences (commercials) there is an example of the instruction given on a tube of toothpaste (Vademecum laboratories, Perfection 5 - Schwarzkopf & Henkel, Dusseldorf - Germany), and as an example of the intensive influences of this type, there is an American textbook (R. Alexander, E. Elias-Bursa} Bosnian, Croatian, Serbian, a Textbook, With Exercises and Basic Grammar, The University of Wisconsin Press, 2006). Both of these language materials proved to be highly compatible when it comes to the characteristics that should become an integral part of the standard language variety of Serbs, and apparently only the Serbs who live in Serbia. Among the language characteristics which are 'typically Serbian' the most prominent are: ekavian dialect ('lepa deca', not: 'lijepa djeca'), the 'da + prezent' construction ('moram da čitam', not: 'moram čitati'), the prepositional form 'sa' ('sa limunom', not: 's limunom'), as well as many other characteristics like interrogative sentences beginning with da li ('Da li si student?', not 'Jesi li student?') etc. As it follows the newly formed political borders in the area of the former SFRY, the contemporary linguistic engineering has engaged itself in creation of the new standard language varieties, including the one (or should we say, primarily the one) that belongs to the Serbs. However, the Serbs don't have the need for the re-standardization of their language (which became widely familiar to the European community since the 17th century, and it underwent the process of standardization at the beginning of the 19th century owing to the work of Vuk Karadžić) after the dissolution of SFRY, especially if it would be carried out from the outside and not take into account all the entities of this nation, e. g. the Serbs in Croatia, Bosnia and Herzegovina, Montenegro etc. Because it is those Serbs who have always contributed significantly to the culture, science, and the overall identity of the Serbs generally, doing an immense favor to the European and even the world culture, and science in general. That is why the European culture - if it seeks to remain multiethnic and democratic - and other cultures similar to her, must allow the Serbs to preserve their cultural and national identity, wherever they may live - and the best proof of this will be its attitude towards the standard language variety which was established by Serbs almost two centuries ago. ; Slabljenje, a zatim i raspad SFRJ odrazili su se, između ostalog, i na razgradnju tzv. srpskohrvatskog jezika. Onako kako su vanjski politički uticaji imali udela u raspadu SFRJ, tako oni danas imaju učešća i u lingvističkom profilisanju novih standarda. No, kao što se rušenje Jugoslavije nije moglo zamisliti bez posledica prvenstveno po srpski narod tako i pretvaranje 'srpskohrvatskog' jezika u niz jezičkih standarda-naslednika ne prolazi bez osporavanja prava delovima srpskog naroda (npr. u Hrvatskoj, Bosni i Hercegovini, Crnoj Gori), - pre svega onih koja se odnose na jezički i kulturni, dakle, nacionalni identitet. To dobro ilustruju upravo vanjski uticaji u oblasti jezičkog inžinjeringa, a oni se, u osnovi mogu svrstati u ekstenzivne (npr. reklame i reklamna uputstva, radio i TV programi) i intenzivne (udžbenici, priručnici i sl).

It is considered that the territory of the eastern part of the Roman province of Dalmatia was inhabited by the population of the same ethnic and cultural identity. The process of romanization of population in the eastern part of Roman province of Dalmatia can be research through epigraphic material from gravestone and votive monuments, and morphological characteristics of gravestones. ; Prvi znaci vojno-političke i ekonomske faze romanizacije na istočnom delu rimske provincije Dalmacije mogu se uočiti od sredine I do sredine II veka. Posle toga, u epigrafskom kao i drugom arheološkom materijalu, vidljiv je veći stepen romanizacije, ne samo vojno-političkog i ekonomskog tipa, već šire, uključujući socijalne faktore stanovništva kroz rimske standarde života i kulture. Prvi podaci o domorodačkom stanovništvu u procesu romanizacije odnose se na dva epigrafska nalaza iz period prve polovine i sredine II veka, sa područja Skelana i Pljevalja. Oba nalaza, iako nisu hronološki identična upućuju na to da je domorodačko stanovništvo na ovim područjima bilo uključeno od perioda Hadrijana u rimske standarde dobijanjem prava građanstva, i da je plemenska aristokratija predstavljala u tom smislu prvu kariku u sprovođenju socijalno – političke romanizacije kroz oblike nemunicipalnih i municipalnih funkcija. Mehanizam socijalno-političke romanizacije odvijao se postepeno, sprovođenjem urbanizacije kao potpune novine rimskog standarda života i raspadanjem starih rodovsko-plemenskih organizacija, za koje se još uvek ne zna u kom hronološkom rasponu ili kojom brzinom su slabile i nestajale. Na određenim područjima, odnosno mikroregijama određenih oblasti, ovi procesi su se odvijali sukcesivno. Analiza epigrafskog materijala pokazuje da se mogu pratiti dve grupe stanovništva. Jednu grupu, koja se može pratiti preko onomastičkih formula uglavnom dvočlanih, a retko tročlanih ili četvoročlanih, sa gentilicijem Aelius, čini domorodačko stanovništvo, dok drugu grupu sačinjava doseljeno stanovništvo koje je već bilo romanizovano na svojim matičnim područjima. Druga grupa stanovništva je uočljiva na području Pljevalja, kao doseljeno stanovništvo, najčešće ili najverovatnije uz Risna i Agruvium-a, koja se prema imenskoj nomenklaturi može okarakterisati kao mešovita grupa italskog, grčkog i ilirskog stanovništva. Analiza krvnog srodstva pokazuje da je doseljavanje ove grupe bilo organizovano ili vršeno u okviru porodica, od kojih su neke kao porodice Paconii i Cipii, bile u krvnom srodstvu, a druge, kao Gavienii i Statii, nastale prethodnim mešanjem putem bračnih veza domorodačkog i grčkog stanovništva primorskih oblasti provincije Dalmacije. Na području Rogatice može se uočiti da doseljenom stanovništvu pripada porodica Clemens, koja se od ranije pominje u Asseri-i. Što se tiče doseljenika sa područja Pljevalja, može se prema hronološkoj determinaciji sahranjivanja prvih članova ove grupe stanovništva u period druge četvrtine i sredine II veka pretpostaviti njihovo doseljavanje na teritoriju istočnog dela provincije Dalmacije najverovatnije u vreme Trajana. Takodje jedino na ovom području nalazimo i zadržavanje tj. ostatke starijih rodovskih oznaka na mestu gentilnih imena, kao što su Carvanius, Cambria, Cameria, Arguriana, Agregianus. U epigrafskom materijalu, pored već pominjanog stanovništva grčkog i italskog porekla, pominju se imena iz repertoara koji je Katičić označio kao grupu identičnu sa srednjedalmacijskim područjem. To su imena: Aplini, Andetia, Bazo, Besus, Carvus Calvus, Dasius, Dussona, Germano, Lautus, Lavius, Panto, Vendo Pinentia, Plator, Plares, Stataria, Statius, Scavenianus, Tata Turo, Turus, Testo, Tritano. Najčešće se ova imena javljaju na području Pljevalja i Prijepolja, ali su u manjoj meri uočljiva i na ostalim područjima istočnog dela provincije Dalmacije. Kao jedna od karakteristika sporog procesa romanizacije u okviru određenih društvenih slojeva ili grupa uočava se dugo zadržavanje konzervatizma. Ovo se ogleda u epigrafskom materijalu, gde se u onomastičkom materijalu mogu pratiti ostaci matrijarhata preko velikog broja ženskih imena u jednočlanim onomastičkim formulama, ili preko ženskih imena na mestu gde bi se inače nalazio patronimik. Reljefne predstave na nadgrobnim spomenicima, kao i nalazi nakita iz grobova iz okoline Požege i Rogatice, pokazuju da se sve do kraja III i početka IV v. zadržao tradicionalni način odevanja i ukrašavanje, naročito u ženskoj nošnji. Izvesni elementi ženske nošnje (marama sa puštenim krajevima) identični su onima iz središnjeg dela provincije Dalmacije, naročito okoline današnjeg Glamoča i Konjica. Ova činjenica, kao i pojava imena identična sa srednjedalmacijskim imeničkim područjem, ipak još uvek ne daje mogućnost da se da odgovor na pitanje da li se radi o doseljenom stanovništvu iz perioda vladavine Rimljana, ili o etnički srodnom ili identičnom stanovništvu naseljenom na ovim područjima još u predrimskom periodu?.

The analysis of interaction of political parties with voters in Ukraine is carried out. The attention is focused on the fact that political parties use new forms of communication with citizens. It is proved that the subjects of the electoral process do not use social networks fully as a means of communication, but as a rule use them as news portals through which inform about the direct activities of parties on the place of location. They are included in political activities to the extent necessary to meet the challenges in the economic, social, cultural, environmental and other fields. The presence of many problems that cannot be solved without power, encourages citizens to unite, includes them in the orbit of political processes.It is noted that political parties should actively involve voters in discussions and debates on websites and social networks. To improve communication with voters, it is advisable to place information on Internet resources in advance. It is grounded that it is necessary to post contact information about the local and district cells of the party. From time to time, they should publish for voters a reminder of how and with what questions, suggestions the voter can apply to the party or its leadership.It is noted that the analysis of regional Facebook-pages can be carried out according to the following criteria: the presence of a page on Facebook, the period of page activity, the number of subscribers of the page, the number of messages, content, the number of messages / likes / comments, mention of national and local policies, the subject of messages.The completeness of the spectrum of political parties and the conditions of their functioning, which are the defining indicators of democratic society, are determined. Democratic society not only declares, but also really guarantees the rights and fundamental freedoms of citizens.In democratic countries, political parties assume a wide range of social functions, becoming an integral structural component of society. The analysis of the role of political parties in political processes makes it necessary to form new approaches to the study of their activities.The current state of political parties' participation in the political process is investigated. It is argued that those political parties that do not fully use social networks as a means of communication with voters lose the level of support. It is found that the lack of proper communication with voters through social networks reduces the ability to overcome the political representative barrier of parties. ; Здійснено аналіз взаємодії політичних партій в Україні з виборцями. Акцентовано увагу на тому, що політичні партії використовують нові форми комунікації з громадянами. Обгрунтовано, що суб'єкти виборчого процесу не використовують соціальні мережі в повній мірі, як засіб комунікації, а як правило використовують їх як новинні портали через які інформують про безпосередню діяльність партій на місцях.Зазначено, що політичні партії мають активніше залучати виборців до обговорення та дискусії на сайтах і у соціальних мережах. Для покращення комунікації з виборцями доцільно інформацію на Інтернет ресурсах розміщувати завчасно. Аргументовано, що слід розміщувати і контактну інформацію про місцеві і районні осередки партії і час від часу публікувати для виборців нагадування про те, як і з якими питаннями, чи пропозиціями виборець може звернутися до партії, чи її керівництва.Зазначено, що аналіз регіональних Facebook-сторінок можна здійснювався за такими критеріями, а саме: наявність Facebook-сторінки, період активності сторінки, кількість підписників сторінки, кількість дописів, контент, кількість поширень дописів / лайків / коментарів, згадки про національних та місцевих політиків, тематика дописів.Визначено повноту спектру політичних партій та умови їх функціонування, які є визначальними індикаторами демократичності суспільства. Демократичне суспільство не лише декларує, але й реально гарантує права й основні свободи громадян. Політичні партії разом із державними і партійними структурами виступають важливими елементами соціальнополітичної конструкції суспільства. В демократичних країнах вони перебирають на себе широке коло суспільних функцій, перетворюючись при цьому на невід'ємний структурний компонент суспільства. Аналіз ролі політичних партій у політичних процесах змушує до необхідності формування нових підходів у вивченні їх діяльності.Досліджено сучасний стан участі політичних партій у політичному процесі. Аргументовано, що ті політичні партії, які не використовують в повній мірі соціальні мережі, як засіб комунікації з виборцями втрачають рівень підтримки. З'ясовано, що відсутність належної комунікації з виборцями через соціальні мережі знижує можливості долати політичним партіям репрезентативний бар'єр.

El propósito central del estudio es Rondas Campesinas y la Violación de Derechos Humanos en el Distrito Judicial Yauli (Chopcca) – Región Huancavelica 2016", considerando como fundamento la base doctrinal donde muchos juristas reconocen la importancia de la "costumbre" en la sociedad particularmente en la influencia que tiene frente a las reformas legislativas referidas a la conducción de predios, sistemas de tenencia de tierras y varias formas de acceso a la propiedad, la familia ancestral peruana tiene una institución que ha llamado la atención de los científicos sociales del mundo entero, denominada en el idioma quechua como "servinacuy". Es así que la sociedad peruana, con diversidades culturales, conserva instituciones del "derecho consuetudinario", muchas de las cuales no han sido tomadas en cuenta por la legislación nacional, debe tenerse presente que en la fecha se habla 47 idiomas en el Perú, en comunidades que no todas tienen vinculación con las ciudades y centros de estudios. Esa es la situación general que ha originado el presente estudio y también tiene fundamento filosófico del derecho consuetudinario, por un lado; y, por otro lado, el establecimiento de las controversias que existen entre ambos sistemas jurídicos. Sabemos que las Rondas Campesinas se iniciaron su acción en el Departamento Cajamarca en los años 1970 y poco a poco se extendió al sur del país en las dos décadas siguientes como es en 1980 y 1990 el surgimiento de las Rondas Campesinas se dio en el ámbito político muy distinto porque estaba involucrado la violencia política ocasionada por el partido comunista del Perú (sendero luminoso); se consolidaron con mayor énfasis como una organización que representa directamente al campesinado en todo las comunidades campesinas de Huancavelica que hasta la fecha operan, sobre todo en las zonas rurales (alturas) de las provincias Angaraes, Acobamba, Huancavelica, Tayacaja, Churcampa y en las otras provincias como Huaytará y Castrovirreyna en menor escala pero estas comunidades campesinas la mayoría de ellos tienen como representantes de la Justicia al Juez de Paz y en algunas comunidades coordinan muy bien con las Rondas Campesinas, todo en base a sus costumbres heredados desde sus abuelos (en algunos casos personas sin tener secundaria completa). Se está utilizando el método básico como un proceso operativo, organizado, de conocimiento y comprensión de la realidad objeto de estudio con el objetivo de alcanzar un resultado de un hecho, en este caso, es ayudar a tratar el comportamiento de las rondas campesinas y la como con su accionar en algunos casos violan los Derechos humanos en el Distrito Judicial de Yauli (Chopcca) Región Huancavelica, a partir de allí la investigación básica plantea teorías, explicaciones, argumentos que ayudan a tratar al fenómeno y encontrar alternativas para su comprensión y explicación. Esta investigación de costumbres y justicia formal es de tipo descriptivo. Concluye este estudio de las Rondas Campesinas en qué; la principal base doctrinal del sistema jurídico actual del Perú, se encuentra en la Constitución del Estado Peruano como Derecho Consuetudinario o más conocido como Derecho de las Costumbres; cuyos planteamientos corresponden al derecho positivo; en tanto que el sistema jurídico que aún persiste en la comunidad campesina de los andes del Perú, particularmente de la Región Huancavelica, podemos resaltar que el 63% de la población es atendida judicialmente por el Juez de Paz en algunas oportunidades estas actúa cumpliendo funciones de Notario Público, lo malo es que muchos de ellos no tienen secundaria completa, pero si donde funciona las rondas campesinas en algunos distritos hay mucho abigeo y los ronderos cuando aplican la justicia son radicales con los que cometen robos e incluso actúan cuando las parejas se sacan la vuelta, etc.; en otros distritos coordina sin contradecir sus funciones respetando sus costumbres e incluso la gobernación distrital coordina muy bien con las rondas campesinas (solo cuando hay excesos por parte de los comuneros integrantes de las rondas actúan con sus propias normas internas) Así mismo de 95 distritos de la Región Huancavelica cuenta con atención legal solo el 37% de su población, todas las demás tiene su base doctrinal en las costumbres y la cosmovisión andina, donde corresponden al derecho consuetudinario.

На формування ефективної національної інноваційної системи як комплексу інститутів правового, фінансового та соціального характеру, що забезпечують інноваційні процеси, впливає багато факторів, як позитивних, так і негативних. В сучасному глобалізованому світі національні інноваційні системи значною мірою залежать від політичної ситуації в світі та культурних особливостей кожної країни. Створення та поширення принципово нових технологій, продуктів та послуг набуває все більшої актуальності. Мета і методи. Метою дослідження є аналіз формування та реалізації національних інноваційних систем в різних країнах світу, впровадження інноваційних практик в готельній індустрії, визначення особливостей державної інноваційної політики, а також факторів, що позитивно або ж негативно впливають на національну інноваційну систему. Для вирішення завдань дослідження були використані наступні методи: історіографічний, порівняльний, методи аналізу та синтезу. Результати дослідження показали, що національні інноваційні системи на сьогоднішній день все більше розвиваються та удосконалюються, адже сучасна економіка характеризується своєю інноваційністю. Найбільш розвиненими є інноваційні системи США та країн Європи. Щодо впровадження інноваційних практик в готельній індустрії, то першість належить знову ж таки США, країнам Європи, Японії. Висновки та обговорення. На основі аналізу національних інноваційних систем можна зробити висновок, що в сучасних умовах інноваційна система потребує постійного вдосконалення. Успішному розвитку національної інноваційної системи сприяє чітка стратегія державної політики в галузі інновацій; раціональне використання наявного інноваційного потенціалу; зміцнення співробітництва між дослідницьким та приватним сектором; впровадження кращого міжнародного досвіду. ; Actuality. The aim of the study is to analyze the formation and implementation of national innovation systems in different countries all around the world, the introduction of innovative practices in the hotel industry, the definition of the features of state innovation policy, as well as factors that have a positive or negative impact on the national innovation system. The following methods have been used to solve the research tasks: historiographical, comparative, methods of analysis and synthesis. Results. The results of the study have showed that national innovation systems have been increasingly developing and improving, because the modern economy is characterized by its innovativeness. The most advanced are the innovative systems in the United States and European countries. As for the introduction of innovative practices in the hotel industry, the championship belongs again to the US, the European countries, Japan. Conclusions and discussion. On the basis of the analysis of national innovation systems, we can conclude that under current conditions, the innovation system needs constant improvement. The successful development of the national innovation system is supported by a clear strategy of state policy in the field of innovation; rational use of existing innovation potential; strengthening cooperation between the research and the private sector; introduction of best international experience. ; Актуальность. На формирование эффективной национальной инновационной системы как комплекса институтов правового, финансового и социального характера, обеспечивающих инновационные процессы, влияет много факторов, как положительных, так и отрицательных. В современном глобализированном мире национальные инновационные системы в значительной степени зависят от политической ситуации в мире и культурных особенностей каждой страны. Создание и распространение принципиально новых технологий, продуктов и услуг приобретает все большую актуальность. Цель и методы. Целью исследования является анализ формирования и реализации национальных инновационных систем в различных странах мира, внедрение инновационных практик в гостиничной индустрии, определение особенностей государственной инновационной политики, а также факторов, положительно или отрицательно влияющих на национальную инновационную систему. Для решения задач исследования были использованы следующие методы: историографический, сравнительный, методы анализа и синтеза. Результаты исследования показали, что национальные инновационные системы на сегодняшний день все больше развиваются и совершенствуются, ведь современная экономика характеризуется своей инновационностью. Наиболее развитыми являются инновационные системы США и стран Европы. По внедрению инновационных практик в гостиничной индустрии первенство принадлежит опять же США, странам Европы, Японии. Выводы и обсуждение. На основе анализа национальных инновационных систем можно сделать вывод, что в современных условиях инновационная система требует постоянного совершенствования. Успешному развитию национальной инновационной системы способствует четкая стратегия государственной политики в области инноваций; рациональное использование имеющегося инновационного потенциала; укрепление сотрудничества между исследовательским и частным сектором; внедрение лучшего международного опыта.
